which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to establish a working group to study regulatory and legislative improvements for the livestock, insect, and agricultural commodities transport industries, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Agricultural Transportation Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id386CFD67E9424DC6A085949F01E2DA7D"><enum>2.</enum><header>Working group on improving the livestock, insect, and agricultural commodities transport industries</header><subsection id="idDDFEF20178F8474EAD09580D3FF7DBA3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7F3A36526FD5454F92F758EDDFB95083"><enum>(1)</enum><header>Agricultural commodity</header><text>The term <term>agricultural commodity</term> means—</text><subparagraph id="id2070F42D6D684B69875D0B3B50D4ADF5"><enum>(A)</enum><text>an agricultural commodity as defined in section 518 of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1518">7 U.S.C. 1518</external-xref>); and</text></subparagraph><subparagraph id="idA990086CF47A44779FB4BCDE8223B6E3"><enum>(B)</enum><text>an agricultural commodity as defined in section 395.2 of title 49, Code of Federal Regulations (or successor regulations).</text></subparagraph></paragraph><paragraph id="id9082D2419A744A179F8DC9F3B9E9AF78"><enum>(2)</enum><header>Livestock</header><text>The term <term>livestock</term> has the meaning given the term in section 602 of the Emergency Livestock Feed Assistance Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/7/1471">7 U.S.C. 1471</external-xref>).</text></paragraph><paragraph id="id46E4AADF347B4AD1BD3A8AA568AC1BCA"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="idD7495A7D942442B995312E4A31A6762B"><enum>(4)</enum><header>Working group</header><text>The term <term>working group</term> means the working group established by the Secretary under subsection (b).</text></paragraph></subsection><subsection id="id004779B2A9B74F07A763465F328DD752"><enum>(b)</enum><header>Establishment</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall establish a working group—</text><paragraph id="id93f917aa5325421a82e82572e1f7fb93"><enum>(1)</enum><text>to identify obstacles to safe, humane, and market-efficient transport of livestock, insects, and agricultural commodities; and</text></paragraph><paragraph id="id6622811376724a73a75cf8f6c0268cd8"><enum>(2)</enum><text>to develop guidelines and recommended regulatory or legislative actions to improve the safe, humane, and efficient transport of livestock, insects, and agricultural commodities.</text></paragraph></subsection><subsection id="id7c360ab1e79140538e75e3a3fa11cc93"><enum>(c)</enum><header>Outreach</header><text>In carrying out the duties of the working group under subsection (b), the working group shall consult with—</text><paragraph id="idc2dc1a4fa0d0421fafd890b037ad2358"><enum>(1)</enum><text>interested Governors;</text></paragraph><paragraph id="id8b56faac01754d8ba714bdbe6ad4d7fd"><enum>(2)</enum><text>representatives of State and local agricultural and highway safety agencies;</text></paragraph><paragraph id="id245072e5f70a4457aab4643d3593a7cf"><enum>(3)</enum><text>other representatives of relevant State and local agencies;</text></paragraph><paragraph id="idefd6569515ac4ceabe94032403674f97"><enum>(4)</enum><text>members of the public with experience in—</text><subparagraph id="id4AEAD09E664A42ABAADDFC16BD1B35DD"><enum>(A)</enum><text>the livestock, insect, and agricultural commodities industries;</text></subparagraph><subparagraph id="idC2E9E80FF13641A788801F947BF43E4C"><enum>(B)</enum><text>the livestock trucking industry; or</text></subparagraph><subparagraph id="idC5A85E68900F436182E69EE636643068"><enum>(C)</enum><text>transportation safety; and</text></subparagraph></paragraph><paragraph id="id9e88612ecab24cc49c7a12349d7b4f59"><enum>(5)</enum><text>any other groups or stakeholders that the working group determines to be appropriate.</text></paragraph></subsection><subsection id="id4d33c2a3ffcb4e96a3807f2aaa4cede7"><enum>(d)</enum><header>Considerations</header><text>In carrying out the duties of the working group under subsection (b), the working group shall—</text><paragraph id="id8e166a3db7f94a739d709b1fb348a5ff"><enum>(1)</enum><text>consider the impact of the existing hours of service regulations under subpart A of part 395 of title 49, Code of Federal Regulations (or successor regulations), on the commercial transport of livestock, insects, and agricultural commodities;</text></paragraph><paragraph id="id940f5111a4364864953f4282d54ebd45"><enum>(2)</enum><text>identify incompatibilities and other challenges and concerns caused by the hours of service regulations described in paragraph (1) and electronic logging device regulations under subpart B of part 395 of title 49, Code of Federal Regulations (or successor regulations), on the transport of livestock, insects, and agricultural commodities;</text></paragraph><paragraph id="idc095d7dd315f4f00a542e62869f6cc27"><enum>(3)</enum><text>identify initiatives and regulatory changes that maintain and protect the safety of highways and allow for the safe, efficient, and productive marketplace transport of livestock, insects, and agricultural commodities; and</text></paragraph><paragraph id="id74cf9412678243afa0434e8b8175f301"><enum>(4)</enum><text>consider such other issues as the Secretary considers appropriate.</text></paragraph></subsection><subsection id="idbbf4b32d911a45c49d2aecb752e325c2"><enum>(e)</enum><header>Composition</header><paragraph id="id450eae1c73f8497eac956b7303cc7530"><enum>(1)</enum><header>In general</header><text>The Secretary (or a designee) shall serve as the chair of the working group.</text></paragraph><paragraph id="idacce530dcdbd40fc8fc5b0f184b97558"><enum>(2)</enum><header>Membership</header><subparagraph id="idE5A420B8412C4EDB8158AC4E989DEC95"><enum>(A)</enum><header>In general</header><text>The working group shall be composed of members appointed by the Secretary, including individuals with knowledge and expertise that includes highway safety, the commercial motor vehicle and transportation industries, animal husbandry, and the transportation of livestock, insects, and agricultural commodities.</text></subparagraph><subparagraph id="idEB350C3C399E40A7866FB7210C7B7A74"><enum>(B)</enum><header>Requirement</header><text>The working group shall include, at a minimum, representatives of—</text><clause id="id383ab38cf7ff4dc49bd1a13abebbb0fb"><enum>(i)</enum><text>the Department of Agriculture;</text></clause><clause id="id62DFD4FC417C41B48E7B952B3E948B07"><enum>(ii)</enum><text>State agencies, including State departments of agriculture and transportation;</text></clause><clause id="id9f0f33df7a3e43bf80c228f72b9a99ef"><enum>(iii)</enum><text>highway and commercial motor vehicle safety organizations;</text></clause><clause id="id0b5a096b634b4bf980de5e7b60dcf844"><enum>(iv)</enum><text>agricultural producers, including producers of livestock, insects, and agricultural commodities; and</text></clause><clause id="id3197d0cd16ba4ca48e276ae1b6d5d4df"><enum>(v)</enum><text>commercial motor vehicle operators, including small business operators and operators who haul livestock, insects, and agricultural commodities.</text></clause></subparagraph></paragraph></subsection><subsection id="id7932fe3655cf41f18a1ce72435a1fba5"><enum>(f)</enum><header>Working group report and regulatory action</header><paragraph id="id903a121d6acb45ee9637bedb5444d1d2"><enum>(1)</enum><header>Report</header><text>Not later than 1 year after the date on which the working group is established, the working group shall submit to the Secretary a report that includes—</text><subparagraph id="ide7e0743d6fd54a8784cd76e5a9a92b54"><enum>(A)</enum><text>the findings of the working group, including a summary of the views expressed by individuals and entities consulted under subsection (c); and</text></subparagraph><subparagraph id="ide188cb60d6fa424db61bc734a3d6991b"><enum>(B)</enum><text>the initiatives and regulatory and legislative changes that the working group identifies as necessary to protect the safety of highways and allow for the safe, efficient, and productive marketplace transport of livestock, insects, and agricultural commodities.</text></subparagraph></paragraph><paragraph id="id8513183ac65b4f409f3f89b5cabe5d64"><enum>(2)</enum><header>Regulatory changes</header><text>Not later than 120 days after the date on which the Secretary receives the report under paragraph (1), the Secretary shall propose regulatory changes that take into account the findings and recommendations of the working group, including—</text><subparagraph id="id5c0070121a1a454db3c7438641991d38"><enum>(A)</enum><text>changes to the hours of service regulations under subpart A of part 395 of title 49, Code of Federal Regulations (or successor regulations);</text></subparagraph><subparagraph id="id17656b419fe043a98cda8fa7e9020984"><enum>(B)</enum><text>changes to the electronic logging device regulations under subpart B of part 395 of title 49, Code of Federal Regulations (or successor regulations), including changes to regulations relating to the performance and design of electronic logging devices; and</text></subparagraph><subparagraph id="id37886003d1544870a3ed84d3c80c8540"><enum>(C)</enum><text>any other changes that the working group recommends.</text></subparagraph></paragraph><paragraph id="id7216d0126dd341c39aec6abea97fbe3e"><enum>(3)</enum><header>Application</header><text>Subsections (a) through (f) of section 31137 of title 49, United States Code (including any regulations promulgated to carry out those subsections), shall not apply to commercial motor vehicles hauling livestock, insects, or agricultural commodities until the date on which the Secretary proposes regulatory changes under paragraph (2).</text></paragraph></subsection><subsection id="id9f0db984c9b74c18b57b720fcf8df3cb"><enum>(g)</enum><header>Report and recommendations by Secretary</header><text>Not later than 30 days after the date on which the Secretary receives the report of the working group under subsection (f)(1), the Secretary shall submit to the appropriate committees of Congress a report, including—</text><paragraph id="idba71aad1318542f6a4f7c840d8da6167"><enum>(1)</enum><text>a summary of the views expressed by the individuals and entities consulted under subsection (c);</text></paragraph><paragraph id="idd5799a24605d4f15a10ab9baead3d6ea"><enum>(2)</enum><text>a description of the findings of the working group, including the identification of any areas of general consensus among the non-Federal participants in the consultation under subsection (c); and</text></paragraph><paragraph id="id6663080b9430408489e6e5969daa5e6e"><enum>(3)</enum><text>any recommendations for legislative or regulatory action that would assist in maintaining and improving the safe, humane, and market-efficient transport of livestock, insects, and agricultural commodities.</text></paragraph></subsection></section></legis-body></bill>
