which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to authorize borrowers to separate joint consolidation loans.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6993A8705DCE4BA7A444D540CCEBCBE1"><section section-type="section-one" id="HB6878834F8944366B16EAC5A9EBAE3A0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Joint Consolidation Loan Separation Act</short-title></quote>.</text></section><section id="HD1AA151E9A9C4749A04340A29F20FC14"><enum>2.</enum><header>Separating joint consolidation loans</header><subsection id="H278D8039545D4523849BB624EB92897D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 455(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(g)</external-xref>) is amended—</text><paragraph id="H6BC81417BDA941F18D9080441603D440"><enum>(1)</enum><text>by striking <quote>A borrower</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H19BB4A6E177144C18DCC5605F5EB7CE5"><paragraph id="H96C28BDB148F4195A222121FC27D43C0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A borrower</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HAC0B8BFEEE694C4F9B0A6DC697DD3DA3"><enum>(2)</enum><text>in the first sentence, insert <quote>(other than a Federal Direct Consolidation Loan separated from a joint consolidation loan under paragraph (2) of this subsection)</quote> after <quote>under this part</quote>; and</text></paragraph><paragraph id="H19804F68310E45F8A6280E3C7FE668D9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB1550628818D456EA0F6740EF1C6CD28"><paragraph id="HC0AB17E2F7BE46969DC7E9857658F513"><enum>(2)</enum><header>Separating joint consolidation loans</header><subparagraph id="H685EAD068A5945488FAA70C537423347"><enum>(A)</enum><header>In general</header><text>A married couple, or 2 individuals who were previously a married couple, and who received a joint consolidation loan as such married couple under subparagraph (C) of section 428C(a)(3) (as such subparagraph was in effect on June 30, 2006), may apply to the Secretary, in accordance with subparagraph (C) of this paragraph, for each individual borrower in the married couple (or previously married couple) to receive a separate Federal Direct Consolidation Loan under this part.</text></subparagraph><subparagraph id="H7DE8BE5629014179B6EB8D26473E5832"><enum>(B)</enum><header>Secretarial requirements</header><text display-inline="yes-display-inline">Notwithstanding section 428C(a)(3)(A) or any other provision of law, for each individual borrower who applies under subparagraph (A), the Secretary shall—</text><clause id="H3A700FF4FFC24860B1A133365769BE51"><enum>(i)</enum><text display-inline="yes-display-inline">award a separate Federal Direct Consolidation Loan under this part that—</text><subclause id="H09ABC993F63641AA87CE1CE5F030C5D3"><enum>(I)</enum><text>shall be for an amount equal to the product of—</text><item id="H437C1CFFBB004096B2EAD0079010AAE5"><enum>(aa)</enum><text display-inline="yes-display-inline">the unpaid principal and accrued unpaid interest of the joint consolidation loan (as of the date that is the day before such separate consolidation loan is made); and</text></item><item id="H9BE13463B45347429EC71D72D18A7546"><enum>(bb)</enum><text display-inline="yes-display-inline">the percentage of the joint consolidation loan attributable to the loans of the individual borrower for whom such separate consolidation loan is being made, as determined on the basis of the loan obligations of such borrower with respect to such joint consolidation loan (as of the date such joint consolidation loan was made); and</text></item></subclause><subclause id="H84D0EE3580C344CB830A183C0DEF1ED5"><enum>(II)</enum><text>has the same rate of interest as the joint consolidation loan (as of the date that is the day before such separate consolidation loan is made); and</text></subclause></clause><clause id="H8489F16A43FE491B9B67C457C582F22C"><enum>(ii)</enum><text display-inline="yes-display-inline">in order to discharge such individual borrower from any remaining obligation with respect to the percentage of the joint consolidation loan described in clause (i)(I)(bb)—</text><subclause id="HB14B0ABFD23B4F7A96D4E4F047B21752"><enum>(I)</enum><text>cancel the outstanding balance of interest and principal due on such percentage, in the case of such a loan held by the Secretary; and</text></subclause><subclause id="HA6B7B14E1EC44CEDA58E9D58C8B61CCC"><enum>(II)</enum><text>through the holder of the loan, assume the obligation to repay the outstanding balance of interest and principal due on such percentage, in the case of such a loan made, insured, or guaranteed under part B;</text></subclause></clause><clause id="H3FB81CDC443540EE9473169BE31FA1FA"><enum>(iii)</enum><text display-inline="yes-display-inline">ensure that such individual borrower shall not be held liable for the repayment of the percentage of the joint consolidation loan that is not described in clause (i)(I)(bb);</text></clause><clause id="HF2BC33FDD0C448A499BF50A7D0E00E7E"><enum>(iv)</enum><text display-inline="yes-display-inline">in a case in which a payment was made under section 455(m)(1)(A) on the joint consolidation loan during a period in which the individual borrower for whom such separate consolidation loan is being made was employed in a public service job described in section 455(m)(1)(B), treat such payment as if such payment were made on the separate consolidation loan; and</text></clause><clause id="H0322FE4DCD1647E3AF25FBF0AE99885F"><enum>(v)</enum><text display-inline="yes-display-inline">in a case in which a payment was made under an income contingent repayment plan or an income-based repayment plan described in subparagraph (D) or (E) of section 455(d)(1), respectively, on the joint consolidation loan, treat such payment as if such payment were made on such separate consolidation loan.</text></clause></subparagraph><subparagraph id="H5C0A8480D8214A188F19022FE9456DE5"><enum>(C)</enum><header>Application for separate direct consolidation loan</header><clause id="HB4C7F38C15714F1DA27B719B9C7A3CE1"><enum>(i)</enum><header>Joint application</header><text>Except as provided in clause (ii), to receive separate consolidation loans under this part, both individual borrowers in a married couple (or previously married couple) shall jointly apply under subparagraph (A).</text></clause><clause id="H42DE4018179E4D92A9AA2D5CF4C64A74"><enum>(ii)</enum><header>Separate application</header><text display-inline="yes-display-inline">An individual borrower in a married couple (or previously married couple) may apply for a separate consolidation loan under subparagraph (A) separately and without regard to whether or when the other individual borrower in the married couple (or previously married couple) applies under subparagraph (A), in a case in which—</text><subclause id="H04B15C8C0C7B40D3B450401C758310F6"><enum>(I)</enum><text display-inline="yes-display-inline">the individual borrower has experienced from the other individual borrower—</text><item id="H4EB983DF0483466DB442FE10B1FD0C89"><enum>(aa)</enum><text>domestic violence (as defined in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925</external-xref> (a))); or</text></item><item id="HD1C2C8B9C9F84D81AFE793A0A57DFED7"><enum>(bb)</enum><text>economic abuse (including behaviors that control such borrower’s ability to acquire, use, and maintain access to money, credit, or the joint financial obligations of both borrowers);</text></item></subclause><subclause id="H60C8ADBB8C5D45D39BF985DA7E69CA5E"><enum>(II)</enum><text display-inline="yes-display-inline">the individual borrower certifies, on a form approved by the Secretary, that such borrower is unable to reasonably reach or access the loan information of the other individual borrower; or</text></subclause><subclause id="H370189C3CE4D485288645A9E8D2EE457"><enum>(III)</enum><text>the Secretary determines that authorizing each individual borrower to apply separately under subparagraph (A) would be in the best fiscal interests of the Federal Government.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1459C8E25C7E49C28FBB3079E06387B8"><enum>(b)</enum><header>Conforming amendment</header><text>Section 428C(a)(3)(B)(i)(V) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-3">20 U.S.C. 1078–3(3)(B)(i)(V)</external-xref>) is amended—</text><paragraph id="HB8BA3DBB873F49838A4868CAB0659E8C"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of item (bb);</text></paragraph><paragraph id="HDA37CA5481D94FD39B3D70738DA5B22B"><enum>(2)</enum><text>by striking the period at the end of item (cc) and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HB64636D83F1E45CC965DBE7C6E7B492E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H795381B3B04D4EF7B2564A082139944D"><item id="HFEEB5DEAA3894A339B8E14146A8F3962"><enum>(dd)</enum><text display-inline="yes-display-inline">for the purpose of separating a joint consolidation loan into 2 separate Federal Direct Consolidation Loans under section 455(g)(2), except that such separated Federal Direct Consolidation Loan may not consolidate such loan with the loans described in section 428C(a)(4).</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
