which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure due process protections of individuals in the United States against unlawful detention based solely on a protected characteristic. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Korematsu-Takai Civil Liberties Protection Act of 2021</short-title></quote>.</text></section><section id="idD38C18EA4BDF4A30A978803B10190372"><enum>2.</enum><header>Prohibition against unlawful detention</header><text display-inline="no-display-inline">Section 4001 of title 18, United States Code, is amended—</text><paragraph id="idC0C9163AA2E6468A807EA9C8FB3EB273"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="idC3CCD3F528044DCA85CB1D373008CB8C"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id6F1F3F08D37D4DECA0B5DA87AB30BCF8"><subsection id="idfe7f6d526a9d4946b395a47185f61cb6"><enum>(b)</enum><header>Prohibition on detention based on protected characteristics</header><paragraph id="id928C7D3372864C9F80533663AE96D243"><enum>(1)</enum><header>In general</header><text>No individual may be imprisoned or otherwise detained based solely on an actual or perceived protected characteristic of the individual.</text></paragraph><paragraph id="id33A7826BAFBD4C149F684DE3D9375C4C"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <quote>protected characteristic</quote> includes each of the following:</text><subparagraph id="idC915061D3DEF4FF597624FB138C8636C"><enum>(A)</enum><text>Race.</text></subparagraph><subparagraph id="id639885A874364261BFCF17E95EDB844B"><enum>(B)</enum><text>Ethnicity.</text></subparagraph><subparagraph id="id409B5C6BABE2496B93F523C2EC0F2277"><enum>(C)</enum><text>National origin.</text></subparagraph><subparagraph id="idD9093D5AF4B246FD9938604C799436DE"><enum>(D)</enum><text>Religion.</text></subparagraph><subparagraph id="idB09B511BAF514D479874FD9020ADA40E"><enum>(E)</enum><text>Sex.</text></subparagraph><subparagraph id="idFF40A6F6B36B469F97CFB386555B96C0"><enum>(F)</enum><text>Gender identity.</text></subparagraph><subparagraph id="idB992B14B7CA846208707388F07B07F4F"><enum>(G)</enum><text>Sexual orientation.</text></subparagraph><subparagraph id="id0D730A976EA246A7B8CDB5C877FE188E"><enum>(H)</enum><text>Disability.</text></subparagraph><subparagraph id="id2F1F652D01DA48A8B4CC3231E8E62597"><enum>(I)</enum><text>Any additional characteristic that the Attorney General determines to be a protected characteristic.</text></subparagraph></paragraph><paragraph id="id1185C29022BF441BBE85B10A267C28DE"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to allow the Attorney General to remove a characteristic described in subparagraphs (A) through (H) of paragraph (2) from the definition of the term <quote>protected characteristic</quote> under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
