which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 17, 2021</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To require the National Oceanic and Atmospheric Administration to make certain operational models available to the public, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Learning Excellence and Good Examples from New Developers Act of 2021</short-title></quote> or the <quote><short-title>LEGEND Act of 2021</short-title></quote>.</text></section><section id="id2a0615f85ef54c9abba6c0eb69ea821c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="id1f8e7b6ae3684ecfbb818ff9968d7341"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="idae507f6fe3fa42fba1ef88c288415b9c"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Under Secretary of Commerce for Oceans and Atmosphere and Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="idfe4233c04e824d159baf84d38513bd22"><enum>(3)</enum><header>Earth Prediction Innovation Center</header><text>The term <term>Earth Prediction Innovation Center</term> means the community global weather research modeling system described in paragraph (5)(E) of section 102(b) of the Weather Research Forecasting and Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8512">15 U.S.C. 8512(b)</external-xref>), as redesignated by section 4(g). </text></paragraph><paragraph id="ide2a4f9b3462b4a1b8807acbb372af0aa"><enum>(4)</enum><header>Model</header><text>The term <term>model</term> means any vetted numerical model and associated data assimilation of the Earth's system or its components— </text><subparagraph id="id44413EF75CC447DBB48E06DA8794301D"><enum>(A)</enum><text>developed, in whole or in part, by scientists and engineers employed by the Administration; or </text></subparagraph><subparagraph id="id5468E6A483844155B29F1594003BE5C8"><enum>(B)</enum><text>otherwise developed using Federal funds. </text></subparagraph></paragraph><paragraph id="idbd0a082dc6744188a2abe47bc4f2e940"><enum>(5)</enum><header>Operational model</header><text>The term <term>operational model</term> means any model that has an output used by the Administration for operational functions.</text></paragraph><paragraph id="id149b2aed5a304f2da7e813a41013dfb5"><enum>(6)</enum><header>Suitable model</header><text>The term <term>suitable model</term> means a model that meets the requirements described in paragraph (5)(E)(ii) of section 102(b) of the Weather Research Forecasting and Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8512">15 U.S.C. 8512(b)</external-xref>), as redesignated by section 4(g), as determined by the Administrator.</text></paragraph></section><section id="id770e3dbd8e38419f9a4f53ac36ff6e53"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id8a915f1c39a94d62bfa5885f8e60eab0"><enum>(1)</enum><text>to support innovation in modeling by allowing interested stakeholders to have easy and complete access to the models used by the Administration, as the Administrator determines appropriate; and</text></paragraph><paragraph id="id8c3d31b1df674db7aebdbffed0e4a960"><enum>(2)</enum><text>to use vetted innovations arising from access described in paragraph (1) to improve modeling by the Administration.</text></paragraph></section><section id="idbcce4393ae27439c9d70d90b87c550ad"><enum>4.</enum><header>Plan and implementation of plan to make certain models and data available to the public</header><subsection id="idf32f25baa52842239653f78a70e835b4"><enum>(a)</enum><header>In general</header><text>The Administrator shall develop and implement a plan to make available to the public the following: </text><paragraph id="id195081bea7e0474f82efae8115a465c8"><enum>(1)</enum><text>Operational models developed by the Administration. </text></paragraph><paragraph id="id0fa051d2f61345248a0bafa60bb9a4e5"><enum>(2)</enum><text>Models that are not operational models, including experimental and developmental models, as the Administrator determines appropriate. </text></paragraph><paragraph id="id7050a80d840440048e67afff0e7b9d5d"><enum>(3)</enum><text>Applicable information and documentation for models described in paragraphs (1) and (2).</text></paragraph><paragraph id="ida7d8f95e49b94e5993b007fc45a7eed7"><enum>(4)</enum><text>Subject to section 7, all data owned by the Federal Government and data that the Administrator has the legal right to redistribute that are associated with models made available to the public pursuant to the plan and used in operational forecasting by the Administration, including—</text><subparagraph id="id252612caa10e4e20bd07925f59c05c95"><enum>(A)</enum><text>relevant metadata;</text></subparagraph><subparagraph id="ida911f5b7986c4004a4d5955e5131c6f5"><enum>(B)</enum><text>data used for operational models used by the Administration as of the date of the enactment of this Act; and</text></subparagraph><subparagraph id="id5204019fecdb4bae8ff305f892f5db08"><enum>(C)</enum><text>a description of intended model outputs.</text></subparagraph></paragraph></subsection><subsection id="id190981b1dccd4b8cb7ee5aabbc4872c5"><enum>(b)</enum><header>Accommodations</header><text>In developing and implementing the plan under subsection (a), the Administrator may make such accommodations as the Administrator considers appropriate to ensure that the public release of any model, information, documentation, or data pursuant to the plan does not jeopardize—</text><paragraph id="id2ae8711ab97b43eba1dfa72289de62a1"><enum>(1)</enum><text>national security;</text></paragraph><paragraph id="idab1f15c71a524a5fa050024851530e00"><enum>(2)</enum><text>intellectual property or redistribution rights, including under titles 17 and 35, United States Code; </text></paragraph><paragraph id="id6ED83A34CAE14CB0A27654557DC19208"><enum>(3)</enum><text>any trade secret or commercial or financial information subject to section 552(b)(4) of title 5, United States Code; </text></paragraph><paragraph id="id5FA2E5D6C4654C6595CE64C4A63A8760"><enum>(4)</enum><text>any models or data that are otherwise restricted by contract or other written agreement; or</text></paragraph><paragraph id="idcb9ace8bd4c9445aa783905ba706375a"><enum>(5)</enum><text>the mission of the Administration to protect lives and property.</text></paragraph></subsection><subsection id="idaaeffb9d3c9e4a45a8bd86373829b40e"><enum>(c)</enum><header>Priority</header><text>In developing and implementing the plan under subsection (a), the Administrator shall prioritize making available to the public the models described in subsection (a)(1).</text></subsection><subsection id="idf3169f36e03c4523ba013bd604c45a87"><enum>(d)</enum><header>Exclusion of certain models</header><text>In developing and implementing the plan under subsection (a), the Administrator may exclude models that the Administrator determines will be retired or superseded in fewer than 5 years after the date of the enactment of this Act.</text></subsection><subsection id="id8634560a5b8c4e3ba671d4676c188cf9"><enum>(e)</enum><header>Platforms</header><text>In carrying out subsections (a) and (b), the Administrator may use government servers, contracts or agreements with a private vendor, or any other platform consistent with the purpose of this Act. </text></subsection><subsection id="idBA8494551CF14753A8060EEBED989D89"><enum>(f)</enum><header>Support program</header><text>The Administrator shall plan for and establish a program to support infrastructure, including telecommunications and technology infrastructure of the Administration and the platforms described in subsection (e), relevant to making operational models and data available to the public pursuant to the plan under subsection (a). </text></subsection><subsection id="id1e3b788ebc5e449f846733efe4c29296"><enum>(g)</enum><header>Technical correction</header><text>Section 102(b) of the Weather Research Forecasting and Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8512">15 U.S.C. 8512(b)</external-xref>) is amended by redesignating the second paragraph (4) (as added by section 4(a) of the National Integrated Drought Information System Reauthorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/423">Public Law 115–423</external-xref>; 132 Stat. 5456)) as paragraph (5).</text></subsection></section><section id="id93b628ce0d4042218ac05ac865361b5f"><enum>5.</enum><header>Requirement to review models and leverage innovations</header><text display-inline="no-display-inline">The Administrator shall—</text><paragraph id="id058e2acc36b6403a8f9a988df247be2c"><enum>(1)</enum><text>consistent with the mission of the Earth Prediction Innovation Center, periodically review innovations and improvements made by persons outside the Administration to the operational models made available to the public pursuant to the plan under section 4(a) in order to improve the accuracy and timeliness of forecasts of the Administration; and</text></paragraph><paragraph id="id3b5f811f59dd47aa9b6997ebb3ebe8db"><enum>(2)</enum><text>if the Administrator identifies an innovation for a suitable model, develop and implement a plan to use the innovation to improve the model.</text></paragraph></section><section id="id11dbeb0fbc2f4b3798f53d573d34efd8"><enum>6.</enum><header>Report on implementation</header><subsection id="idab165508ceb5411b84a8e8437ad21990"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Administrator shall submit to the appropriate congressional committees a report on the implementation of this Act that includes a description of—</text><paragraph id="id9eb01bff45cf4668af9b482391126519"><enum>(1)</enum><text>the implementation of the plan required by section 4; </text></paragraph><paragraph id="id870cdc574aac4bbeb356c7ceb8f8a056"><enum>(2)</enum><text>the process of the Administration under section 5—</text><subparagraph id="idb81d299009284d56bf07539508df71bf"><enum>(A)</enum><text>for engaging with interested stakeholders to learn what innovations those stakeholders have found;</text></subparagraph><subparagraph id="id9b35dfb0d98447ec9a8d172a7f6720c9"><enum>(B)</enum><text>for reviewing those innovations; and</text></subparagraph><subparagraph id="id859e0f787cc3490b963b565ca55aa427"><enum>(C)</enum><text>for operationalizing innovations to improve suitable models.</text></subparagraph></paragraph></subsection><subsection id="id5f8a3bc509164508a538689729e92acd"><enum>(b)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="ida3c9288f30ff462695cc5526ebdcec88"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation and the Committee on Appropriations of the Senate; and</text></paragraph><paragraph id="id28b803647c974b8abad792dc74d1d9ef"><enum>(2)</enum><text>the Committee on Science, Space, and Technology and the Committee on Appropriations of the House of Representatives.</text></paragraph></subsection></section><section id="id7fdd9681152d4a1684db4c692939e73d"><enum>7.</enum><header>Protection of national security interests</header><subsection id="idb05813cc1ca74c539df6eca576ed572b"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this Act, the Administrator, in consultation with the Secretary of Defense, as appropriate, may withhold any model or data if the Administrator determines doing so to be necessary to protect the national security interests of the United States.</text></subsection><subsection id="id2558d67afd6d4c6cb5f02d1cc364c117"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to supersede any other provision of law governing the protection of the national security interests of the United States.</text></subsection></section><section id="idFF0A3E13136C4ACDB1B2EDFAA6F27D1A"><enum>8.</enum><header>Authorization of appropriations</header><subsection id="id4FB5CE92E8464E1680096DBCA37794FB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this Act $2,000,000 for each of fiscal years 2022 through 2026.</text></subsection><subsection id="id344758BCB90741A8986690DACD3C3651"><enum>(b)</enum><header>Derivation of funds</header><text>Funds to carry out this section shall be derived from amounts authorized to be appropriated to the National Weather Service that are enacted after the date of the enactment of this Act.</text></subsection></section></legis-body><endorsement><action-date>December 17, 2021</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
