<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1078</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210413">April 13, 2021</action-date><action-desc><sponsor name-id="S362">Mr. Kaine</sponsor> (for himself and <cosponsor name-id="S349">Mr. Portman</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Labor to award grants for promoting industry or sector partnerships to encourage industry growth and competitiveness and to improve worker training, retention, and advancement as part of an infrastructure investment.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Building U.S. Infrastructure by Leveraging Demands for Skills </short-title></quote> or the <quote><short-title>BUILDS Act</short-title></quote>.</text></section><section id="idc0769a17e3f7488cb564c2f53b3c05e8"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to promote industry or sector partnerships that engage in collaborative planning, resource alignment, and training efforts across multiple businesses, for a range of workers employed or potentially employed by infrastructure industries, in order to encourage industry growth and competitiveness and to improve worker training, retention, and advancement.</text></section><section id="id89485a5d599843449165ce0e7307e356"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idff049ae0600d45778f4e752b2b6c628a"><enum>(1)</enum><header>Career and technical education; career guidance and academic counseling</header><text>The terms <term>career and technical education</term> and <term>career guidance and academic counseling</term> have the meanings given such terms in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph><paragraph id="id6f132668516b4af2a17ffdb80ef0837f"><enum>(2)</enum><header>Career pathway; economic development agency</header><text>The terms <term>career pathway</term> and <term>economic development agency</term> have the meanings given such terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph id="id4bad9b37b1f9441da73020e673a926b7"><enum>(3)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means a partnership that is an industry or sector partnership, or, with respect to an implementation grant, a partnership that is in the process of establishing an industry or sector partnership.</text></paragraph><paragraph id="idB6BF4861871B47F9A8D8CF62C3E9DE13"><enum>(4)</enum><header>Implementation grant</header><text>The term <term>implementation grant</term>, with respect to a grant under this Act, means a grant described in section 4(b)(1)(A).</text></paragraph><paragraph id="id1b31f8f517e041afb56bb56e0708f1ca"><enum>(5)</enum><header><italic></italic>Individual with a barrier to employment; industry or sector partnership; local board; recognized postsecondary credential</header><text>The terms <term>individual with a barrier to employment</term>, <term>industry or sector partnership</term>, <term>local board</term>, and <term>recognized postsecondary credential</term> have the meanings given such terms in section 3 of the Workforce Innovation and Opportunity Act.</text></paragraph><paragraph id="idb5c88b5e1381429799e4f6b7ccbfbb63"><enum>(6)</enum><header>Registered apprenticeship program</header><text>The term <term>registered apprenticeship program</term> has the meaning given such term in section 171 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3226">29 U.S.C. 3226</external-xref>).</text></paragraph><paragraph id="id1EAF86A4916243FAB8004CD068986B6A"><enum>(7)</enum><header>Renewal grant</header><text>The term “renewal grant”, with respect to a grant under this Act, means a grant described in section 4(b)(1)(B).</text></paragraph><paragraph id="idE19027B2CD2A469C8A44FB58660FA379"><enum>(8)</enum><header>Secondary school</header><text>The term <term>secondary school</term> has the meaning given such term in section 3 of the Workforce Innovation and Opportunity Act.</text></paragraph><paragraph id="id512cfbdab07544459835a950aae9acee"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="ida1ec2a0fe60c4d4894a54c08273c2cd8"><enum>(10)</enum><header>State; state board</header><text>The terms <term>State</term> and <term>State board</term> have the meanings given such terms in section 3 of such Act.</text></paragraph><paragraph id="idd7e23f0e90f74ffb8afc9b60b90ed5ae"><enum>(11)</enum><header>Targeted infrastructure industry</header><text>The term <term>targeted infrastructure industry</term> means an industry, including transportation (including surface, transit, maritime, aviation, or railway transportation), construction, energy, information technology, or utilities industries, that the eligible partnership identifies in accordance with section 5(c) to be served by a grant under this Act.</text></paragraph><paragraph id="id0f1c7c545b2e40e9a1864db6fdc6577a"><enum>(12)</enum><header>Work-based learning program</header><subparagraph id="id3ceeb90bf6a7489eb2d4f208013965cf"><enum>(A)</enum><header>In general</header><text>The term <term>work-based learning program</term> means a program (which may be a registered apprenticeship program) that provides workers with paid work experience and corresponding approved classroom instruction, delivered in an employment relationship that both the employer and worker intend to lead to continuing employment after the program ends.</text></subparagraph><subparagraph id="id08694223d1664374af180f4d4dcf31ec"><enum>(B)</enum><header>Paid work experience</header><text>In subparagraph (A), the term <term>paid work experience</term> includes training by an employer that is provided to a paid employee while engaged in productive work in a job that provides knowledge or skills essential to the full and adequate performance of the job.</text></subparagraph></paragraph></section><section id="id7a3530a2370e41228efc523bc15ff784"><enum>4.</enum><header>Grants authorized</header><subsection id="id0ac4f614a4284d8cbb52287ab34f4fce"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of Transportation, the Secretary of Energy, the Secretary of Commerce, the Secretary of Education, the Administrator of the Environmental Protection Agency, and the Chief of Engineers and Commanding General of the Army Corps of Engineers, shall award, on a competitive basis, grants to eligible partnerships to plan and implement activities described in section 6 to achieve the strategic objectives described in section 5(d) with respect to a targeted infrastructure industry.</text></subsection><subsection id="id1e11761ca0f3489997424b7089bc1d6f"><enum>(b)</enum><header>Grants</header><paragraph id="idBFE6EB58E6F04BEBB76A5AA57BAB8428"><enum>(1)</enum><header>Types of grants</header><text>A grant awarded under this Act may be in the form of—</text><subparagraph id="idC40E7AB6008C496BB170442C416C636C"><enum>(A)</enum><text>an implementation grant, for eligible partnerships seeking an initial grant under this Act; or</text></subparagraph><subparagraph id="id205FE1A2535F490FB1B59619006302A4"><enum>(B)</enum><text>a renewal grant for eligible partnerships that have already received an implementation grant under this Act.</text></subparagraph></paragraph><paragraph id="idF36A9DBB3C76444DA6FEDC60D035124F"><enum>(2)</enum><header>Duration</header><text>Each grant awarded under this Act shall be for a period not to exceed 3 years.</text></paragraph><paragraph id="id67BA4CB41C6746069CB683545BC4A835"><enum>(3)</enum><header>Amount</header><text>The amount of a grant awarded under this Act may not exceed—</text><subparagraph id="id3FEE3AF797DB43D4A1CCCEB51114703B"><enum>(A)</enum><text>for an implementation grant, $2,500,000; and</text></subparagraph><subparagraph id="id473A4BDEE63B446894EFC64338D51104"><enum>(B)</enum><text>for a renewal grant, $1,500,000.</text></subparagraph></paragraph></subsection><subsection id="id1A601FC9ECAE40C0A89B23FD1EA0E421"><enum>(c)</enum><header>Award basis</header><paragraph id="idAB562982DF7649A2A8C3E0F404723B86"><enum>(1)</enum><header>Geographic diversity</header><text>The Secretary shall award grants under this Act in a manner that ensures geographic diversity in the areas in which activities will be carried out under the grants.</text></paragraph><paragraph id="idB05E96105B6F4BC8859D1406DF26E860"><enum>(2)</enum><header>Priority for renewal grants</header><text>In awarding renewal grants under this Act, the Secretary shall give priority to eligible partnerships that—</text><subparagraph id="idae13a04c52604e61b689c8abe6c9c8c5"><enum>(A)</enum><text>demonstrate long-term sustainability of an industry or sector partnership;</text></subparagraph><subparagraph id="id6402e50b6f6543fcbf74278b48a1a64f"><enum>(B)</enum><text>demonstrate success in improving access to and retention in work-based learning programs for individuals with barriers to employment and those underrepresented in the infrastructure industry; and</text></subparagraph><subparagraph id="id1644f81fd20b4e728fdf4df690775860"><enum>(C)</enum><text>agree to provide a non-Federal share of the cost of the activities that will be carried out under the grant.</text></subparagraph></paragraph></subsection></section><section id="id5471d231111e4648ae13f324109c98c2"><enum>5.</enum><header>Application process</header><subsection id="id4C04580E93444A73B8B79C78A1AA6E92"><enum>(a)</enum><header>In general</header><text>An eligible partnership desiring a grant under this Act shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including the contents described in subsection (b).</text></subsection><subsection id="id14E6D15B402B4CB28F3EA9519CC1EA39"><enum>(b)</enum><header>Contents</header><text>An application submitted under this Act shall contain, at a minimum—</text><paragraph id="id1b90a4d6d47d435f98db03b0b89f6911"><enum>(1)</enum><text>a description of the eligible partnership, evidence of the eligible partnership's capacity to carry out activities to achieve the strategic objectives described in subsection (d), and the expected participation and responsibilities of each of the partners included in the eligible partnership;</text></paragraph><paragraph id="id5ed2d32f2b044b829e5c20d8998beeb9"><enum>(2)</enum><text>a description of the targeted infrastructure industry served by the grant and a description of how such industry was identified in accordance with subsection (c);</text></paragraph><paragraph id="idf9fde1a7cbb143a68d043be62cf90840"><enum>(3)</enum><text>a description of the workers that will be targeted or recruited by the eligible partnership, including an analysis of the existing labor market, a description of potential barriers to employment for targeted workers, and a description of strategies that will be employed to help workers overcome such barriers;</text></paragraph><paragraph id="id438478433106465c939f6fca83b0093c"><enum>(4)</enum><text>a description of the federally, State, or locally funded infrastructure projects on which the eligible partnership anticipates engaging partners;</text></paragraph><paragraph id="idd3f4b31a5f964fe896f7bed5817e7430"><enum>(5)</enum><text>a description of the strategic objectives described in subsection (d) that the eligible partnership intends to achieve concerning the targeted infrastructure industry;</text></paragraph><paragraph id="idaae18241d90a4006a3c04d52fbd04b46"><enum>(6)</enum><text>a description of the credentials that the eligible partnership proposes to use or develop as a performance measure to assess the degree to which the eligible partnership has achieved such strategic objectives, which such credentials—</text><subparagraph id="id7BDB29F94117425297D25CCD4D3C168D"><enum>(A)</enum><text>shall be nationally portable;</text></subparagraph><subparagraph id="idC423DB4A80BB416D96FA080D2EE155E3"><enum>(B)</enum><text>shall be recognized postsecondary credentials or, if not available for the industry, other credentials determined by the Secretary to be appropriate;</text></subparagraph><subparagraph id="id62794E80E80D4779AC5118A9384513CB"><enum>(C)</enum><text>shall be related to the targeted infrastructure industry that the eligible partnership proposes to support; and</text></subparagraph><subparagraph id="id3fc731eec7ea42f9bc2171642d09a72f"><enum>(D)</enum><text>may be credentials for a registered apprenticeship program;</text></subparagraph></paragraph><paragraph id="id614ef1c35395439fb3bb310cc21450db"><enum>(7)</enum><text>a description of the manner in which the eligible partnership intends to make sustainable progress towards achieving such strategic objectives;</text></paragraph><paragraph id="id6b16f5f8e0f544c3b8abc55111bfad86"><enum>(8)</enum><text>performance measures for measuring progress towards achieving such strategic objectives;</text></paragraph><paragraph id="id1defb8e0d31c46a6bd72282b136b4a4e"><enum>(9)</enum><text>a description of the Federal and non-Federal resources, available under provisions of law other than this Act, that will be leveraged in support of the partnerships and activities under this Act; and</text></paragraph><paragraph id="id8fb94abbf4eb423989ab60873f7ce20a"><enum>(10)</enum><text>a timeline for progress towards achieving such strategic objectives.</text></paragraph></subsection><subsection id="idF1C987B8B162407FBFD1E5E8A6EC0E2F"><enum>(c)</enum><header>Targeted infrastructure industry</header><text>Each grant under this Act shall serve a targeted infrastructure industry that is identified by the eligible partnership through working with businesses, industry associations and organizations, labor organizations, State boards, local boards, economic development agencies, and other organizations that the eligible partnership determines necessary.</text></subsection><subsection id="idBF23FB90AA2040D59754955075CA9CCB"><enum>(d)</enum><header>Strategic objectives</header><text>The activities to be carried out under each grant awarded under this Act shall be designed to achieve strategic objectives that include the following:</text><paragraph id="id4ce8cb42365c413fb928669fa8908b8d"><enum>(1)</enum><text>Recruiting key stakeholders in the targeted infrastructure industry, such as multiple businesses, labor organizations, local boards, and education and training providers (including providers of career and technical education) and regularly convening the stakeholders in a collaborative structure that supports the sharing of information, ideas, and challenges common to the targeted infrastructure industry.</text></paragraph><paragraph id="id4d828f2cf48346b29ba09742b9fb215b"><enum>(2)</enum><text>Supporting the training needs of multiple businesses in the targeted infrastructure industry, including needs—</text><subparagraph id="idA62EE8BC7C3648278CD224A5B576C7D7"><enum>(A)</enum><text>for skills critical to competitiveness and innovation in the industry;</text></subparagraph><subparagraph id="id4B63A548BED24352A60BCE112FF8BF01"><enum>(B)</enum><text>of the registered apprenticeship programs or other work-based learning programs supported by the grant; and</text></subparagraph><subparagraph id="idFD415223D7AD4A5993B7FD8DF26B9E65"><enum>(C)</enum><text>related to integrating career pathways.</text></subparagraph></paragraph><paragraph id="idc6df864410ab44c093f7fe375755d179"><enum>(3)</enum><text>Facilitating actions that lead to economies of scale by aggregating training and education needs of multiple businesses.</text></paragraph><paragraph id="ideb6146c736544e91a6b81c183d5935fb"><enum>(4)</enum><text>Helping postsecondary educational institutions, training institutions, sponsors of registered apprenticeship programs, and all other providers of career and technical education and training programs receiving assistance under this Act, align curricula, entrance requirements, and programs to the targeted infrastructure industry needs and the credentials described in subsection (b)(6), particularly for higher skill, high-priority occupations related to the targeted infrastructure industry.</text></paragraph><paragraph id="id7e33148daf7e46e1b89c8dc4e97b8e4d"><enum>(5)</enum><text>Providing information on the grant activities to the State agency carrying out the State program under the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/49">29 U.S.C. 49</external-xref> et seq.), including staff of the agency that provide services under such Act, to enable the agency to inform recipients of unemployment compensation of the employment and training opportunities that may be offered through the grant activities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40F7BE33003941788D259AF27525F991"><enum>(6)</enum><text>Helping partner businesses in industry or sector partnerships to attract and retain workers from a diverse jobseeker base, including individuals with barriers to employment and those underrepresented in the industry or sector, by identifying any such barriers through analysis of the labor market and implementing strategies to help such workers overcome such barriers.</text></paragraph><paragraph id="idb2700854b67046a3948a24585d447ada"><enum>(7)</enum><text>Expanding the number of individuals with a barrier to employment who have access to training and education opportunities that are aligned with business needs and providing those individuals with supports necessary to address the barrier to their employment.</text></paragraph></subsection></section><section id="id415ea807612946e493a2e7da674b915f"><enum>6.</enum><header>Activities</header><subsection id="id321ffe7ff42e4126b4c9b6cfc71b2be6"><enum>(a)</enum><header>In general</header><text>An eligible partnership receiving a grant under this Act shall—</text><paragraph id="idA9C0BC7807C94DE1B71846D0F2807CA8"><enum>(1)</enum><text>designate an entity in the eligible partnership as the fiscal agent for the grant funds; and</text></paragraph><paragraph id="idEEF46B34FCF043869F1E9A27F3F001DB"><enum>(2)</enum><text>carry out activities described in subsections (b) (as applicable), (c), and (d) to achieve the strategic objectives identified in the eligible partnership's application under section 5(b)(5), in a manner that integrates services and funding sources to ensure effectiveness of the activities and that uses the grant funds efficiently.</text></paragraph></subsection><subsection id="ide901a7b6dad04f4989802899f8023169"><enum>(b)</enum><header>Planning activities</header><text>An eligible partnership receiving an implementation grant under this Act shall use not more than $250,000 of the grant funds to carry out planning activities during the first year of the grant period. Such activities may include—</text><paragraph id="id48EA3AAB7D6B4FF98C646873471DECE4"><enum>(1)</enum><text>establishing the industry or sector partnership;</text></paragraph><paragraph id="idACF68C1525004668A556739121C8B5A4"><enum>(2)</enum><text>convening key stakeholders as identified in the application process;</text></paragraph><paragraph id="idA19A85CEBB3F4DA1A25CF209C9679612"><enum>(3)</enum><text>conducting outreach to local businesses and business associations;</text></paragraph><paragraph id="idA32E4734F2704D1897247407B9FCC01B"><enum>(4)</enum><text>conducting an evaluation of workforce needs in the local area; or</text></paragraph><paragraph id="id6ad4b3ae1adc48c8b3bbfcaa9acd7ce1"><enum>(5)</enum><text>recruiting individuals with barriers to employment.</text></paragraph></subsection><subsection id="id79bb05d656984a55be5e49618e09fe92"><enum>(c)</enum><header>Business engagement</header><text>An eligible partnership receiving a grant under this Act shall use the grant funds to provide services to engage businesses in efforts to achieve the strategic objectives identified in the eligible partnership's application under section 5(b)(5). Such services may include assisting businesses—</text><paragraph id="idd4f3aa43907d49c590132c771ba1dc27"><enum>(1)</enum><text>in navigating the registration process for a sponsor of a registered apprenticeship program;</text></paragraph><paragraph id="idca4ad54f43af4e74abcb6e816509586b"><enum>(2)</enum><text>by connecting the business with an education provider, including a provider of career and technical education, to develop classroom instruction to complement on-the-job learning;</text></paragraph><paragraph id="id9d8f4cd794c44e01885bd23423f1d453"><enum>(3)</enum><text>in developing the curriculum design of a work-based learning program;</text></paragraph><paragraph id="id17f07d94605f413d86bba04246cca267"><enum>(4)</enum><text>in employing workers participating in a work-based learning program for a transitional period before a business hires the worker for full-time employment of not less than 30 hours a week;</text></paragraph><paragraph id="ideb83ef55c3724cc7932ea5001e1eea5d"><enum>(5)</enum><text>in providing training to managers and front-line workers to serve as trainers or mentors to workers participating in a work-based learning program;</text></paragraph><paragraph id="id5c62744d1d1d4fc08f6c677f3d053e22"><enum>(6)</enum><text>in providing career awareness activities, such as career guidance and academic counseling; and</text></paragraph><paragraph id="idb5c23cbd47044de393a7e2f644e71176"><enum>(7)</enum><text>in recruiting, for participation in a work-based learning program, individuals eligible to receive additional workforce or human services, including—</text><subparagraph id="id66ec8c02751641ffa4d703c647349c95"><enum>(A)</enum><text>individuals participating in programs under the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101</external-xref> et seq.), and the amendments made by such Act, including to the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701</external-xref> et seq.);</text></subparagraph><subparagraph id="id8199df07bb354d749f0f34f57e701d4d"><enum>(B)</enum><text>recipients of assistance through the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.);</text></subparagraph><subparagraph id="id574b718858334dac8e061de2737af69c"><enum>(C)</enum><text>recipients of assistance through the program of block grants to States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.); or</text></subparagraph><subparagraph id="id737D8DA9808D42E0ABE7FEF2B4EEE11A"><enum>(D)</enum><text>any other individuals with a barrier to employment.</text></subparagraph></paragraph></subsection><subsection id="id38ce3948c78843418c880549ba65cc75"><enum>(d)</enum><header>Support services</header><text>An eligible partnership receiving a grant under this Act shall use the grant funds to provide services to support the success and retention of individuals described in subsection (c)(7) who are participating in a work-based learning program for a period of not less than 12 months. Such services may include the following:</text><paragraph id="id229d1945961f4994bd4ed9c8398d1384"><enum>(1)</enum><header>Pre-employment services</header><text>Services, provided in a pre-employment stage of the program, to expand access to a work-based learning program for individuals described in subsection (c)(7). Such services may include—</text><subparagraph id="idf3dcb67d6e634999ba7c5c24941de7e3"><enum>(A)</enum><text>skills training;</text></subparagraph><subparagraph id="idCBE73CC0FE1D432F875EB36633D84783"><enum>(B)</enum><text>career and technical education or adult basic education;</text></subparagraph><subparagraph id="idB8496C356436448EBC7741E006A56EAA"><enum>(C)</enum><text>initial skills assessments;</text></subparagraph><subparagraph id="id75d842e768b34dec8d2e87b8e1d7a171"><enum>(D)</enum><text>providing work attire, necessary tools for a work site, and other required items necessary to start employment;</text></subparagraph><subparagraph id="idc0fc191d308f42a48581a4db84df401f"><enum>(E)</enum><text>wrap-around services, such as child care and transportation; and</text></subparagraph><subparagraph id="id02eef41865c24efdb682fa50973b677b"><enum>(F)</enum><text>job placement assistance.</text></subparagraph></paragraph><paragraph id="id8a84cb34371e4bf5aa835a0af85ad86d"><enum>(2)</enum><header>Early employment services</header><text>Services provided to individuals described in subsection (c)(7) who are participating in a work-based learning program during their first 6 months of employment through such program to assure the individuals succeed in the program. Such services may include—</text><subparagraph id="id59b374a8faef4149a47560e7c0456172"><enum>(A)</enum><text>ongoing case management and support services, including the services provided in the pre-employment stage described in paragraph (1);</text></subparagraph><subparagraph id="ideded6221dc8746258ac434ffd9cdb49b"><enum>(B)</enum><text>continued skills training, including career and technical education conducted in collaboration with employers of such individuals;</text></subparagraph><subparagraph id="id800f294a09dd49ac95f4a6bd8c0fcc2e"><enum>(C)</enum><text>additional mentorship and retention supports for such individuals;</text></subparagraph><subparagraph id="id0ad2c84c8eb7460385c9d6427f2c2ee7"><enum>(D)</enum><text>targeted training for frontline managers, journey-level workers working with such individuals (such as mentors), and human resource representatives within the business where such individuals are placed; and</text></subparagraph><subparagraph id="id0a96090d073d43299c0aae6f3deb5bae"><enum>(E)</enum><text>wages and benefits for a period of not more than 6 months, during which the eligible partnership shall serve as the employer of record of such individuals.</text></subparagraph></paragraph><paragraph id="id59c6557b6eb64df8bacde98646fe663e"><enum>(3)</enum><header>Employment services</header><text>Services to ensure the individuals described in paragraph (2) maintain employment in the work-based learning program for at least 12 months. The services shall include support necessary to complete the work-based learning program, such as continuation of mentoring and support services provided under paragraph (2).</text></paragraph></subsection><subsection id="id2643E1E1FC354DC8BC8D05F61088B70F"><enum>(e)</enum><header>Evaluation and progress reports</header><paragraph id="idD51C1502F607421B858591019B3A708C"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after receiving a grant under this Act, and annually thereafter, the eligible partnership receiving the grant shall submit a report to the Secretary and the Governor of the State that the eligible partnership serves, that—</text><subparagraph id="idF0668EFB23F140CA8AC44F542C118AC9"><enum>(A)</enum><text display-inline="yes-display-inline">describes the activities funded by the grant;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6AB281CB667A4583B57B024A4FDE18B3"><enum>(B)</enum><text display-inline="yes-display-inline">evaluates the progress the eligible partnership has made towards achieving the strategic objectives identified under section 5(b)(5); and</text></subparagraph><subparagraph commented="no" id="id9e0e3ecb2c7a4c019bac69916722a4ed"><enum>(C)</enum><text>evaluates the progress of the eligible partnership based on each of the indicators of performance described in paragraph (2)(A), as disaggregated in accordance with paragraph (2)(C).</text></subparagraph></paragraph><paragraph commented="no" id="idEE03068F3A85424C9AFAEEDF0AF0DE75"><enum>(2)</enum><header>Indicators of performance</header><subparagraph commented="no" id="idD9C81028AD764924A67CA79C17F859CE"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1)(C), the indicators of performance described in this subparagraph are each of the following:</text><clause commented="no" id="P06DBCADC47B120445940A491004E00F"><enum>(i)</enum><text>The percentage of individuals participating in a work-based learning program supported by the grant who are in unsubsidized employment during the second quarter after exit from participating in such program.</text></clause><clause commented="no" id="P0FEDC03D43A83EA7A8BA8EAB6B25DAD"><enum>(ii)</enum><text>The percentage of individuals participating in a work-based learning program supported by the grant who are in unsubsidized employment during the fourth quarter after exit from participating in such program.</text></clause><clause commented="no" id="PE632122D49B4CD613B39E69CE827DF1"><enum>(iii)</enum><text>The median earnings of individuals participating in a work-based learning program supported by the grant who are in unsubsidized employment during the second quarter after exit from participating in such program.</text></clause><clause commented="no" id="P29B9C75B4D7CD52D755539ADE86BF87"><enum>(iv)</enum><text>The percentage of individuals participating in a work-based learning program supported by the grant who obtain a recognized postsecondary credential, or a secondary school diploma or its recognized equivalent (subject to subparagraph (B)), during such participation in such program or within 1 year after exit from participating in such program.</text></clause><clause commented="no" id="PC2284EE84491F303FAA19D84C748952"><enum>(v)</enum><text>The percentage of individuals participating in a work-based learning program supported by the grant who, during a program year, are in an education or training program that leads to a recognized postsecondary credential or employment and who are achieving measurable skill gains toward such a credential or employment.</text></clause></subparagraph><subparagraph commented="no" id="idBC00634ABFFD4E5CB882D50580215BEE"><enum>(B)</enum><header>Indicator relating to credential</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(iv), individuals participating in a work-based learning program supported by the grant who obtain a secondary school diploma or its recognized equivalent shall be included in the percentage counted as meeting the criterion under such subparagraph only if such individuals, in addition to obtaining such diploma or its recognized equivalent, have obtained or retained employment or are in an education or training program leading to a recognized postsecondary credential not later than 1 year after exit from the work-based learning program supported by the grant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7F914CA58C149738B2F0B02FED26EA0"><enum>(C)</enum><header>Disaggregation</header><text>The indicators of performance under paragraph (1)(C) shall be disaggregated by—</text><clause commented="no" display-inline="no-display-inline" id="idD47F640E392A43B99D40BB1BC0D7B409"><enum>(i)</enum><text>each population specified in subparagraphs (A) through (N) of section 3(24) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102(24)</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id973AE6EA91CC491084755D8FE57657FD"><enum>(ii)</enum><text>race, ethnicity, sex, and age.</text></clause></subparagraph></paragraph></subsection><subsection id="id7DD7F6434E254D39A9FCDE2B0CBCF3A0"><enum>(f)</enum><header>Administrative costs</header><text>An eligible partnership may use not more than 5 percent of the funds awarded through a grant under this Act for administrative expenses in carrying out this section.</text></subsection></section><section id="id0706f5fb216f411c938f7c74a4a8d1d6"><enum>7.</enum><header>Administration by the Secretary</header><subsection id="idf3b399b20261474a866897e7e824d02a"><enum>(a)</enum><header>In general</header><text>The Secretary may use not more than 10 percent of the amount appropriated under section 8 for each fiscal year for administrative expenses to carry out this Act, including the expenses of providing the technical assistance and oversight activities under subsection (b).</text></subsection><subsection id="id76366c628ae84eabbc094d645ce6f6bd"><enum>(b)</enum><header>Technical assistance; oversight</header><text>The Secretary shall provide technical assistance and oversight to assist the eligible partnerships in applying for and administering grants awarded under this Act.</text></subsection></section><section commented="no" id="id2DB553B7BB1945379C541808F68DC10A"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section></legis-body></bill>
