<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 1143</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To prohibit certain individuals from downloading or using TikTok on any device issued by the United States or a government corporation.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id8c8c5f86-04e4-4d0e-a4ae-2331486d4679" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No TikTok on Government Devices Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idc39547df-e39d-4ed5-9422-6136f433b2d5" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on the use of TikTok</header><subsection commented="no" display-inline="no-display-inline" id="idc55d93ada3ad4ae884e3657c1a9bf592" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id545eda454ad84dc9a4b5573bec026a10" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>covered application</quote> means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id389a4dc64366429c99b53d95d7cb1a99" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>executive agency</term> has the meaning given that term in section 133 of title 41, United States Code; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1fad807df32405cbd18c4ffc18be184" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>information technology</quote> has the meaning given that term in section 11101 of title 40, United States Code.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb825492cb3504cf68ac5f594275ec8b6" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition on the use of TikTok</header><paragraph commented="no" display-inline="no-display-inline" id="id71ae356bf356494085a915ab6e0e817c" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of the Office of Management and Budget, in consultation with the Administrator of General Services, the Director of the Cybersecurity and Infrastructure Security Agency, the Director of National Intelligence, and the Secretary of Defense, and consistent with the information security requirements under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, shall develop standards and guidelines for executive agencies requiring the removal of any covered application from information technology.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26bdf0370fdd4664b1911944296e8260" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">National security and research exceptions</header><text display-inline="yes-display-inline">The standards and guidelines developed under paragraph (1) shall include— </text><subparagraph commented="no" display-inline="no-display-inline" id="idC32B1D1DCD384D7A89726BEBD103A0E7" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">exceptions for law enforcement activities, national security interests and activities, and security researchers; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a235c1c7f634357a42127caa44ff232" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">for any authorized use of a covered application under an exception, requirements for agencies to develop and document risk mitigation actions for such use. </text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20221214" chamber="Senate">Passed the Senate December 14, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
