<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 117</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> (for herself, <cosponsor name-id="S342">Mr. Blunt</cosponsor>, <cosponsor name-id="S343">Mr. Boozman</cosponsor>, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an Intercountry Adoption Advisory Committee, and for other purposes.</official-title></form><legis-body><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intercountry Adoption Advisory Committee Act</short-title></quote>.</text></section><section id="idb72d02371a3b4651a41247b88d7de9ff"><enum>2.</enum><header>Intercountry Adoption Advisory Committee</header><subsection id="id63f919989e894ea0b485001bf6f09389"><enum>(a)</enum><header>Establishment</header><text>The Secretary of State shall establish within the Bureau of Consular Affairs an intercountry adoption advisory committee (the <quote>Advisory Committee</quote>).</text></subsection><subsection id="idac779b02fefe4d03a0207f5974e38274"><enum>(b)</enum><header>Duties</header><paragraph id="idbb1a708ec0e24c6b9df2070e3b037c18"><enum>(1)</enum><header>In general</header><text>The Secretary of State shall consult the Advisory Committee, as appropriate, on intercountry adoption, including on the development, refinement, and implementation of policies and programs pertaining to intercountry adoption.</text></paragraph><paragraph id="idc87f8d0ca73a435caac35c995bc50890"><enum>(2)</enum><header>Recommendations</header><text>The Advisory Committee shall develop, at the request of the Secretary, recommendations for improvements to intercountry adoption.</text></paragraph><paragraph id="id1f6e52db04994bfaa71781b436785e73"><enum>(3)</enum><header>Periodic reports</header><text>The Advisory Committee shall periodically submit to the Secretary of State—</text><subparagraph id="id27a7ddc86c80438a9f5ec8d5783c8b2c"><enum>(A)</enum><text>reports on matters identified by the Secretary; and</text></subparagraph><subparagraph id="id8a173f71f8494e26aa41446552c29535"><enum>(B)</enum><text>reports on other matters identified by a majority of the members of the Advisory Committee.</text></subparagraph></paragraph><paragraph id="id55f4a2b7a1ff4376aaef842a97aba995"><enum>(4)</enum><header>Annual report</header><text>The Advisory Committee shall submit to the Secretary of State an annual report providing information on the activities, findings, and recommendations of the Advisory Committee for the preceding year. Not later than 180 days after the date that the Secretary receives the annual report, the Secretary shall publish a public version describing the Advisory Committee's activities and such related matters as would be informative to the public consistent with the policy of section 552(b) of title 5, United States Code. The report required under this paragraph may be submitted as part of the Department of State's annual adoption report.</text></paragraph><paragraph id="id0f732d52e6e64f70bb7ea0ca6b64e50f"><enum>(5)</enum><header>Feedback</header><text>Not later than 90 days after receiving recommendations transmitted by the Advisory Committee under paragraph (4), the Secretary of State shall respond in writing to the Advisory Committee with feedback on each of the recommendations, an action plan to implement any of the recommendations with which the Secretary concurs, and a justification for why any of the recommendations have been rejected.</text></paragraph><paragraph id="id3372d2aced204baab5571b8335715c52"><enum>(6)</enum><header>Congressional notification</header><text>Not later than 30 days after providing written feedback to the Advisory Committee under paragraph (5), the Secretary of State shall notify Congress of the feedback.</text></paragraph></subsection><subsection id="id3c78d2f670f14daf85589412485612b1" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Membership</header><text>Not later than 180 days after establishing the Advisory Committee under subsection (a), the Secretary of State shall appoint the members of the Advisory Committee. The members so appointed shall include groups representing adoption service providers, adoptive families, adoptees, adoption attorneys, social workers, and representatives of U.S. Citizen and Immigration Services (USCIS) and the Department of State. Members shall be appointed or reappointed by the Secretary every two years. </text></subsection></section></legis-body></bill>
