which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Office of Regional Greenhouse Gas Reduction Programs within the Environmental Protection Agency, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Regional Greenhouse Gas Reduction Act of 2021</short-title></quote>.</text></section><section id="id5D984FF7819741F8AD9CC02C3428798C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id15526E38006143C99F6486FF37445566"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idB9226296DF03476A8E47BD1FBDB1938E"><enum>(2)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> means carbon dioxide, methane, nitrous oxide, hydrofluorocarbon, perfluorocarbon, and sulfur hexafluoride.</text></paragraph><paragraph id="id7F4D2F0DF57146C9BD76CAEA68B23A6D"><enum>(3)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Regional Greenhouse Gas Reduction Programs established under section 3(a).</text></paragraph><paragraph id="idA92617A3E9594B7297013295737A0DD3"><enum>(4)</enum><header>Regional greenhouse gas reduction program</header><text>The term <term>regional greenhouse gas reduction program</term> means a program that uses market-based tools to reduce greenhouse gases across States at the regional level, such as—</text><subparagraph id="id6411477134EE499B849F8F97D3D0A1FE"><enum>(A)</enum><text>the Regional Greenhouse Gas Initiative organized among, as of March 24, 2021, the States of Connecticut, Delaware, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Rhode Island, Vermont, and Virginia to cap and reduce carbon dioxide emissions from the power sector; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6BEB8BD5447C479DB800CB48E8A68FE1"><enum>(B)</enum><text>the Western Climate Initiative, a regional carbon trading system organized between the State of California and Quebec, Canada.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27204CCF7E54416C9CED85D5FFED492D"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id821C65BB464749D8BF983611BE55EFC1"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id78249FA1075145BD8FF3D894E9F51F37"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7020696D19614AD784710A910C34D98D"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC0E5E63CEFDF4D34A8DA6DB5C0D509F8"><enum>(D)</enum><text>the United States Virgin Islands;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4A71860420844DD2AA4D97A44896D954"><enum>(E)</enum><text>Guam;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4E95C37BFCC443390FE9A825FB66A84"><enum>(F)</enum><text>American Samoa;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5365563B49214CDAAF74D30FC34A29ED"><enum>(G)</enum><text>the Commonwealth of the Northern Mariana Islands; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD3FF927581AB425CB72046C2F495CA40"><enum>(H)</enum><text>the Trust Territory of the Pacific Islands.</text></subparagraph></paragraph><paragraph id="id0C549DA559DC432CA11CD86DF37DB903"><enum>(6)</enum><header>Unit of local government</header><text>The term <term>unit of local government</term> means—</text><subparagraph id="idFFF32C01BFB249258D7F3A8787A6A81E"><enum>(A)</enum><text>a city, town, borough, county, parish, district, association, or other public body created by or pursuant to State law;</text></subparagraph><subparagraph id="id35B285F990C84C8D9D6E4E0A1C01C2CA"><enum>(B)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3115ECA25FA642F9B46C644891A4A5F2"><enum>(C)</enum><text>a Tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subparagraph></paragraph></section><section id="id4a61a51ac52a45d3ad2953125e96c47a"><enum>3.</enum><header>Office of Regional Greenhouse Gas Reduction Programs</header><subsection id="id609924b200d34a3b9bfacb752b4305c3"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, there shall be established within the Environmental Protection Agency an office, to be known as the <quote>Office of Regional Greenhouse Gas Reduction Programs</quote>.</text></subsection><subsection id="id24d976e44cd540b3ad476e8c5788bf07"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Office shall be—</text><paragraph id="id36AE98EAD7BC4370B43852886D9E70E7"><enum>(1)</enum><text>to support, and assist in the expansion of, existing regional greenhouse gas reduction programs; and</text></paragraph><paragraph id="idA0FAC51391ED4D5AA8959638D9BEC1C4"><enum>(2)</enum><text>to facilitate the establishment of new regional greenhouse gas reduction programs.</text></paragraph></subsection><subsection id="id1671186490b2416cb880302f6b90d8d9"><enum>(c)</enum><header>Director</header><text>The Office shall be headed by a Director, who shall be appointed by the Administrator—</text><paragraph id="id9fa27cb70f1f4320bc061bd3c0357a4b"><enum>(1)</enum><text>without regard to political affiliation; and</text></paragraph><paragraph id="idbebc8f9601d4459abe28149f3fa3c302"><enum>(2)</enum><text>solely on the basis of fitness to perform the duties of the Director described in subsection (d).</text></paragraph></subsection><subsection id="ida41e6e09286142ed940c93b92c40ad15"><enum>(d)</enum><header>Duties of director</header><text>The Director of the Office shall—</text><paragraph id="id29b9e68b5d9943c2bbfd6bce18f76534"><enum>(1)</enum><text>on request by a State or other relevant entity, provide access to Federal data relevant to regional greenhouse gas reduction programs;</text></paragraph><paragraph id="id78824a8f4a324605b0fa73fb3b124409"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD8816320E1564127957DC272F63900A0"><enum>(A)</enum><text>assist States and other relevant entities with analysis and modeling of technical, economic, and public policy issues relating to regional greenhouse gas reduction programs; and</text></subparagraph><subparagraph id="idBBD78304411146A5BA0BBE51D5F85726" indent="up1"><enum>(B)</enum><text>provide any other relevant technical support, on request;</text></subparagraph></paragraph><paragraph id="id8bc6822b241d4b539287af19962036ed"><enum>(3)</enum><text>develop and share best practices based on existing regional greenhouse gas reduction programs;</text></paragraph><paragraph id="id07cc7ad882114754a895f1870ab4f935"><enum>(4)</enum><text>track and report on greenhouse gas emissions in States participating in regional greenhouse gas reduction programs using data collected by the Environmental Protection Agency;</text></paragraph><paragraph id="id99265dd9160f4ae28d595f8cf52c2cd0"><enum>(5)</enum><text>designate a representative in the Office—</text><subparagraph id="id6cea18c9a6a943909609896e7157bace"><enum>(A)</enum><text>to act as a liaison to regional greenhouse gas reduction programs; and</text></subparagraph><subparagraph id="idcd910ca5b32843619f578a182ee48ed1"><enum>(B)</enum><text>to communicate with States and other entities seeking to establish regional greenhouse gas reduction programs;</text></subparagraph></paragraph><paragraph id="id0ebb7f7ebd9f413aa07a9828b8fb6d35"><enum>(6)</enum><text>facilitate communication among Federal and State agencies, agencies of units of local government, and stakeholders to share lessons learned about greenhouse gas monitoring and control programs, through methods such as workshops, conferences, websites, and newsletters;</text></paragraph><paragraph id="id98dbe1154ff1486cadec31722833abba"><enum>(7)</enum><text>administer the grant program established under section 4;</text></paragraph><paragraph id="id9B80949560AF4447958E914F156F9380"><enum>(8)</enum><text>coordinate with the interagency task force established under section 5; and</text></paragraph><paragraph id="id4dcee2e2ae10430c97f989e502de85af"><enum>(9)</enum><text>carry out any other activity relevant to the function of the Office.</text></paragraph></subsection><subsection id="id1cdbc8fe2c0e4e86b7d0aefab07cd1f0"><enum>(e)</enum><header>Report</header><text>The Administrator, acting through the Director of the Office, shall submit a biannual report to Congress that describes and summarizes the efforts made and technical assistance provided by the Office to help States improve the health and environment of communities in those States.</text></subsection><subsection id="ideb33fa2bfb714e9685a87299083c3f9d"><enum>(f)</enum><header>Access to information</header><text>On request of the Director, the head of each Federal agency shall provide the Director any information and data necessary for any analyses or reports required as part of the function of the Office.</text></subsection><subsection id="id10153524caa44cb08279d0890f414042"><enum>(g)</enum><header>No additional reporting requirements</header><text>Nothing in this section authorizes the Administrator or the Director of the Office to impose an additional reporting requirement on a State participating in a regional greenhouse gas reduction program.</text></subsection></section><section id="id7be4bb98046d48559da562911330b24a"><enum>4.</enum><header>Regional greenhouse gas reduction program startup grants</header><subsection id="id843fdc08ba0248f093d59e7e21d98131"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="idcbd028ddbc224497ba04f7802488d19b"><enum>(1)</enum><text>a State;</text></paragraph><paragraph id="id1f73db4e70e141239777969d3d93e94b"><enum>(2)</enum><text>a unit of local government; and</text></paragraph><paragraph id="id08147fd2d90d45f19e43a1cf01df00fa"><enum>(3)</enum><text>a regional consortium that is a partnership between or among 1 or more entities described in paragraphs (1) and (2).</text></paragraph></subsection><subsection id="id877c19e6522c48d78a19d6609ade92c5"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Director of the Office shall establish a program within the Office to provide grants to eligible entities, on a competitive basis, to take active preliminary steps (including information-gathering) towards developing or participating in a regional greenhouse gas reduction program.</text></subsection><subsection id="id0d428b8fdc994a5296fb92f0960b10a6"><enum>(c)</enum><header>Application</header><text>An eligible entity shall submit to the Director of the Office an application to receive a grant under subsection (b) at such time, in such manner, and containing such information as the Director of the Office may require.</text></subsection><subsection id="idE4BA758EFEF14AF481B633E419BEA1D8"><enum>(d)</enum><header>Minimum grant amount</header><text>A grant awarded under subsection (b) shall be in an amount that is not less than $250,000.</text></subsection><subsection id="idf60156fe4d2b49b7b08353c50ae61d39"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Director of the Office such amounts as are necessary to carry out this section, to remain available until expended.</text></subsection></section><section id="id65FA2B8E79994E049887CCD9AFF480E9"><enum>5.</enum><header>Interagency task force</header><subsection id="idB22039691F204E04A7F194CFF8C3EA18"><enum>(a)</enum><header>Establishment</header><text>The Administrator shall establish an interagency task force (referred to in this section as the <quote>task force</quote>)—</text><paragraph commented="no" id="id7b71a31f57fc4b8a83f4092490673e36"><enum>(1)</enum><text>to determine how best to support existing regional greenhouse gas reduction programs;</text></paragraph><paragraph commented="no" id="id096b0243bd9048b28011e1d954826eda"><enum>(2)</enum><text>to consult with States to determine how best to support States and other entities that seek to develop regional greenhouse gas reduction programs or expand existing regional greenhouse gas reduction programs; and</text></paragraph><paragraph commented="no" id="id97f93989fbe4494f967baa0c41677b60"><enum>(3)</enum><text>to analyze existing gaps in Federal data that are relevant to the formation or analysis of regional greenhouse gas reduction programs.</text></paragraph></subsection><subsection commented="no" id="id7d6bcdb509b3440e9806763223db6c0b"><enum>(b)</enum><header>Members</header><text>The task force shall—</text><paragraph commented="no" id="idA71E7AF181A34728BA2EE52452B56CA7"><enum>(1)</enum><text>be headed by a representative from the Office; and</text></paragraph><paragraph commented="no" id="idF96E073A6CFD465C9BECD535338F5C4F"><enum>(2)</enum><text>include representatives from—</text><subparagraph commented="no" id="ida90fbc8cdad6482ca38154fc375aef8f"><enum>(A)</enum><text>the Department of Energy;</text></subparagraph><subparagraph commented="no" id="id1308bbec5863407c94626ad6fd90b718"><enum>(B)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph commented="no" id="id4e08091204fd47f4b68ea6b0bc0d2267"><enum>(C)</enum><text>the Department of Transportation; and</text></subparagraph><subparagraph commented="no" id="id129f2b9020de40eea7a2f20946df0980"><enum>(D)</enum><text>the Department of the Interior.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb36dded384404a4bbd3d04a687192f0b"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date on which the task force is established under subsection (a), the task force shall submit to Congress a report that describes a plan—</text><paragraph commented="no" display-inline="no-display-inline" id="id6CD96C8E66324D34A3EDA32D137FE585"><enum>(1)</enum><text>to support existing regional greenhouse gas reduction programs;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8BC23425470443C985CDAA4FCB7E999"><enum>(2)</enum><text>to support States and other entities seeking to develop regional greenhouse gas reduction programs; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEAD8F78AE61548618BD44C20F9AB36FC"><enum>(3)</enum><text>that addresses Federal data gaps with respect to regional greenhouse gas reduction programs.</text></paragraph></subsection></section></legis-body></bill>
