which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Veterans Affairs to carry out a pilot program to provide pension claim enhancement assistance to individuals submitting claims for pension from the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body><section id="idBFF1BA13A19846D0ABE1FC90A4F4461D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Application Assistance Inefficiency Decrease Act of 2021</short-title></quote> or the <quote><short-title>VA AID Act of 2021</short-title></quote>.</text></section><section id="idd5b5c75097564629a74d6d96ed1d48e4"><enum>2.</enum><header>Pilot program to provide claim enhancement assistance to individuals submitting claims for Department of Veterans Affairs pension</header><subsection id="ide5fe23b58bdf4ebdb4bb6eca410c89e9"><enum>(a)</enum><header>Pilot program authorized</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall commence carrying out a pilot program to assess the feasibility and advisability of providing claim enhancement assistance to individuals applying for pension under subchapter II or III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/15">chapter 15</external-xref> of title 38, United States Code, in order to reduce the backlog of the Department of Veterans Affairs for claims for pension under such chapter and to expedite claims processing by—</text><paragraph id="idfbc82a9019dc471fa692a6be903549c0"><enum>(1)</enum><text>improving the efficiency of the claims submittal process; and</text></paragraph><paragraph id="iddfec315e9d46434fab50c184bab2089c"><enum>(2)</enum><text>proactively engaging claimants with claim enhancement services prior to submission of their claims.</text></paragraph></subsection><subsection id="id121B259A816A4DCF9FA6BCDA109BB4D1"><enum>(b)</enum><header>Claim enhancement assistance</header><text>For purposes of this subsection, claim enhancement assistance includes, with respect to submitting claims described in subsection (a), the following:</text><paragraph id="id96D4775901834379A89C3AE4012983A1"><enum>(1)</enum><text>Consultive services to assess and advise claimants based upon a review of each claimant's specific circumstances.</text></paragraph><paragraph id="id6C0B0F871DC84FD6B4959EEB3C31EC72"><enum>(2)</enum><text>Assistance in gathering all necessary supporting documentation for the submission.</text></paragraph><paragraph id="idA1CDB551453D46B08E92827CFC2FC3A5" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>The creation of a fully developed application ready to be submitted to the Pension Management Centers of the Department of Veterans Affairs with postal tracking.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idE5AD2DFFD9D94E4E883CC4F9A8127E14"><enum>(4)</enum><text>Such other assistance and services as the Secretary considers appropriate for purposes of the pilot program.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id7E524D011AE04E699281090C5EB94647"><enum>(c)</enum><header>Contract</header><text>The Secretary shall carry out the pilot program by entering into a contract with one eligible entity to provide, as part of the pilot program, claim enhancement assistance to individuals and spouses applying for pension under subchapter II or III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/15">chapter 15</external-xref> of title 38, United State Code.</text></subsection><subsection id="id7eb7fd76a2524c39a73f88d0d3e3653c"><enum>(d)</enum><header>Eligible entities</header><text>For purposes of this section, an eligible entity is any entity that—</text><paragraph id="iddbf5380ca58b492190939b5958804ddd"><enum>(1)</enum><text>is not part of the Department of Veterans Affairs;</text></paragraph><paragraph id="ide14cce4bd24b434c81e5761e1615053b"><enum>(2)</enum><text>specializes in matters relating to one specific benefit exclusively for five or more years that is provided under laws administered by the Secretary, such as pension under chapter 15 of such title;</text></paragraph><paragraph id="id0a74d76f04ca453c82a7d6017ac734b4"><enum>(3)</enum><text>does not engage in the promotion or sale of financial products of any type, including annuities;</text></paragraph><paragraph id="id849e272aa4c4441492a870c62f494ac4"><enum>(4)</enum><text>is not affiliated with any entity that is engaged in promotion or sale described in paragraph (3);</text></paragraph><paragraph id="id377a37ea06274d759a1963ce4cce73e4"><enum>(5)</enum><text>does not manage the assets of veterans or the survivors of veterans;</text></paragraph><paragraph id="id37c8080b16e44974961d5cb2d65410cc"><enum>(6)</enum><text>is not a fiduciary (as defined in section 5506 of such title) for any person submitting a claim for pension under chapter 15 of such title or in receipt of pension under such chapter;</text></paragraph><paragraph id="id582afbe728554bac9454b757ba0b9a48"><enum>(7)</enum><text>is not a fiduciary under section 5502 of such title;</text></paragraph><paragraph id="id6297e9d972a04530bd756e466c852dcf"><enum>(8)</enum><text>has at least one owner that is recognized by the Secretary under section 5904 of such title as an agent or attorney for the preparation, presentation, and prosecution of claims under laws administered by the Secretary; </text></paragraph><paragraph id="idc32953adc11b465eb53843ef6ced7c3a"><enum>(9)</enum><text>does not provide health care for a claimant receiving claim enhancement assistance from the entity as part of the pilot program; and</text></paragraph><paragraph id="id60b869ee80714678ae3c41bd6ee4c74b"><enum>(10)</enum><text>demonstrates to the Secretary that it has the ability to provide claim enhancement assistance in sufficient volume by having current systems, processes, and procedures in place that are of sufficient scale.</text></paragraph></subsection><subsection id="idb80abf16215641f9ab2c5fc88fba252f"><enum>(e)</enum><header>Duration</header><text>The Secretary shall carry out the pilot program during the three-year period beginning on the date of the commencement of the pilot program.</text></subsection><subsection id="id033435a2194c4e6ba9f494f81ed1f749"><enum>(f)</enum><header>Review, study, and report by Comptroller General of the United States</header><text>Not later than 90 days after the date of the completion of the pilot program, the Comptroller General of the United States shall—</text><paragraph id="idf58493cb298d46afa05d27857fdd2867"><enum>(1)</enum><text>complete a review of the pilot program;</text></paragraph><paragraph id="idd52566d7cdb945e687bbb312679c6006"><enum>(2)</enum><text>complete a study on the feasibility and advisability of permanently extending claim enhancement services to individuals and spouses applying for pension under subchapter II or III of chapter 15 of such title; and</text></paragraph><paragraph id="id1bef91b193154d99a9ad44ff55310428"><enum>(3)</enum><text>submit to Congress a report on the findings of the Comptroller General with respect to the review conducted under paragraph (1) and the study conducted under paragraph (2).</text></paragraph></subsection><subsection id="idDEA394F5323842418E1A9524C6C02430"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed—</text><paragraph id="id349E986313E14FB9848FF8064A169B3A"><enum>(1)</enum><text>to limit the right of a veteran to apply for pension under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/15">chapter 15</external-xref> of title 38, United States Code; or</text></paragraph><paragraph id="id50A8C9DB920643C4A0E834A11B136864"><enum>(2)</enum><text>to authorize the Secretary to limit such right.</text></paragraph></subsection></section></legis-body></bill>
