establish the National Institute of Manufacturing, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Institute of Manufacturing Act</short-title></quote>.</text></section><section id="id553F1F75EAE049CA8E3753962EAED566"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id95A38ADE76A14AC9ABD91591E32FA457"><enum>(1)</enum><header>Council</header><text>The term <term>Council</term> means the National Manufacturing Advisory Council established under section 4. </text></paragraph><paragraph id="id88F85ECFBDCC4DB9A3DECF4EE021DAAE"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Institute and the principal advisor to the Secretary regarding manufacturing issues. </text></paragraph><paragraph id="id6ac9ccab09d9499e87ab0c9c00cd0c07"><enum>(3)</enum><header>Institute</header><text>The term <term>Institute</term> means the National Institute of Manufacturing established under section 3. </text></paragraph><paragraph id="id4168F533E90C4BA0B1DF27B73CE45CCF"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="idB9D00C8B9CF1454D805B1C0DA616C741"><enum>(5)</enum><header>Secondary school</header><text>The term <term>secondary school</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="idb75ffd0ef91a48ac9c36fd9de7bdfe54"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce. </text></paragraph></section><section id="id696080F194B74636946FD2731F03A898"><enum>3.</enum><header>Establishment of National Institute of Manufacturing</header><subsection id="idfbeeadf24cba495cb61facf2841acf85"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department of Commerce an institute to be known as the <quote>National Institute of Manufacturing</quote>.</text></subsection><subsection id="id7e88bdf7aa974302a662af2f751798db"><enum>(b)</enum><header>Mission</header><text>The primary missions of the Institute are to—</text><paragraph id="id6031fb9dbecd490496ed5c65dd572a68"><enum>(1)</enum><text>ensure global leadership in advanced manufacturing technologies critical to the long-term economic and national security of the United States;</text></paragraph><paragraph id="id9173a7373ecf4ffabdafbe65db260265"><enum>(2)</enum><text>restore and strengthen the United States industrial commons, which includes the essential skills, equipment, and suppliers that provide the foundation for the innovativeness and competitiveness of all United States manufacturers;</text></paragraph><paragraph id="idc945c316851847db87f6c60f0220629c"><enum>(3)</enum><text>strengthen the technical, financial, and educational conditions and assets necessary to ensure that the United States is the best location for the creation and production of advanced technologies emerging from national research and development investments;</text></paragraph><paragraph id="idc57e831c87c24f13a1721a0bc608816b"><enum>(4)</enum><text>capitalize on the scientific and technological advances produced by researchers and innovators in the United States by developing capable and responsive institutions focused on advancing the technology and manufacturing readiness levels of those advances;</text></paragraph><paragraph id="id03b883547bb843df935042504e51c13e"><enum>(5)</enum><text>support the discovery, invention, scale-up, and transition of new products and manufacturing technologies to full-scale production in the United States;</text></paragraph><paragraph id="id5fedf99b537a48958ef43ab02f19b1c3"><enum>(6)</enum><text>address the evolving needs of manufacturers to find a diverse set of workers with the necessary skills, training, and expertise;</text></paragraph><paragraph id="id0757acc06dad4a2a980e96b594897662"><enum>(7)</enum><text>improve and expand manufacturing engineering and technology offerings within institutions of higher education and secondary schools to be more closely aligned with the needs of the United States manufacturing sector and the goal of strengthening the long-term competitiveness of United States manufacturing; and</text></paragraph><paragraph id="id38239f7ab8504677bd77418183981107"><enum>(8)</enum><text>work collaboratively with the private sector to leverage the knowledge, resources, and programs of the private sector to foster manufacturing in the United States and anticipate and prepare for emergencies and global, national, and regional supply chain disruptions.</text></paragraph></subsection><subsection id="idd9b9bace37184d6389c40089e7bc63a9"><enum>(c)</enum><header>Functions</header><text>In carrying out the purposes of this Act, the Institute shall—</text><paragraph id="id30026dee46524f229877a70ca97265f5"><enum>(1)</enum><text>convene key industry, academic, and other stakeholders to identify short-, medium-, and long-term needs and priorities of the manufacturing sector in the United States, including emergency readiness;</text></paragraph><paragraph id="idff3a52d46f354a9c991800de07604c6a"><enum>(2)</enum><text>monitor the status of technological developments, critical production capacity, skill availability, investment patterns, emerging defense needs, and other key indicators of manufacturing competitiveness, such as key indicators from manufacturing dealers, to guide investment decisions; </text></paragraph><paragraph id="id4dadbb96135041d3bed38e1aaae87628"><enum>(3)</enum><text>initiate and support discovery, invention, and translational research in engineering and manufacturing by making contracts or other arrangements, including grants, awards, cooperative agreements, loans, and other forms of assistance, to conduct that research and to assess the impact of that research on the economic well-being, climate, and national security of the United States;</text></paragraph><paragraph id="idf5c0ff7a2b864373a8b7ab0722123f15"><enum>(4)</enum><text>administer programs that incentivize and facilitate collaboration among private and public sector stakeholders in United States manufacturing;</text></paragraph><paragraph id="idbc52271fbbea4d5b8bc4143444f4a81b"><enum>(5)</enum><text>award scholarships and graduate fellowships in the engineering and manufacturing disciplines;</text></paragraph><paragraph id="idb780a0720c62405b9791283e8b6a650c"><enum>(6)</enum><text>award industrial, academic, and governmental fellowships to faculty and retired manufacturing experts to support the manufacturing interests of the United States;</text></paragraph><paragraph id="id50de6169ae8c4edaa526380abbba03fb"><enum>(7)</enum><text>advise United States manufacturers on international trade and investment policies in international markets and advise the Federal Government on how to expand business opportunities for United States manufacturers in international markets;</text></paragraph><paragraph id="id846725bf41e14836ac3638703447778d"><enum>(8)</enum><text>develop and assess key indicators of manufacturing competitiveness, including the geographic diversity of manufacturing in the United States, and provide interpretation and analysis of collected data on the manufacturing sector in the United States; </text></paragraph><paragraph id="id43fb12da3b754936a2533a1eff7f01b4"><enum>(9)</enum><text>provide small and medium manufacturers, including new startups, with financial support, including loans, counseling, training, technical assistance, and advocacy; and</text></paragraph><paragraph id="id243f0c24a1844867aba356f6aac14bf0"><enum>(10)</enum><text>identify opportunities to achieve commercial-scale production of emerging technologies by leveraging government procurement contracts.</text></paragraph></subsection><subsection id="id07364390dba64c7ca8c4b8f028f0f76a"><enum>(d)</enum><header>Director</header><paragraph id="idb309c6ec7c414582b32d0482b1c866c4"><enum>(1)</enum><header>In general</header><text>There shall be a Director of the Institute, who shall—</text><subparagraph id="ida3c7210b3bd24520b0beaab9b6bf5b82"><enum>(A)</enum><text>be appointed by the President, by and with the consent of the Senate;</text></subparagraph><subparagraph id="id7609fc860a76408ea4c59aa84cbad7f9"><enum>(B)</enum><text>oversee all Institute activities;</text></subparagraph><subparagraph id="idA20C741D45CD4CC68FDF08A0989CDB07"><enum>(C)</enum><text>serve as an ex-officio member of the Council;</text></subparagraph><subparagraph id="idd1a1e481266b4a4598fd7cf9bbf7c87c"><enum>(D)</enum><text>make recommendations regarding, and manage, the budget of the Institute; and</text></subparagraph><subparagraph id="id5DB4285E9B124EF29FE63ED93D382D9D"><enum>(E)</enum><text>advise and consult with the Secretary on all policy issues relating to manufacturing.</text></subparagraph></paragraph><paragraph id="id0ba4c35cb5aa42f8829f02627d1174df"><enum>(2)</enum><header>Exercise of authority of the National Institute of Manufacturing</header><subparagraph id="id0a5fb090911a416aa7289f35efadad86"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided, the Director shall exercise all of the authority granted to the Institute under this Act, including any powers and functions that may be delegated to the Director by the Secretary.</text></subparagraph><subparagraph id="id4414c020b1144825b7742fe7f50300c5"><enum>(B)</enum><header>Final actions</header><text>All actions taken by the Director under this Act, or under the terms of a delegation described in subparagraph (A), shall be final and binding upon the Institute.</text></subparagraph></paragraph><paragraph id="id9869DE1C383B497BA554BF6689887C28"><enum>(3)</enum><header>Duties as Director</header><text>The Director shall—</text><subparagraph id="idbe304b09bb3c407d89d34c6d74f1cc2e"><enum>(A)</enum><text>coordinate all activities within the Department of Commerce relating to manufacturing and advise and consult with the Secretary on all policy issues relating to manufacturing;</text></subparagraph><subparagraph id="id59eb93c606f648a0b949140d1189b600"><enum>(B)</enum><text>advise and consult with the Secretary on the national security supply chain;</text></subparagraph><subparagraph id="id8f99df6f24734487861d1d2a4c78d66d"><enum>(C)</enum><text>monitor the status of technological developments, critical production capacity, skill availability, investment patterns, emerging defense needs, and other key indicators of manufacturing competitiveness to coordinate with the Chief Financial Officer and Assistant Secretary for Administration of the Department of Commerce in developing the annual budgets for manufacturing-related programs of the Department of Commerce;</text></subparagraph><subparagraph id="id17d56061fe8248efb34d125f42e9ea8d"><enum>(D)</enum><text>oversee and convene the Council; and</text></subparagraph><subparagraph id="id5c323ed60e594a6d9f03a1fb55830640"><enum>(E)</enum><text>solicit input from the public and private sectors and academia regarding emerging trends in manufacturing and the responsiveness of Federal programming.</text></subparagraph></paragraph><paragraph id="id0b73403f43cd4ed3a6bf9eeea492f5d7"><enum>(4)</enum><header>Term</header><text>The Director shall serve for a term of 6 years, unless removed earlier by the President.</text></paragraph></subsection><subsection id="idcef6efe4cf0748e5889369527984e8f0"><enum>(e)</enum><header>Directorates</header><text>Unless otherwise provided by the Director, there shall be within the Institute the following Directorates:</text><paragraph id="id053d8f75e2ea48daac4c0682fe950e28"><enum>(1)</enum><text>A Directorate for Technology Development, which shall—</text><subparagraph id="id810ba320788c49d2908c88cb666fad17"><enum>(A)</enum><text>make competitive awards to support discovery, invention, and translational research in the fields of engineering and manufacturing;</text></subparagraph><subparagraph id="id15d06c93521642d89236627f0d52f2b4"><enum>(B)</enum><text>conduct prize competitions in accordance with section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) to stimulate innovation that has the potential to advance manufacturing technology;</text></subparagraph><subparagraph id="idC809B07EA66E47E6966CAAF5D1A233A1"><enum>(C)</enum><text>administer a pilot program establishing translational research centers associated with institutions of higher education, which will guide and fund research needed to translate laboratory results to testable beta prototypes and facilitate connections with domestic manufacturers to scale domestic production; and</text></subparagraph><subparagraph id="id9DA4251EFAD94FA89917757E4E76FB55"><enum>(D)</enum><text>administer other programs and activities that promote technology development.</text></subparagraph></paragraph><paragraph id="id54c4cbd0a686463fa8db9191fa510e51"><enum>(2)</enum><text>A Directorate for the Industrial Commons, which shall—</text><subparagraph id="id0757fbeb2d534dfea40f8e25f0484563"><enum>(A)</enum><text>administer the Investing in Manufacturing Communities Partnership;</text></subparagraph><subparagraph id="id02905a16edeb44509ed154f3f1210875"><enum>(B)</enum><text>administer the Manufacturing USA Program established under section 34 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s</external-xref>); and</text></subparagraph><subparagraph id="iddd55f9fb5a37400292b5a622f6d02bda"><enum>(C)</enum><text>administer other programs and activities that promote robust manufacturing innovation ecosystems and support manufacturing supply chains in the United States during emergencies.</text></subparagraph></paragraph><paragraph id="id09ba8e7b197f495ba3f786ff21b0fc12"><enum>(3)</enum><text>A Directorate for Education and Workforce Development, which shall—</text><subparagraph id="idf59e440c475741deb8ad8cd63c59ea4a"><enum>(A)</enum><text>make competitive awards for scholarships and graduate fellowships;</text></subparagraph><subparagraph id="ide0235f8673c44cb1b48d2e7f01c71742"><enum>(B)</enum><text>make competitive awards for industrial, academic, and governmental fellowships to faculty and retired manufacturing experts;</text></subparagraph><subparagraph id="iddec398b3c2004c8eb1194488bcccc73d"><enum>(C)</enum><text>make competitive awards for research, development, and evaluation of innovative training programs; and</text></subparagraph><subparagraph id="idB9705B9412284158BD04A67C8BBF7DDE"><enum>(D)</enum><text>administer programs and activities that promote the short-term and long-term workforce and education needs of the manufacturing sector.</text></subparagraph></paragraph><paragraph id="id9dd389cdd11a45e4a5e4a93e97f02ebc"><enum>(4)</enum><text>A Directorate for Small and Medium Manufacturers, which shall—</text><subparagraph id="idd4d208050231481f8bda2d97e1ef3246"><enum>(A)</enum><text>administer programs for loans, investment capital, and surety bonds for small and medium manufacturing firms;</text></subparagraph><subparagraph id="id0bf21c7020804438bd92b9a0861b3978"><enum>(B)</enum><text>administer the Hollings Manufacturing Extension Partnership Program established under 25 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k</external-xref>); and</text></subparagraph><subparagraph id="id3EF532D1DF834E77AC7DF984BD057EB2"><enum>(C)</enum><text>administer other programs and activities that help small and medium manufacturers prosper.</text></subparagraph></paragraph><paragraph id="idf765a631d7f9404ebfb138eb69a23c46"><enum>(5)</enum><text>A Directorate on Trade, which shall—</text><subparagraph id="id137BAE102DF8458D99873DC60479BB5C"><enum>(A)</enum><text>manage and oversee an Office of Manufacturer Trade, which shall—</text><clause id="idAD42E3DF12744FBEB4850EBC42FEF7D8"><enum>(i)</enum><text>advise manufacturers in the United States on trade;</text></clause><clause id="id5A8C643F728446C4A466AE73A6F88D55"><enum>(ii)</enum><text>advise the United States Trade Representative, the Undersecretary of Commerce for International Trade, and other entities in the Federal Government on trade to benefit manufacturers in the United States;</text></clause><clause id="idf9e0c175cfb34e259d4baeea6bd67e65"><enum>(iii)</enum><text>receive and solicit recommendations and feedback from manufacturers in the United States; and</text></clause><clause id="id4F2B07CA1B5B4FB1BCDF78265EF68D0C"><enum>(iv)</enum><text>appoint an employee of the Office to serve as a liaison between—</text><subclause id="idCD720E78399843D8B40AAC06B13F2DBC"><enum>(I)</enum><text>the Office; and</text></subclause><subclause id="idC4F394E966504B6E99A75021DFEE1D09"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id0E2354F5AD3A4D9BBF95FFECC3048812"><enum>(aa)</enum><text>the United States Trade Representative; and</text></item><item id="id2707BAE0F94441788E391C5A35A63C19" indent="up1"><enum>(bb)</enum><text>the Industry Trade Advisory Committees on Aerospace Equipment, Automotive Equipment and Capital Goods, and Steel; and</text></item></subclause></clause></subparagraph><subparagraph id="idae9f86032cda4ff7a8ec04cc4adf9f55"><enum>(B)</enum><text>manage and oversee a United States Manufacturer Trade Council, which shall—</text><clause id="id61D51B64F701440C82B6C02836A5BD8A"><enum>(i)</enum><text>receive and solicit recommendations and feedback from manufacturers in the United States; and</text></clause><clause id="idEEE35F969EB14265A00F95FD1CE854C5"><enum>(ii)</enum><text>in addition to voting members, be composed of ex-officio members of the Industry Trade Advisory Committees described in subparagraph (A)(iv)(II)(bb).</text></clause></subparagraph></paragraph></subsection><subsection id="idbe0e295a6cc64c9c9d01325c299aa222"><enum>(f)</enum><header>Authorities</header><text>In carrying out the duties of the Director under this Act, the Director may—</text><paragraph id="id7887872dc54447578ae4569247e8355a"><enum>(1)</enum><text>appoint or create such advisory committees as may be appropriate for purposes of consultation and advice to the Institute in the performance of the functions of the Institute;</text></paragraph><paragraph id="ide5ad92393b87461ebfe355d69bf45afd"><enum>(2)</enum><text>issue rules governing the manner of operations of the Institute;</text></paragraph><paragraph id="idc6a44ab9cb7144e9836eb3d6de26ffb0"><enum>(3)</enum><text>make expenditures necessary for administering the provisions in this Act;</text></paragraph><paragraph id="idbc581f7c947d4d099d0aa1d4662b368c"><enum>(4)</enum><text>enter into contracts or other arrangements with organizations and individuals in the United States and foreign countries as the Director determines necessary to carry out the functions of the Institute;</text></paragraph><paragraph id="idc3614177310e4a2c9b155e99ac25f5cb"><enum>(5)</enum><text>award scholarships and fellowships to citizens of the United States for the purpose of study or scientific work in manufacturing;</text></paragraph><paragraph id="id8abe4caeb0f14de1b7b21efe40c61e0c"><enum>(6)</enum><text>acquire, construct, hold, and dispose of real and personal property as the Director determines necessary; and</text></paragraph><paragraph id="idf1ef1955674f4dc5bb8e75e8d4639e30"><enum>(7)</enum><text>accept unconditional gifts or donations of services, money, or property. </text></paragraph></subsection><subsection id="idbabf5edd05444d7abafdc1d1e18b34dd"><enum>(g)</enum><header>Advisory committees</header><text>The Institute shall manage and oversee the following advisory committees:</text><paragraph commented="no" id="idc9b3204fc48b417084000819b24f62e8"><enum>(1)</enum><text>The Council.</text></paragraph><paragraph id="idd4fdd0f4719649cebf5b6a41b1e05f65"><enum>(2)</enum><text>The Manufacturing Extension Partnership Advisory Board established under section 25(m) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(m)</external-xref>).</text></paragraph><paragraph id="ida97adbeb5a21475c99d675919db85982"><enum>(3)</enum><text>The Materials Processing Equipment Technical Advisory Committee.</text></paragraph></subsection><subsection id="id65d9f458f7c041d69247c0fc846d7673"><enum>(h)</enum><header>Patent rights</header><paragraph id="idc21c9c093561428c8778ca4953806432"><enum>(1)</enum><header>In general</header><text>Each contract entered into by the Director shall contain provisions governing the disposition of inventions produced under the contract.</text></paragraph><paragraph id="id3d012587cbeb433ebe11e2b788dc7406"><enum>(2)</enum><header>Prohibition</header><text>No officer or employee of the Institute may acquire or transfer any rights under the patent laws of the United States for any invention achieved in performing the assigned activities of the officer or employee.</text></paragraph></subsection><subsection id="id4B0FFD93EA4E47D8B9294FA8BA47DB0B"><enum>(i)</enum><header>Transfer of functions and technical and conforming amendments</header><paragraph id="id5C4EEEC999E543259C96B094C72307B5"><enum>(1)</enum><header>Investing in Manufacturing Communities Partnership</header><subparagraph id="ida68d8552eb1247ed81b03fc07eb8b901"><enum>(A)</enum><header>Transfer of functions</header><text>All functions of the Investing in Manufacturing Communities Partnership of the Department of Commerce, including the personnel, assets, and obligations of the Investing in Manufacturing Communities Partnership of the Department of Commerce, as in existence on the day before the date of enactment of this Act, shall be transferred to the Institute.</text></subparagraph><subparagraph id="idf0554a8795644639a9039167fc23635a"><enum>(B)</enum><header>Deeming of name</header><text>Any reference in any law, regulation, document, paper, or other record of the United States to the Investing in Manufacturing Communities Partnership of the Department of Commerce shall be deemed a reference to the Investing in Manufacturing Communities Partnership of the Institute.</text></subparagraph><subparagraph id="id4f9269573ac544c48843ec574a266248"><enum>(C)</enum><header>Unexpended balances</header><text>Unexpended balances of appropriations, authorization, allocations, or other funds related to the Investing in Manufacturing Communities Partnership of the Department of Commerce shall be available for use by the Institute for purposes for which the appropriations, authorizations, allocations, or other funds were originally made available.</text></subparagraph></paragraph><paragraph commented="no" id="idFBC309F997FF44BBB48E09266F4D1AC7"><enum>(2)</enum><header>Manufacturing USA Program</header><subparagraph id="id8C9AD9BF66B94A3DA22A1DAC629E3205"><enum>(A)</enum><header>Transfer of functions</header><text>All functions of the Manufacturing USA Program carried out by the National Office of the Manufacturing USA Network of the National Institute of Standards and Technology, including the personnel, assets, and obligations carried out by that National Office, as in existence on the day before the date of enactment of this Act, shall be transferred to the Directorate for the Industrial Commons of the Institute.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF61613D41C894271A5942ED6365860BB"><enum>(B)</enum><header>Deeming of name</header><text>Any reference in any law, regulation, document, paper, or other record of the United States to the Manufacturing USA Program carried out by the National Office of the Manufacturing USA Network of the National Institute of Standards and Technology shall be deemed a reference to the Manufacturing USA Program carried out by the Directorate for the Industrial Commons of the Institute.</text></subparagraph><subparagraph Manufacturing USA Program carried out by the National Office of the Manufacturing USA Network of the National Institute of Standards and Technology shall be available for use by the Institute for purposes for which the appropriations, authorizations, allocations, or other funds were originally made available.</text></subparagraph><subparagraph id="id3D3A0575B99644E199CE718D1327B4FF"><enum>(D)</enum><header>Technical and conforming amendments</header><text>Section 34 of the National Institute of Standards and Technology Act (<external-xref innovation</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to affect, or require the transfer to the Institute of, any Federal financial assistance that is provided to a center for manufacturing innovation by any Federal entity other than the Institute under the Manufacturing USA Program carried out by the National Office of the Manufacturing USA Network of the National Institute of Standards and Technology.</text></subparagraph></paragraph><paragraph id="id3C397DEB30EE4CAAAD3EB4A9BD1A95FE"><enum>(3)</enum><header>Hollings Manufacturing Extension Partnership Program</header><subparagraph id="id1DE617C8D47E4098A7534EFF885BAE9C"><enum>(A)</enum><header>Transfer of functions</header><text>All functions of the Hollings Manufacturing Extension Partnership Program of the National Institute of Standards and Technology, including the personnel, assets, and obligations of the Hollings Manufacturing Extension Partnership Program of the National Institute of Standards and Technology, as in existence on the day before the date of enactment of this Act, shall be transferred to the Directorate for Small and Medium Manufacturers of the Institute.</text></subparagraph><subparagraph id="idE154D352DEC14FF18DA37AD41A0401A1"><enum>(B)</enum><header>Deeming of name</header><text>Any reference in any law, regulation, document, paper, or Security of the Department of Commerce, as in existence on the day before the date of enactment of this Act, shall be transferred to the Institute.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF1DE56C6F8F845F6B28BD661B4D53495"><enum>(B)</enum><header>Deeming of name</header><text>Any reference in any law, regulation, document, paper, or other record of the United States to the Materials Processing Equipment Technical Advisory Committee of the Bureau of Industry and Security of the Department of Commerce shall be deemed a reference to the Materials Processing Equipment Technical Advisory Committee of the Institute.</text></subparagraph><subparagraph id="idD2094F596AD54B2183598EDAD0B0DE08"><enum>(C)</enum><header>Unexpended balances</header><text>Unexpended balances of appropriations, authorization, allocations, or other funds related to the Materials Processing Equipment Technical Advisory Committee of the Bureau of Industry and Security of the Department of Commerce shall be available for use by the Institute for purposes for which the appropriations, authorizations, allocations, or other funds were originally made available.</text></subparagraph></paragraph></subsection><subsection id="idB4208881FB0A4134876BC2304D689C4A"><enum>(j)</enum><header>Transitional provisions</header><paragraph id="idB9E38FD712E44014A2F3EFBF00F175EA"><enum>(1)</enum><header>Transitional authorities</header><subparagraph id="idb1b73bbb06044a1e95da621cd6679a70"><enum>(A)</enum><header>Provision of assistance by officials</header><text>Until the date of the transfer of an entity to the Institute or a component of the Institute under subsection (i), any official having authority over the entity, or functions relating to the entity, as of the day before the date of enactment of this Act shall provide to the Director such assistance, including the use of personnel and assets, as the Director may request in preparing for the transfer and integration of the entity into the Institute or a component of the Institute.</text></subparagraph><subparagraph id="ida267a756224449cd9697c0f9dd4600be"><enum>(B)</enum><header>Services and personnel</header><text>During the 1-year period beginning on the date of enactment of this Act, upon the request of the Secretary, the head of any executive agency may, on a reimbursable basis, provide services or detail personnel to assist with the transfer of an entity to the Institute or a component of the Institute under subsection (i).</text></subparagraph></paragraph><paragraph id="id5973bd568fd946c3a8bdd10e080b103c"><enum>(2)</enum><header>Incidental transfers</header><text>The Director of the Office of Management and Budget, in consultation with the Director, shall make such additional incidental dispositions of personnel, assets, and liabilities held, used, arising from, available, or to be made available, in connection with the functions transferred under subsection (i), as the Director of the Office of Management and Budget may determine necessary to accomplish the purposes of this Act.</text></paragraph></subsection></section><section id="idcb44124cdfc24139828cb55da98719e8"><enum>4.</enum><header>National Manufacturing Advisory Council</header><subsection id="idfc286bb6a64d4bc0a653fa08d807f557"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department of Commerce the <quote>National Manufacturing Advisory Council</quote>.</text></subsection><subsection id="idbbd0a4d58f784d93bb27efd86d5da03d"><enum>(b)</enum><header>Mission</header><text>The mission of the Council shall be to—</text><paragraph id="id10178ee9f3c24862adeacd4bea698b6d"><enum>(1)</enum><text>ensure regular communication between the Federal Government and the manufacturing sector in the United States;</text></paragraph><paragraph id="id3654213f1fe848e3b5e43a0f8c5e4bff"><enum>(2)</enum><text>advise the Secretary on government policies and government programs that affect United States manufacturing and provide a forum for discussing and proposing solutions to industry-related problems; and</text></paragraph><paragraph id="ide3c41af940e1405f8e66a30495ce426d"><enum>(3)</enum><text>ensure that the United States remains the preeminent destination for investment in manufacturing throughout the world.</text></paragraph></subsection><subsection id="idb7017d4e28c14aafabee9bf14c536854"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Council shall include—</text><paragraph id="ida371330b3f6741f7b1859d5a58ae019f"><enum>(1)</enum><text>meeting from time to time to provide independent advice and recommendations to the Secretary regarding issues involving United States manufacturing;</text></paragraph><paragraph id="id9C88352D0D454451BD2DA7F9F65DE47A"><enum>(2)</enum><text>completing specific tasks requested by the Director or the Secretary;</text></paragraph><paragraph id="id187a821f32fa41598df73b17251a13a4"><enum>(3)</enum><text>monitoring the status of technological developments, critical production capacity, skill availability, investment patterns, emerging defense needs, and other key indicators of manufacturing competitiveness;</text></paragraph><paragraph id="id96504c332845402dadb2571db47b3135"><enum>(4)</enum><text>soliciting input from the public and private sector and academia regarding emerging trends in manufacturing, the responsiveness of Federal programming, and suggestions for areas of increased Federal attention;</text></paragraph><paragraph id="id4c695cf5d8f944aeadcfc8f117a87f98"><enum>(5)</enum><text>monitoring global manufacturing trends and global threats to manufacturing sectors in the United States;</text></paragraph><paragraph id="id0914c43d75d5467095632dbf15b6b4bc"><enum>(6)</enum><text>providing input on providing Federal assistance for manufacturers relating to—</text><subparagraph id="id91869eb3765d4fe381f1c2aa925f68f3"><enum>(A)</enum><text>international trade and investment matters;</text></subparagraph><subparagraph id="idb165ab89a04e46e59a3c6866998868a5"><enum>(B)</enum><text>research and technology development opportunities;</text></subparagraph><subparagraph id="idc410676660df458ba585dd1912fda79d"><enum>(C)</enum><text>workforce development and training programs and opportunities;</text></subparagraph><subparagraph id="id307571d92f96403d9fbdc25b7e37b2b7"><enum>(D)</enum><text>small and medium manufacturer needs; and</text></subparagraph><subparagraph id="idb91a0a4a5be340e9bc6db6e53a0408f7"><enum>(E)</enum><text>industrial commons and supply chains needs.</text></subparagraph></paragraph></subsection><subsection id="id424e9c8f482b49c8bdfa18e91f4da852"><enum>(d)</enum><header>Charter</header><text>The Council shall develop a charter to govern the structure and mission of the Council.</text></subsection><subsection id="id89b0ab282b7646a19c29ff023c349f08"><enum>(e)</enum><header>Membership</header><paragraph id="id051119bb033f49ec86d6fbe0237c80bd"><enum>(1)</enum><header>In general</header><text>The Council shall—</text><subparagraph id="id1BD30D375B05432CA5F74AEAE8ED032B"><enum>(A)</enum><text>consist of individuals with a balance of backgrounds, experiences, and viewpoints; and</text></subparagraph><subparagraph id="idADEF14C1FFE44B638FD72CC013B2A463"><enum>(B)</enum><text>include individuals that directly represent private industry, academia, and labor.</text></subparagraph></paragraph><paragraph id="id1b175dddffe74c7c848f0148d7903ebd"><enum>(2)</enum><header>Public participation</header><text>The nomination process for membership on the Council shall include a public nomination process to the maximum extent practicable.</text></paragraph></subsection><subsection id="id62638ae029fe4444b903757674ba76e4"><enum>(f)</enum><header>Transfer of functions</header><paragraph id="id5A3BA319974348E3980513246850F981"><enum>(1)</enum><header>Transfer of functions</header><text display-inline="yes-display-inline">All functions of the Manufacturing Council of the International Trade Administration of the Department of Commerce, including the personnel, assets, and obligations of the United States Manufacturing Council of the International Trade Administration of the Department of Commerce, as in existence on the day before the date of enactment of this Act, shall be transferred to the Institute.</text></paragraph><paragraph id="id9a2b7140f4774bf8bb27c458c312b2f9"><enum>(2)</enum><header>Deeming of name</header><text>Any reference in law, regulation, document, paper, or other record of the United States to the Manufacturing Council of the International Trade Administration of the Department of Commerce shall be deemed a reference to the National Manufacturing Advisory Council.</text></paragraph><paragraph id="idfae0d99170624f349db8c0eac1e59200"><enum>(3)</enum><header>Unexpended balances</header><text>Unexpended balances of appropriations, authorization, allocations, or other funds related to the Manufacturing Council of the International Trade Administration of the Department of Commerce shall be available for use by the Director for which the appropriations, authorizations, allocations, or other funds were originally made available. </text></paragraph></subsection><subsection commented="no" id="id7B63E010960E401B88DB085654EF6D15"><enum>(g)</enum><header>Permanent authority</header><text>Notwithstanding <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /14">section 14</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.), the Council shall be a permanent authority.</text></subsection></section><section commented="no" id="id996781D950624ED084E58EA21FF345A7"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Institute such sums as may be necessary to carry out this Act.<italic></italic></text></section></legis-body></bill>
