<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1177</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210415">April 15, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself and <cosponsor name-id="S153">Mr. Grassley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to modify the eligibility criteria for E visas.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id805E420B23724AF981E43D78F673D27A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>E Visa Integrity Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id5A581D198A63400CB6BE9F9A8DBB1794"><enum>2.</enum><header>Modification of eligibility criteria for E visas</header><text display-inline="no-display-inline">Section 101(a)(15)(E) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(E)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8AEFC7012DA41C5AB7FB5937891B82C"><subparagraph id="id97F29E614C294545B3DE30C57E6FA71E" indent="up1"><enum>(E)</enum><text>an alien entitled to enter the United States under and in pursuance of the provisions of a treaty of commerce and navigation between the United States and the foreign state of which the alien is a national (or, in the case of an alien who acquired the relevant nationality through a financial investment and who has not previously been granted status under this subparagraph, the foreign state of which the alien is a national and in which the alien has been domiciled for a continuous period of not less than 3 years at any point before applying for a nonimmigrant visa under this subparagraph) and the spouse and children of any such alien if accompanying or following to join the alien—</text><clause id="idFF2317AD198445D8AE3EE11C204EF7F5"><enum>(i)</enum><text>solely to carry on substantial trade, including trade in services or trade in technology, principally between the United States and the foreign state of which the alien is a national;</text></clause><clause id="id33AD0267810E462A966018F515A09993"><enum>(ii)</enum><text>solely to develop and direct the operations of an enterprise in which the alien has invested, or is actively in the process of investing, a substantial amount of capital; or</text></clause><clause id="idF988A97971C44D4B9F83FBACB3F2E6E3"><enum>(iii)</enum><text>solely to perform services in a specialty occupation in the United States if the alien is a national of the Commonwealth of Australia and with respect to whom the Secretary of Labor determines and certifies to the Secretary of Homeland Security and the Secretary of State that the intending employer has filed with the Secretary of Labor an attestation under section 212(t)(1).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
