<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 1098</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to authorize borrowers to separate joint consolidation loans.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Joint Consolidation Loan Separation Act</short-title></quote>.</text></section><section id="ide56cae3f84744a879a9144076264bf83" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Separating joint consolidation loans</header><subsection id="idd9a73014d0d4415db83f5543b29a3dbd" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 455(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(g)</external-xref>) is amended—</text><paragraph id="id828877e523dc4d76ad3f39a460acfb16" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>A borrower</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida957ff3d576e4dfa835cfa601151da6b"><paragraph id="id31c5f586d4ad4e19b83fc515890db335" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A borrower</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="id773a088043f641da836e298807f91c24" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9972315E440C4495861B61BDA0E10973"><paragraph id="id640e4e07461b4d728542fbf4ee8a08e2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Separating joint consolidation loans</header><subparagraph id="id2fc5e97a8a6742d2b5431a3521b0daee" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><clause id="idF4A1D97E5E6E416EA083730BF4E9A28B" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">A married couple, or 2 individuals who were previously a married couple, and who received a joint consolidation loan as such married couple under subparagraph (C) of section 428C(a)(3) (as such subparagraph was in effect on June 30, 2006), may apply to the Secretary, in accordance with subparagraph (C) of this paragraph, for each individual borrower in the married couple (or previously married couple) to receive a separate Federal Direct Consolidation Loan under this part.</text></clause><clause id="id15E4C1A634F448EAA16E7AC1E4885221" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Eligibility for borrowers in default</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, a married couple, or 2 individuals who were previously a married couple, who are in default on a joint consolidation loan may be eligible to receive a separate Federal Direct Consolidation Loan under this part in accordance with this paragraph.</text></clause></subparagraph><subparagraph id="id6a2fc5d5bfb84f2681cba0783d90e4fb" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Secretarial requirements</header><text display-inline="yes-display-inline">Notwithstanding section 428C(a)(3)(A) or any other provision of law, for each individual borrower who applies under subparagraph (A), the Secretary shall—</text><clause id="idE05FB37E9EAF44D8807E2E4D16C04B48" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">make a separate Federal Direct Consolidation Loan under this part that—</text><subclause id="idE4552C10516A45F2B97F53C323811A59" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">shall be for an amount equal to the product of—</text><item id="id6876B99B0C9F4797838AAE59B55FC5C6" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">the unpaid principal and accrued unpaid interest of the joint consolidation loan (as of the date that is the day before such separate consolidation loan is made) and any outstanding charges and fees with respect to such loan; and</text></item><item id="id121D2215CF8144729697EFA5673C329B" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">the percentage of the joint consolidation loan attributable to the loans of the individual borrower for whom such separate consolidation loan is being made, as determined—</text><subitem id="idA4542D5EA7224D61ADB953890E29E4FF" commented="no" display-inline="no-display-inline"><enum>(AA)</enum><text display-inline="yes-display-inline">on the basis of the loan obligations of such borrower with respect to such joint consolidation loan (as of the date such joint consolidation loan was made); or</text></subitem><subitem id="id899996406E544250A7D1D12CAF93E155" commented="no" display-inline="no-display-inline"><enum>(BB)</enum><text display-inline="yes-display-inline">in the case in which both borrowers request, on the basis of proportions outlined in a divorce decree, court order, or settlement agreement; and </text></subitem></item></subclause><subclause id="id47ab2f9a0e5f49bfba5d083653524fb1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">has the same rate of interest as the joint consolidation loan (as of the date that is the day before such separate consolidation loan is made); and</text></subclause></clause><clause id="id8CC59EFA4C9942DD8F70E53C0A938EF0" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in a timely manner, notify each individual borrower that the joint consolidation loan had been repaid and of the terms and conditions of their new loans. </text></clause></subparagraph><subparagraph id="id898349eb8495415aacfaf9bb6b4b939f" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Application for separate direct consolidation loan</header><clause id="idd5fa5df7912d49639b53a5f6f23a4884" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Joint application</header><text display-inline="yes-display-inline">Except as provided in clause (ii), to receive separate consolidation loans under this part, both individual borrowers in a married couple (or previously married couple) shall jointly apply under subparagraph (A).</text></clause><clause id="id644e8e80d82d447db3b8fe5713779e54" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Separate application</header><text display-inline="yes-display-inline">An individual borrower in a married couple (or previously married couple) may apply for a separate consolidation loan under subparagraph (A) separately and without regard to whether or when the other individual borrower in the married couple (or previously married couple) applies under subparagraph (A), in a case in which—</text><subclause id="idf47239f91e2b496ca8fd1285cd350d40" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the individual borrower certifies to the Secretary that such borrower—</text><item id="id6318667b4df04351bb4e851cdb29eadd" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">has experienced an act of domestic violence (as defined in section 40002 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291</external-xref>) from the other individual borrower;</text></item><item id="idc813968d02b94251affa5f94cbf130dc" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">has experienced economic abuse (as defined in section 40002 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291</external-xref>) from the other individual borrower; or</text></item><item id="id8b640d9e9d6e48cc9e331c52184df53b" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">is unable to reasonably reach or access the loan information of the other individual borrower; or</text></item></subclause><subclause id="idd92e51aab6c041d190e750884ce22c7b" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the Secretary determines that authorizing each individual borrower to apply separately under subparagraph (A) would be in the best fiscal interests of the Federal Government.</text></subclause></clause><clause id="ide0d3471f3df8491b9789c4d7f16cc3f4" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Remaining obligation from separate application</header><text display-inline="yes-display-inline">In the case of an individual borrower who receives a separate consolidation loan due to the circumstances described in clause (ii), the other non-applying individual borrower shall become solely liable for the remaining balance of the joint consolidation loan.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4750b5d47671427b9ed42c0139b26ef6" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 428C(a)(3)(B)(i)(V) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-3">20 U.S.C. 1078–3(3)(B)(i)(V)</external-xref>) is amended—</text><paragraph id="id0698e959f47644838b899e0ae6e4e214" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of item (bb);</text></paragraph><paragraph id="idf285b2a5739541debb6073fe201b1353" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the period at the end of item (cc) and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="id7a5e13dd0e014ed2ac90140e50892e92" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0877dc6432854eb0b3894371f7384702"><item id="id39846995fa284c159b4acd532a49582a" commented="no" display-inline="no-display-inline"><enum>(dd)</enum><text display-inline="yes-display-inline">for the purpose of separating a joint consolidation loan into 2 separate Federal Direct Consolidation Loans under section 455(g)(2).</text></item><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
