<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1086</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210413">April 13, 2021</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> (for himself and <cosponsor name-id="S347">Mr. Moran</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide incentives for hate crime reporting, provide grants for State-run hate crime hotlines, and establish alternative sentencing for individuals convicted under the Matthew Shephard and James Byrd, Jr. Hate Crimes Prevention Act.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Khalid Jabara and Heather Heyer National Opposition to Hate, Assault, and Threats to Equality Act of 2021</short-title></quote> or the <quote><short-title>Jabara-Heyer NO HATE Act</short-title></quote>.</text></section><section id="HC4A3E473BB8D41F183EA71C0AD5CDA07"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id77caa828ee1a4bce8a20959763948aed"><enum>(1)</enum><text>The incidence of violence known as hate crimes, or crimes motivated by bias, poses a serious national problem.</text></paragraph><paragraph id="id9de92f1df5654e3f887a18d0195b6b64"><enum>(2)</enum><text>According to data obtained by the Federal Bureau of Investigation, the incidence of such violence increased in 2019, the most recent year for which data is available.</text></paragraph><paragraph id="idcadcd0f5870f48af818bcc8013e7d787"><enum>(3)</enum><text>In 1990, Congress enacted the Hate Crime Statistics Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/275">Public Law 101–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/534">28 U.S.C. 534</external-xref> note) to provide the Federal Government, law enforcement agencies, and the public with data regarding the incidence of hate crime. The Hate Crime Statistics Act and the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act (division E of <external-xref legal-doc="public-law" parsable-cite="pl/111/84">Public Law 111–84</external-xref>; 123 Stat. 2835) have enabled Federal authorities to understand and, where appropriate, investigate and prosecute hate crimes.</text></paragraph><paragraph id="idB62CFCA0FB1847878EFAD8E8D6C54FB4"><enum>(4)</enum><text>A more complete understanding of the national problem posed by hate crime is in the public interest and supports the Federal interest in eradicating bias-motivated violence referenced in section 249(b)(1)(C) of title 18, United States Code.</text></paragraph><paragraph id="id8f9dc1f2a1394e60901e93e45f173d34"><enum>(5)</enum><text>However, a complete understanding of the national problem posed by hate crimes is hindered by incomplete data from Federal, State, and local jurisdictions through the Uniform Crime Reports program authorized under section 534 of title 28, United States Code, and administered by the Federal Bureau of Investigation.</text></paragraph><paragraph id="id8021fdf23fbc45ff8289e708398e8d28"><enum>(6)</enum><text>Multiple factors contribute to the provision of inaccurate and incomplete data regarding the incidence of hate crime through the Uniform Crime Reports program. A significant contributing factor is the quality and quantity of training that State and local law enforcement agencies receive on the identification and reporting of suspected bias-motivated crimes.</text></paragraph><paragraph id="id8d67b2509e3f434da33d29412530dc56"><enum>(7)</enum><text>The problem of crimes motivated by bias is sufficiently serious, widespread, and interstate in nature as to warrant Federal financial assistance to States and local jurisdictions.</text></paragraph><paragraph id="idd3b72c5e56db41868034899ce7735000"><enum>(8)</enum><text>Federal financial assistance with regard to certain violent crimes motivated by bias enables Federal, State, and local authorities to work together as partners in the investigation and prosecution of such crimes.</text></paragraph></section><section id="id3B4F5C410D0F401F96EA9C06970ACAA3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id2F853491E8164307B5604EDBD2B1703E"><enum>(1)</enum><header>Hate crime</header><text display-inline="yes-display-inline">The term <term>hate crime</term> means an act described in section 245, 247, or 249 of title 18, United States Code, or in section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>).</text></paragraph><paragraph id="idaa18ab5d24fd46c3b2840d28c181d21d"><enum>(2)</enum><header>Priority agency</header><text>The term <term>priority agency</term> means—</text><subparagraph id="idea43421307fc46aab57ed88abfc21407"><enum>(A)</enum><text>a law enforcement agency of a unit of local government that serves a population of not less than 100,000, as computed by the Federal Bureau of Investigation; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65b205af93314363bad759e54f945c9a"><enum>(B)</enum><text>a law enforcement agency of a unit of local government that—</text><clause commented="no" display-inline="no-display-inline" id="idFB11DAC46C95497DBFD4EEEC295E1B51"><enum>(i)</enum><text>serves a population of not less than 50,000 and less than 100,000, as computed by the Federal Bureau of Investigation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7D460F6E57774FB5802B1109372A05DA"><enum>(ii)</enum><text>has reported no hate crimes through the Uniform Crime Reports program in each of the 3 most recent calendar years for which such data is available.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21B487CC1CF1432B99FD8EF0BA1C514C"><enum>(3)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph><paragraph id="HA306CFE5DD6D4168B80648B08B2188DE"><enum>(4)</enum><header>Uniform Crime Reports</header><text>The term <term>Uniform Crime Reports</term> means the reports authorized under section 534 of title 28, United States Code, and administered by the Federal Bureau of Investigation that compile nationwide criminal statistics for use—</text><subparagraph id="idF8191055D89346D6B590F5D34E5D69E9"><enum>(A)</enum><text>in law enforcement administration, operation, and management; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87A49067A30F46279C7ADCEAD3AF2F15"><enum>(B)</enum><text>to assess the nature and type of crime in the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0013EE645354A9A8D103997E6C74753"><enum>(5)</enum><header>Unit of local government</header><text>The term <term>unit of local government</term> has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph></section><section id="id78993F4D99DA4E1DBB95B3DF6EAA5E5D"><enum>4.</enum><header>Reporting of hate crimes</header><subsection id="id7D9D61945D2F4F5BAAFAFF5CFAD7CA5D"><enum>(a)</enum><header>Implementation grants</header><paragraph id="idA704268C15A54E5492FEE46330057D24"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may make grants to States and units of local government to assist the State or unit of local government in implementing the National Incident-Based Reporting System, including to train employees in identifying and classifying hate crimes in the National Incident-Based Reporting System.</text></paragraph><paragraph id="id23F8D90DFCC24AE3818C6B6997BB4093"><enum>(2)</enum><header>Priority</header><text>In making grants under paragraph (1), the Attorney General shall give priority to States and units of local government with larger populations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="P16BDB784492F2E13E587DA88D0CE5E9"><enum>(b)</enum><header display-inline="yes-display-inline">Reporting</header><paragraph commented="no" display-inline="no-display-inline" id="P999DE92742AB49F9F36AB49C64C42B6"><enum>(1)</enum><header>Compliance</header><subparagraph commented="no" display-inline="no-display-inline" id="id77B716E705BD4E9091F07F91777447E7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), in each fiscal year beginning after the date that is 3 years after the date on which a State or unit of local government first receives a grant under subsection (a), the State or unit of local government shall provide to the Attorney General, through the Uniform Crime Reporting system, information pertaining to hate crimes committed in that jurisdiction during the preceding fiscal year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id373D0F2A065141278307416F6FF401DA"><enum>(B)</enum><header>Extensions; waiver</header><text>The Attorney General—</text><clause id="P131CE88E47214AB555B26CB6B4B6945"><enum>(i)</enum><text>may provide a 120-day extension to a State or unit of local government that is making good faith efforts to comply with subparagraph (A); and</text></clause><clause commented="no" id="P6BDF21634BFA77CB11850798CE14CCB"><enum>(ii)</enum><text>shall waive the requirements of subparagraph (A) if compliance with that subparagraph by a State or unit of local government would be unconstitutional under the constitution of the State or of the State in which the unit of local government is located, respectively.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="P589BE69D49D2987E5A449FA5B248695"><enum>(2)</enum><header>Failure to comply</header><text>If a State or unit of local government that receives a grant under subsection (a) fails to substantially comply with paragraph (1) of this subsection, the State or unit of local government shall repay the grant in full, plus reasonable interest and penalty charges allowable by law or established by the Attorney General.</text></paragraph></subsection></section><section id="idaf7c65f49eb94db798c263b73689558a"><enum>5.</enum><header>Grants for State-run hate crime hotlines</header><subsection id="idC59BC181711046B2BD52696CB1F678BA"><enum>(a)</enum><header>Grants authorized</header><paragraph id="id171EB08C497E43BB88583DEE8059CC16"><enum>(1)</enum><header>In general</header><text>The Attorney General shall make grants to States to create State-run hate crime reporting hotlines.</text></paragraph><paragraph id="id7EDAE43C2E40428C9DC56BE07BD9B955"><enum>(2)</enum><header>Grant period</header><text>A grant made under paragraph (1) shall be for a period of not more than 5 years.</text></paragraph></subsection><subsection id="id9CC3679544214B6997B76791D36FB5AC"><enum>(b)</enum><header>Hotline requirements</header><text>A State shall ensure, with respect to a hotline funded by a grant under subsection (a), that—</text><paragraph id="id18ECB20978D94930831EA9504CA15ED4"><enum>(1)</enum><text>the hotline directs individuals to—</text><subparagraph id="ide34e39b77c554d7ab043f350350a729f"><enum>(A)</enum><text>law enforcement if appropriate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida04610b4ea594795b22af57009e8e18a"><enum>(B)</enum><text>local support services;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0264066922C7427B8BE1DBA79ED17879"><enum>(2)</enum><text>any personally identifiable information that an individual provides to an agency of the State through the hotline is not directly or indirectly disclosed, without the consent of the individual, to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD91E2FAF7F7F468DB61A692387EE024C"><enum>(A)</enum><text>any other agency of that State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8F15DF441CD746BE8EED5A10CD70BDE0"><enum>(B)</enum><text>any other State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07831A3090E045CA82ED660009FA11F8"><enum>(C)</enum><text>the Federal Government; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39C5B7F2FDF6465B94BDCFE28EB76E48"><enum>(D)</enum><text>any other person or entity;</text></subparagraph></paragraph><paragraph id="ide06abf62e0ad40b0a4bf2133895bbce4"><enum>(3)</enum><text>the staff members who operate the hotline are trained to be knowledgeable about—</text><subparagraph id="idBFE6145272D8456CBA34D9382C74E4C4"><enum>(A)</enum><text>applicable Federal, State, and local hate crime laws; and</text></subparagraph><subparagraph id="id65263240ECBE4D0881A5B7C81190C6CE"><enum>(B)</enum><text>local law enforcement resources and applicable local support services; and</text></subparagraph></paragraph><paragraph id="id5eddaf7ead43499f975e3c7fa96b2cc7"><enum>(4)</enum><text>the hotline is accessible to—</text><subparagraph id="id565BE2C598D54CFAB71178620B443736"><enum>(A)</enum><text>individuals with limited English proficiency, where appropriate; and</text></subparagraph><subparagraph id="idD5FAB4CD91364AEC991DF28A4780AF13"><enum>(B)</enum><text>individuals with disabilities.</text></subparagraph></paragraph></subsection><subsection id="idFC08E5509F2B4DF393B6B7258554E549"><enum>(c)</enum><header>Best practices</header><text>The Attorney General shall issue guidance to States on best practices for implementing the requirements of subsection (b).</text></subsection></section><section id="id38f383b508e4499ba9be7efae4f3d7a0"><enum>6.</enum><header>Information collection by States and units of local government</header><subsection id="id0303A621FCC54288B696D2799832F5EF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idAA41D10EC72A4074AF697FE3D8223861"><enum>(1)</enum><header>Applicable agency</header><text>The term <term>applicable agency</term>, with respect to an eligible entity that is—</text><subparagraph id="idDCB061D5E3F4466688B5D71182185B73"><enum>(A)</enum><text>a State, means—</text><clause id="id271125ED5A1943FD8198B0FB684A2BA2"><enum>(i)</enum><text>a law enforcement agency of the State; and</text></clause><clause id="idA196A287C6F649BDAD7B6E9D1D87E8A0"><enum>(ii)</enum><text>a law enforcement agency of a unit of local government within the State that—</text><subclause id="id00031F09322B49BBAC4DD0A5068CC203"><enum>(I)</enum><text>is a priority agency; and</text></subclause><subclause id="id78B1150387E947FB951C971E89144A60"><enum>(II)</enum><text>receives a subgrant from the State under this section; and</text></subclause></clause></subparagraph><subparagraph id="id4CFF4FC442944E5792F09E2A826AA44D"><enum>(B)</enum><text>a unit of local government, means a law enforcement agency of the unit of local government that is a priority agency.</text></subparagraph></paragraph><paragraph id="id28E05F01E8AF42E392F827D6FEBC2685"><enum>(2)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means—</text><subparagraph id="idA2B985150AB84E90968EB631F03CF6B6"><enum>(A)</enum><text>a State law enforcement agency; and</text></subparagraph><subparagraph id="idC58DAB271CC744A8B2D61BDF7C95C3EF"><enum>(B)</enum><text>a priority agency.</text></subparagraph></paragraph><paragraph id="id0CCEFF4AE6C64F3CAAF7E21BD2E96E80"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idEB909AF16D4A48A2A5FEA5C2CEF28714"><enum>(A)</enum><text>a State; or</text></subparagraph><subparagraph id="idB1E66E623237472BBEDEF07F91A7F6CD"><enum>(B)</enum><text>a unit of local government that has a priority agency.</text></subparagraph></paragraph></subsection><subsection id="id387DA2FB88354F65AA802BCAF3992592"><enum>(b)</enum><header>Grants</header><paragraph id="id7AF34E48C8924BD7B4D96883B30C582E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may make grants to eligible entities to assist covered agencies within the jurisdiction of the eligible entity in conducting law enforcement activities or crime reduction programs to prevent, address, or otherwise respond to hate crime, particularly as those activities or programs relate to reporting hate crimes through the Uniform Crime Reports program, including—</text><subparagraph id="id95e01ae2296c457d82b83d3343114522"><enum>(A)</enum><text>adopting a policy on identifying, investigating, and reporting hate crimes;</text></subparagraph><subparagraph id="iddd857255bb8e41bab770126aeb8f669d"><enum>(B)</enum><text>developing a standardized system of collecting, analyzing, and reporting the incidence of hate crime;</text></subparagraph><subparagraph id="id66368c8df8c74b3dbddefdfaa39e2c9d"><enum>(C)</enum><text>establishing a unit specialized in identifying, investigating, and reporting hate crimes;</text></subparagraph><subparagraph id="ide2b8b8212cc04d629fdf40dbcabe813d"><enum>(D)</enum><text>engaging in community relations functions related to hate crime prevention and education such as—</text><clause id="id31efe1d2a2e941558662ab9ea2c9923c"><enum>(i)</enum><text>establishing a liaison with formal community-based organizations or leaders; and</text></clause><clause id="id0bb6258c909846558ea8291840824999"><enum>(ii)</enum><text>conducting public meetings or educational forums on the impact of hate crimes, services available to hate crime victims, and the relevant Federal, State, and local laws pertaining to hate crimes; and</text></clause></subparagraph><subparagraph id="id62e8d729b4674a558955e5b0f8fecc67"><enum>(E)</enum><text>providing hate crime trainings for agency personnel.</text></subparagraph></paragraph><paragraph id="id994CA81AD37A461F8FEF5846D6674C50"><enum>(2)</enum><header>Subgrants</header><text>A State that receives a grant under paragraph (1) may award a subgrant to a priority agency of a unit of local government within the State for the purposes under that paragraph.</text></paragraph></subsection><subsection id="id765746586a5a41a7825883795c32cc16"><enum>(c)</enum><header>Information required of States and units of local government</header><paragraph id="idd838388eef554b3e8bf9052001e46223"><enum>(1)</enum><header>In general</header><text>For each fiscal year in which an eligible entity receives a grant under subsection (b), the eligible entity shall—</text><subparagraph id="id49A19A81EFC84BFBA954338CE3E8BD4A"><enum>(A)</enum><text>collect information from each applicable agency summarizing the law enforcement activities or crime reduction programs conducted by the agency to prevent, address, or otherwise respond to hate crime, particularly as those activities or programs relate to reporting hate crimes through the Uniform Crime Reports program; and</text></subparagraph><subparagraph id="idADF7F7EDBDD644C192874ABE9058FB0B"><enum>(B)</enum><text>submit to the Attorney General a report containing the information collected under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idb8029be237744436b9353b4aa61eab4e"><enum>(2)</enum><header>Semiannual law enforcement agency report</header><subparagraph id="id35F58125DD794EAD85E01516B1843589"><enum>(A)</enum><header>In general</header><text>In collecting the information required under paragraph (1)(A), an eligible entity shall require each applicable agency to submit a semiannual report to the eligible entity that includes a summary of the law enforcement activities or crime reduction programs conducted by the agency during the reporting period to prevent, address, or otherwise respond to hate crime, particularly as those activities or programs relate to reporting hate crimes through the Uniform Crime Reports program.</text></subparagraph><subparagraph id="id9A5A3C872A5C4491A247583C037F9AB2"><enum>(B)</enum><header>Contents</header><text>In a report submitted under subparagraph (A), a law enforcement agency shall, at a minimum, disclose—</text><clause id="id72c4c2b525e24995afe0ecb32622cb89"><enum>(i)</enum><text>whether the agency has adopted a policy on identifying, investigating, and reporting hate crimes;</text></clause><clause id="id621c8d5f20e8496993a132fbdfde2844"><enum>(ii)</enum><text>whether the agency has developed a standardized system of collecting, analyzing, and reporting the incidence of hate crime;</text></clause><clause id="id773fc3be93684c7fb1e571570d8b5fe6"><enum>(iii)</enum><text>whether the agency has established a unit specialized in identifying, investigating, and reporting hate crimes;</text></clause><clause id="id1ae1a414cb6b4a629a594be80a35660a"><enum>(iv)</enum><text>whether the agency engages in community relations functions related to hate crime, such as—</text><subclause id="id8DC5C96F46C14B0E91D9008E3DB4FA4C"><enum>(I)</enum><text>establishing a liaison with formal community-based organizations or leaders; and</text></subclause><subclause id="id16EE73D9DFCD42AF95A152FBB11C1B6B"><enum>(II)</enum><text>conducting public meetings or educational forums on the impact of hate crime, services available to hate crime victims, and the relevant Federal, State, and local laws pertaining to hate crime; and</text></subclause></clause><clause id="id3ed27e8788a340a7ba06006586323429"><enum>(v)</enum><text>the number of hate crime trainings for agency personnel, including the duration of the trainings, conducted by the agency during the reporting period.</text></clause></subparagraph></paragraph></subsection><subsection id="idc029fea7c8a1476794a69a711c4e3059"><enum>(d)</enum><header>Compliance and redirection of funds</header><paragraph id="id5af4396617e04fe4a1fabced88815ae2"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), beginning not later than 1 year after the date of this Act, an eligible entity receiving a grant under subsection (b) shall comply with subsection (c).</text></paragraph><paragraph id="id7d63891f472340a4bf900a54c6568ab1"><enum>(2)</enum><header>Extensions; waiver</header><text>The Attorney General—</text><subparagraph id="idfd6248700d2b4dd5b96a16bfc3846c2f"><enum>(A)</enum><text>may provide a 120-day extension to an eligible entity that is making good faith efforts to collect the information required under subsection (c); and</text></subparagraph><subparagraph id="id64e5838aae1c41ae993839caa6cd5108"><enum>(B)</enum><text>shall waive the requirements of subsection (c) for a State or unit of local government if compliance with that subsection by the State or unit of local government would be unconstitutional under the constitution of the State or of the State in which the unit of local government is located, respectively.</text></subparagraph></paragraph></subsection></section><section id="id0bef2157c94c487a8c11af1670e91437"><enum>7.</enum><header>Requirements of the Attorney General</header><subsection id="idDEE375253E9841EEB3F02566B80E91B2"><enum>(a)</enum><header>Information collection and analysis; report</header><text display-inline="yes-display-inline">In order to improve the accuracy of data regarding the incidence of hate crime provided through the Uniform Crime Reports program, and promote a more complete understanding of the national problem posed by hate crime, the Attorney General shall—</text><paragraph id="id766d2b4c03764c1d826b9f884f39f879"><enum>(1)</enum><text>collect and analyze the information provided by States and units of local government under section 6 for the purpose of developing policies related to the provision of accurate data obtained under the Hate Crime Statistics Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/275">Public Law 101–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/534">28 U.S.C. 534</external-xref> note) by the Federal Bureau of Investigation; and</text></paragraph><paragraph id="idfb6e575ea72b41cb815c00a42b96e1ff"><enum>(2)</enum><text>for each calendar year beginning after the date of enactment of this Act, publish and submit to Congress a report based on the information collected and analyzed under paragraph (1).</text></paragraph></subsection><subsection id="id573F8B90B0DE449FBC09066655F6498B"><enum>(b)</enum><header>Contents of report</header><text>A report submitted under subsection (a) shall include—</text><paragraph id="id9c1a4c7be99e48649503bacdb2cc1c6b"><enum>(1)</enum><text>a qualitative analysis of the relationship between—</text><subparagraph id="id96D824AB30BE4D7F9F7E7C71BA57B75A"><enum>(A)</enum><text>the number of hate crimes reported by State law enforcement agencies or priority agencies through the Uniform Crime Reports program; and</text></subparagraph><subparagraph id="idA770715869BF4C549EA5E22791ADAE93"><enum>(B)</enum><text>the nature and extent of law enforcement activities or crime reduction programs conducted by those agencies to prevent, address, or otherwise respond to hate crime; and</text></subparagraph></paragraph><paragraph id="idf83aab2bfce74f81a3d0f38c0ef880b9"><enum>(2)</enum><text>a quantitative analysis of the number of State law enforcement agencies and priority agencies that have—</text><subparagraph id="id02ca7f3a78bf43da9075aa11e2f52933"><enum>(A)</enum><text>adopted a policy on identifying, investigating, and reporting hate crimes;</text></subparagraph><subparagraph id="id94bec58e54b849b6a5ea2dd062146c4a"><enum>(B)</enum><text>developed a standardized system of collecting, analyzing, and reporting the incidence of hate crime;</text></subparagraph><subparagraph id="id6579e6bc8d9f4dee97389619b99b7482"><enum>(C)</enum><text>established a unit specialized in identifying, investigating, and reporting hate crimes;</text></subparagraph><subparagraph id="idd6331204a1be46918b220256f0831cac"><enum>(D)</enum><text>engaged in community relations functions related to hate crime, such as—</text><clause id="id58F87B3A66B44D5D958E7545EA3D7C63"><enum>(i)</enum><text>establishing a liaison with formal community-based organizations or leaders; and</text></clause><clause id="id13B9E1D47961462E994D0C830B394843"><enum>(ii)</enum><text>conducting public meetings or educational forums on the impact of hate crime, services available to hate crime victims, and the relevant Federal, State, and local laws pertaining to hate crime; and</text></clause></subparagraph><subparagraph id="id1b2e3e00dd1f4cb6a65c78195e42cf2b"><enum>(E)</enum><text>conducted hate crime trainings for agency personnel during the reporting period, including—</text><clause id="id90F68C5DC11F47F7BB78D38D101754E1"><enum>(i)</enum><text>the total number of trainings conducted by each agency; and</text></clause><clause id="id79913D23BC6143A3B947316888A815A6"><enum>(ii)</enum><text>the duration of the trainings described in clause (i).</text></clause></subparagraph></paragraph></subsection></section><section id="idabb0aa7c36aa46cea1813a0e5fe0baaa"><enum>8.</enum><header>Alternative sentencing</header><text display-inline="no-display-inline">Section 249 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9145B07AE8A144009BD7034F699C2000"><subsection id="id588461285D074962AFDFFFB7B2C85542"><enum>(e)</enum><header>Supervised release</header><text>If a court includes, as a part of a sentence of imprisonment imposed for a violation of subsection (a), a requirement that the defendant be placed on a term of supervised release after imprisonment under section 3583, the court may order, as an explicit condition of supervised release, that the defendant undertake educational classes or community service directly related to the community harmed by the defendant's offense.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
