<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 114</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S345">Mr. Johnson</sponsor> (for himself, <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the SOAR Act.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id66548D11CA0D4DF2A4D13D8D3DCA63A7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SOAR Permanent Authorization Act</short-title></quote>.</text></section><section id="id0BC39149D0034462B9E260799D697521"><enum>2.</enum><header>Amendments to the SOAR Act</header><text display-inline="no-display-inline">The Scholarships for Opportunity and Results Act (division C of <external-xref legal-doc="public-law" parsable-cite="pl/112/10">Public Law 112–10</external-xref>) is amended—</text><paragraph id="id723817C8ABCB419CA3E79913526F92D1"><enum>(1)</enum><text>in section 3007 (sec. 38–1853.07 D.C. Official Code)—</text><subparagraph id="id70F5D17E72E04BF68FB025EA6DC6978C"><enum>(A)</enum><text>in subsection (a)(5)(A)(i), by striking subclause (I) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0213BB819C9241C59C47BA83AFA915BF"><subclause id="idB9C343425C7149C7BB1D37A8DD990A55"><enum>(I)</enum><text>is fully accredited by an accrediting body with jurisdiction in the District of Columbia or that is recognized by the Student and Visitor Exchange English Language Program administered by U.S. Immigration and Customs Enforcement; or</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id08E40C216FE747BF9AC6D0A575B96D56"><enum>(B)</enum><text>by striking subsection (c) and redesignating subsection (d) as subsection (c);</text></subparagraph><subparagraph id="id3EBD114C459144E2B04EEBF7BD5E883A"><enum>(C)</enum><text>in subsection (b)—</text><clause id="id181CE00C63F84D868A78B275D65FCBA4"><enum>(i)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">and Parental Assistance</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, Parental Assistance, and Student Academic Assistance</header-in-text></quote>;</text></clause><clause id="idBCD3F1018A094E7483E05D9F2A4AFD4D"><enum>(ii)</enum><text>in the matter preceding paragraph (1), by striking <quote>$2,000,000</quote> and inserting <quote>$2,200,000</quote>; and</text></clause><clause id="idEEFF2429243A42ACBE635278F59DCC02"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA84CCAC859744F9B94FAFC5AEEEFA5EE"><paragraph id="id284753E271784AA5BE590634DE044893"><enum>(3)</enum><text>The expenses of providing tutoring service to participating eligible students that need additional academic assistance. If there are insufficient funds to provide tutoring services to all such students in a year, the eligible entity shall give priority in such year to students who previously attended an elementary school or secondary school identified as one of the lowest-performing schools under the District of Columbia’s accountability system.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idBCE0A4C516B0434B9914CA65A8CCC4CB"><enum>(D)</enum><text>in subsection (c), as redesignated by subparagraph (B)—</text><clause id="idAFF2DD86EA59461DAF9A1F91FA23772E"><enum>(i)</enum><text>in paragraph (2)(B), by striking <quote>subsections (b) and (c)</quote> and inserting <quote>subsection (b)</quote>; and</text></clause><clause id="idE5D25730D18D490CB8E867B1389D0249"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>subsections (b) and (c)</quote> and inserting <quote>subsection (b)</quote>;</text></clause></subparagraph></paragraph><paragraph commented="no" id="id17038B3297534A47B4AE92B9077ABF49"><enum>(2)</enum><text>in section 3008(h) (sec. 38–1853.08(h) D.C. Official Code)—</text><subparagraph commented="no" id="idE02C671218C14D119A7325FA3281D065"><enum>(A)</enum><text>in paragraph (1), by striking <quote>section 3009(a)(2)(A)(i)</quote> and inserting <quote>section 3009(a)</quote>;</text></subparagraph><subparagraph commented="no" id="id93D3DACCF65C4F8780C44CE095F3C7B6"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0F9D20F67D9147BAA1F28BAE8D3F8377"><paragraph commented="no" id="idA4201ADF591D4ED3985702B74106207F"><enum>(2)</enum><header>Administration of tests</header><text>The Institute of Education Sciences may administer assessments to students participating in the evaluation under section 3009(a) for the purpose of conducting the evaluation under such section.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="id20D666C07AD348978CC7CE6577DC6BD7"><enum>(C)</enum><text>in paragraph (3), by striking <quote>the nationally norm-referenced standardized test described in paragraph (2)</quote> and inserting <quote>a nationally norm-referenced standardized test</quote>;</text></subparagraph></paragraph><paragraph id="id02D13D0B38B5402096776BEC3B266969"><enum>(3)</enum><text>in section 3009(a) (sec. 38–1853.09(a) D.C. Official Code)—</text><subparagraph id="id2EB13721441549D9ADE5B9D4116CD378"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>annually</quote> and inserting <quote>regularly</quote>;</text></subparagraph><subparagraph id="id4EC0EAA1499A4F3C809F98F772DF7EE5"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idC746B3D522D3403C80253F4D2FF5C19F"><enum>(i)</enum><text>in subparagraph (A), by striking clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67A07816A2744DEA96B29CBB46E2F8F7"><clause id="id110144F5E95E4C5C89F635F51B45F4B9"><enum>(i)</enum><text>is rigorous; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id6A3F6015439C46ACB6B1301862FF5722"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>impact of the program</quote> and all that follows through the end of the subparagraph and inserting <quote>impact of the program on academic progress and educational attainment.</quote>;</text></clause></subparagraph><subparagraph id="id1D9288F8225D456690FCCF87ACD6B42B"><enum>(C)</enum><text>in paragraph (3)—</text><clause id="id8478996DDA134E6EA78243DBF517A68C"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">on Education</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">of Education</header-in-text></quote>;</text></clause><clause id="idFC399CCE56004179A3B810BF4C45DDFD"><enum>(ii)</enum><text>in subparagraph (A)—</text><subclause id="id6414410231844F81872448883BF3686E"><enum>(I)</enum><text>by inserting <quote>the academic progress of</quote> after <quote>assess</quote>; and</text></subclause><subclause id="id7D32AE1792FE4FB8A7BB17EA916A9DBA"><enum>(II)</enum><text>by striking <quote>in each of grades 3</quote> and all that follows through the end of the subparagraph and inserting <quote>; and</quote>;</text></subclause></clause><clause id="id3110F063E8134870A2A6A49B9CD88029"><enum>(iii)</enum><text>by striking subparagraph (B); and</text></clause><clause id="idD77BC6FCC9F2452E954BC7420CE16D9A"><enum>(iv)</enum><text>by redesignating subparagraph (C) as subparagraph (B); and</text></clause></subparagraph><subparagraph id="id1F2C329F952D4DFAACF381265EC012C6"><enum>(D)</enum><text>in paragraph (4)—</text><clause id="id76EFD7B5287A420499E0133B1E69C908"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="id5D890C8583F14149AAEC6E8E013A39AE"><enum>(I)</enum><text>by striking <quote>A comparison of the academic achievement of participating eligible students who use an opportunity scholarship on the measurements described in paragraph (3)(B) to the academic achievement</quote> and inserting <quote>The academic progress of participating eligible students who use an opportunity scholarship compared to the academic progress</quote>; and</text></subclause><subclause id="idDDBEC56A6A5C45B593A8D30DC027225A"><enum>(II)</enum><text>by inserting <quote>, which may include students</quote> after <quote>students with similar backgrounds</quote>;</text></subclause></clause><clause id="id9F0D63D4CC8F49CF941CB492B8F3DB8E"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>increasing the satisfaction of such parents and students with their choice</quote> and inserting <quote>those parents' and students' satisfaction with the program</quote>;</text></clause><clause id="id5C4D5E10B21744DEA862BEED730312F4"><enum>(iii)</enum><text>by striking subparagraph (D) through (F) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id46F597CEA4904593985FF4444BBCBD6E"><subparagraph id="id5D106309CC974F3AA42D44EDBCCE63E4"><enum>(D)</enum><text>The high school graduation rates, college enrollment rates, college persistence rates, and college graduation rates of participating eligible students who use an opportunity scholarship compared with the rates of public school students described in subparagraph (A), to the extent practicable.</text></subparagraph><subparagraph id="id6DE69A8CC4DD4B7DA1909CD2C4EB9F73"><enum>(E)</enum><text>The college enrollment rates, college persistence rates, and college graduation rates of students who participated in the program as the result of winning the Opportunity Scholarship Program lottery compared to the enrollment, persistence, and graduation rates for students who entered but did not win such lottery and who, as a result, served as the control group for previous evaluations of the program under this division. Nothing in this subparagraph may be construed to waive section 3004(a)(3)(A)(iii) with respect to any such student.</text></subparagraph><subparagraph id="idD1532BB17F494AFA98A29C9DB4BE3E07"><enum>(F)</enum><text>The safety of the schools attended by participating eligible students who use an opportunity scholarship compared with the schools attended by public school students described in subparagraph (A), to the extent practicable.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id60CDE6F908AA4DA49C80F3901AA1663E"><enum>(iv)</enum><text>in subparagraph (G), by striking <quote>achievement</quote> and inserting <quote>progress</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id043541004D474D97811C1322813946C7"><enum>(4)</enum><text>in section 3014 (sec. 38–1853.14, D.C. Official Code)—</text><subparagraph id="idBB0BF884859B472FB04445569D36274E"><enum>(A)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking “$60,000,000 for fiscal year 2012 and for each fiscal year through fiscal year 2023” and inserting <quote>$75,000,000 for fiscal year 2022 and for each succeeding fiscal year</quote>; and</text></subparagraph><subparagraph id="id9C63E01892574B91B7F483353C1234D8"><enum>(B)</enum><text>in subsection (b), by striking <quote>$60,000,000</quote> and inserting <quote>$75,000,000</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
