which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food, Agriculture, Conservation, and Trade Act of 1990 to establish a competitive grant program under which the Secretary of Agriculture provides grants to land-grant colleges and universities to support agricultural producers in adopting conservation and innovative climate practices, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservation and Innovative Climate Partnership Act of 2021</short-title></quote>.</text></section><section id="id589A041FBABD42659A23C0AD6F71C9AE"><enum>2.</enum><header>Conservation and innovative climate partnership competitive grant program</header><subsection id="id2E79EDA77B8D4F84930A6BDC117C11CD"><enum>(a)</enum><header>In general</header><text>Subtitle H of title XVI of the Food, Agriculture, Conservation, and Trade Act of 1990 is amended by inserting after section 1672 (<external-xref legal-doc="usc" parsable-cite="usc/7/5925">7 U.S.C. 5925</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFB145121922644F989B98331DF162223"><section id="id18FCFC9176624123920DC407A915D52B"><enum>1672A.</enum><header>Conservation and innovative climate partnership competitive grant program</header><subsection id="id6E8F7F87570C4EB4A9FC1EF221195A2C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBC7C7AB44E164AE3A432F6D7FAB43ACE"><enum>(1)</enum><header>1862 Institution; 1890 Institution</header><text>The terms <term>1862 Institution</term> and <term>1890 Institution</term> have the meanings given those terms in section 2 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>). </text></paragraph><paragraph id="id2E8F2CBAC5DC46248BA05295C38888F9"><enum>(2)</enum><header>1994 Institution</header><text>The term <term>1994 Institution</term> has the meaning given the term in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>).</text></paragraph><paragraph id="id9DA7C92A8132426699F4E8213B32117B"><enum>(3)</enum><header>Conservation practice</header><text>The term <term>conservation practice</term> means a practice—</text><subparagraph id="id585AE3ED05FD42CAA8F3111AAE593469"><enum>(A)</enum><text>that may include any or a combination of—</text><clause id="id7A6DA584257D4C96B54045F0E1FA2E1F"><enum>(i)</enum><text>carbon retention or carbon sequestration cropping practices;</text></clause><clause id="id4EA6311E7E954E4088502C804AA5F94C"><enum>(ii)</enum><text>resource conserving crop rotation;</text></clause><clause id="idC0C0A08C6E0A48AE947C6BBF7274FCF2"><enum>(iii)</enum><text>alley cropping;</text></clause><clause id="id24E96832A54F4F14B37D4B8D22C5476B"><enum>(iv)</enum><text>integrated livestock-crop systems;</text></clause><clause id="id31E752B80446454480A64CB4C1BE8380"><enum>(v)</enum><text>advanced grazing management;</text></clause><clause id="id0D631EB4C0364716B34AD557D70F5FAB"><enum>(vi)</enum><text>improved forestry or agroforestry management;</text></clause><clause id="id43EC415D3C0F42C8B27BB013ACFA00E7"><enum>(vii)</enum><text>the insertion of buffers or saturated buffers; or </text></clause><clause id="id29F176C8015842618AE12C5501494B75"><enum>(viii)</enum><text>any other practice that an eligible institution carrying out a project under the program determines to be appropriate; and</text></clause></subparagraph><subparagraph id="idBCFEC7EBA00F4637B7A92E8D28637C6E"><enum>(B)</enum><text>the purpose of which is to increase overall sustainability on farmland or ranch land through—</text><clause id="id06AFB7A36BCE446BB930C93243EE2E0A"><enum>(i)</enum><text>improved soil health and tilth;</text></clause><clause id="idD14C53A1A9CD496087929A774C93E0BD"><enum>(ii)</enum><text>improved water quality, quantity, and management;</text></clause><clause id="id99808043CB31406CB95CA8CB97AD254D"><enum>(iii)</enum><text>improved nutrient management;</text></clause><clause id="id31E7C86A92EB41D79617D315B3D4483D"><enum>(iv)</enum><text>reduction in tillage; or</text></clause><clause id="id4082CB4495934F1F9B57368CF555E37F"><enum>(v)</enum><text>wildlife promotion and maintenance.</text></clause></subparagraph></paragraph><paragraph id="idFAAB40DA49034D5AAB73152733B5B031"><enum>(4)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means—</text><subparagraph id="id972C035C228F453EA79FF700583C347D"><enum>(A)</enum><text>an 1862 Institution;</text></subparagraph><subparagraph id="id274C425DFC5D44899BCFFAE2C6FF7C06"><enum>(B)</enum><text>an 1890 Institution; and</text></subparagraph><subparagraph id="id3B26B5F596C348CBB65F29851B040BD1"><enum>(C)</enum><text>a 1994 Institution.</text></subparagraph></paragraph><paragraph id="id067C833A35FE439A98C37E77C5553D49"><enum>(5)</enum><header>Innovative climate practice</header><text>The term <term>innovative climate practice</term> means a practice, including any practice that an eligible institution carrying out a project under the program determines to be appropriate, that results in—</text><subparagraph id="id549A0F0D6D47474C848F97FFEBE11ECC"><enum>(A)</enum><text>a reduction of greenhouse gas emissions, including carbon dioxide, methane, sulfur dioxide, and nitrous oxide; </text></subparagraph><subparagraph id="id34FCBE1D03A04A0E8AFA60BD975ABAB0"><enum>(B)</enum><text>carbon sequestration;</text></subparagraph><subparagraph id="id33179328F43B4E8CA4A6A3906E601B56"><enum>(C)</enum><text>soil health improvement; or</text></subparagraph><subparagraph id="idA45D750689D6493A9433BB2F8CC44005"><enum>(D)</enum><text>reduced exposure to climate-related risk.</text></subparagraph></paragraph><paragraph id="idD0DFBA72B4BE41CCB21EBDE8EB5FFAFD"><enum>(6)</enum><header>Program</header><text>The term <term>program</term> means the competitive grant program established under subsection (b).</text></paragraph><paragraph id="id42A64A58B7FF4963ADD7E9645C722B9A"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id165074B7562F490A8C9F7DE0AFC383B2"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a program to provide competitive grants pursuant to section 3(d) of the Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/343">7 U.S.C. 343(d)</external-xref>) to eligible institutions to carry out projects to increase the voluntary adoption of conservation practices and innovative climate practices through public awareness campaigns, workshops, and specialized technical assistance.</text></subsection><subsection id="idE0460A90B2934E909537197961ACC63E"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under the program, an eligible institution shall submit to the Secretary an application, including a demonstration that the applicant will—</text><paragraph id="id79D61765FE7342909E2C3655BBB90D52"><enum>(1)</enum><text>increase interaction with local agricultural producers by a rate of not less than 25 percent above the outreach rate before the implementation of the project under the program;</text></paragraph><paragraph id="id69507E0DEFFF4599ABF9273E6208212F"><enum>(2)</enum><text>assist agricultural producers in implementing new conservation practices or innovative climate practices on farms or edges of fields, improving existing conservation practices or innovative climate practices on farms or edges of fields, or any combination thereof; and</text></paragraph><paragraph id="id2A00D13D1B7646429DA30677958F0006"><enum>(3)</enum><text>assist agricultural producers in implementing a combination of conservation practices or innovative climate practices that contribute to—</text><subparagraph id="id8683108A81FE4D189BC162B1192116FC"><enum>(A)</enum><text>the overall improvement of conservation; or</text></subparagraph><subparagraph id="id2C6048BA3DB44EAB91C388089D25D95F"><enum>(B)</enum><text>a decrease in, or sequestration of, greenhouse gas emissions.</text></subparagraph></paragraph></subsection><subsection id="id2A0DE70DFE9942138C6FA9A232771B4F"><enum>(d)</enum><header>Partnerships</header><text>An eligible institution shall carry out a project using a grant under the program in partnership with not fewer than 1 other entity, which may include—</text><paragraph id="id06B40AB33A5E4BBFB4C8496029652AFB"><enum>(1)</enum><text>a nonprofit organization;</text></paragraph><paragraph id="idA479CEF9F6B84A93B81E4B5FAF330EC8"><enum>(2)</enum><text>a State entity;</text></paragraph><paragraph id="id84FBB828416D4778BAD217EE829D56EC"><enum>(3)</enum><text>the Natural Resources Conservation Service;</text></paragraph><paragraph id="id4717DF37704F4E10AC1B9D80B8E5611D"><enum>(4)</enum><text>an 1862 Institution;</text></paragraph><paragraph id="id9797F31926B84A55AC1BA697572C8FE0"><enum>(5)</enum><text>an 1890 Institution;</text></paragraph><paragraph id="id5BA52312A3494E14A870F67FFB5699D4"><enum>(6)</enum><text>a 1994 Institution; or</text></paragraph><paragraph id="idF18F2CD5792B4A7298F3ADDB66FE3EC7"><enum>(7)</enum><text>any combination thereof.</text></paragraph></subsection><subsection id="idCC102C29D6AC4CEBB012E84253854F68"><enum>(e)</enum><header>Maximum amount</header><text>The amount of a grant under the program shall be not more than $400,000.</text></subsection><subsection id="id446EAA50EDF943AD91B652E0C84475DF"><enum>(f)</enum><header>Use of funds</header><text>An eligible institution may use a grant under the program—</text><paragraph id="id49E47474E8E44BB0B37D38B9A1455638"><enum>(1)</enum><text>to support agricultural producers in implementing a conservation practice or an innovative climate practice;</text></paragraph><paragraph id="id74CD08637D1C43029A5DFB4F0C5D5995"><enum>(2)</enum><text>subject to subsection (g), for additional staffing at the eligible institution to assist in carrying out a project using the grant;</text></paragraph><paragraph id="id2C3F77FB46554010B61CE6BF15B5D1BD"><enum>(3)</enum><text>to conduct workshops for agricultural producers, and develop and distribute digital and hard-copy materials directly to agricultural producers, that provide clear directions for accessing technical assistance for adopting conservation practices and innovative climate practices; and</text></paragraph><paragraph id="id27A53293D3A44D60B1256E7A0CC6DA8F"><enum>(4)</enum><text>for soil testing and the measuring of other indicators of the effectiveness of conservation practices and innovative climate practices.</text></paragraph></subsection><subsection id="id6453F6B9863E4788BDF8B318F56670C7"><enum>(g)</enum><header>Limitation on administrative expenses</header><text>An eligible institution may use not more than 30 percent of the amount of a grant under the program for administrative expenses.</text></subsection><subsection id="idCDD6C2566EEF4F18981FB4C948530F75"><enum>(h)</enum><header>Duration</header><text>A grant provided under the program shall be for such period as the Secretary determines to be appropriate, but not less than 4 years.</text></subsection><subsection id="id2A36A49FB9274C1989C6FFE69E2B4727"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to provide grants under the program pursuant to section 3(d) of the Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/343">7 U.S.C. 343(d)</external-xref>) $13,000,000 for each fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAB12E1698A1C4C2C820BA2ACBD95B3E6"><enum>(b)</enum><header>Eligibility of 1994 Institutions</header><text>Section 3(d) of the Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/343">7 U.S.C. 343(d)</external-xref>) is amended, in the third sentence—</text><paragraph id="idA5BA700A287F424F8D8393C69C946D26"><enum>(1)</enum><text>by striking <quote>program and</quote> and inserting <quote>program,</quote>; and</text></paragraph><paragraph id="idC49527093ABC497E8B3AF22BA1FB9971"><enum>(2)</enum><text>by inserting <quote>, and the conservation and innovative climate partnership competitive grant program established under section 1672A of the Food, Agriculture, Conservation, and Trade Act of 1990</quote> before the period at the end.</text></paragraph></subsection></section></legis-body></bill>
