which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to make permanent the protections under Medicaid for recipients of home and community-based services against spousal impoverishment.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD8B12656C18F4C409B31AA0256B48565"><section section-type="section-one" id="H22B3628F95D442D08F5585D01A980062"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Married Seniors From Impoverishment Act</short-title></quote>.</text></section><section id="HD4708FE03F7E4E689AAE148E339F36E6"><enum>2.</enum><header>Making permanent the protection under Medicaid for recipients of home and community-based services against spousal impoverishment</header><subsection id="HB41C489811C0438BB69B26C2BAED9185"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1924(h)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5(h)(1)(A)</external-xref>) is amended by striking <quote>(at the option of the State) is described in section 1902(a)(10)(A)(ii)(VI)</quote> and inserting the following: <quote>is eligible for medical assistance for home and community-based services provided under subsection (c), (d), or (i) of section 1915, under a waiver approved under section 1115, or who is eligible for such medical assistance by reason of being determined eligible under section 1902(a)(10)(C) or by reason of section 1902(f) or otherwise on the basis of a reduction of income based on costs incurred for medical or other remedial care, or who is eligible for medical assistance for home and community-based attendant services and supports under section 1915(k)</quote>.</text></subsection><subsection id="HF83B38558BAB4B5E8A5C66BC121B6502"><enum>(b)</enum><header>Conforming amendment</header><text>Section 2404 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5</external-xref> note) is amended by striking <quote>September 30, 2023</quote> and inserting <quote>the date of the enactment of the <short-title>Protecting Married Seniors From Impoverishment Act</short-title></quote>. </text></subsection><subsection id="id494db9e87b1c45c5880932c2a6461720"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in section 1924 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5</external-xref>) or section 1902(a)(17) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(17)</external-xref>) shall be construed as prohibiting a State from applying an income or resource disregard authorized under section 1902(r)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(r)(2)</external-xref>)—</text><paragraph id="id5682f939cf3940ccbdc6df741368e941"><enum>(1)</enum><text>to the income or resources of individuals described in section 1902(a)(10)(A)(ii)(VI) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(ii)(VI)</external-xref>) (including a disregard of the income or resources of such individual’s spouse); or</text></paragraph><paragraph id="idc3c67bfb0bea441c8a865c84ddddbe06" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>on the basis of an individual’s need for home and community-based services authorized under subsection (c), (d), (i), or (k) of section 1915 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n</external-xref>) or under section 1115 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
