<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1124</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210414">April 14, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to add a definition for the term <quote>common carrier</quote>, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCE913A1D18254B2DB84BE21ECA1C30A0"><section section-type="section-one" id="HEC1633ACD70342678234685CD6C9E227"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flight Sharing Freedom Act</short-title></quote>.</text></section><section id="HBD39DBCB67944390A4A7E99C77BEC7CB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 40102(a) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A72CE8C966F41C095ABA18A5A04C11F"><paragraph id="idd9506f2528e34ff6936f5ae7901d9e44"><enum>(48)</enum><text><term>common carrier</term> means a service provided by a person that meets the following elements:</text><subparagraph id="idfb2ebb0abf9c487e9421114b637a5a8b"><enum>(A)</enum><text>holding out of a willingness to;</text></subparagraph><subparagraph id="idC5AC10E33F4D4ED4B21BF5F0A5CE38E7"><enum>(B)</enum><text>transport persons or property;</text></subparagraph><subparagraph id="id81DF8AF5206D4909B3C976B1476C563F"><enum>(C)</enum><text>from place to place;</text></subparagraph><subparagraph id="idEFEEC93BEDAA41ED9412F8CE853AA8EE"><enum>(D)</enum><text>for compensation; and</text></subparagraph><subparagraph id="idC8030EBFFB994C728B5EC2F3D16532FF"><enum>(E)</enum><text>without refusal unless authorized by law.</text></subparagraph><continuation-text continuation-text-level="paragraph">In applying subparagraph (D), the term <term>compensation</term> requires the intent to pursue monetary profit but does not include flights in which the pilot and passengers share aircraft operating expenses or the pilot receives any benefit.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idb3d2bff7c5a149199138e561abdbb309"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Transportation shall issue or revise regulations to comply with this Act and to ensure that a person who holds a pilot certificate may communicate with the public, in any manner the person determines appropriate, to facilitate an aircraft flight for which the pilot and passengers share aircraft operating expenses in accordance with section 61.113(c) of title 14, Code of Federal Regulations (or any successor regulation) and that such flight-sharing operations under section 61.113(c) of title 14, Code of Federal Regulations (or any successor regulation) shall not be deemed a common carrier, as defined in paragraph (48) of section 40102(a) of title 49, United States Code, or a commercial operation requiring a certificate under part 119 or 135 of title 14, Code of Federal Regulations (or any successor regulation).</text></section></legis-body></bill>
