which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Health and Human Services to award additional funding through the Sanitation Facilities Construction Program of the Indian Health Service, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H66B396A470674075A971AC3C53BF1B57"><section section-type="section-one" id="HDA239B37B0304733B42BB901E03B6353"><enum>1.</enum><header>Indian Health Service Sanitation Facilities Construction Program funding</header><subsection id="idCB2854F804FE4B2C9F604095AB2B9518"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id8E79C75EABE148998753DFF5175EA25B"><enum>(1)</enum><text>the COVID–19 crisis has highlighted the lack of infrastructure and sanitation available in Native communities; </text></paragraph><paragraph id="id341795E18C58426EAB49A94F66D43B3E"><enum>(2)</enum><text>addressing the Sanitation Facilities Deficiency List of the Division of Sanitation Facilities and Construction of the Indian Health Service included in the report will—</text><subparagraph id="id2A11B50D29DE4FA8A50A1E8D42C2EA18"><enum>(A)</enum><text>result in investments in necessary water infrastructure; and</text></subparagraph><subparagraph id="idCF4C762D00BD46E6A6CA2360520D685E"><enum>(B)</enum><text>improve health outcomes; and</text></subparagraph></paragraph><paragraph id="idbcac47702da64abc8feb2b8d797d7571"><enum>(3)</enum><text>it is in the interest of the United States, and it is the policy of the United States, that all existing and new Indian communities and Indian homes be provided with safe and adequate water supply systems and sanitary sewage waste disposal systems as soon as practicable.</text></paragraph></subsection><subsection id="id30136C19C0AB4E599756B07EECF57030"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id32078B6D9A8545119DFCEAE3434BBAA4"><enum>(1)</enum><header>Report</header><text>The term <term>report</term> means the fiscal year 2018 report of the Division of Sanitation Facilities and Construction of the Indian Health Service entitled <quote>Annual Report to the Congress of the United States on Sanitation Deficiency Levels for Indian Homes and Communities</quote>.</text></paragraph><paragraph id="idED7F3517C4C54DFF9C9FE89E83C8AB39"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Director of the Indian Health Service.</text></paragraph></subsection><subsection id="idB058803913D04D4EA031A60326D88532"><enum>(c)</enum><header>Additional funding for sanitation facilities</header><paragraph id="id3F126E0D0E8047859CEFA2C2B0202CBB"><enum>(1)</enum><header>In general</header><text>The Secretary shall award additional funding under the Sanitation Facilities Construction Program for the planning, design, construction, modernization, improvement, and renovation of water, sewer, and solid waste sanitation facilities that are funded, in whole or part, by the Indian Health Service through, or provided for in, a contract or compact with the Indian Health Service under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> et seq.).</text></paragraph><paragraph id="H8B2FFC17929342F0AD9865C81F9451F1"><enum>(2)</enum><header>Priority for funding</header><text display-inline="yes-display-inline">In awarding funding to sanitation facilities under paragraph (1), the Secretary shall prioritize sanitation facilities with the highest deficiency level, as established in the report. </text></paragraph></subsection><subsection id="HFC204662093D41B1961CDA3B65EA7CAB"><enum>(d)</enum><header>Authorization of appropriations</header><paragraph id="id31BB7BF7F4BA4B25AFF7DEF979884272"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $1,335,000,000 for the period of fiscal years 2021 through 2025.</text></paragraph><paragraph id="id244E274AE8B7418AAF79E980F09E7F2B"><enum>(2)</enum><header>Requirement</header><text>Amounts made available under paragraph (1) shall be in addition to any amounts made available to carry out the purposes described in subsection (c)(1) under any other provision of law.</text></paragraph></subsection></section></legis-body></bill>
