that—</text><paragraph id="id3694e533-70fe-4bf4-8dda-0469bc27cd23" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">ongoing efforts by the government of President Daniel Ortega in Nicaragua to suppress the voice and actions of political opponents through intimidation and unlawful detainment, civil society, and independent news media violate the fundamental freedoms and basic human rights of the people of Nicaragua;</text></paragraph><paragraph id="id02232823c7ac4f278960f7ba319d6515" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">Congress unequivocally condemns the politically motivated and unlawful detention of presidential candidates Cristiana Chamorro, Arturo Cruz, Felix Maradiaga, and Juan Sebastian Chamorro; </text></paragraph><paragraph id="id6dc2fffd-6bfb-4086-9be9-928249c389ec" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">Congress unequivocally condemns the passage of the Foreign Agents Regulation Law, the Special Cybercrimes Law, the Self-Determination Law, and the Consumer Protection Law by the National Assembly of Nicaragua, which represent clear attempts by the Ortega government to curtail the fundamental freedoms and basic human rights of the people of Nicaragua;</text></paragraph><paragraph id="id4e7c7b4c-544d-4334-aa76-5296509d25db" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">Congress recognizes that free, fair, and transparent elections predicated on robust reform measures and the presence of domestic and international observers represent the best opportunity for the people of Nicaragua to restore democracy and reach a peaceful solution to the political and social crisis in Nicaragua;</text></paragraph><paragraph id="idbbc5ab1a355943cbad5038ef5f072747" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">the United States recognizes the right of the people of Nicaragua to freely determine their own political future as vital to ensuring the sustainable restoration of democracy in their country; </text></paragraph><paragraph id="id6660932c-34a6-40e8-bb1d-902f13762d10" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(6)</enum><text display-inline="yes-display-inline">the United States should align the use of diplomatic engagement and all other foreign policy tools, including the use of targeted sanctions, in support of efforts by democratic political actors and civil society in Nicaragua to advance the necessary conditions for free, fair, and transparent elections in Nicaragua;</text></paragraph><paragraph id="id51fd9526-7092-4db1-bcb0-912bf9c95682" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(7)</enum><text display-inline="yes-display-inline">the United States, in order to maximize the effectiveness of efforts described in paragraph (6), should—</text><subparagraph id="id1bd2e1be-d651-4dbc-8ae0-563364ad5eac" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">coordinate with diplomatic partners, including the Government of Canada, the European Union, and partners in Latin America and the Caribbean; </text></subparagraph><subparagraph id="id3a37487c-8796-436c-9968-4c238d525efa" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">advance diplomatic initiatives in consultation with the Organization of American States and the United Nations; and </text></subparagraph><subparagraph id="id0a37c5b2fb974d6c9287f49202486afe" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">thoroughly investigate the assets and holdings of the Nicaraguan Armed Forces in the United States and consider appropriate actions to hold such forces accountable for gross violations of human rights; and</text></subparagraph></paragraph><paragraph id="idd271cd71-cea1-41e6-abd1-cb52426f5fe4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(8)</enum><text display-inline="yes-display-inline">pursuant to section 6(b) of the Nicaragua Investment Conditionality Act of 2018, the President should waive the application of restrictions under section 4 of that Act and the sanctions under section 5 of that Act if the Secretary of State certifies that the Government of Nicaragua is taking the steps identified in section 6(a) of that Act, including taking steps to <quote>to hold free and fair elections overseen by credible domestic and international observers</quote>. </text></paragraph></section><section id="id6DD018C09E4B489293214D324F17A50C" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Review of participation of Nicaragua in Dominican Republic-Central America-United States Free Trade Agreement</header><subsection id="id0534887095ac411099f8e056e260c55b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text><paragraph id="id89cd7648b28e4c30b82eec92aa01a0bb" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">On November 27, 2018, the President signed Executive Order 13851 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of certain persons contributing to the situation in Nicaragua), which stated that <quote>the situation in Nicaragua, including the violent response by the Government of Nicaragua to the protests that began on April 18, 2018, and the Ortega regime's systematic dismantling and undermining of democratic institutions and the rule of law, its use of indiscriminate violence and repressive tactics against civilians, as well as its corruption leading to the destabilization of Nicaragua's economy, constitutes an unusual and extraordinary threat to the national security and foreign policy of the United States</quote>.</text></paragraph><paragraph id="id49529e9fd4b54da4a9032bb8f22b0873" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">Article 21.2 of the Dominican Republic-Central America-United States Free Trade Agreement approved by Congress under section 101(a)(1) of the Dominican Republic-Central America-United States Free Trade Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4011">19 U.S.C. 4011(a)(1)</external-xref>) states, <quote>Nothing in this Agreement shall be construed . . . to preclude a Party from applying measures that it considers necessary for the fulfillment of its obligations with respect to the maintenance or restoration of international peace or security, or the protection of its own essential security interests.</quote>.</text></paragraph></subsection><subsection id="id2d14f45e348f4cae8958fcd885a7d07b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the President should review the continued participation of Nicaragua in the Dominican Republic-Central America-United States Free Trade Agreement if the Government of Nicaragua continues to tighten its authoritarian rule in an attempt to subvert democratic elections in November 2021 and undermine democracy and human rights in Nicaragua.</text></subsection></section><section id="id745e54ae-7dce-4189-b095-05e017b62eaa" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Restrictions on international financial institutions relating to Nicaragua</header><text display-inline="no-display-inline">Section 4 of the Nicaragua Investment Conditionality Act of 2018 is amended—</text><paragraph id="id2ad6233f-3022-4f0a-a562-a786d663e302" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (a), (b), and (c) as subsections (b), (c), and (d), respectively;</text></paragraph><paragraph id="idefc897a5-eb50-4010-b0ce-d2d726d3167c" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before subsection (b), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3a9f6022-bbea-4612-817a-d360f96d9a12" changed="not-changed"><subsection id="id151b1607-2b72-488e-9ff3-a8f1c48770f6" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the Secretary of the Treasury should take all possible steps, including through the full implementation of the exceptions set forth in subsection (c), to ensure that the restrictions required under subsection (b) do not negatively impact the basic human needs of the people of Nicaragua.</text></subsection><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph id="id569429bd-6e24-4743-afb8-9c7264d7f3dc" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c), as so redesignated, by striking <quote>subsection (a)</quote> and inserting <quote>subsection (b)</quote>; and</text></paragraph><paragraph id="id093bd1e7-1a49-4455-8142-4a7c3635ae4d" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsection (d), as so redesignated, and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03eb1f56-2ba2-4b1b-bab7-2904c556c22e" changed="not-changed"><subsection id="id2f6dc933-2abd-4316-8cfd-5a02b11590f5" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Increased oversight</header><paragraph id="id7d270eb1-16de-4d39-a5b9-201ad664764e" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The United States Executive Director at each international financial institution of the World Bank Group, the United States Executive Director at the Inter-American Development Bank, and the United States Executive Director at each other international financial institution, including the International Monetary Fund, shall take all practicable steps—</text><subparagraph id="idFB12FE3EA16C47B6B4071E3F4696E3CE" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">to increase scrutiny of any loan or financial or technical assistance provided for a project in Nicaragua; and</text></subparagraph><subparagraph id="id9C57F172D24C4EA8B0E55A3EC2836352" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure that the loan or assistance is administered through an entity with full technical, administrative, and financial independence from the Government of Nicaragua.</text></subparagraph></paragraph><paragraph id="idecc5dde6-b71b-4120-b41a-834b04c09002" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Mechanisms for increased scrutiny</header><text display-inline="yes-display-inline">The United States Executive Director at each international financial institution described in paragraph (1) shall use the voice, vote, and influence of the United States to encourage that institution to increase oversight mechanisms for new and existing loans or financial or technical assistance provided for a project in Nicaragua.</text></paragraph></subsection><subsection id="id112ceaff-54f7-4bc3-8938-9c607a8bc7e1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Interagency consultation</header><text display-inline="yes-display-inline">Before implementing the restrictions described in subsection (b), or before exercising an exception under subsection (c), the Secretary of the Treasury shall consult with the Secretary of State and with the Administrator of the United States Agency for International Development to ensure that all loans and financial or technical assistance to Nicaragua are consistent with United States foreign policy objectives as defined in section 3.</text></subsection><subsection id="iddfd2db91-2f02-41f7-a619-90e4ebc9f047" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>RENACER Act</short-title>, and annually thereafter until the termination date specified in section 10, the Secretary of the Treasury, in coordination with the Secretary of State and the Administrator of the United States Agency for International Development, shall submit to the appropriate congressional committees a report on the implementation of this section, which shall include—</text><paragraph id="id8d383c7d-e7e2-4a3f-8523-7b0164dd4ac1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">summary of any loans and financial and technical assistance provided by international financial institutions for projects in Nicaragua;</text></paragraph><paragraph id="id1a71febc-ecb2-4824-a689-14bdd6028d1a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the implementation of the restrictions described in subsection (b);</text></paragraph><paragraph id="idd01a04b0-8d43-4f78-8189-4e186c09cfe1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">an identification of the occasions in which the exceptions under subsection (c) are exercised and an assessment of how the loan or assistance provided with each such exception may address basic human needs or promote democracy in Nicaragua;</text></paragraph><paragraph id="id21561dfb-52bf-4edd-9e97-c5998c2b5dd7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the results of the increased oversight conducted under subsection (d); and</text></paragraph><paragraph id="id387b46f77139407d921fa9118ca905dc" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">a description of international efforts to address the humanitarian needs of the people of Nicaragua.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="id0658114d-2947-4afd-b662-6e7ca1ce6821" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Targeted sanctions to advance democratic elections</header><subsection id="idd816b348-6f5c-4a9b-9202-3bf1cdf6e3d5" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Coordinated strategy</header><paragraph id="id8a313a50-7e81-40d0-952f-e293e8c09e3f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of State and the Secretary of the Treasury, in consultation with the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), shall develop and implement a coordinated strategy to align diplomatic engagement efforts with the implementation of targeted sanctions in order to support efforts to facilitate the necessary conditions for free, fair, and transparent elections in Nicaragua.</text></paragraph><paragraph id="id55179ee7-f5ba-414e-8f55-0645c5faae81" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and every 90 days thereafter until December 31, 2022, the Secretary of State and the Secretary of the Treasury shall brief the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives on steps to be taken by the United States Government to develop and implement the coordinated strategy required by paragraph (1).</text></paragraph></subsection><subsection id="id095adc65-bdd4-4c0d-8e83-322accc93d85" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Targeted sanctions prioritization</header><paragraph id="id2d84d869-5b2f-40bf-ad80-235b25de2a0e" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Pursuant to the coordinated strategy required by subsection (a), the President shall prioritize the implementation of the targeted sanctions required under section 5 of the Nicaragua Investment Conditionality Act of 2018.</text></paragraph><paragraph id="id7b30331c-3fe9-4061-80ce-c1beb3cd19e1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Targets</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the President—</text><subparagraph id="id6990ED1FBBB34FE1A93A5F5E8C4552A1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">shall examine whether foreign persons involved in directly or indirectly obstructing the establishment of conditions necessary for the realization of free, fair, and transparent elections in Nicaragua are subject to sanctions under section 5 of the Nicaragua Investment Conditionality Act of 2018; and </text></subparagraph><subparagraph id="idF4A97E13FAC449D2878C5F06DB3B7040" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">should, in particular, examine whether the following persons have engaged in conduct subject to such sanctions:</text><clause id="ida4600fd5-0ee4-4be5-9869-c7a0163a0cc1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">Officials in the government of President Daniel Ortega.</text></clause><clause id="id71f81470-ffa9-4468-aa90-296180934586" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">Family members of President Daniel Ortega.</text></clause><clause id="id9d50b725-73a2-446d-8700-6348cbb86f0d" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">High-ranking members of the National Nicaraguan Police.</text></clause><clause id="id4eda75a0-aab8-4ec9-b791-2503a851fd76" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">High-ranking members of the Nicaraguan Armed Forces.</text></clause><clause id="idad4de7da-2c76-439f-adea-6969dd20d3df" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(v)</enum><text display-inline="yes-display-inline">Members of the Supreme Electoral Council of Nicaragua.</text></clause><clause id="idc51a6d559303460f948ee2c767f1ae02" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(vi)</enum><text display-inline="yes-display-inline">Officials of the Central Bank of Nicaragua. </text></clause><clause id="id2faa4b54-658e-45a1-9798-b58dcb8d7602" commented="no" display-inline="no-display-inline" display-inline="yes-display-inline">Individuals or entities affiliated with businesses engaged in corrupt financial transactions with officials in the government of President Daniel Ortega, his party, or his family.</text></clause><clause id="ida5ed3b03-9276-4289-8473-946e3367cd0f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ix)</enum><text display-inline="yes-display-inline">Individuals identified in the report required by section 8 as involved in significant acts of public corruption in Nicaragua. </text></clause></subparagraph></paragraph></subsection></section><section id="id7dc82bd8-4744-4b11-bd83-f6ec60b15abc" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Developing and implementing a coordinated sanctions strategy with diplomatic partners</header><subsection id="idd58d1961-ac4e-4cac-ad77-6bacbab92a3b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text><paragraph id="id8881820a-4133-4df9-a2e8-caca81ba0066" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">On June 21, 2019, the Government of Canada, pursuant to its Special Economic Measures Act, designated 9 officials of the Government of Nicaragua for the imposition of sanctions in response to gross and systematic human rights violations in Nicaragua.</text></paragraph><paragraph id="id0cbff54b-8731-427e-bd4b-127378baf721" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">On May 4, 2020, the European Union imposed sanctions with respect to 6 officials of the Government of Nicaragua identified as responsible for serious human rights violations and for the repression of civil society and democratic opposition in Nicaragua.</text></paragraph><paragraph id="id0dfa44b1-e79f-49af-8e1d-0330300e4811" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">On October 12, 2020, the European Union extended its authority to impose restrictive measures on <quote>persons and entities responsible for serious human rights violations or abuses or for the repression of civil society and democratic opposition in Nicaragua, as well as persons and entities whose actions, policies or activities otherwise undermine democracy and the rule of law in Nicaragua, and persons associated with them</quote>.</text></paragraph></subsection><subsection id="idd9c8d875-2fba-459a-a7c5-3bf26d52d7cb" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the United States should encourage the Government of Canada, the European Union and governments of members countries of the European Union, and governments of countries in Latin America and the Caribbean to use targeted sanctions with respect to persons involved in human rights violations and the obstruction of free, fair, and transparent elections in Nicaragua.</text></subsection><subsection id="id1fe17121-056f-4c2a-bbc1-1d9979d5ce16" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Coordinating international sanctions</header><text display-inline="yes-display-inline">The Secretary of State, working through the head of the Office of Sanctions Coordination established by section 1(h) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(h)</external-xref>), and in consultation with the Secretary of the Treasury, shall engage in diplomatic efforts with governments of countries that are partners of the United States, including the Government of Canada, governments of countries in the European Union, and governments of countries in Latin America and the Caribbean, to impose targeted sanctions with respect to the persons described in section 5(b) in order to advance democratic elections in Nicaragua.</text></subsection><subsection id="idd5fc5132-cbe8-4b31-ba06-9c14e3ce4cdc" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Briefing requirement</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and every 90 days thereafter until December 31, 2022, the Secretary of State, in consultation with the Secretary of the Treasury, shall brief the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives on the implementation of this section.</text></subsection></section><section id="id86437dcb-e86f-4586-b0f0-c4d30dc3f9ee" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Inclusion of Nicaragua in list of countries subject to certain sanctions relating to corruption</header><text display-inline="no-display-inline">Section 353 of title III of division FF of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended—</text><paragraph id="id65b3b876-30c0-46cd-88dc-435cb5a56759" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text style="OLC" level="section">and Honduras</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">, Honduras, and Nicaragua</header-in-text></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Classified report on the involvement of Ortega family members and Nicaraguan government officials in corruption</header><subsection id="id67820487-2f59-48e0-9bf2-6813261e5e55" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State, acting through the Bureau of Intelligence and Research of the Department of State, and in coordination with the Director of National Intelligence, shall submit a classified report to the appropriate congressional committees on significant acts of public corruption in Nicaragua that—</text><paragraph id="id92b85141-2089-4eb7-b519-9770444f6252" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">involve—</text><subparagraph id="id208771a2-7bea-4297-be03-5a6c149ae1e2" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the President of Nicaragua, Daniel Ortega;</text></subparagraph><subparagraph id="ided6419f4-183a-4a2a-95d5-512e08ac1596" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">members of the family of Daniel Ortega; and</text></subparagraph><subparagraph id="ida6825e25-047f-4c99-828e-45484fb55921" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">senior officials of the Ortega government, including—</text><clause id="iddc1ed02e-55fa-4636-8987-c0875e1dafee" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">members of the Supreme Electoral Council, the Nicaraguan Armed Forces, and the National Nicaraguan Police; and</text></clause><clause id="id3bcd0a45-f6bd-4d3d-a61d-461d55f674ba" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">elected officials from the Sandinista National Liberation Front party; </text></clause></subparagraph></paragraph><paragraph id="id27ddb548-d271-4dda-b992-5798e698f304" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">pose challenges for United States national security and regional stability;</text></paragraph><paragraph id="id0297241e-36c5-4dfc-aa11-68354555afe1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">impede the realization of free, fair, and transparent elections in Nicaragua; and</text></paragraph><paragraph id="id547250ee-7d4b-42be-9c84-34a0117c3b71" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">violate the fundamental freedoms of civil society and political opponents in Nicaragua.</text></paragraph></subsection><subsection id="id99775060-333b-4b97-88ca-1f49233a6326" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id8ea2f80e-09b7-40c4-a36f-e2c36f4f2cd7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Foreign section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Classified report on the activities of the Russian Federation in Nicaragua</header><subsection id="id53410A2E19AA45A2B41FA37BBF9D64B4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State, acting through the Bureau of Intelligence and Research of the Department of State, and in coordination with the Director of National Intelligence, shall submit a classified report to the appropriate congressional committees on activities of the Government of the Russian Federation in Nicaragua, including—</text><paragraph id="idf255dda5-8069-40d8-9147-64d5a8482563" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">cooperation between Russian and Nicaraguan military personnel, intelligence services, security forces, and law enforcement, and private Russian security contractors;</text></paragraph><paragraph id="iddb6c4c95-ad11-4915-be9f-5a00811dfa77" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">cooperation related to telecommunications and satellite navigation;</text></paragraph><paragraph id="idfda67916-1162-41f3-94bc-f894c4a14b79" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">other political and economic cooperation, including with respect to banking, disinformation, and election interference; and</text></paragraph><paragraph id="idbbb3cb68-4ef2-4097-84bd-27a6078acd00" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">the threats and risks that such activities pose to United States national interests and national security. </text></paragraph></subsection><subsection id="idDB85526DF93444338E32422AC27D2969" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Imposition of sanctions under section 231 of Countering America’s Adversaries Through Sanctions Act with respect to Government of Nicaragua</header><subsection id="id9620afe3e1d147a8bd33955c54d0755b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header><paragraph id="id3e2035036bff46ddb145bc3290e334a3" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State, acting through the Bureau of Intelligence and Research of the Department of State, and in coordination with the Director of National Intelligence and the Director of the Defense Intelligence Agency, shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report that includes—</text><subparagraph id="ide1dfdcde6a6b41199602922d5cfae21a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a list of—</text><clause id="id7b42276b010e48079f72a398bf43ca4f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">all equipment, technology, or infrastructure with respect to the military or intelligence sector of Nicaragua purchased, on or after January 1, 2011, by the Government of Nicaragua from an entity identified by the Department of State under section 231(e) of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9525">22 U.S.C. 9525(e)</external-xref>); and</text></clause><clause id="idb05ba565209940a7a1425b481850c62f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">all agreements with respect to the military or intelligence sector of Nicaragua entered into, on or after January 1, 2011, by the Government of Nicaragua with an entity described in clause (i); and</text></clause></subparagraph><subparagraph id="id4669d6e7fa9b47bf991c5bf8fe9db226" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a description of and date for each purchase and agreement described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id9b0b0965b3d3447684d1f2f752632e73" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be prepared after consideration of the content of the report of the Defense Intelligence Agency entitled, <quote>Russia: Defense Cooperation with Cuba, Nicaragua, and Venezuela</quote> and dated February 4, 2019.</text></paragraph><paragraph id="id43f00b35d5314378a4af811aa54747d6" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Form of report</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be submitted in unclassified form but may include a classified annex.</text></paragraph></subsection><subsection id="idb58be97f774d458abdf74891fa54db9d" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Review required</header><text display-inline="yes-display-inline">Not later than 30 days after submitting the report required by subsection (a), the Secretary of State, in coordination with the Director of National Intelligence and the Director of the Defense Intelligence Agency, shall—</text><paragraph id="idF8AA679BAB0A42DAB8E4F693276A902A" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">review whether any of the purchases or agreements included in the list required by subsection (a)(1)(A) that occurred after August 2, 2017, qualify as significant transactions described in section 231(a) of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9525">22 U.S.C. 9525(a)</external-xref>); and</text></paragraph><paragraph id="id07B97E27F3BD456BA197DDB32F789933" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on the results of the review conducted under paragraph (1).</text></paragraph></subsection><subsection id="ide3241febdade463ab385fbc9abd1a839" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Imposition of sanctions</header><text display-inline="yes-display-inline">Pursuant to the review conducted under subsection (b) and section 231 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9525">22 U.S.C. 9525</external-xref>), the President shall impose 5 or more of the sanctions described in section 235 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9529">22 U.S.C. 9529</external-xref>) with respect to each significant transaction identified pursuant to the review. </text></subsection></section><section id="idb1c4a8eb-e0ff-4277-b8e3-e3ef6cf010f9" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Report on human rights abuses in Nicaragua</header><subsection id="id35ffcbe8-089e-416a-a934-4313f14b417c" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that, since the June 2018 initiation of <quote>Operation Clean-up</quote>, an effort of the government of Daniel Ortega to dismantle barricades constructed throughout Nicaragua during social demonstrations in April 2018, the Ortega government has increased its abuse of campesinos and members of indigenous communities, including arbitrary detentions, torture, and sexual violence as a form of intimidation.</text></subsection><subsection id="iddaedd2ec-5312-42d4-b2c6-d0ae4edf7d65" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a report that documents the perpetration of gross human rights violations by the Ortega government against the citizens of Nicaragua, including campesinos and indigenous communities in the interior of Nicaragua.</text></subsection><subsection id="id627def67-c967-4b58-b49d-e80b962660b2" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by subsection (b) shall—</text><paragraph id="idbc567c37-dfb8-4194-9743-5643dfc13b17" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">include a compilation of human rights violations committed by the Ortega government against the citizens of Nicaragua, with a focus on such violations committed since April 2018, including human rights abuses and extrajudicial killings in—</text><subparagraph id="id17414898-3f9c-4d77-9230-916ff62afe03" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the cities of Managua, Carazo, and Masaya between April and June of 2018; and</text></subparagraph><subparagraph id="id5308a61c-2ee0-4bbf-8955-5d89fa33ca7b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the municipalities of Wiwili, El Cuá, San Jose de Bocay, and Santa Maria de Pantasma in the Department of Jinotega, Esquipulas in the Department of Rivas, and Bilwi in the North Caribbean Coast Autonomous Region between 2018 and 2021; </text></subparagraph></paragraph><paragraph id="id660cf5af-bb3f-45b2-bda7-8fd9892965bd" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">outline efforts by the Ortega government to intimidate and disrupt the activities of civil society organizations attempting to hold the government accountable for infringing on the fundamental rights and freedoms of the people of Nicaragua; and</text></paragraph><paragraph id="idec61676b-9a76-403b-b89e-06e7bd0f0fa3" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">provide recommendations on how the United States, in collaboration with international partners and Nicaraguan civil society, should leverage bilateral and regional relationships to curtail the gross human rights violations perpetrated by the Ortega government and better support the victims of human rights violations in Nicaragua.</text></paragraph></subsection><subsection id="id703242c9-f48f-450f-bfbd-134fb14793e3" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id8838a3c5-0606-46a9-b269-66a69ca7cb32" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations of the Senate; and</text></paragraph><paragraph id="id25c2aa5f-b106-48e3-9c39-89f1a7742725" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs of the House of Representatives.</text></paragraph></subsection></section><section id="idf20028cb-f800-4f8f-8e4f-f29da4da79e3" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Supporting independent news media and freedom of information in Nicaragua</header><subsection id="id72dba3c0-5908-4292-a624-847c19b50a9d" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State, the Administrator for the United States Agency for International Development, and the Chief Executive Officer of the United States Agency for Global Media, shall submit to Congress a report that includes—</text><paragraph id="id7f82e461-3973-446b-984c-603d391f48ab" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">an evaluation of the governmental, political, and technological obstacles faced by the people of Nicaragua in their efforts to obtain accurate, objective, and comprehensive news and information about domestic and international affairs; and</text></paragraph><paragraph id="id38b7e7f5-298d-4bf1-9121-435326b16d27" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a list of all TV channels, radio stations, online news sites, and other media platforms operating in Nicaragua that are directly or indirectly owned or controlled by President Daniel Ortega, members of the Ortega family, or known allies of the Ortega government.</text></paragraph></subsection><subsection id="id508282ed-e8f8-45d9-b61b-0e9250538b6b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include—</text><paragraph id="idda1ec8e6-846b-4bb7-be17-4d31a9be87c4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the extent to which the current level and type of news and related programming and content provided by the Voice of America and other sources is addressing the informational needs of the people of Nicaragua;</text></paragraph><paragraph id="id1b527a10-0927-4849-b77c-99eece6e1f85" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a description of existing United States efforts to strengthen freedom of the press and freedom of expression in Nicaragua, including recommendations to expand upon those efforts; and</text></paragraph><paragraph id="ida0efe5f0-9ad0-4f3f-90c3-13c53929f017" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">a strategy for strengthening independent broadcasting, information distribution, and media platforms in Nicaragua.</text></paragraph></subsection></section><section id="id32900a8e-370b-4e75-a701-a31e6fb0b830" changed="not-changed" commented="no" display-inline="no-display-inline"
