Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that certain materials used in carrying out Federal infrastructure aid programs are made in the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H687E6E9E7CCB4115ACF13E20D3758DE6"><section id="HAFC17015AFE542E7BC7900F11F774631" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Made in America Act of 2021</short-title></quote>.</text></section><section id="HEAE96F4034F74C6C9305589418CEA6C6"><enum>2.</enum><header>American-made infrastructure</header><subsection id="HF256A50CD7624F4C9C86C5891987D008"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5CD930DAC31241BBA7A58F9D2E06AE5F"><enum>(1)</enum><header>Produced in the United States</header><text>The term <term>produced in the United States</term> means—</text><subparagraph id="HF9AC2D86CCB34C7EB75E367235157511"><enum>(A)</enum><text>in the case of iron or steel products, that all manufacturing processes for the iron or steel product, from the initial melting stage through the application of coatings, occurred in the United States;</text></subparagraph><subparagraph id="HB661EF60D4694C2D973956BD167364B5"><enum>(B)</enum><text>in the case of manufactured products, that—</text><clause id="H615EC0C2FC5F4504836BD06E599266BC"><enum>(i)</enum><text>the manufactured product was manufactured in the United States; and</text></clause><clause id="H69275B8E586149C582C55B8243116AC2"><enum>(ii)</enum><text>the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 50 percent of the total cost of all components of the manufactured product; and</text></clause></subparagraph><subparagraph id="HBDF5948A6D98433FBE7142B3FED9BDAF"><enum>(C)</enum><text>in the case of construction materials described in subparagraphs (D) through (I) of subsection (c)(1), that all manufacturing processes for the construction material occurred in the United States.</text></subparagraph></paragraph><paragraph id="HBE9FBB82411B40C4919D85FD5F4BCE1D"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></subsection><subsection id="HF80AB0476C104C20AF32E27497DA9923"><enum>(b)</enum><header>Uniform standards</header><paragraph id="HFBD6B69411D54D3CB7F6EBC0821D078B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall issue uniform standards that define the term <term>all manufacturing processes</term> for the purposes of this Act—</text><subparagraph id="H17871D4DF2354D5CBBAF5045D36B45DC"><enum>(A)</enum><text>in the case of iron and steel, in a manner consistent with section 635.410(b)(1)(ii) of title 23, Code of Federal Regulations (as in effect on the date of enactment of this Act); and</text></subparagraph><subparagraph id="HE4C86769EA7C43139E22279113F66AC3"><enum>(B)</enum><text>in the case of construction materials described in subparagraphs (D) through (I) of subsection (c)(1), in accordance with paragraph (2).</text></subparagraph></paragraph><paragraph id="H3DF4D2DEDADC439B82797A683042ACDC"><enum>(2)</enum><header>Considerations</header><text>In issuing uniform standards under paragraph (1)(B), the Secretary shall—</text><subparagraph id="H23B27629591941679D42EFFA62A2F6E2"><enum>(A)</enum><text>ensure that the uniform standards require that each manufacturing process required for the manufacture of the construction material and the inputs of the construction material occurs in the United States, without regard to the origin of raw material inputs; and</text></subparagraph><subparagraph id="HDF5DACEAF97E4BC394E81722D2489BF0"><enum>(B)</enum><text>take into consideration and seek to maximize the direct and indirect jobs benefited or created in the production of the construction material.</text></subparagraph></paragraph><paragraph id="H30046C9D2BD944BC9F6B6093DCA89834"><enum>(3)</enum><header>Application</header><text>In carrying out a program described in subsection (d), the head of each Federal department or agency that administers a program described in subsection (d) shall—</text><subparagraph id="H0CB17928BDB34A21B261DCE6140327C7"><enum>(A)</enum><text>implement this Act; and</text></subparagraph><subparagraph id="H5B225BB6DE3C4F6AAA75F51D1547787E"><enum>(B)</enum><text>adopt the uniform standards issued by the Secretary under paragraph (1) for purposes of implementing this Act.</text></subparagraph></paragraph></subsection><subsection id="H4410CA671AA94834A72D4EE114CB7421"><enum>(c)</enum><header>Requirement</header><paragraph id="H116146F33D1E43C496350868BE81FDF5"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, none of the funds made available to carry out a program described in subsection (d) may be used for a project under that program unless all of the following materials used in the project are produced in the United States:</text><subparagraph id="H869F1067F93B47E08B4839930F5F2520"><enum>(A)</enum><text>Steel.</text></subparagraph><subparagraph id="H5FA35EF5CA3D4F019EF0C2B83B14601E"><enum>(B)</enum><text>Iron.</text></subparagraph><subparagraph id="HB8F8A18A09E748309EAF9856110BFE31"><enum>(C)</enum><text>Manufactured products.</text></subparagraph><subparagraph id="H2C9D21FD6B694173981CCBBA058F9E58"><enum>(D)</enum><text>Non-ferrous metals.</text></subparagraph><subparagraph id="H6CB8BF7F598E4671A87B8138EB8E28FD"><enum>(E)</enum><text>Plastic and polymer-based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cables).</text></subparagraph><subparagraph id="H2D7A206F1A2D45918C4007AB169D4145"><enum>(F)</enum><text>Concrete and other aggregates.</text></subparagraph><subparagraph id="HD5FE59D43F104E529411D907B1F8810C"><enum>(G)</enum><text>Glass (including optic glass).</text></subparagraph><subparagraph id="HFED9B3CCAA8547E5916080796AA48370"><enum>(H)</enum><text>Lumber.</text></subparagraph><subparagraph id="H4129D0F5BD934606B9C30C2382A04A32"><enum>(I)</enum><text>Drywall.</text></subparagraph></paragraph><paragraph id="HD8BB81D379254E9FAF05A2E7844952D9"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply in any case in which the head of the Federal department or agency with authority to carry out the applicable program determines that—</text><subparagraph id="HE7BA5A8C6E9B4DFB9FD96F29C9B8521D"><enum>(A)</enum><text>applying paragraph (1) would be inconsistent with the public interest;</text></subparagraph><subparagraph id="H3FC0A376F2C64CD0B6BD1D0AF4509744"><enum>(B)</enum><text>the relevant material is not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or</text></subparagraph><subparagraph id="HD673537C49AC43689AA0E9EF0C161E53"><enum>(C)</enum><text>inclusion of the relevant material produced in the United States will increase the cost of the overall project by more than 25 percent.</text></subparagraph></paragraph><paragraph id="H6EA5D2F1CD8741E4966DF9FBEA0E526B"><enum>(3)</enum><header>Waiver</header><text>If the head of the Federal department or agency with authority to carry out the applicable program makes a finding under paragraph (2) to waive paragraph (1), the head of the Federal department or agency shall, before the date on which the waiver takes effect—</text><subparagraph id="HB72CC05CA8DD4E89842C9E523DFBE5F0"><enum>(A)</enum><text>publish in the Federal Register a detailed written justification that provides the reasons that the waiver is needed; and</text></subparagraph><subparagraph id="H11B0DFF965E84317B69213073CF4F5F8"><enum>(B)</enum><text>provide an opportunity for public comment on the proposed waiver for a period of not more than 60 days.</text></subparagraph></paragraph><paragraph commented="no" id="HF7472DD97ED240559246E0AF4FED12FA"><enum>(4)</enum><header>Application</header><text>This subsection shall be applied in a manner consistent with United States obligations under international agreements.</text></paragraph></subsection><subsection id="HBB563139DA9343A3AC0CC9710B515BDE"><enum>(d)</enum><header>Programs described</header><text>The programs referred to in subsection (c)(1) are each of the following:</text><paragraph id="H0E305ECB6C2C470E804720070CFD0F85"><enum>(1)</enum><text>Direct and guaranteed loans and grants under section 306(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>).</text></paragraph><paragraph id="H37C9F8A931F843EAA3D9872E597AFC55"><enum>(2)</enum><text>Distance learning and telemedicine grants under section 2333 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/950aaa-2">7 U.S.C. 950aaa–2</external-xref>).</text></paragraph><paragraph id="H8D9941F0F7FE424686D906E4FD17246A"><enum>(3)</enum><text>Broadband loans and loan guarantees under title IV of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref> et seq.).</text></paragraph><paragraph id="HEF3D5ADDCD4B4A16ACEE45F2278368DB"><enum>(4)</enum><text>The community connect grant program established under title III of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations, 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/199">Public Law 108–199</external-xref>; 118 Stat. 29).</text></paragraph><paragraph id="HA41BA14CE4B345D49A25BA13386EDD14"><enum>(5)</enum><text>Solid waste management grants under section 310B(b) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(b)</external-xref>).</text></paragraph><paragraph id="H239B4970DFF44261A7A377ED18178437"><enum>(6)</enum><text>A program or project carried out under the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121</external-xref> et seq.). </text></paragraph><paragraph id="H6F4CD045F5CE4EAAB362B53AEF499844"><enum>(7)</enum><text>Financial assistance for development, implementation, or modification of a State energy conservation plan under section 363 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6323">42 U.S.C. 6323</external-xref>).</text></paragraph><paragraph id="HF38FBA94B4B0411895075DAA1A208117"><enum>(8)</enum><text>Grants for construction of health centers provided by the Secretary of Health and Human Services.</text></paragraph><paragraph id="HA053F4AF99E8422F97B253CABCADDF33"><enum>(9)</enum><text>Grants for construction, renovation, or repair of non-Federal research facilities provided by the Director of the National Institutes of Health.</text></paragraph><paragraph id="H10000B900DBE46999B3871A572B7F9A6"><enum>(10)</enum><text>The public transportation security assistance grant program under section 1406 of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/1135">6 U.S.C. 1135</external-xref>).</text></paragraph><paragraph id="HF06B16F760E7474BB2E688451C6D97F3"><enum>(11)</enum><text>Assistance provided under the Public Housing Capital Fund established under section 9(d) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(d)</external-xref>).</text></paragraph><paragraph id="H06564AD96A924502BC168BEF194AFE86"><enum>(12)</enum><text>The community development block grant program under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.).</text></paragraph><paragraph id="H4003DB53DC1C43999C8972897C39894A"><enum>(13)</enum><text>The Indian housing block grant program under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>).</text></paragraph><paragraph id="H2B9A0CA24FB049279559F04E1D925572"><enum>(14)</enum><text>The rural water supply program under section 103 of the Rural Water Supply Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/2402">43 U.S.C. 2402</external-xref>).</text></paragraph><paragraph id="HD3E4EB6DD11E440D89BB0150DFE7A429" commented="no"><enum>(15)</enum><text display-inline="yes-display-inline">The National Parks and Public Land Legacy Restoration Fund established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2004">chapter 2004</external-xref> of title 54, United States Code.</text></paragraph><paragraph id="H60EA5B19588B434698D816E3BC83B022"><enum>(16)</enum><text>The Western Area Power Administration borrowing authority under title III of the Hoover Power Plant Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/16421a">42 U.S.C. 16421a</external-xref>).</text></paragraph></subsection></section><section id="H31D81CC2C4C44B4D83412584C07FAD17"><enum>3.</enum><header>Federal-Aid highways</header><subsection id="H53BD72D677E2403D982CE4593C898D76"><enum>(a)</enum><header>In general</header><text>Section 313(a) of title 23, United States Code, is amended by striking <quote>and manufactured products</quote> and inserting <quote>manufactured products, and construction materials described in subparagraphs (D) through (I) of section 2(c)(1) of the <short-title>Made in America Act of 2021</short-title></quote>.</text></subsection><subsection id="HC151A6A795F94FEF986EE8A7DB27B093"><enum>(b)</enum><header>No effect on iron or steel</header><text>Nothing in this section or an amendment made by this section affects section 313 of title 23, United States Code, or the implementation of that section by the Secretary of Transportation with respect to iron or steel under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code.</text></subsection><subsection id="HF7857994D2ED4E509FE64F1B955651C9" commented="no"><enum>(c)</enum><header>Buy America</header><text display-inline="yes-display-inline">Section 313(g) of title 23, United States Code, is amended—</text><paragraph id="H5F8A2C70A1D44CE494DFA3C57187B075"><enum>(1)</enum><text>by striking <quote>assistance under this chapter</quote> and inserting <quote>assistance under this title</quote>; and</text></paragraph><paragraph id="H0921F0E9039143BA9159E1384A7DE374"><enum>(2)</enum><text>by inserting <quote>section 330 or</quote> after <quote>decision under</quote> .</text></paragraph></subsection><subsection id="H0CD139427408483CB3DC64DE8D54D32C" commented="no"><enum>(d)</enum><header>Repeal of national waiver</header><text display-inline="yes-display-inline">The Secretary of Transportation shall rescind any finding made under section 313(b)(1) of title 23, United States Code, for any manufactured product other than steel and iron manufactured products in the final rule entitled <quote>Buy America Requirements</quote> (48 Fed. Reg. 53099 (November 25, 1983)).</text></subsection></section><section id="H9D0353BB07734D1E8E445B827A4F82D8"><enum>4.</enum><header>Transportation infrastructure finance and innovation</header><text display-inline="no-display-inline">Section 602(c)(1) of title 23, United States Code, is amended by inserting <quote>and section 22905(a)</quote> after <quote>section 5333(a)</quote>. </text></section><section id="HB86213C18E524F26A9DC4A1F51F35949"><enum>5.</enum><header>Railroad Rehabilitation and Improvement Financing</header><text display-inline="no-display-inline">Section 502 of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822(h)(3)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H46E8E9B1423F42D5B61908E27D1173CE" display-inline="no-display-inline"><subsection id="H7C37D2F680A947589AB3381C9CABAE7B"><enum>(n)</enum><header>Buy America</header><paragraph id="H802AFF404AC9456AAF8273F660D460D4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In awarding direct loans or loan guarantees under this section, the Secretary shall require each recipient to comply with section 22905(a) of title 49, United States Code.</text></paragraph><paragraph id="HBE347469CF834D34A38095427855605A"><enum>(2)</enum><header>Specific compliance</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the Secretary shall require the National Railroad Passenger Corporation (Amtrak) to comply with section 24305(f) of title 49, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H15361EEB99EC4F39995568405CFF055C"><enum>6.</enum><header>Public Transportation</header><text display-inline="no-display-inline">Section 5323(j) of title 49, United States Code, is amended—</text><paragraph id="H961CF62F62864359BB33B76FFBEE60BF"><enum>(1)</enum><text>in paragraph (1) by striking <quote>and manufactured goods</quote> and inserting <quote>manufactured products, and construction materials described in subparagraphs (D) through (I) of section 2(c)(1) of the <short-title>Made in America Act of 2021</short-title></quote>;</text></paragraph><paragraph id="H34D80E5043F444EE965BDE5017A1DF43"><enum>(2)</enum><text>in paragraph (2)(B) by striking <quote>and goods</quote> and inserting <quote>manufactured products, and construction materials</quote>;</text></paragraph><paragraph id="H6700F23B432649BD8A6593BFFC160578"><enum>(3)</enum><text>in paragraph (6)(A)(i) by striking <quote>or manufactured goods</quote> and inserting <quote>manufactured products, or construction materials</quote>; and</text></paragraph><paragraph id="H504330EDC6834BEFB65B73C2949B1755"><enum>(4)</enum><text>in paragraph (10) by striking <quote>or manufactured goods</quote> and inserting <quote>manufactured products, or construction materials</quote>. </text></paragraph></section><section id="HB05C122D48CA448D8B4C383E9E66AEF7"><enum>7.</enum><header>Rail improvement grants</header><text display-inline="no-display-inline">Section 22905(a) of title 49, United States Code, is amended—</text><paragraph id="HB1B2B4418A6D4D279FA90180CE993515"><enum>(1)</enum><text>in paragraph (1) by striking <quote>manufactured goods</quote> and inserting <quote>manufactured products, and construction materials described in subparagraphs (D) through (I) of section 2(c)(1) of the <short-title>Made in America Act of 2021</short-title></quote>; </text></paragraph><paragraph id="H78CBEEE0E61341D485DAB58D04D56240"><enum>(2)</enum><text>in paragraph (2)(B) by striking <quote>and goods</quote> and inserting <quote>manufactured products, and construction materials</quote>; </text></paragraph><paragraph id="HADF6BA800E174F1A800AE7D553EC4C2A"><enum>(3)</enum><text>in paragraph (9) by striking <quote>or manufactured goods</quote> and inserting <quote>manufactured products, or construction materials</quote>; and</text></paragraph><paragraph id="H918138D312FB407D9F2AD51A06B21A0D"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="HBDDE14EADA5B4B6390D5ED3B2EEAD4C3" display-inline="no-display-inline"><paragraph id="H4B1F8A28E1AA41B7B6EA19039F1979F1"><enum>(12)</enum><text display-inline="yes-display-inline">The requirements of this subsection apply to all contracts for a project carried out within the scope of the applicable finding, determination, or decisions under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), regardless of the funding source for activities carried out pursuant to such contracts, if at least 1 contract for the project is funded with amounts made available to carry out a provision specified in paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0EC1EE0FAB3B40CE8832793E87E9C0F0"><enum>8.</enum><header>Civil aviation facility programs</header><subsection id="HF251762B474645249290B3DECCC65B8A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 50101 of title 49, United States Code, is amended—</text><paragraph id="H5B0B2436E9BC4C3B86E830C5464A5028"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H27E0A971AB4646C7A5DF9BCC008F1D30"><enum>(A)</enum><text>by striking <quote>steel and manufactured goods</quote> and inserting <quote>steel, iron, manufactured products, and construction materials described in subparagraphs (D) through (I) of section 2(c)(1) of the <short-title>Made in America Act of 2021</short-title></quote>; and</text></subparagraph><subparagraph id="HC8174A8351AD44BDB7990BF1A32CD54A"><enum>(B)</enum><text>by striking <quote>(except section 47127)</quote>; and </text></subparagraph></paragraph><paragraph id="H221B1933B76F42A6A18BD65DBA8219F8"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HF135B14866A3489DBEAD2C225799E329"><enum>(A)</enum><text>in paragraph (2) by striking <quote>steel and goods</quote> and inserting <quote>steel, iron, manufactured products, and construction materials</quote>; and </text></paragraph><paragraph id="H812AD12F0F1F4C61AF3C34CF38C3599E"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H06974B046E7340DBA81883E33DA09BAE"><enum>(A)</enum><text>in paragraph (2) by inserting <quote>, manufactured products, and construction materials</quote> after <quote>iron and steel products</quote>; and</text></subparagraph><subparagraph id="H7BA74CF32E12475EA0EBBEEFB68748DF"><enum>(B)</enum><text>in paragraph (3) by inserting <quote>, manufactured products, and construction materials</quote> after <quote>iron and steel products</quote>. </text></subparagraph></paragraph></section><section id="H046E49FBCD384D63A7FCF1C7510E1D57"><enum>12.</enum><header>Water infrastructure finance and innovation</header><text display-inline="no-display-inline">Section 5035 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3914">33 U.S.C. 3914</external-xref>) is amended—</text><paragraph id="HB20CD09EA7EC4A8FB61074DCF6CF13C8"><enum>(1)</enum><text>in subsection (a) by inserting <quote>, manufactured products, and construction materials described in subparagraphs (D) through (I) of section 2(c)(1) of the <short-title>Made in America Act of 2021</short-title></quote> after <quote>iron and steel products</quote>; and </text></paragraph><paragraph id="HE6AB0663455C4820A53BE8E120023643"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H926C41723EF64B5FAB2A88B7E9C656EC"><enum>(A)</enum><text>in paragraph (2) by inserting <quote>, manufactured products, and construction materials</quote> after <quote>iron and steel products</quote>;
