<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 205</calendar><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 116</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> (for herself, <cosponsor name-id="S347">Mr. Moran</cosponsor>, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20211219">December 17, 2021</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, with an amendment</action-desc><action-instruction>Insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To require the Consumer Product Safety Commission to study the effect of the COVID–19 pandemic on injuries and deaths associated with consumer products, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA4E5C8D793EB43DEA3639DCB76A2E25E"><section section-type="section-one" id="HC60A27A090DD4282A36A82F23388385A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Home Safety Act of 2021</short-title></quote>.</text></section><section id="H40A510A3B67B4E0A9679426CDCD7C2D7"><enum>2.</enum><header>Report</header><subsection id="H11AE6C3F8EDB4534AD84E42876B30202"><enum>(a)</enum><header>COVID–<enum-in-header>19</enum-in-header> report required</header><text display-inline="yes-display-inline">Not later than 3 months after the date of the enactment of this section and every 3 months thereafter for the duration of the COVID–19 public health emergency, the Consumer Product Safety Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available, a report on the effect of the COVID–19 public health emergency on injuries and deaths from consumer products.</text></subsection><subsection id="H811DCF7F75CB4274BCCFE87571E56E59"><enum>(b)</enum><header>Contents of report</header><text>The report shall include the following:</text><paragraph id="HC68381FB24E5444885F78BECDB5CDDA9"><enum>(1)</enum><text>A list of the top consumer products, prioritizing products <added-phrase committee-id="SSCM00" reported-display-style="italic">that caused serious injury or death as well as products</added-phrase> that have been associated with the highest risk of serious injury or death during the COVID–19 emergency. The list under this paragraph should be based on relevant data and statistics from—</text><subparagraph id="H0A8D471340CC47F09418CF049EAEB301"><enum>(A)</enum><text>the data sources of the Commission;</text></subparagraph><subparagraph id="HE538FBAF1CCF49ADB54E5BA10E032AF0"><enum>(B)</enum><text>other appropriate agencies;</text></subparagraph><subparagraph id="H118E6A0A8FC94A7486D405CD1E7A2468"><enum>(C)</enum><text>media reports;</text></subparagraph><subparagraph id="H75301D22B90F42FE9DC62D0C2BE2132E"><enum>(D)</enum><text>poison control centers, to the extent practical; and</text></subparagraph><subparagraph id="HFB80637AB3204C1BA7F3B8C74A5CF16C"><enum>(E)</enum><text>any other relevant data sources.</text></subparagraph></paragraph><paragraph id="HED32D3144C85462293DF7EC67A7ADA79"><enum>(2)</enum><text>An identification of trends in injuries and deaths in the consumer products listed under paragraph (1), comparing data from representative time periods before and during the COVID–19 public health emergency.</text></paragraph><paragraph id="HB728E63CF919434DA951F0C133DB889E"><enum>(3)</enum><text display-inline="yes-display-inline">An identification of subpopulations that have experienced elevated risk of injury or death from the consumer products listed under paragraph (1) during the COVID–19 public health emergency, such as minorities, infants, people with disabilities, children, or the elderly.</text></paragraph><paragraph id="HEC0FCBCDC79348618E2A609F6156F175"><enum>(4)</enum><text display-inline="yes-display-inline">An identification of where most injuries or deaths from consumer products during the COVID–19 public health emergency are taking place, such as the type of building or outdoor environment.</text></paragraph><paragraph id="H230DF7D1F8FA407188ABC85D89A4C5F3"><enum>(5)</enum><text>An identification of whether any specific consumer products in the categories described in paragraph (1) are—</text><subparagraph id="H1CE061773A1F49A8A7A4F195EE255198"><enum>(A)</enum><text>under recall or other corrective action;</text></subparagraph><subparagraph id="H4201A6DB4FBD46ABA90B945759A16007"><enum>(B)</enum><text>subject to a voluntary consumer product safety standard; or</text></subparagraph><subparagraph id="HA4798537D61246FFB81C5EAF57513377"><enum>(C)</enum><text>subject to a mandatory consumer product safety standard.</text></subparagraph></paragraph><paragraph id="H1FB494E6ADDA4F0BBC61ED550DBACFE8"><enum>(6)</enum><text display-inline="yes-display-inline">An identification of any emerging consumer products or consumer product categories that are posing new risks to consumers.</text></paragraph><paragraph id="idDB697C9161FD4C1CBA78A11B9F6631FB"><enum>(7)</enum><text>A comprehensive assessment of the Commission’s operations, re-entry criteria and associated metrics, operational readiness, enforcement efforts (including import-export surveillance of counterfeit and untested consumer goods and laboratory functions), and corrective action taken (including the number of corrective actions announced and recall effectiveness) during the COVID–19 public health emergency and recommendations to improve the Commission’s ability to address unforeseen effects of the COVID–19 public health emergency with regard to consumer product safety.</text></paragraph></subsection><subsection id="id1963648BB13E43C58E8AA44FAD50DAEA"><enum>(c)</enum><header>Distribution of information</header><text>The Consumer Product Safety Commission shall coordinate with public media outlets to distribute resource information based on the report under this section to help increase home safety during the COVID–19 public health emergency, including information such as Home Safe Checklists. </text></subsection><subsection id="H62C70BD9A3F149C49D9CF3A375217626"><enum>(d)</enum><header>COVID–19 public health emergency defined</header><text display-inline="yes-display-inline">The term <term>COVID–19 public health emergency</term> means a public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) as a result of confirmed cases of 2019 novel coronavirus (COVID–19), including any renewal thereof.</text></subsection></section></legis-body><endorsement><action-date date="20211219">December 17, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
