which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase collaboration between offices within the Department of Energy to develop and deploy technology to assist the mission of the Office of Environmental Management. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmental Management Liability Reduction and Technology Development Act of 2021</short-title></quote>.</text></section><section id="id8BC4745E11F84D2AAFE56D46A0C03913"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish programs—</text><paragraph id="idC763AF955FF64BBF864099132EB6E13E"><enum>(1)</enum><text>to develop and deploy technologies in a timely manner to better fulfill the mission of the Office of Environmental Management of the Department of Energy;</text></paragraph><paragraph id="id972fb0a8a28641389cae73917aef9f38"><enum>(2)</enum><text>to coordinate available technologies with remediation projects to enable the start, and cost-efficient and economical completion, of remediation projects;</text></paragraph><paragraph id="idD51659128D49407D8C70FD6BF042BD34"><enum>(3)</enum><text>to establish a consistent process for technology development to achieve long-term solutions rather than developing technologies to address 1 phase of a project at a time, which potentially increases the long-term cleanup costs;</text></paragraph><paragraph id="id57B938E4D1274AACA8828BBF18784BC4"><enum>(4)</enum><text>to reduce aggregate cost, better protect workers, and complete the mission more effectively and safely; and</text></paragraph><paragraph id="id70B93C8C973F468FB3F6320B8E7D89C5"><enum>(5)</enum><text>to develop new technology and to train a skilled workforce to enable the Secretary of Energy to address the significant challenges the Department faces.</text></paragraph></section><section id="idBF2609974DA84441940350904A8EEBEB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id59F75695B6994AFE9E397D69EF6D0218"><enum>(1)</enum><header>Complex</header><text>The term <term>complex</term> means all sites managed in whole or in part by the Office.</text></paragraph><paragraph id="id295F34C8537140C28485F51CEC73E9C2"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text></paragraph><paragraph id="id73A4AFA0634C4F469DF16AD24EADB3C4"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="id7D6BEEE5242A40C48FF457ABBF8EA470"><enum>(4)</enum><header>Mission</header><text>The term <term>mission</term> means the mission of the Office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98E6438C5D8942F49E3F464A7FD4D82C"><enum>(5)</enum><header display-inline="yes-display-inline">National Laboratory</header><text display-inline="yes-display-inline">The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="idC2CC88763E4C40CF941167275A52CB89"><enum>(6)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Environmental Management of the Department.</text></paragraph><paragraph id="id9EFF4C84FABC4031AFB4526680223FFC"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy, acting through the Assistant Secretary for Environmental Management.</text></paragraph><paragraph commented="no" id="id2FB56816DA014F7DAC4D588EE468D397"><enum>(8)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></section><section commented="no" id="id0E52642931144D7093215AA2C404E395"><enum>4.</enum><header>Independent assessment and management</header><subsection id="ida8e1bb6a1ced4d76a4a9c232b26bee67"><enum>(a)</enum><header>Independent assessment</header><paragraph id="id0a181a7d92a54bfe9edfb13ddd8f306e"><enum>(1)</enum><header>In general</header><text>The Secretary shall obtain from the Corps of Engineers an independent assessment of the lifecycle costs and schedules of the cleanup programs of the Office.</text></paragraph><paragraph id="idc13004811de64dbfac38753861acdb3e"><enum>(2)</enum><header>Focus of assessment</header><text>The assessment under paragraph (1) shall be focused on identifying key remaining technical risks and uncertainties of the cleanup programs.</text></paragraph><paragraph id="idc492a6c1c44e40cbb72ba987c1929f68"><enum>(3)</enum><header>Use of assessment</header><text>The Office shall use the assessment under paragraph (1)—</text><subparagraph id="id71b8a1bab041412cade60c6dbd192638"><enum>(A)</enum><text>to reevaluate the major cleanup challenges faced by the Office, including the timeline and costs associated with addressing those challenges with existing science and technology investments;</text></subparagraph><subparagraph id="id1db8e80ba7594c5baf30aaf0c90cb720"><enum>(B)</enum><text>to make any adjustments to the science and technology development program of the Office that are necessary to address those major cleanup challenges;</text></subparagraph><subparagraph id="id365acb9a42f548e59a9a4bee67a2fef7"><enum>(C)</enum><text>to evaluate potential savings from the development of new technologies over the life of the cleanup programs of the Office; and</text></subparagraph><subparagraph id="idd32ef0095b49435cbd6b13e1db6096fa"><enum>(D)</enum><text>to provide recommendations to Congress with respect to the annual funding levels for the Incremental Technology Development Program established under section 5(a), the High-Impact Technology Development Program established under section 6(a), and the Fundamental Research Program established under section 7(a) that will ensure maximum cost-savings over the life of the cleanup programs of the Office.</text></subparagraph></paragraph><paragraph id="idb5680b75ed3f474fafb4613fb5a0f081"><enum>(4)</enum><header>No effect on program implementation</header><text>Nothing in this subsection affects the establishment, implementation, or carrying out of any project or program under any other provision of law, including this Act, during the time period in which the assessment under paragraph (1) is carried out.</text></paragraph></subsection><subsection id="id406b8981fd164f30b850588ee603d16b"><enum>(b)</enum><header>Management process</header><text>The Secretary shall design and implement a science and technology management process for identifying, prioritizing, selecting, developing, and deploying the new knowledge and technologies needed to address the cleanup challenges faced by the Office, including the technical risks and uncertainties identified by the assessment under subsection (a).</text></subsection><subsection id="id829776634b2e4d4d925e6dbde0538300"><enum>(c)</enum><header>Peer review</header><text>The Secretary shall use independent peer review to evaluate—</text><paragraph id="id65739791e5df4142ba119b320537f478"><enum>(1)</enum><text>the science and technology management process designed under subsection (b) before that process is implemented;</text></paragraph><paragraph id="idd9418834d2bb4c4197af2b2b906a21e4"><enum>(2)</enum><text>any science and technology projects before those projects are funded; and</text></paragraph><paragraph id="id0ea74986f8b84cf7a0077e7df99d5316"><enum>(3)</enum><text>the overall effectiveness and impact of the science and technology efforts of the Office.</text></paragraph></subsection></section><section id="id3EE2A908C12748AD85A915B5397AE587"><enum>5.</enum><header>Incremental Technology Development Program</header><subsection id="id14E479E7497041FA9A1B642268AE2E52"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program, to be known as the <quote>Incremental Technology Development Program</quote> (referred to in this section as the <quote>program</quote>), to improve the efficiency and effectiveness of the cleanup processes of the Office.</text></subsection><subsection id="id886D8207CF7D4E45BF3BE3462124F613"><enum>(b)</enum><header>Focus</header><paragraph id="idE49CB296093341779EC807DE433B16A4"><enum>(1)</enum><header>In general</header><text>The program shall focus on the continuous improvement of new or available technologies for—</text><subparagraph id="id5CAA7CBDF1CC45549D9BE9B23AD97C9C"><enum>(A)</enum><text>decontamination chemicals and techniques;</text></subparagraph><subparagraph id="ideb854431bdae4133aacb86f5c375ba4d"><enum>(B)</enum><text>remote sensing and wireless communication to reduce manpower and laboratory efforts;</text></subparagraph><subparagraph id="idDAE30D4EB8BC4075A0CAF961BB316DE3"><enum>(C)</enum><text>detection, assay, and certification instrumentation;</text></subparagraph><subparagraph id="id1DDFE898BBBA40FEAAA5D40BB5BC061B"><enum>(D)</enum><text>packaging materials, methods, and shipping systems; and</text></subparagraph><subparagraph id="idD9C22C76414F49ED8DC5D168B6F902A4"><enum>(E)</enum><text>improving the overall efficiency and effectiveness of the Office.</text></subparagraph></paragraph><paragraph id="idC7C8CEAEBD2148A48B29288F43BFF601"><enum>(2)</enum><header>Other areas</header><text>The program may include mission-relevant development, demonstration, and deployment activities unrelated to the focus areas described in paragraph (1).</text></paragraph></subsection><subsection id="ida0e451a16272496893741bf4619eccec"><enum>(c)</enum><header>Use of new and emerging technologies</header><paragraph id="idC194571B60944DDF8B4D17B03431551B"><enum>(1)</enum><header>In general</header><text>In carrying out the program, the Secretary shall ensure that site offices of the Office conduct technology development and demonstration of new and emerging technologies to establish a sound technical basis for the selection of technologies for cleanup or infrastructure operations.</text></paragraph><paragraph id="id43142eb69f894784be03460b0ec620f0"><enum>(2)</enum><header>Collaboration required</header><text>The Secretary shall collaborate with the heads of other Federal agencies, the National Laboratories, other Federal laboratories, appropriate State regulators and agencies, and the Department of Labor in the development, demonstration, and deployment of new technologies under the program.</text></paragraph></subsection><subsection id="id239002aeb63e44519e831a4bb78843dd"><enum>(d)</enum><header>Grant program</header><paragraph id="idE35B12D1A5624977B621A9A1F72BE9F3"><enum>(1)</enum><header>In general</header><text>In carrying out the program, the Secretary may provide to eligible entities grants for technology development, demonstration, and deployment projects to improve technologies in accordance with subsection (b).</text></paragraph><paragraph id="ided6899fd14004ab4b8edeca5b858fb94"><enum>(2)</enum><header>Eligible entities</header><text>Entities eligible to receive a grant under the program include—</text><subparagraph id="id55e5085e1e4641439782fb99bef2f7b7"><enum>(A)</enum><text>the National Laboratories;</text></subparagraph><subparagraph id="id167E72F89EC840F48B898C0EDC04C515"><enum>(B)</enum><text>other Federal laboratories;</text></subparagraph><subparagraph id="idB78D1E9B376649B694D41B75BEC93C4F"><enum>(C)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="id0CA4A2AAA51E4A18B04108B6F89DA3DA"><enum>(D)</enum><text>contractors; and</text></subparagraph><subparagraph id="id83C7C133A32743699B88CFFE7DEF63B4"><enum>(E)</enum><text>small business concerns.</text></subparagraph></paragraph><paragraph id="id2BF997D73EBD41248CCA6F62B89FD3B3"><enum>(3)</enum><header>Selection</header><text>The Secretary shall select eligible entities for grants under the program through a rigorous process that involves—</text><subparagraph id="idcedec12d5df746f180a43d0f15ddfc26"><enum>(A)</enum><text>transparent and open competition; and</text></subparagraph><subparagraph id="id86a06ce96bbd402683391ddd046e1d54"><enum>(B)</enum><text>an independent peer review process described in paragraph (4).</text></subparagraph></paragraph><paragraph id="idB655B304E19C4DBAAECE438B2246C35B"><enum>(4)</enum><header>Peer review process</header><subparagraph id="id4C2E1B115B304C64BD66F18DA01D6F3C"><enum>(A)</enum><header>In general</header><text>Each technology development, demonstration, and deployment project of an eligible entity under consideration for a grant under the program shall undergo an independent peer review process by a panel of not fewer than 3 peer reviewers selected in accordance with subparagraph (C), who shall evaluate the project in accordance with the criteria described in subparagraph (B), with the goal of maximizing—</text><clause id="id70C0DF627FE54FCFB2B8914BC6FB6D1D"><enum>(i)</enum><text>returns on the research and development expenditures of the Office; and</text></clause><clause commented="no" id="id736ABBE76C7248BA8BB317DB82B40075"><enum>(ii)</enum><text>the return on investment of grant funds awarded under the program. </text></clause></subparagraph><subparagraph id="idA5FAF1F6BCFF4F4398E96D43D5624294"><enum>(B)</enum><header>Criteria</header><text>The general criteria for peer review under subparagraph (A) shall include, with respect to each project, including any technology to be developed, demonstrated, or deployed by the project, an evaluation of—</text><clause id="id4638503D8CAA47719A08B472A20A374B"><enum>(i)</enum><text>mission relevancy;</text></clause><clause id="id5C4B90C155474255A3BD25168BC20704"><enum>(ii)</enum><text>scientific and technical validity;</text></clause><clause id="idCC64C48A823145B388E9E57C1A3B99D8"><enum>(iii)</enum><text>ability to meet an existing mission void;</text></clause><clause id="idBDE7AA8457364ED2A82CDCEEF9C0B8A0"><enum>(iv)</enum><text>superiority to alternatives;</text></clause><clause id="idCBCD4B099EE54A8BBBA1542A486A3ED4"><enum>(v)</enum><text>cost effectiveness; </text></clause><clause id="idA2E5032A478B486B8B5121B7C7967C54"><enum>(vi)</enum><text>ability to reduce risk;</text></clause><clause id="id588B9CCB5D024F7EB55CA15124211408"><enum>(vii)</enum><text>regulatory acceptance;</text></clause><clause id="id6301D97CCCA9404592A746C7061BC2E9"><enum>(viii)</enum><text>public acceptance; and</text></clause><clause id="idF5DD31F041EE47BDB8BD607E87159FB2"><enum>(ix)</enum><text> likelihood of implementation.</text></clause></subparagraph><subparagraph id="idF2DE12F659B64B059940A5F5C22B97EB"><enum>(C)</enum><header>Peer reviewers</header><clause id="id99FCA51DC49B41F1A4D5CA9474BB603A"><enum>(i)</enum><header>In general</header><text>A peer reviewer for a project under subparagraph (A) shall be selected—</text><subclause id="id30D3EF564A6845528E0E1C19E3EDF3A3"><enum>(I)</enum><text>through a systematic approach to accessing peer reviewer information that ensures the appropriate range of expertise for the peer review panel; and</text></subclause><subclause id="id1F9D4ED362E7425EAAA567848E760CD0"><enum>(II)</enum><text>from among—</text><item id="idA5C888C3170B4088A3DE6242AD94E91F"><enum>(aa)</enum><text>contractors;</text></item><item id="id43A05DABD4D74DD3B9C098A570919392"><enum>(bb)</enum><text>the National Laboratories; </text></item><item id="id94385D096BE3412EBED48F44C6396E80"><enum>(cc)</enum><text>other Federal Laboratories; </text></item><item id="idDDDB333A2B2040FA8FBEBCCA8207BA28"><enum>(dd)</enum><text>institutions of higher education; and </text></item><item id="idF59FF177CA1448E9BBC32776C5DF0952"><enum>(ee)</enum><text>members of relevant professional societies.</text></item></subclause></clause><clause id="id8D351D6776B44E4794C7515424F6ADA4"><enum>(ii)</enum><header>Minimization of DOE participation</header><text>To the maximum extent practicable, the peer reviewer selection process under clause (i) shall minimize the participation of staff of the Department as peer reviewers.</text></clause><clause id="id2AEF1A13A317480B8C3AC0EC0D04D878"><enum>(iii)</enum><header>Minimization of conflicts of interest</header><text>A peer reviewer selected under clause (i) to review the project may not be affiliated with the eligible entity or the project being reviewed.</text></clause></subparagraph><subparagraph id="idfd81d855ac674a52a9894608fb43a750"><enum>(D)</enum><header>Review process</header><text>Each panel of peer reviewers shall review the project—</text><clause id="id244660B71BB445ED8B93F99B22F719CC"><enum>(i)</enum><text>using a process of regular review and staged decision making that is comparable to other peer review programs; and</text></clause><clause id="idD446DD9803BE47BCA571E889098569F3"><enum>(ii)</enum><text>with rigorous attention to—</text><subclause id="id96D469DF5CB54B7EA07B31BE6AB2129F"><enum>(I)</enum><text>the collection of activity; and</text></subclause><subclause id="idA9A5B93CF7B5422780C4927C57AFE7AC"><enum>(II)</enum><text>the achievement of performance metrics.</text></subclause></clause></subparagraph></paragraph><paragraph id="id1906F8D09BF848978B7D4EB8B4C0EDFB"><enum>(5)</enum><header>Cost-sharing</header><text>The Federal share of the costs of the development, demonstration, and deployment of new technologies carried out using a grant under this subsection shall be not more than 70 percent.</text></paragraph></subsection><subsection id="idD6489BEC16A94A10BE4C43E1C2EE4721"><enum>(e)</enum><header>Funding</header><text>There is authorized to be appropriated to carry out the program—</text><paragraph id="id7290CAF2743B48EE980D29903ABB7B96"><enum>(1)</enum><text>$30,000,000 for each of fiscal years 2022 through 2024; and</text></paragraph><paragraph id="idE2ABC2964D7A4C9F9E1FAADA3BCDA494"><enum>(2)</enum><text>$50,000,000 for fiscal year 2025 and each fiscal year thereafter.</text></paragraph></subsection></section><section id="id99c26b1ab5b1424b9c3e96e0cafb509e"><enum>6.</enum><header>High-impact Technology Development Program</header><subsection id="id46c7c58413fb43d9b4e5827a856b869e"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program, to be known as the <quote>High-Impact Technology Development Program</quote> (referred to in this section as the <quote>program</quote>), under which the Secretary shall make grants to eligible entities for projects that pursue technologies that, with respect to the mission—</text><paragraph id="idcd43995904fd42848855e1b7a4c4f981"><enum>(1)</enum><text>holistically address difficult challenges;</text></paragraph><paragraph id="id602D3FE9496E4C858A99350D403F5367"><enum>(2)</enum><text>hold the promise of breakthrough improvements; or</text></paragraph><paragraph id="id34C59E935E4C46BD9CE0E0476BE41EE5"><enum>(3)</enum><text>align existing or in-use technologies with difficult challenges.</text></paragraph></subsection><subsection id="ida098f00c4bcb4d3b924b47e047afe568"><enum>(b)</enum><header>Workshop</header><text>The Secretary shall commence the program with a workshop to identify, with respect to the technologies developed pursuant to the program—</text><paragraph id="id38f926c674324937bad54c398b200088"><enum>(1)</enum><text>the challenges that need to be addressed; and</text></paragraph><paragraph id="id5298621d6ba54c3696c475d92843c563"><enum>(2)</enum><text>how—</text><subparagraph id="id26a2f02691324e00b5d956f265ab105c"><enum>(A)</enum><text>to maximize the impact of existing resources of the Office; and</text></subparagraph><subparagraph id="id79650bbb69f746e0a76161e523579145"><enum>(B)</enum><text>to ensure that the technology development targets challenges across the complex.</text></subparagraph></paragraph></subsection><subsection id="id79d77e84f5ca47e388e2035cc894e1bd"><enum>(c)</enum><header>Areas of focus</header><text>Areas of focus of a project receiving a grant under this section may include—</text><paragraph id="idc1f9b9516b0942f3893727ebd6b0a996"><enum>(1)</enum><text>developing and demonstrating improved methods for source and plume characterization and monitoring, with an emphasis on—</text><subparagraph id="id8CBCBABDD64D4EE8824D6BFEF4202442"><enum>(A)</enum><text>real-time field acquisition; and</text></subparagraph><subparagraph id="id732C44B48EC24853A3E1EEAF99F2843E"><enum>(B)</enum><text>the use of indicator species analyses with advanced contaminant transport models to enable better understanding of contaminant migration;</text></subparagraph></paragraph><paragraph id="idcc7be2ac324c49c585dfe9bfcf06bd0f"><enum>(2)</enum><text>developing and determining the limits of performance for remediation technologies and integrated remedial systems that prevent migration of contaminants, including by producing associated guidance and design manuals for technologies that could be widely used across the complex;</text></paragraph><paragraph id="ide9b4e5806eb74bb180125386457e84f4"><enum>(3)</enum><text>demonstrating advanced monitoring approaches that use multiple lines of evidence for monitoring long-term performance of—</text><subparagraph id="id7B90860AED4A42118B34729A431C5BD7"><enum>(A)</enum><text>remediation systems; and</text></subparagraph><subparagraph id="id7664D44ECED244D6BB23FFF9404DBC9C"><enum>(B)</enum><text>noninvasive near-field monitoring techniques;</text></subparagraph></paragraph><paragraph id="ida68e8ee6e583463bb8a8a6b66b25f347"><enum>(4)</enum><text>developing and demonstrating methods to characterize the physical and chemical attributes of waste that control behavior, with an emphasis on—</text><subparagraph id="id06DF9FD858DD45A386A9BF4A88B991BF"><enum>(A)</enum><text>rapid and nondestructive examination and assay techniques; and</text></subparagraph><subparagraph id="idD93CFAE32C1247D2B4B8A9811A1D2929"><enum>(B)</enum><text>methods to determine radio-nuclide, heavy metals, and organic constituents;</text></subparagraph></paragraph><paragraph id="idb4f9fccdbe3d4e21b598bb3fdfe9a3d9"><enum>(5)</enum><text>demonstrating the technical basis for determining when enhanced or natural attenuation is an appropriate approach for remediation of complex sites;</text></paragraph><paragraph id="idb2a83b280f094973bfa3fd165509a1f2"><enum>(6)</enum><text>developing and demonstrating innovative methods to achieve real-time and, if practicable, in situ characterization data for tank waste and process streams that could be useful for all phases of the waste management program, including improving characterization of residual waste in tanks;</text></paragraph><paragraph id="id3e6d88ccbabd4faebe88522aeb8ecc64"><enum>(7)</enum><text>adapting existing treatment technologies or demonstrating new treatment technologies at the pilot plant scale using real wastes or realistic surrogates—</text><subparagraph id="idCE477D6143E742F99A60DD9C83F17D6B"><enum>(A)</enum><text>to address engineering adaptations; and</text></subparagraph><subparagraph id="id3D0A2A10B077436FBDAB9AA395B4F079"><enum>(B)</enum><text>to enable successful deployment at full-scale and in support of operations;</text></subparagraph></paragraph><paragraph id="id6afa79aad4c842f88bc64b9baeb3baca"><enum>(8)</enum><text>developing and demonstrating rapid testing protocols that—</text><subparagraph id="id88780C71135D4502A51C3C7FC3CF6C57"><enum>(A)</enum><text>are accepted by the Environmental Protection Agency, the Nuclear Regulatory Commission, the Department, and the scientific community;</text></subparagraph><subparagraph id="idA8E0E4016E054C09885C0E067A98B38F"><enum>(B)</enum><text>can be used to measure long-term waste form performance under realistic disposal environments;</text></subparagraph><subparagraph id="id6B0858DE44EA4810928964F4282879D0"><enum>(C)</enum><text>can determine whether a stabilized waste is suitable for disposal; and</text></subparagraph><subparagraph id="idC06AABEF123C43418504D23BC278AC06"><enum>(D)</enum><text>reduce the need for extensive, time-consuming, and costly analyses on every batch of waste prior to disposal;</text></subparagraph></paragraph><paragraph id="id0781bf73d6494caaaaf6e5971d669d86"><enum>(9)</enum><text>developing and demonstrating direct stabilization technologies to provide waste forms for disposing of elemental mercury; and</text></paragraph><paragraph id="ide1b14297fc974390afb4731e8339c132"><enum>(10)</enum><text>developing and demonstrating innovative and effective retrieval methods for removal of residual materials from tanks and connecting pipelines.</text></paragraph></subsection><subsection id="id64D8CF8EAFFB4385B5ED696ABCA41878"><enum>(d)</enum><header>Project selection</header><paragraph id="id44ef496f638845128f4d06ea8407a89b"><enum>(1)</enum><header>Eligible entities</header><text>Entities eligible to receive a grant under the program include—</text><subparagraph id="idF87685535D704D2B9F834858B552AF70"><enum>(A)</enum><text>the National Laboratories;</text></subparagraph><subparagraph id="id154403CA88FE47D69EC53B86363A23D3"><enum>(B)</enum><text>other Federal laboratories;</text></subparagraph><subparagraph id="id0E0603F7DC3C401B88D3AD47B86F226D"><enum>(C)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="idBE8D7CB64A654ACFA1B38DF53627E9FC"><enum>(D)</enum><text>contractors; and</text></subparagraph><subparagraph id="id9B824B0F13024947ACCF4FF75FD01173"><enum>(E)</enum><text>small business concerns.</text></subparagraph></paragraph><paragraph id="id59EF2DEC2C7C49E8AD1258D4E28A71C2"><enum>(2)</enum><header>Selection</header><text>The Secretary shall select eligible entities for grants under the program through a rigorous process that involves—</text><subparagraph id="idFE1A20992A944FD9B5B5B300229F2B56"><enum>(A)</enum><text>transparent and open competition; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29FBB8F0223841D0AB11EBB0B53EE1BE"><enum>(B)</enum><text>an independent peer review process described in paragraph (3).</text></subparagraph></paragraph><paragraph id="idBF2E10829E9F44FAABA15C09326A86FE"><enum>(3)</enum><header>Peer review process</header><subparagraph id="idA4413FE38E764D0D8DDC668EDE86B71E"><enum>(A)</enum><header>In general</header><text>Each project of an eligible entity under consideration for a grant under the program shall undergo an independent peer review process by a panel of not fewer than 3 peer reviewers selected in accordance with subparagraph (B).</text></subparagraph><subparagraph id="id19A7A4EF71AD4468AA3D8C7B05C41548"><enum>(B)</enum><header>Peer reviewers</header><clause id="id465BF500B5C14F5D9C455118BE3F739F"><enum>(i)</enum><header>In general</header><text>A peer reviewer for a project under subparagraph (A) shall be selected—</text><subclause id="idA3CB8A47C0F24FE682779D7C18CC422D"><enum>(I)</enum><text>through a systematic approach to accessing peer reviewer information that ensures the appropriate range of expertise for the peer review panel; and</text></subclause><subclause id="idB42BC2E3696B4479B2D008A276EC6471"><enum>(II)</enum><text>from—</text><item id="id36489EE2C0A04E9A842CC8F1D890181F"><enum>(aa)</enum><text>a relevant database, such as a database of chemical engineers, geologists, physicists, materials scientists, or biologists; or</text></item><item id="id882F4BCAB5C24D89B715ED621CA2556C"><enum>(bb)</enum><text>among members of relevant professional societies.</text></item></subclause></clause><clause id="id43C7C6ACE4814238AF719DE7E2B59C72"><enum>(ii)</enum><header>Minimization of DOE participation</header><text>To the maximum extent practicable, the peer reviewer selection process under clause (i) shall minimize the participation of staff of the Department as peer reviewers.</text></clause><clause commented="no" id="idDA52AE0725334B7C9DA0AFD8C8FED6FE"><enum>(iii)</enum><header>Minimization of conflicts of interest</header><text>A peer reviewer selected under clause (i) to review the project may not be affiliated with the eligible entity or the project being reviewed.</text></clause></subparagraph><subparagraph id="id6872B9C3EE804D3380682D4D52BEA938"><enum>(C)</enum><header>Review process</header><text>Each panel of peer reviewers shall review the project—</text><clause id="idEA4A1204939E4FD2A3DEA3B997957B43"><enum>(i)</enum><text>using a process of regular review and staged decision making that is comparable to other peer review programs; and</text></clause><clause id="id3A376D65179C488DB30C7527557A9C61"><enum>(ii)</enum><text>with rigorous attention to—</text><subclause id="idC329D3F349DF4F2BA395F333EE619ECB"><enum>(I)</enum><text>the collection of activity; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE9156100BBF54112B8D3ABD028466B7A"><enum>(II)</enum><text>the achievement of performance metrics.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id11e63bb9317a44178f79b16882035e45"><enum>(e)</enum><header>Funding</header><text>There is authorized to be appropriated to carry out the program $150,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></subsection></section><section id="idb40c9ea1a751471d8b27f70d14c03f7a"><enum>7.</enum><header>Fundamental research program</header><subsection id="ide4603b17741e4b998c7734a129b11b47"><enum>(a)</enum><header>Establishment</header><text>The Director of the Office of Science (referred to in this section as the <quote>Director</quote>) shall establish a program, to be known as the <quote>Fundamental Research Program</quote> (referred to in this section as the <quote>program</quote>), under which the Director shall make grants to eligible entities for projects focused on developing new knowledge and capabilities that are associated with the challenges of the mission.</text></subsection><subsection id="idf9d11e8597f84dfb918ce8ee261830d1"><enum>(b)</enum><header>Administration</header><text>The Director shall—</text><paragraph id="id924b938ad91e4b478d21f5e61d818dcf"><enum>(1)</enum><text>manage the program in close coordination with the Assistant Secretary of Energy for Environmental Management;</text></paragraph><paragraph id="idc865f15ba9734dd8a8a3691f39164da0"><enum>(2)</enum><text>specifically tailor the program to the mission; and</text></paragraph><paragraph id="idb191ea568f064d97877b3096309c5022"><enum>(3)</enum><text>align the program with long-term, 5- to 10-year site milestones agreed to by Federal regulators and the States, so that the science developed pursuant to the program can—</text><subparagraph id="id9be4b105bdc4490ebb189c7947f3e1b5"><enum>(A)</enum><text>progress effectively; and</text></subparagraph><subparagraph id="idadae9d2748d1448d94a2e0a75f980c17"><enum>(B)</enum><text>provide the understanding necessary to develop solutions that align with the site timelines.</text></subparagraph></paragraph></subsection><subsection id="id5c3a118c1f154f7eb8287eff311051c6"><enum>(c)</enum><header>Areas of focus</header><text>Areas of focus of a project receiving a grant under this section may include research on—</text><paragraph id="id213dce87f1d54ffdba1ffae9242e52b5"><enum>(1)</enum><text>the atomic- and molecular-scale chemistries of waste processing;</text></paragraph><paragraph id="idc246b17a2c904622acf14cd58ce527fd"><enum>(2)</enum><text>contaminant immobilization in engineered and natural systems;</text></paragraph><paragraph id="id8a3edf8c29e04c2f96da770c29505e16"><enum>(3)</enum><text>developing innovative materials, with an emphasis on nanomaterials or biomaterials, that could enable sequestration of challenging hazardous or radioactive constituents such as technetium and iodine;</text></paragraph><paragraph id="id93836eae48c84fbb84c992e9f6a8c2d4"><enum>(4)</enum><text>elucidating and exploiting complex speciation and reactivity far from equilibrium;</text></paragraph><paragraph id="ide258cd6112a44e16b1b1e46065f6ef8d"><enum>(5)</enum><text>understanding and controlling chemical and physical processes at interfaces;</text></paragraph><paragraph id="iddffed3378715498fa24f189c23e04e81"><enum>(6)</enum><text>harnessing physical and chemical processes to revolutionize separations;</text></paragraph><paragraph id="id14e7e6a13ab243318721fef513117290"><enum>(7)</enum><text>tailoring waste forms for contaminants in harsh chemical environments; or</text></paragraph><paragraph id="id94ea85ff81c443ca9f50fb5a5926b549"><enum>(8)</enum><text>predicting and understanding subsurface system behavior and response to perturbations.</text></paragraph></subsection><subsection commented="no" id="id192A8E2DD39047DE9676F40B4665A9E6"><enum>(d)</enum><header>Program Requirements</header><text>.</text><paragraph commented="no" id="id47E61F6D318E46F09E9C70EF7D31512A"><enum>(1)</enum><header>Eligible entities</header><text>Entities eligible to receive a grant under the program include—</text><subparagraph commented="no" id="idF87685535D704D2B9F834858B552AF70A"><enum>(A)</enum><text>the National Laboratories;</text></subparagraph><subparagraph commented="no" id="id154403CA88FE47D69EC53B86363A23D3A"><enum>(B)</enum><text>other Federal laboratories;</text></subparagraph><subparagraph commented="no" id="id0E0603F7DC3C401B88D3AD47B86F226DA"><enum>(C)</enum><text>institutions of higher education;</text></subparagraph><subparagraph commented="no" id="idBE8D7CB64A654ACFA1B38DF53627E9FCA"><enum>(D)</enum><text>contractors; and</text></subparagraph><subparagraph commented="no" id="id9B824B0F13024947ACCF4FF75FD01173Z"><enum>(E)</enum><text>small business concerns.</text></subparagraph></paragraph><paragraph commented="no" id="idEAA7050F61494214B28C63ADD7EE69BB"><enum>(2)</enum><header>Selection</header><text>The Secretary shall select eligible entities for grants under the program through a rigorous process that involves—</text><subparagraph commented="no" id="idEFEBF2EC61A84F23B30EEC32EE5175FA"><enum>(A)</enum><text>transparent and open competition; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id823838D8FCD84CBD9763634DA50C7E68"><enum>(II)</enum><text>the achievement of performance metrics.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id1b4f0ee7aecc438f895f15595a130b3e"><enum>(e)</enum><header>Funding</header><text>There is authorized to be appropriated to carry out the program $30,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></subsection></section><section id="id2367d245e5744057abad70dee7ffb669"><enum>8.</enum><header>Environmental management university program</header><subsection id="ide75f4b82b9284b66a513aef5c1a136e7"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program, to be known as the <quote>Environmental Management University Program</quote> (referred to in this section as the <quote>program</quote>)—</text><paragraph id="id4ab724d4eef24d38952a95d998d8de24"><enum>(1)</enum><text>to engage faculty, post-doctoral fellows or researchers, and graduate students of institutions of higher education on subjects relating to the mission to show a clear path for students for employment with the Department;</text></paragraph><paragraph id="id5504a4f60cdc43618a8efad4c152e002"><enum>(2)</enum><text>to provide to institutions of higher education—</text><subparagraph id="id4dd3a1cac6664749ab281d6394e60422"><enum>(A)</enum><text>a source of new ideas; and</text></subparagraph><subparagraph id="idc5e286c0a6fd43beb30e7077a3566915"><enum>(B)</enum><text>access to advances in engineering and science;</text></subparagraph></paragraph><paragraph id="idc3195386c0d342c2ab5cefe68d1f4d67"><enum>(3)</enum><text>to clearly identify to institutions of higher education the tools necessary to enter into the environmental management field professionally; or</text></paragraph><paragraph id="id2fec29e2d44e4152a69b4287f755c72f"><enum>(8)</enum><text>predicting and understanding subsurface system behavior and response to perturbations.</text></paragraph></subsection><subsection id="ide136bcd1865a4db6bb5d20bbbcb1c978"><enum>(c)</enum><header>Individual research grants</header><text>In carrying out the program, the Secretary may make individual research grants, in the amount of not less than $150,000 but not more than $300,000 per year, to faculty, post-doctoral fellows or researchers, and graduate students of institutions of higher education for 3-year research projects, with an option for an extension of 1 additional period of 2 years.</text></subsection><subsection id="iddcf665b6dc1f4e3baea19d7cea986150"><enum>(d)</enum><header>Grants for interdisciplinary collaborations</header><text>In carrying out the program, the Secretary may make research grants, in the amount of not more than $400,000 per year for each grant, for strategic partnerships among scientists, faculty, post-doctoral fellows or researchers, and graduate students of institutions of higher education for 3-year research projects.</text></subsection><subsection id="idb26da456a47a46699d903ab41dbc9260"><enum>(e)</enum><header>Hiring of undergraduates</header><text>In carrying out the program, the Secretary may establish a summer internship program for undergraduates of institutions of higher education to work on projects relating to environmental management.</text></subsection><subsection id="idee2f05f3ca9f4ce997ec80ae0f02f094"><enum>(f)</enum><header>Workshops</header><text>In carrying out the program, the Secretary may hold workshops with the Office of Environmental Management, the Office of Science, and members of academia and industry concerning environmental management challenges and solutions.</text></subsection><subsection id="ideb456e4e0cfb43328f5cab1afe26564f"><enum>(g)</enum><header>Funding</header><text>There is authorized to be appropriated to carry out the program $7,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></subsection></section></legis-body></bill>
