which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy Act of 2005 to require the Secretary of the Interior to establish a program to plug, remediate, and reclaim orphaned oil and gas wells and surrounding land, to provide funds to State and Tribal governments to plug, remediate, and reclaim orphaned oil and gas wells and surrounding land, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8CC8DAADE87740F69D92A4831E19A547"><section section-type="section-one" id="HE1101229D5494D22B0AAD5EFC98B0EB8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revive Economic Growth and Reclaim Orphaned Wells Act of 2021</short-title></quote> or the <quote><short-title>REGROW Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6A549797053143E396D8599816D83A74"><enum>2.</enum><header>Orphaned well site plugging, remediation, and restoration</header><text display-inline="no-display-inline">Section 349 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15907">42 U.S.C. 15907</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7C76103865D347D3B7343069E72AB646"><section id="HE89DEDDF267C4779B052211CA41CF335"><enum>349.</enum><header>Orphaned well site plugging, remediation, and restoration</header><subsection id="H4C2DD94D26FD44B894FBB7E2AFA0D942"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFBF47A9831D141D28156E800C8348DBA"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means land administered by a land management agency within—</text><subparagraph id="id1A538793F69B4C75BB538A9B462769AD"><enum>(A)</enum><text>the Department of Agriculture; or</text></subparagraph><subparagraph id="id11FF206A5D8B402F9F8335CBA0DF0CAC"><enum>(B)</enum><text>the Department of the Interior.</text></subparagraph></paragraph><paragraph id="idBC8E9C1B4FB84320AC36D952E3A578C0"><enum>(2)</enum><header>Idled well</header><text>The term <term>idled well</term> means a well—</text><subparagraph id="id92B9854D87CA449899855797F8361A0B"><enum>(A)</enum><text>that has been nonoperational for not fewer than 4 years; and</text></subparagraph><subparagraph id="idAB1826982EA84C04A06CAE489CC99428"><enum>(B)</enum><text>for which there is no anticipated beneficial future use.</text></subparagraph></paragraph><paragraph id="H3550159AF2214790A0B4AD470CA5AC86"><enum>(3)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H455714637D4E4FCFB14AC5D01E9A4FC9"><enum>(4)</enum><header>Operator</header><text>The term <term>operator</term>, with respect to an oil or gas operation, means any entity, including a lessee or operating rights owner, that has provided to a relevant authority a written statement that the entity is responsible for the oil or gas operation, or any portion of the operation.</text></paragraph><paragraph id="HB57518E4E67749149530FB248C76DEDD"><enum>(5)</enum><header>Orphaned well</header><text display-inline="yes-display-inline">The term <term>orphaned well</term>—</text><subparagraph id="HA99F1FEBB57B4ED0B9D4FBD918173660"><enum>(A)</enum><text>with respect to Federal land or Tribal land, means a well—</text><clause id="id965C058A70F14D52B500313EDA5C1ADA"><enum>(i)</enum><text>that is not used for an authorized purpose, such as production, injection, or monitoring; and</text></clause><clause id="id5DE56452CCC441A1BA296F36F609AB3F"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7D4FFA940D744F35BB82EE5460C84C87"><enum>(I)</enum><text>for which no operator can be located; or </text></subclause><subclause id="id9F9E6AC0FD31481993C5ED1613EECD3F" indent="up1"><enum>(II)</enum><text>the operator of which is unable—</text><item id="id1E6E557242064CAFA8A7312AAAC9386E"><enum>(aa)</enum><text>to plug the well; and</text></item><item id="id5FCE8D57E4AD4774AA64ADA6406298B6"><enum>(bb)</enum><text>to remediate and reclaim the well site; and</text></item></subclause></clause></subparagraph><subparagraph id="HD3293562E2064C768EFC2D64CBA831D9"><enum>(B)</enum><text>with respect to State or private land—</text><clause id="H501E6172ED514FD3B5D53976BC614406"><enum>(i)</enum><text>has the meaning given the term by the applicable State; or</text></clause><clause id="H254C00B7DEEF430784A3CB323194FE72"><enum>(ii)</enum><text>if that State uses different terminology, has the meaning given another term used by the State to describe a well eligible for plugging, remediation, and reclamation by the State.</text></clause></subparagraph></paragraph><paragraph id="H743AFEF7896F45B8B32DFAC356853DD3"><enum>(6)</enum><header>Tribal land</header><text display-inline="yes-display-inline">The term <term>Tribal land</term> means any land or interest in land owned by an Indian Tribe, the title to which is—</text><subparagraph id="id5DF230E214BA4DA89F4B1DC4B872CBEC"><enum>(A)</enum><text display-inline="yes-display-inline">held in trust by the United States; or</text></subparagraph><subparagraph id="id1C44E35FDFBD410CAFED5CCABDAA8831"><enum>(B)</enum><text display-inline="yes-display-inline">subject to a restriction against alienation under Federal law.</text></subparagraph></paragraph></subsection><subsection id="HDE66E80F1AF64025A18045B08060A9E6"><enum>(b)</enum><header>Federal program</header><paragraph id="H5B9CC734D1D4469EA979C787C0F10665"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of the <short-title>Revive Economic Growth and Reclaim Orphaned Wells Act of 2021</short-title>, the Secretary shall establish a program to plug, remediate, and reclaim orphaned wells located on Federal land.</text></paragraph><paragraph id="H3EBFC73EBF3F4370987772CD943B2470"><enum>(2)</enum><header>Included activities</header><text>The program under this subsection shall—</text><subparagraph id="H1680367AFC2B43E29821D727BBB46056"><enum>(A)</enum><text>include a method of—</text><clause id="id3C41B00A7C644035BB5C6DB44945BF03"><enum>(i)</enum><text>identifying, characterizing, and inventorying orphaned wells and associated pipelines, facilities, and infrastructure on Federal land; and</text></clause><clause id="id35069EFFC2C2415E8110D4B122F58025"><enum>(ii)</enum><text>ranking those orphaned wells for priority in plugging, remediation, and reclamation, based on—</text><subclause id="id2885C0476AC848BDA60023B754390E5A"><enum>(I)</enum><text>public health and safety;</text></subclause><subclause id="id524DE2DAAC1142A09A8AC6A12B333BB0"><enum>(II)</enum><text>potential environmental harm; and</text></subclause><subclause id="id2EA18E5D5FA74DDCAD5C71A610B1A89F"><enum>(III)</enum><text>other subsurface impacts or land use priorities;</text></subclause></clause></subparagraph><subparagraph id="HD13C65C2920E4E8BA7FFAF75C3A214F6"><enum>(B)</enum><text>distribute funding in accordance with the priorities established under subparagraph (A)(ii) for—</text><clause id="H4B0599A2948F488D9A09E24BC405E584"><enum>(i)</enum><text>plugging orphaned wells;</text></clause><clause id="HF167D4C0DF664D25BB555938D0B56310"><enum>(ii)</enum><text>remediating and reclaiming well pads and facilities associated with orphaned wells; </text></clause><clause id="H6232AC465F274D22A4A27E04322EDD5F"><enum>(iii)</enum><text>remediating soil and restoring native species habitat that has been degraded due to the presence of orphaned wells and associated pipelines, facilities, and infrastructure; and</text></clause><clause id="H0528D490A4E04DFFB6C68392F31005EC"><enum>(iv)</enum><text>remediating land adjacent to orphaned wells and decommissioning or removing associated pipelines, facilities, and infrastructure;</text></clause></subparagraph><subparagraph id="HCF29907F2F974649BA4AF42A2006E2DC"><enum>(C)</enum><text>provide a public accounting of the costs of plugging, remediation, and reclamation for each orphaned well;</text></subparagraph><subparagraph id="id3689f6b7da6446c480057e853d21a067"><enum>(D)</enum><text>seek to determine the identities of potentially responsible parties associated with the orphaned well (or a surety or guarantor of such a party), to the extent such information can be ascertained, and make efforts to obtain reimbursement for expenditures to the extent practicable;</text></subparagraph><subparagraph id="H01A9FBF73CCC48E48D078DF0F074E8B1"><enum>(E)</enum><text display-inline="yes-display-inline">measure and track—</text><clause id="idC7C3004193454877B5C1D710808B6B7D"><enum>(i)</enum><text display-inline="yes-display-inline">emissions of methane and other gases associated with orphaned wells; and</text></clause><clause id="H7B51786DD03E433287C89D75E1E9C5A9"><enum>(ii)</enum><text>contamination of groundwater or surface water associated with orphaned wells; and</text></clause></subparagraph><subparagraph id="idfa97a0b3eea044d1a80351a96d53d2c1"><enum>(F)</enum><text>identify and address any disproportionate burden of adverse human health or environmental effects of orphaned wells on communities of color, low-income communities, and Tribal and indigenous communities.</text></subparagraph></paragraph><paragraph id="H5CB1DDE10E3F43DF9C5423DBC146A05E"><enum>(3)</enum><header>Idled wells</header><text>The Secretary, acting through the Director of the Bureau of Land Management, shall—</text><subparagraph id="id21CA0D38E65846DD91FEA91EDDA1D8E9"><enum>(A)</enum><text>periodically review all idled wells on Federal land; and</text></subparagraph><subparagraph id="id1493aa397a734024843980c7bdca729c"><enum>(B)</enum><text>reduce the inventory of idled wells on Federal land.</text></subparagraph></paragraph><paragraph id="H5444A6D803154F8FB5581644851279BF"><enum>(4)</enum><header>Cooperation and consultation</header><text>In carrying out the program under this subsection, the Secretary shall—</text><subparagraph id="HAE0EADF8A3A245BBB150672278DF68AA"><enum>(A)</enum><text>work cooperatively with—</text><clause id="idF054E25A76A74FC293F0E08FE57D701A"><enum>(i)</enum><text>the Secretary of Agriculture;</text></clause><clause id="idAC44C6050CBD4C73BF5106D17A486D7F"><enum>(ii)</enum><text>affected Indian Tribes; and</text></clause><clause id="id31B5AE6EF53843B1B2D6ED001131989B"><enum>(iii)</enum><text>each State within which Federal land is located; and</text></clause></subparagraph><subparagraph id="H348CF796A7C84382A3CD6D6B81A74EE6"><enum>(B)</enum><text>consult with—</text><clause id="idD43C8822F54444BC8778E352E77D35B4"><enum>(i)</enum><text>the Secretary of Energy; and</text></clause><clause id="id6E6E99265AF349EF8B0E96243DF2B66A"><enum>(ii)</enum><text>the Interstate Oil and Gas Compact Commission.</text></clause></subparagraph></paragraph></subsection><subsection id="HA2B9E7BE6BDF4A159D2F91CA92A1B4C9"><enum>(c)</enum><header>Funding for State programs</header><paragraph id="HF1B5FCA9975D44CA9782DADBC424BFF2"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide to States, in accordance with this subsection—</text><subparagraph id="id24E3154F121641AF88E164263FE41BA8"><enum>(A)</enum><text>initial grants under paragraph (3);</text></subparagraph><subparagraph id="id06B8529D50094995AF64FC23DB656441"><enum>(B)</enum><text>formula grants under paragraph (4); and</text></subparagraph><subparagraph id="idBAC428E05CA749A3AEF8950EF4071B69"><enum>(C)</enum><text>performance grants under paragraph (5).</text></subparagraph></paragraph><paragraph id="HD3DFB4DDD2144AA2B843A958442612F7"><enum>(2)</enum><header>Activities</header><subparagraph id="idB545FDC85FA249C3995CB0E3F7CA6E4A"><enum>(A)</enum><header>In general</header><text>A State may use funding provided under this subsection for any of the following purposes:</text><clause id="HBC72254F691643F5BFE64F72EC1645B4"><enum>(i)</enum><text>To plug, remediate, and reclaim orphaned wells located on State-owned or privately owned land.</text></clause><clause id="HD6F30F6B64ED459B85B8C544F590E527"><enum>(ii)</enum><text>To identify and characterize undocumented orphaned wells on State and private land.</text></clause><clause id="HAA7B6EFAE6334C15899BA8E798EAC0A8"><enum>(iii)</enum><text display-inline="yes-display-inline">To rank orphaned wells based on factors including—</text><subclause id="idF813D09AF18444FD8B9DC972EB15EA70"><enum>(I)</enum><text display-inline="yes-display-inline">public health and safety;</text></subclause><subclause id="id7489C03F9BA44103BE7EE3916BAF1E9D"><enum>(II)</enum><text display-inline="yes-display-inline">potential environmental harm; and</text></subclause><subclause id="id88398F7EAB9647F9BFB1C0AEB1602409"><enum>(III)</enum><text display-inline="yes-display-inline">other land use priorities.</text></subclause></clause><clause id="HE1FF7A999A1F4AEB9D1B55607B29C3FC"><enum>(iv)</enum><text>To make information regarding the use of funds received under this subsection available on a public website.</text></clause><clause id="HD6793FA6296C40E6B753918715C7F9DF"><enum>(v)</enum><text>To measure and track—</text><subclause id="idCD0292E312964AA9B97C97E255589461"><enum>(I)</enum><text>emissions of methane and other gases associated with orphaned wells; and</text></subclause><subclause id="H4E898632F60F459CBE6369BF6A8EECAB"><enum>(II)</enum><text display-inline="yes-display-inline">contamination of groundwater or surface water associated with orphaned wells.</text></subclause></clause><clause id="HA346C365FCCA44E28B26EF670790D87D"><enum>(vi)</enum><text display-inline="yes-display-inline">To remediate soil and restore native species habitat that has been degraded due to the presence of orphaned wells and associated pipelines, facilities, and infrastructure. </text></clause><clause id="HD91BB1BB40BD4370AF7ED0629C696DC3"><enum>(vii)</enum><text display-inline="yes-display-inline">To remediate land adjacent to orphaned wells and decommission or remove associated pipelines, facilities, and infrastructure.</text></clause><clause id="id5a4cb345212947cf9081322c63fb5a03"><enum>(viii)</enum><text>To identify and address any disproportionate burden of adverse human health or environmental effects of orphaned wells on communities of color, low-income communities, and Tribal and indigenous communities.</text></clause><clause id="H5B3B80EA67D44701ACB84D5818DB4DD3"><enum>(ix)</enum><text display-inline="yes-display-inline">Subject to subparagraph (B), to administer a program to carry out any activities described in clauses (i) through (viii).</text></clause></subparagraph><subparagraph id="H72DFF00238F145F4859EFE85E71A5956"><enum>(B)</enum><header>Administrative cost limitation</header><clause id="id845A31C2696D4BEFA2A8A37F4D44DB0D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), a State shall not use more than 10 percent of the funds received under this subsection during a fiscal year for administrative costs under subparagraph (A)(ix).</text></clause><clause id="id5E455D1D8F7C4C38847880823AAC5D39"><enum>(ii)</enum><header>Exception</header><text>The limitation under clause (i) shall not apply to funds used by a State as described in paragraph (3)(A)(ii).</text></clause></subparagraph></paragraph><paragraph id="H5CD97A90646C4730A89C0AA4559AD29B"><enum>(3)</enum><header>Initial grants</header><subparagraph id="HA4CC0B2C0B4646DBB9F7BAFF08FD0DB2"><enum>(A)</enum><header>In general</header><text>The Secretary shall distribute—</text><clause id="H32A0A7062C2D48AF8B1A356EE9276AAB"><enum>(i)</enum><text>not more than $25,000,000 to each State that submits to the Secretary, by not later than 180 days after the date of enactment of the <short-title>Revive Economic Growth and Reclaim Orphaned Wells Act of 2021</short-title>, a request for funding under this clause, including—</text><subclause id="id64b46734de2f4c8dab491f2bd45ef586"><enum>(I)</enum><text>an estimate of the number of jobs that will be created or saved through the activities proposed to be funded; and</text></subclause><subclause id="id8CCF9CB80032466D9FFE805850D59947"><enum>(II)</enum><text>a certification that—</text><item id="H809005BA43D94C30B537CB1C3D7B0C8A"><enum>(aa)</enum><text display-inline="yes-display-inline">the State is a Member State or Associate Member State of the Interstate Oil and Gas Compact Commission;</text></item><item id="H5CB1FB4E04DA4B1199647A601FED4AF2"><enum>(bb)</enum><text>there are 1 or more documented orphaned wells located in the State; and</text></item><item id="idCA4BA2964DA844B1AFFEE7028664178C"><enum>(cc)</enum><text>the State will use not less than 90 percent of the funding requested under this subsection to issue new contracts, amend existing contracts, or issue grants for plugging, remediation, and reclamation work by not later than 90 days after the date of receipt of the funds; and</text></item></subclause></clause><clause id="H49569C29F4154115956FC0EFE220C611"><enum>(ii)</enum><text display-inline="yes-display-inline">not more than $5,000,000 to each State that—</text><subclause id="H85C24603566045FEABCC79B3ED1651C9"><enum>(I)</enum><text>requests funding under this clause;</text></subclause><subclause id="H1CDE000E15F245B3A9DA2149353CF8B9"><enum>(II)</enum><text>does not receive a grant under clause (i); and</text></subclause><subclause id="H9AF1463545E04272A27F7ECAC90404B0"><enum>(III)</enum><text display-inline="yes-display-inline">certifies to the Secretary that—</text><item id="H5DB61A92FDB04FA2A86370CE7B77507B"><enum>(aa)</enum><text>the State—</text><subitem id="id5B6241450C624034B6EC39ECFCF71BBC"><enum>(AA)</enum><text>has in effect a plugging, remediation, and reclamation program for orphaned wells; or</text></subitem><subitem id="id1F08C9DA27F8485387F61531E2320075"><enum>(BB)</enum><text>the capacity to initiate such a program; or</text></subitem></item><item id="HF381759DC3394CE4886C5C1F15BF7272"><enum>(bb)</enum><text display-inline="yes-display-inline">the funds provided under this paragraph will be used to carry out any administrative actions necessary to develop an application for a formula grant under paragraph (4) or a performance grant under paragraph (5).</text></item></subclause></clause></subparagraph><subparagraph id="HD5C12FE968634B228B666AE176B70C83"><enum>(B)</enum><header>Distribution</header><text>The Secretary shall distribute funds to a State under this paragraph by not later than the date that is 30 days after the date on which the State submits to the Secretary the certification required under clause (i)(II) or (ii)(III) of subparagraph (A), as applicable.</text></subparagraph><subparagraph id="HDF3B8E2AAC684384AD88DBC73FE88915"><enum>(C)</enum><header>Deadline for expenditure</header><text>A State that receives funds under this paragraph shall reimburse the Secretary in an amount equal to the amount of the funds that remain unobligated on the date that is 1 year after the date of receipt of the funds.</text></subparagraph><subparagraph id="H6D91C394A2384A2C957BBCB05F99BECF"><enum>(D)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 15 months after the date on which a State receives funds under this paragraph, the State shall submit to the Secretary a report that describes the means by which the State used the funds in accordance with the certification submitted by the State under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HB8D27D64F3724B75B1BF358E6123D2B2"><enum>(4)</enum><header>Formula grants</header><subparagraph id="HAA0B185C9FA54BA3B63355AD5984E160"><enum>(A)</enum><header>Establishment</header><clause id="H665938AA08094754A8C8087429BBCCAB"><enum>(i)</enum><header>In general</header><text>The Secretary shall establish a formula for the distribution to each State described in clause (ii) of funds under this paragraph.</text></clause><clause id="idE93067FD4F1B4DFDB7719EDB4EF4D21C"><enum>(ii)</enum><header>Description of States</header><text>A State referred to in clause (i) is a State that, by not later than 45 days after the date of enactment of the <short-title>Revive Economic Growth and Reclaim Orphaned Wells Act of 2021</short-title>, submits to the Secretary a notice of the intent of the State to submit an application under subparagraph (B), including a description of the factors described in clause (iii) with respect to the State.</text></clause><clause id="idB28991E2DA1646A4A718D459F8B38F23"><enum>(iii)</enum><header>Factors</header><text>The formula established under clause (i) shall account for, with respect to an applicant State, the following factors:</text><subclause id="H4E2B3455A4164173AE52DB6D7579FD87"><enum>(I)</enum><text>Job losses in the oil and gas industry in the State during the period—</text><item id="id10F20554D6914F29A565DCB4F40998EE"><enum>(aa)</enum><text>beginning on March 1, 2020; and</text></item><item id="idB825F77255594DA48CB07E7DDC601CE7"><enum>(bb)</enum><text>ending on the date of enactment of the <short-title>Revive Economic Growth and Reclaim Orphaned Wells Act of 2021</short-title>.</text></item></subclause><subclause id="H18A4EC21D8C8404AA897D18ED3392E49"><enum>(II)</enum><text>The number of documented orphaned wells located in the State, and the projected cost—</text><item id="idC73BF3B05E3B449D887575938F638CA1"><enum>(aa)</enum><text>to plug or reclaim those orphaned wells;</text></item><item id="id435285EC63274EC19870E8C8E88C80FE"><enum>(bb)</enum><text>to reclaim adjacent land; and </text></item><item id="idAC0DA6A17F2045A7ABC68A4CC7C05144"><enum>(cc)</enum><text>to decommission or remove associated pipelines, facilities, and infrastructure.</text></item></subclause></clause><clause id="H28CBA7002D954CB3B8F6F963FB4E8725"><enum>(iv)</enum><header>Publication</header><text>Not later than 75 days after the date of enactment of this Act, the Secretary shall publish on a public website the amount that each State is eligible to receive under the formula under this subparagraph.</text></clause></subparagraph><subparagraph id="H38B05A79C9204A73B0854331148CA3FF"><enum>(B)</enum><header>Application</header><text>To be eligible to receive a formula grant under this paragraph, a State shall submit to the Secretary an application that includes—</text><clause id="H3D9E9582E0B34776B5A5FBF29B74684C"><enum>(i)</enum><text>a description of—</text><subclause id="HDFA5BFF5A17144149A3D17C0355E078A"><enum>(I)</enum><text>the State program for orphaned well plugging, remediation, and restoration, including legal authorities, processes used to identify and prioritize orphaned wells, procurement mechanisms, and other program elements demonstrating the readiness of the State to carry out proposed activities using the grant;</text></subclause><subclause id="H8F17E765FBF44D55AAF8E57623A0A9E8"><enum>(II)</enum><text display-inline="yes-display-inline">the activities to be carried out with the grant, including an identification of the estimated health, safety, habitat, and environmental benefits of plugging, remediating, or reclaiming orphaned wells; and</text></subclause><subclause id="H115CC0E111CC4AE8BA6A5F34182FE23B"><enum>(III)</enum><text display-inline="yes-display-inline">the means by which the information regarding the activities of the State under this paragraph will be made available on a public website; </text></subclause></clause><clause id="HCA112A89B98342F999A166C3C8176C69"><enum>(ii)</enum><text>an estimate of—</text><subclause id="H7F7C84C4B7C94F20AF36F025BB82C54C"><enum>(I)</enum><text>the number of orphaned wells in the State that will be plugged, remediated, or reclaimed;</text></subclause><subclause id="HA98548B9BF36440B8E4FB83CCE4FEB8B"><enum>(II)</enum><text>the projected cost of—</text><item id="id92067932126449B887E81A5964351830"><enum>(aa)</enum><text>plugging, remediating, or reclaiming orphaned wells;</text></item><item id="idDA78D9A46D0F4F17B906A86474D8EE30"><enum>(bb)</enum><text>remediating or reclaiming adjacent land; and </text></item><item id="id79B657AEC13D45199271EC50B26E0E86"><enum>(cc)</enum><text>decommissioning or removing associated pipelines, facilities, and infrastructure; </text></item></subclause><subclause id="H9AB1A12E13FA4E1283C86CE6069C95C7"><enum>(III)</enum><text>the amount of that projected cost that will be offset by the forfeiture of financial assurance instruments, the estimated salvage of well site equipment, or other proceeds from the orphaned wells and adjacent land;</text></subclause><subclause id="H75AEFA5889FB4369ADCF7652E727D40F"><enum>(IV)</enum><text display-inline="yes-display-inline">the number of jobs that will be created or saved through the activities to be funded under this paragraph; and</text></subclause><subclause id="HE57C5BEB16DC462F896D3FEBE587E4AD"><enum>(V)</enum><text display-inline="yes-display-inline">the amount of funds to be spent on administrative costs; </text></subclause></clause><clause id="H4A5855A055994D56BF1BCC80DEEE9FE3"><enum>(iii)</enum><text>a certification that any financial assurance instruments available to cover plugging, remediation, or reclamation costs will be used by the State; and</text></clause><clause id="HAD4C01C6F7F6451FAD9E2A93D5789D77"><enum>(iv)</enum><text display-inline="yes-display-inline">the definitions and processes used by the State to formally identify a well as—</text><subclause id="idA3F4D3BFA6D2432C98083412793C1C97"><enum>(I)</enum><text display-inline="yes-display-inline">an orphaned well; or</text></subclause><subclause id="id39B9D713806C4ADA8FE44F3E5F7ADD0B"><enum>(II)</enum><text display-inline="yes-display-inline">if the State uses different terminology, otherwise eligible for plugging, remediation, and reclamation by the State.</text></subclause></clause></subparagraph><subparagraph id="idE000DC86FA3446DE9151100E48C040C1"><enum>(C)</enum><header>Distribution</header><text>The Secretary shall distribute funds to a State under this paragraph by not later than the date that is 60 days after the date on which the State submits to the Secretary a completed application under subparagraph (B). </text></subparagraph><subparagraph id="id0FD6855FFB5F4A5F9F0952E765ABE354"><enum>(D)</enum><header>Deadline for expenditure</header><text>A State that receives funds under this paragraph shall reimburse the Secretary in an amount equal to the amount of the funds that remain unobligated on the date that is 5 years after the date of receipt of the funds.</text></subparagraph><subparagraph id="H9C58E66C73814AFDAE963E0F966AF1EF"><enum>(E)</enum><header>Consultation</header><text>In making a determination under this paragraph regarding the eligibility of a State to receive a formula grant, the Secretary shall consult with—</text><clause id="id3534427C522C4053A247F675F31F9E8B"><enum>(i)</enum><text>the Administrator of the Environmental Protection Agency;</text></clause><clause id="id6969BEBD75FA44478B1D0BFAFF10CFE0"><enum>(ii)</enum><text>the Secretary of Energy; and</text></clause><clause id="idCF2E8033A2B34F789A8CFEEDB440562C"><enum>(iii)</enum><text>the Interstate Oil and Gas Compact Commission.</text></clause></subparagraph></paragraph><paragraph id="id2fc64c56fbdf4c55affca0e332848e89"><enum>(5)</enum><header>Performance grants</header><subparagraph id="id63565f4c6ba54b678300f33a131380f2"><enum>(A)</enum><header>Establishment</header><text>The Secretary shall provide to States, in accordance with this paragraph—</text><clause id="id46DB32C171304BF2B8E350E0FD210391"><enum>(i)</enum><text>regulatory improvement grants under subparagraph (E); and</text></clause><clause id="id1BC52BD8E177460F92F6785BFCB180C7"><enum>(ii)</enum><text>matching grants under subparagraph (F).</text></clause></subparagraph><subparagraph id="id20c53e5cf5f94cf9a0f06a5a449ed777"><enum>(B)</enum><header>Application</header><text>To be eligible to receive a grant under this paragraph, a State shall submit to the Secretary an application including—</text><clause id="iddc8dc07b87164231a5fe853ee428ce93"><enum>(i)</enum><text>each element described in an application for a grant under paragraph (4)(B);</text></clause><clause id="ida8330ad8f5564a219aff58e13dcfad7d"><enum>(ii)</enum><text>activities carried out by the State to address orphaned wells located in the State, including—</text><subclause id="idF7DED4C946BE4C03AC8F3DB3E6628A67"><enum>(I)</enum><text>increasing State spending on well plugging, remediation, and reclamation; or</text></subclause><subclause id="id69211F45F4444839BFC69B1094A6E2CD"><enum>(II)</enum><text>improving regulation of oil and gas wells; and</text></subclause></clause><clause id="idfcdef2a30c6b450bb362c07fd9d9e32d"><enum>(iii)</enum><text>the means by which the State will use funds provided under this paragraph—</text><subclause id="ida2fe21ff00c0478786d523126c4a0db0"><enum>(I)</enum><text>to lower unemployment in the State; and</text></subclause><subclause id="id559578e022ca424da3f842c851a813a0"><enum>(II)</enum><text>to improve economic conditions in economically distressed areas of the State.</text></subclause></clause></subparagraph><subparagraph id="idC37CE87F6CA243F8817D5F71413DD7A5" commented="no"><enum>(C)</enum><header>Distribution</header><text>The Secretary shall distribute funds to a State under this paragraph by not later than the date that is 60 days after the date on which the State submits to the Secretary a completed application under subparagraph (B).</text></subparagraph><subparagraph id="id7C5106C5732E46D0A820BA288A0BD8B5"><enum>(D)</enum><header>Consultation</header><text>In making a determination under this paragraph regarding the eligibility of a State to receive a grant under subparagraph (E) or (F), the Secretary shall consult with—</text><clause id="id221A3EB730D04399ABDC29C91F6BFF17"><enum>(i)</enum><text>the Administrator of the Environmental Protection Agency;</text></clause><clause id="id6FBD005D8C6940DF9F3E4018F240596D"><enum>(ii)</enum><text>the Secretary of Energy; and</text></clause><clause id="idEDAD9A49AF434538978B80EF2A5AFD82"><enum>(iii)</enum><text>the Interstate Oil and Gas Compact Commission. </text></clause></subparagraph><subparagraph id="idFEDF21E6C614417395C758A487FC9CFE"><enum>(E)</enum><header>Regulatory improvement grants</header><clause id="id36bb44f400aa4ac09259e064501e7353"><enum>(i)</enum><header>In general</header><text>Beginning on the date that is 180 days after the date on which an initial grant is provided to a State under paragraph (3), the Secretary shall provide to the State a regulatory improvement grant under this subparagraph, if the State meets, during the 10-year period ending on the date on which the State submits to the Secretary an application under subparagraph (B), 1 of the following criteria:</text><subclause id="id5fb66aaa871049cab0128c5856260219"><enum>(I)</enum><text>The State has strengthened plugging standards and procedures designed to ensure that wells located in the State are plugged in an effective manner that protects groundwater and other natural resources, public health and safety, and the environment.</text></subclause><subclause id="idda4bac44b6be4ed48271adde26c8189e"><enum>(II)</enum><text>The State has made improvements to State programs designed to reduce future orphaned well burdens, such as financial assurance reform, alternative funding mechanisms for orphaned well programs, and reforms to programs relating to well transfer or temporary abandonment.</text></subclause></clause><clause id="id32554f3b662f4360948e3b37bb582920"><enum>(ii)</enum><header>Limitations</header><subclause id="id947022EE2CA942EB8A1A8F8F1E702629"><enum>(I)</enum><header>Number</header><text>The Secretary may issue to a State under this subparagraph not more than 1 grant for each criterion described in subclause (I) or (II) of clause (i).</text></subclause><subclause id="id0CAC2673A6EB447784BD2622FDA8CCD9"><enum>(II)</enum><header>Maximum amount</header><text>The amount of a single grant provided to a State under this subparagraph shall be not more than $20,000,000.</text></subclause></clause><clause id="idec7ede5dd2124818823675a171645825" commented="no"><enum>(iii)</enum><header>Reimbursement for failure to maintain protections</header><text>A State that receives a grant under this subparagraph shall reimburse the Secretary in an amount equal to the amount of the grant in any case in which, during the 10-year period beginning on the date of receipt of the grant, the State enacts a law or regulation that, if in effect on the date of submission of the application under subparagraph (B), would have prevented the State from being eligible to receive the grant under clause (i).</text></clause></subparagraph><subparagraph id="id2b4948afae8444969fce6c9419fde3b6"><enum>(F)</enum><header>Matching grants</header><clause id="id3B2A9C513B314DFDA2868F8C39D139D9"><enum>(i)</enum><header>In general</header><text>Beginning on the date that is 180 days after the date on which an initial grant is provided to a State under paragraph (3), the Secretary shall provide to the State funding, in an amount equal to the difference between—</text><subclause id="id833f674e25624c2db7fd895d19d4442c"><enum>(I)</enum><text>the average annual amount expended by the State during the period of fiscal years 2010 through 2019—</text><item id="idDCE3B4586E444675A7D464797B895315"><enum>(aa)</enum><text>to plug, remediate, and reclaim orphaned wells; and</text></item><item id="idB98558AE13A64A97ADD8A075B35386D1"><enum>(bb)</enum><text>to decommission or remove associated pipelines, facilities, or infrastructure; and</text></item></subclause><subclause id="id031bb02df9ee45e8a09a1e86df31578c"><enum>(II)</enum><text>the amount that the State certifies to the Secretary the State will expend, during the fiscal year in which the State will receive the grant under this subparagraph—</text><item id="id1B7D116A97E44219AAED8F37E87C009D"><enum>(aa)</enum><text>to plug, remediate, and reclaim orphaned wells; </text></item><item id="id25C97001AF31495788D1385C17B49E15"><enum>(bb)</enum><text>to remediate or reclaim adjacent land; and </text></item><item id="id9CC961E6C6DD49ABBCE0F1FA08CB3DC1"><enum>(cc)</enum><text>to decommission or remove associated pipelines, facilities, and infrastructure.</text></item></subclause></clause><clause id="id6230348F4943451B8787FA031C0BEF77"><enum>(ii)</enum><header>Limitations</header><subclause id="id5744B08280CC41FFA8BEB01FC82BADCC"><enum>(I)</enum><header>Fiscal year</header><text>The Secretary may issue to a State under this subparagraph not more than 1 grant for each fiscal year.</text></subclause><subclause id="id8bd92d4ad80347bd94270e77fca6a1e7"><enum>(II)</enum><header>Total funds provided</header><text>The Secretary may provide to a State under this subparagraph a total amount equal to not more than $30,000,000 during the period of fiscal years 2021 through 2030.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HB7E59858F1A74EC5ACECA5AE08E7E6DD"><enum>(d)</enum><header>Tribal orphaned well site plugging, remediation, and restoration</header><paragraph id="H1F5683C604D94912828DC99B73B8EECA"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish in the Bureau of Indian Affairs a program under which the Secretary shall provide to Indian Tribes grants in accordance with this subsection.</text></paragraph><paragraph id="H7ECD687A24D94F7E8E3A29D23BCECC5B"><enum>(2)</enum><header>Eligible activities</header><subparagraph id="id8AC16F9514EC44F5BE1C949F4843EDDF"><enum>(A)</enum><header>In general</header><text>An Indian Tribe may use a grant received under this subsection—</text><clause id="HC83AFFFD8777485CA8AD85FE732722E4"><enum>(i)</enum><text display-inline="yes-display-inline">to plug, remediate, or reclaim an orphaned well on Tribal land of the Indian Tribe;</text></clause><clause id="H2B2D4F5DD8E7489BA755624166EA116B"><enum>(ii)</enum><text display-inline="yes-display-inline">to remediate soil and restore native species habitat that has been degraded due to the presence of an orphaned well or associated pipelines, facilities, or infrastructure on Tribal land;</text></clause><clause id="id03005CF7934F4904ADD69AD4C1E19A5A"><enum>(iii)</enum><text display-inline="yes-display-inline">to remediate Tribal land adjacent to orphaned wells and decommission or remove associated pipelines, facilities, and infrastructure;</text></clause><clause id="H20BDC1AA0FEE4ADC94EAFE386851BE08"><enum>(iv)</enum><text>to provide an online public accounting of the cost of plugging, remediation, and reclamation for each orphaned well site on Tribal land; </text></clause><clause id="H311D9D1D53B24BA98F66AF4F55D8D871"><enum>(v)</enum><text>to identify and characterize undocumented orphaned wells on Tribal land; and</text></clause><clause id="HFF67CE6903EC4BDF99F6671283C9A828"><enum>(vi)</enum><text>to develop or administer a Tribal program to carry out any activities described in clauses (i) through (v).</text></clause></subparagraph><subparagraph id="HC41B7CDDF36743B4BA2819A3D6C93338"><enum>(B)</enum><header>Administrative cost limitation</header><clause id="idB3FB984963434533BC01F93B5037EF05"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), an Indian Tribe shall not use more than 10 percent of the funds received under this subsection during a fiscal year for administrative costs under subparagraph (A)(vi).</text></clause><clause id="id4294fd89b25946ab83c893af8a7c6bf9"><enum>(ii)</enum><header>Exception</header><text>The limitation under clause (i) shall not apply to any funds used to carry out an administrative action necessary for the development of a Tribal program described in subparagraph (A)(vi).</text></clause></subparagraph></paragraph><paragraph id="HA0A1211B162249DF9B621A4B122DC212"><enum>(3)</enum><header>Factors for consideration</header><text>In determining whether to provide to an Indian Tribe a grant under this subsection, the Secretary shall take into consideration—</text><subparagraph id="H642AA31FE11440ECB3F0550BC7487446"><enum>(A)</enum><text display-inline="yes-display-inline">the unemployment rate of the Indian Tribe on the date on which the Indian Tribe submits an application under paragraph (4); and</text></subparagraph><subparagraph id="H0EF106AF2CFC47D4A488AFBBACEB97F3"><enum>(B)</enum><text>the estimated number of orphaned wells on the Tribal land of the Indian Tribe.</text></subparagraph></paragraph><paragraph id="H72CE714436184828894D606CFE6EC444"><enum>(4)</enum><header>Application</header><text>To be eligible to receive a grant under this subsection, an Indian Tribe shall submit to the Secretary an application that includes—</text><subparagraph id="HA6C0513DB7804CB1BEED8B8AF79074CE"><enum>(A)</enum><text>a description of—</text><clause id="HA73FC31B42804BBC9AA66A722E5918FF"><enum>(i)</enum><text display-inline="yes-display-inline">the Tribal program for orphaned well plugging, remediation, and restoration, including legal authorities, processes used to identify and prioritize orphaned wells, procurement mechanisms, and other program elements demonstrating the readiness of the Indian Tribe to carry out the proposed activities, or plans to develop such a program; and</text></clause><clause id="id0E9DBD1B8D5C47BFA467780DD6950339"><enum>(ii)</enum><text display-inline="yes-display-inline">the activities to be carried out with the grant, including an identification of the estimated health, safety, habitat, and environmental benefits of plugging, remediating, or reclaiming orphaned wells and remediating or reclaiming adjacent land; and</text></clause></subparagraph><subparagraph id="id9E8B5612837843D8B107CE42B5DDDDAE"><enum>(B)</enum><text>an estimate of—</text><clause id="id05DA32D0D9AE4496A56BD4816E80F5A5"><enum>(i)</enum><text>the number of orphaned wells that will be plugged, remediated, or reclaimed; and</text></clause><clause id="idE9CDDEAB4CB34431A37A6336B74ADEC2"><enum>(ii)</enum><text>the projected cost of—</text><subclause id="id9E559EF68AC94BE48D7BD4A7D61B5208"><enum>(I)</enum><text>plugging, remediating, or reclaiming orphaned wells;</text></subclause><subclause id="id9DE3D513CCA64409923240717422BEB5"><enum>(II)</enum><text>remediating or reclaiming adjacent land; and </text></subclause><subclause id="id263CEFD5CD1D43D0B8A8F7B353560789"><enum>(III)</enum><text>decommissioning or removing associated pipelines, facilities, and infrastructure.</text></subclause></clause></subparagraph></paragraph><paragraph id="idEE9E6275AB0249CA9411821C4C4A2117"><enum>(5)</enum><header>Distribution</header><text>The Secretary shall distribute funds to an Indian Tribe under this subsection by not later than the date that is 60 days after the date on which the Indian Tribe submits to the Secretary a completed application under paragraph (4).</text></paragraph><paragraph id="idEA56FFA39954412F9623CE4E84F0E035"><enum>(6)</enum><header>Deadline for expenditure</header><text>An Indian Tribe that receives funds under this subsection shall reimburse the Secretary in an amount equal to the amount of the funds that remain unobligated on the date that is 5 years after the date of receipt of the funds. </text></paragraph><paragraph id="HF2AB988230D446A7B7E3035F365FE98C"><enum>(7)</enum><header>Delegation to Secretary</header><subparagraph id="id901F994D649E4D39820BD27DF20B76DB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An Indian Tribe on the Tribal land of which is located an orphaned well may submit to the Secretary a request for the Secretary to administer and carry out plugging, remediation, and reclamation activities relating to the orphaned well on behalf of the Indian Tribe.</text></subparagraph><subparagraph id="id19F6664CE6844D64A967B046F73C1A13"><enum>(B)</enum><header>Treatment</header><text display-inline="yes-display-inline">For the purposes of subsection (b), an orphaned well with respect to which an Indian Tribe of jurisdiction has submitted to the Secretary a request under subparagraph (A) shall be considered to be located on Federal land administered by a land management agency within the Department of the Interior.</text></subparagraph></paragraph></subsection><subsection id="HD57B097E7C8F4A5696054A08E66BC448"><enum>(e)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary of Energy, in cooperation with the Secretary and the Interstate Oil and Gas Compact Commission, shall provide technical assistance to the Federal land management agencies and oil and gas producing States and Indian Tribes to support practical and economical remedies for environmental problems caused by orphaned wells on Federal land, Tribal land, and State and private land, including the sharing of best practices in the management of oil and gas well inventories to ensure the availability of funds to plug, remediate, and restore oil and gas well sites on cessation of operation.</text></subsection><subsection id="H19FCE1F9FB754DF299C2346CDA5778EF"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of the <short-title>Revive Economic Growth and Reclaim Orphaned Wells Act of 2021</short-title>, and not less frequently than annually thereafter, the Secretary shall submit to the Committees on Appropriations and Energy and Natural Resources of the Senate and the Committees on Appropriations and Natural Resources of the House of Representatives a report describing the program established and grants awarded under this section, including—</text><paragraph id="HDEAD9E048BE44182BEBC6E6D458C6B6E"><enum>(1)</enum><text>an updated inventory of wells located on Federal land, Tribal land, and State and private land that are—</text><subparagraph id="idD69658D6B86C4C66890AD2FB9EA20F70"><enum>(A)</enum><text>orphaned wells; or</text></subparagraph><subparagraph id="HF3A5B07425EE477E9DB1FEA8AB539231"><enum>(B)</enum><text display-inline="yes-display-inline">at risk of becoming orphaned wells;</text></subparagraph></paragraph><paragraph id="HC69EB1BAAD8F46A1BBE2C403BEE55EAB"><enum>(2)</enum><text>an estimate of the quantities of—</text><subparagraph id="H4594686900B94F1EBF1148EC7EB1E98F"><enum>(A)</enum><text display-inline="yes-display-inline">methane and other gasses emitted from orphaned wells; and</text></subparagraph><subparagraph id="H989499F0A08546AF862AC9EDE4D3D2DE"><enum>(B)</enum><text display-inline="yes-display-inline">emissions reduced as a result of plugging, remediating, and reclaiming orphaned wells;</text></subparagraph></paragraph><paragraph id="HFC0378F4DAC347CF9642831810FEE753"><enum>(3)</enum><text display-inline="yes-display-inline">the number of jobs created and saved through the plugging, remediation, and reclamation of orphaned wells; and</text></paragraph><paragraph id="H90673E49F4DF4BD287909AB1C54EF2B2"><enum>(4)</enum><text display-inline="yes-display-inline">the acreage of habitat restored using grants awarded to plug, remediate, and reclaim orphaned wells and to remediate or reclaim adjacent land, together with a description of the purposes for which that land is likely to be used in the future.</text></paragraph></subsection><subsection id="HD203D53A67B9475A99A40BAC04815903"><enum>(g)</enum><header>Effect of section</header><paragraph id="HD96084705DE24E4FA340F3198072A8CF"><enum>(1)</enum><header>No expansion of liability</header><text>Nothing in this section establishes or expands the responsibility or liability of any entity with respect to—</text><subparagraph id="id978CFF4F41FC467380793E3294F1F362"><enum>(A)</enum><text>plugging any well; or</text></subparagraph><subparagraph id="idC9C160FFB92B4AC7BC05FB675736EA8D"><enum>(B)</enum><text>remediating or reclaiming any well site.</text></subparagraph></paragraph><paragraph id="HAC84F1A00A0E4A1DAB7E42E0458775A3"><enum>(2)</enum><header>Tribal land</header><text display-inline="yes-display-inline">Nothing in this section—</text><subparagraph id="idF71111A9469B43A599ACBBE58E0CE079"><enum>(A)</enum><text display-inline="yes-display-inline">relieves the Secretary of any obligation under section 3 of the Act of May 11, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/396c">25 U.S.C. 396c</external-xref>; 52 Stat. 348, chapter 198), to plug, remediate, or reclaim an orphaned well located on Tribal land; or</text></subparagraph><subparagraph id="id88DF5900AB894CB98A7C8FF1C0236EF4"><enum>(B)</enum><text display-inline="yes-display-inline">absolves the United States from a responsibility to plug, remediate, or reclaim an orphaned well located on Tribal land or any other responsibility to an Indian Tribe, including any responsibility that derives from—</text><clause id="idF88265C5956240399DA57AA367D8204C"><enum>(i)</enum><text display-inline="yes-display-inline">the trust relationship between the United States and Indian Tribes;</text></clause><clause id="id62336FC5E6F1416081529F95F9E7753B"><enum>(ii)</enum><text display-inline="yes-display-inline">any treaty, law, or Executive order; or</text></clause><clause id="id5A4879072A1D44C2BF56DE571BBFC6B6"><enum>(iii)</enum><text display-inline="yes-display-inline">any agreement between the United States and an Indian Tribe.</text></clause></subparagraph></paragraph><paragraph id="HCD75C3F4FCDC4DF58E9EAE8D44E96553"><enum>(3)</enum><header>Owner or operator not absolved</header><text display-inline="yes-display-inline">Nothing in this section absolves the owner or operator of an oil or gas well of any potential liability for—</text><subparagraph id="id969ADB3A41F54FA99DFF8599FC634152"><enum>(A)</enum><text display-inline="yes-display-inline">reimbursement of any plugging or reclamation costs associated with the well; or</text></subparagraph><subparagraph id="id734D8D5BA0D54608B42D281B3C60CAF6"><enum>(B)</enum><text display-inline="yes-display-inline">any adverse effect of the well on the environment.</text></subparagraph></paragraph></subsection><subsection id="HF8292952FEC74FED814450993FAA356A"><enum>(h)</enum><header>Funding</header><paragraph id="id45807A19D44D4835AF763060EB08BA6F"><enum>(1)</enum><header>In general</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer the following amounts, to remain available until September 30, 2030:</text><subparagraph id="H431BDF0F83504F1B812728F463C2182D"><enum>(A)</enum><text>To the Secretary—</text><clause id="H9667063224954D2FAC3B8967188FAF4A"><enum>(i)</enum><text>$250,000,000 to carry out the program under subsection (b);</text></clause><clause id="HC7D63F9E128E495C81F91073E67E7F0B"><enum>(ii)</enum><text display-inline="yes-display-inline">$775,000,000 to provide grants under subsection (c)(3);</text></clause><clause id="H5E73F292736A4319B7B8B28092941FF9"><enum>(iii)</enum><text>$2,000,000,000 to provide grants under subsection (c)(4);</text></clause><clause id="ida7eb79b24c5c42c8870c1c51a0cde56f" commented="no"><enum>(iv)</enum><text>$1,500,000,000 to provide grants under subsection (c)(5); and </text></clause><clause id="H9E96910FC74A42E587A1C85CAF746503"><enum>(v)</enum><text>$150,000,000 to carry out the program under subsection (d).</text></clause></subparagraph><subparagraph id="HD3337BCA44E24FE8B7A220253CF6CEB5"><enum>(B)</enum><text>To the Secretary of Energy, $30,000,000 to conduct research and development activities in cooperation with the Interstate Oil and Gas Compact Commission to assist the Federal land management agencies, States, and Indian Tribes in—</text><clause id="id5B4CC26EE3074F6CA3B587C7E427D0F1"><enum>(i)</enum><text>identifying and characterizing undocumented orphaned wells; and</text></clause><clause id="idA584BB27E05E4C3AADFA5DF44863CE28"><enum>(ii)</enum><text>mitigating the environmental risks of undocumented orphaned wells.</text></clause></subparagraph><subparagraph id="HD5D6F15FF5B74F0DB3F74140248B5B20"><enum>(C)</enum><text>To the Interstate Oil and Gas Compact Commission, $2,000,000 to carry out this section.</text></subparagraph></paragraph><paragraph id="IDD175969DD23E48919CAB125FC34908A3"><enum>(2)</enum><header>Receipt and acceptance</header><text>The Secretary, the Secretary of Energy, and the Interstate Oil and Gas Compact Commission shall be entitled to receive, shall accept, and shall use to carry out this section the funds transferred under subparagraphs (A), (B), and (C), respectively, of paragraph (1), without further appropriation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
