<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 1095</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for the disapproval by the Secretary of Veterans Affairs of courses of education offered by public institutions of higher learning that do not charge veterans the in-State tuition rate for purposes of Survivors’ and Dependents’ Educational Assistance Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAE11F0139CD0448C8C8D178B545FDC03"><section section-type="section-one" id="H73BB7F6B80B049A19C06D6B10B777EED" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Colonel John M. McHugh Tuition Fairness for Survivors Act of 2021</short-title></quote>.</text></section><section id="H194259432D24407280371240AC354676" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Department of Veterans Affairs disapproval of courses offered by public institutions of higher learning that do not charge veterans the in-State tuition rate for purposes of Survivors’ and Dependents’ Educational Assistance Program</header><subsection id="H1104A4A4B36E4A40A9F5991D10A4897F" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 3679(c) of title 38, United States Code, is amended—</text><paragraph id="HFFA8D33285B24FFCA9AC2318B98B47B2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>or 33</quote> and inserting <quote>33, or 35</quote>;</text></paragraph><paragraph id="HD8D7D3A825AF463595B733D2C46E4BCF" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA2C5577E46FF4409B018E9441CC50FCF"><subparagraph id="HAC07BB335F2145A688E149544BD17ECD" indent="up1" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">An individual who is entitled to assistance under section 3510 of this title.</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HA4DBAA74349544879F00CDE7BB96DF5E" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>and 33</quote> and inserting <quote>33, and 35</quote>.</text></paragraph></subsection><subsection id="H7A399548A46447418F6331BBF64C1B10" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 3679(e) of such title is amended—</text><paragraph id="H16AF952B7B944C24B788685D84AAA490" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="HA44676C23C6F4F909F693FB818CDF6A5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>or 33</quote> and inserting <quote>, 33, or 35</quote>; and</text></subparagraph><subparagraph id="H67499732915B464CA416BA4A9E928029" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>or 33</quote> and inserting <quote>33, or 35</quote>; and </text></subparagraph></paragraph><paragraph id="H7C0D1A42D2144E4591F94F5E1DD495B7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>or 33</quote> and inserting <quote>33, or 35</quote>.</text></paragraph></subsection><subsection id="H42B8226968B84819B5E73F70F463473B" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on the date of the enactment of this Act and shall apply with respect to an academic period that begins on or after August 1, 2022.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210624" chamber="Senate">Passed the Senate June 24, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
