which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to require the Administrator of the Federal Aviation Administration to give preferential consideration to individuals who have successfully completed air traffic controller training when hiring air traffic control specialists, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H21B341D52D7744AAB0619A01EF2EE024"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Air Traffic Control Safe Operation and Readiness Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id17134E178BCE460D89548A6D83BA6118"><enum>2.</enum><header display-inline="yes-display-inline">Hiring of air traffic control specialists</header><text display-inline="no-display-inline">Section 44506(f)(1)(B) of title 49, United States Code, is amended by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id746DE65AB1784CA8AF5847EE08033395"><clause commented="no" display-inline="no-display-inline" id="id67EC0C13C9574A4CB15EEF039143EB41"><enum>(iv)</enum><header>Consideration of candidates</header><text>The Administrator shall consider for the interview stage of the hiring process candidates in each applicant pool described in this subparagraph who—</text><subclause commented="no" display-inline="no-display-inline" id="id9B3CFAFBD7AF49C090B0CAB5087A4A44"><enum>(I)</enum><text>score at or above a passing score as determined by the Administrator on the Air Traffic Skills Assessment (AT–SA); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idCCF006DC47DF4172A4CA6F329713A702"><enum>(II)</enum><text>meet minimum qualifications established by the Administrator.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="idE57FD338F3B74D69B1DF0B01E454EA18"><enum>3.</enum><header>Ensuring hiring of air traffic control specialists is based on assessment of job-relevant aptitudes</header><subsection commented="no" display-inline="no-display-inline" id="idD3E5710A24124404974058A8952B2C1F"><enum>(a)</enum><header>Update of the air traffic skills assessment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall revise the Air Traffic Skills Assessment (in this section referred to as the <term>AT–SA</term>) administered to air traffic controller applicants described in clauses (ii) and (iii) of section 44506(f)(1)(B) of title 49, United States Code, in accordance with the following requirements:</text><paragraph id="id39ffb26e3e5144b7b5b30d05bf5b7f99"><enum>(1)</enum><text>The Administrator shall ensure that all questions on the AT–SA are supported by a peer-reviewed job analysis that ensures all questions test job-relevant aptitudes.</text></paragraph><paragraph id="id20c37cae5d5b459d8534b62daade85f1"><enum>(2)</enum><text>The Administrator shall ensure that the AT–SA does not incorporate any biographical questionnaire or assessment or other questions of a biographical nature (other than basic identifiers such as first and last name) for applicants for the position of air traffic controller from the applicant pools described in clauses (ii) and (iii) of section 44506(f)(1)(B) of title 49, United States Code.</text></paragraph></subsection><subsection id="id24575D01F6604A3284B9E18B87E83472"><enum>(b)</enum><header>Conforming amendments eliminating use of biographical assessments for all applicants</header><text>Section 44506(f) of title 49, United States Code, as amended by section 2, is further amended—</text><paragraph id="idF54B9CC548FA43E88EEC93C461FE8B06"><enum>(1)</enum><text>in paragraph (1)(C)—</text><subparagraph id="idA9200366DD214B609B3FA54EF00EA50C"><enum>(A)</enum><text>by striking clause (ii); and</text></subparagraph><subparagraph id="id881C3D9FE4B244E8A91709A9991CC403"><enum>(B)</enum><text>by redesignating clause (iii) as clause (ii); and</text></subparagraph></paragraph><paragraph id="id3E94C5437B1E40DCBDFF869352085D66"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id94C8239D43034B8AA11E17FF93BAF0E7"><paragraph id="id40A56D483F35464FB3AC5A6168787798"><enum>(2)</enum><header>No biographical assessments</header><text>The Administrator shall not use any biographical assessment when hiring under paragraph (1)(A) or paragraph (1)(B).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id2345dc3332454858bcf315b5c736b3f0"><enum>4.</enum><header>DOT Inspector General report</header><text display-inline="no-display-inline">Not later than 180 days after the date on which the Administrator of the Federal Aviation Administration completes the revision of the Air Traffic Skills Assessment (AT–SA) required under section 3(a), the Inspector General of the Department of Transportation shall submit a report to the Administrator, the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and, upon request, to any member of Congress, that assesses the assumptions and methodologies used to develop such revisions, the job-relevant aptitudes measured, and the scoring process for the revised assessment, together with, if appropriate, a description of any actions taken or recommended to be taken to address the results of the report.</text></section></legis-body></bill>
