which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand and improve access to trauma-informed mental health interventions for newly arriving immigrants at the border, to alleviate the stress of and provide education for border agents, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF899F7B797E54073B7050DFEE563FAB9"><section section-type="section-one" id="H1ACC48B25FF347FCAE37057EE671E4AC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immigrants’ Mental Health Act of 2021</short-title></quote>.</text></section><section id="H0543E1DB352E41C082086647A127715D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2E95CABD701B480A8B143BD1A0EEABBB"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Health Resources and Services Administration of the Department of Health and Human Services.</text></paragraph><paragraph id="id05449B5EB6C84CFEA3974D495876ECDC"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id14AB42F3F8D645039C80EA531ED2DB99"><enum>(A)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph id="idCF6BA08BC95745289B513F53D8F1B9DF"><enum>(B)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph id="idE07EDC336AE04A4B98592D77AA90D4E4"><enum>(C)</enum><text>the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>;</text></subparagraph><subparagraph id="id883EEC16AE5F4A38B625F6090376B7EB"><enum>(D)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>; </text></subparagraph><subparagraph id="idA95B49D4C03040E7A279C7DECC1CFCD2"><enum>(E)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph id="id7DC20639414D40E8BEFFE82A27AA72B7"><enum>(F)</enum><text>the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="id8FACDE0DD1AB414082ABCD653C0FFF8A"><enum>(3)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Health and Human Services for Mental Health and Substance Use.</text></paragraph><paragraph id="id77EA6D4101FF484DA02585151662DC9C"><enum>(4)</enum><header>CBP</header><text>The term <term>CBP</term> means U.S. Customs and Border Protection.</text></paragraph><paragraph id="id66A10D6701E2468CA9F95847F6E2C070"><enum>(5)</enum><header>CBP detention facility</header><text>The term <term>CBP detention facility</term> means any of the following facilities that typically detain migrants on behalf of CBP:</text><subparagraph id="H626CC0E28FA640A6A458A3F242FC46C9"><enum>(A)</enum><text>U.S. Border Patrol station.</text></subparagraph><subparagraph id="HDB2016F5CB9E47249827BC2429745696"><enum>(B)</enum><text>Port of entry.</text></subparagraph><subparagraph id="H15B11CD6869542B293AFEE6156DFDCA6"><enum>(C)</enum><text>Checkpoint.</text></subparagraph><subparagraph id="H7110D8744BC945C3AC4BE810A481F30D"><enum>(D)</enum><text>Forward operating base.</text></subparagraph><subparagraph id="HBF95CFB076D94BADB9A7BD7E1B41FFD5"><enum>(E)</enum><text>Secondary inspection area.</text></subparagraph><subparagraph id="HB484AA0C0B3D419191A27D7FA8991885"><enum>(F)</enum><text>Short-term custody facility.</text></subparagraph></paragraph><paragraph id="idFB0ADF8C1F7A4B64A1E37E2998EF524A"><enum>(6)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of U.S. Customs and Border Protection.</text></paragraph><paragraph id="H401909DF2BC24BB98921DD0EC4A3C940" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header>Forward operating base</header><text display-inline="yes-display-inline">The term <term>forward operating base</term> means a permanent facility established by CBP in forward or remote locations, and designated as such by the Commissioner. </text></paragraph></section><section id="HABDB056B7B41443D8968303613698740"><enum>3.</enum><header>Training for certain CBP personnel in mental health issues</header><subsection id="H5D9706A5694149F9987A52A7D747D579"><enum>(a)</enum><header>Training To identify risk factors and warning signs in immigrants and refugees</header><paragraph id="HDA6EE43571574455A54A08F55E7025C1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner, in consultation with the Assistant Secretary, the Administrator, and nongovernmental experts in the delivery of health care to children in humanitarian crises, shall develop and implement a training curriculum for CBP agents and officers assigned to CBP detention facilities to enable such agents and officers to identify the risk factors and warning signs in immigrants and refugees of mental health issues relating to trauma.</text></paragraph><paragraph id="HA6D414B3E36840798D15266AA901545C"><enum>(2)</enum><header>Requirements</header><text>The training curriculum required under paragraph (1) shall—</text><subparagraph id="H5CED68F9E8D4459392C654C70B849275"><enum>(A)</enum><text display-inline="yes-display-inline">apply to all CBP agents and officers working at CBP detention facilities;</text></subparagraph><subparagraph id="H671CD04520D4495F9259C86E6D91FDD8"><enum>(B)</enum><text>provide for crisis intervention using a trauma-informed approach; and</text></subparagraph><subparagraph id="HA760A13E42FE43A8B4975AAB5168243D"><enum>(C)</enum><text>provide for mental health screenings for immigrants and refugees arriving at the border in their preferred language or with appropriate language assistance.</text></subparagraph></paragraph></subsection><subsection id="HF172AF052A7348CAB912B2F47F2B241B"><enum>(b)</enum><header>Training To address mental health and wellness of CBP agents and officers</header><paragraph id="HD504690F2FA84DFE83F7BCE9A896F72E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner, in consultation with the Assistant Secretary, the Administrator, and nongovernmental experts in the delivery of mental health care, shall develop and implement a training curriculum for CBP agents and officers assigned to CBP detention facilities to address the mental health and wellness of the individuals working at such facilities.</text></paragraph><paragraph id="H1708243DE16A46C1BA019699BC4271D4"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">The training curriculum required under paragraph (1) shall be designed to help CBP agents and officers working at CBP detention facilities—</text><subparagraph id="H46A7EED4CC744BF7AAB5D0A6A416F302"><enum>(A)</enum><text>to better manage their own stress and the stress of their coworkers; and</text></subparagraph><subparagraph id="HF95A22F7BF5A4F22BA81CDC01B977F09"><enum>(B)</enum><text>to be more aware of the psychological pressures experienced during their jobs.</text></subparagraph></paragraph></subsection><subsection id="HCABAC6B5910E4D9297C0607F1CA39492"><enum>(c)</enum><header>Annual review of training</header><text display-inline="yes-display-inline">Beginning on October 1, 2022, the Assistant Secretary shall—</text><paragraph id="H13CE7C7278E94BAA8500702216A20B1B"><enum>(1)</enum><text>conduct an annual review of the training implemented pursuant to subsections (a) and (b); and</text></paragraph><paragraph id="H3B2DEA92F95842D985A351E87E02D768"><enum>(2)</enum><text display-inline="yes-display-inline">submit the results of each such review, including any recommendations for improvement of such training, to—</text><subparagraph id="H526A878C16D7419B9BA4444FFCF92C53"><enum>(A)</enum><text display-inline="yes-display-inline">the Commissioner; and</text></subparagraph><subparagraph id="H81C847758A4C4EE5A76C9E06348085C4"><enum>(B)</enum><text>the appropriate congressional committees.</text></subparagraph></paragraph></subsection><subsection id="HE5FE7DA2F1B74EB9983B310FAC7B0953"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section—</text><paragraph id="H16239F58AF0B404DB009A8F114B824BA"><enum>(1)</enum><text>$50,000 for fiscal year 2022, which shall be expended to develop the training described in subsections and (a) and (b); and</text></paragraph><paragraph id="H7DBE629423784412BB6F8D56A176449D"><enum>(2)</enum><text display-inline="yes-display-inline">for each of the fiscal years 2023 through 2026—</text><subparagraph id="H14B38DAFE0A1406C8C0087A34D921400"><enum>(A)</enum><text>$20,000 to implement the training described in subsections (a) and (b); and</text></subparagraph><subparagraph id="H79815197E3504EC49BD8FB5A721BBE2A"><enum>(B)</enum><text>such sums as may be necessary to review, and make recommendations for, such training pursuant to subsection (c).</text></subparagraph></paragraph></subsection></section><section id="H53C9992EC07D499C8C0122AD620B5B88"><enum>4.</enum><header><editorial></editorial>Staffing border facilities and detention centers</header><subsection id="H8ED838AF14124DBF93DCA3B2224ACD83"><enum>(a)</enum><header>Staffing border facilities</header><paragraph id="H2F3FD64C57B842238FE16DB6D8BA84D8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner shall assign at least 1 qualified mental or behavioral health expert to each CBP detention facility to adequately evaluate the mental health needs of immigrants, refugees, border patrol agents, and staff.</text></paragraph><paragraph id="HBF973E3CAABA47A28C6F9D6D9E697881"><enum>(2)</enum><header>Qualifications</header><text>A mental or behavioral health expert shall be considered to be qualified under paragraph (1) if he or she—</text><subparagraph id="H28542933A3CC4E5EA01E61B0A1ADAB78"><enum>(A)</enum><text>is bilingual;</text></subparagraph><subparagraph id="H3A9FC8D8D9914F3AA8E352557ED191A3"><enum>(B)</enum><text>is well-versed in culturally appropriate and trauma-informed interventions; and</text></subparagraph><subparagraph id="H0F196F98419844F58E0165C33F3B6DCE"><enum>(C)</enum><text>has particular expertise in child or adolescent mental health or family mental health.</text></subparagraph></paragraph></subsection><subsection id="H7DD64DCA6BFF4A75AD28FAE573EBECB9"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $3,000,000 for each of the fiscal years 2022 through 2026 to carry out this section.</text></subsection></section><section id="H9CFBE08FCE9B40E2AAA3FFCAC6A90EAC"><enum>5.</enum><header>No sharing of Department of Health and Human Services mental health information for immigration hearings, asylum determinations, or removal proceedings</header><text display-inline="no-display-inline">The officers, employees, and agents of the Department of Health and Human Services, including the Office of Refugee Resettlement, may not share with the Department of Homeland Security, and the officers, employees, and agents of the Department of Homeland Security may not request or receive from the Department of Health and Human Services, for purposes of an immigration hearing, an asylum determination, or a deportation proceeding, any information or record—</text><paragraph id="H6774BF1F28A343E3B406936A24700742"><enum>(1)</enum><text display-inline="yes-display-inline">related to the mental health of an alien; or</text></paragraph><paragraph id="HE185FFC83F2A4727A178ABC4A143003B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>that was obtained or produced by a mental or behavioral health professional while the alien was in a shelter or otherwise in the custody of the Federal Government. </text></paragraph></section></legis-body></bill>
