which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Environmental Justice Mapping Committee, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmental Justice Mapping and Data Collection Act of 2021</short-title></quote>.</text></section><section id="idD785FC116164405DAA3C9284F38F17E2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="ide69f886986a941619d4298d80c14441a"><enum>(1)</enum><text>environmental hazards causing adverse health outcomes have disproportionately affected environmental justice communities as a result of systemic injustices relating to factors that include race and income;</text></paragraph><paragraph id="id5ff2b478f2ce4c839b110d9bb18acb16"><enum>(2)</enum><text>environmental justice communities have increased vulnerability to the adverse effects of climate change and need significant investment to face current and future environmental hazards;</text></paragraph><paragraph id="id5c3c21ce3c9847d0b03f0878965b0d58"><enum>(3)</enum><text>the Federal Government has lacked a cohesive and consistent strategy to carry out the responsibilities of Federal agencies described in Executive Order 12898 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to Federal actions to address environmental justice in minority populations and low-income populations);</text></paragraph><paragraph id="id8971be7240a04b83b18a14a0f7b9436e"><enum>(4)</enum><text>it is necessary that the Federal Government meaningfully engage environmental justice communities in the process of developing a robust strategy to address environmental justice, including high levels of review, input, and consent;</text></paragraph><paragraph id="id24ab98cce0634ff7b40097eee8ca7e1b"><enum>(5)</enum><text>there is a lack of nationwide high-quality data relating to environmental justice concerns, such as socioeconomic factors, air pollution, water pollution, soil pollution, and public health, and a failure to update the existing data with adequate frequency;</text></paragraph><paragraph id="id10779070f5c0469ab32a62b5f4e7db3e"><enum>(6)</enum><text>there is no nationally consistent method to identify environmental justice communities based on the cumulative effects of socioeconomic factors, pollution burden, and public health;</text></paragraph><paragraph id="id10F0BFC5C7214B0FB7E23A1108527B1C"><enum>(7)</enum><text>a method described in paragraph (6) is needed to correct for racist and unjust practices leading to historical and current environmental injustices through the targeted investment in environmental justice communities of at least 40 percent of the funds provided for a clean energy transition and other related investments, including transportation infrastructure, housing infrastructure, and water quality infrastructure;</text></paragraph><paragraph id="id4d7f91c04afd48378592c620a22b1c09"><enum>(8)</enum><text>funds targeted for environmental justice communities should include set-asides for technical assistance and capacity building for environmental justice communities to access the funds;</text></paragraph><paragraph id="id396fd31c069e4f0284ffd9efe9335641"><enum>(9)</enum><text>particular oversight and care are necessary when investing in environmental justice communities to ensure that existing issues are not exacerbated and new issues are not created, particularly issues relating to pollution burden and the displacement of residents;</text></paragraph><paragraph id="id17cf6c309bbb4ce7b2e61cf8bcf9c434"><enum>(10)</enum><text>several States, academic institutions, and nonprofit organizations have engaged in cumulative impact environmental justice mapping efforts that can serve as references for a Federal mapping effort;</text></paragraph><paragraph id="id95c4a17e06f9423c8e6a24431aa65e87"><enum>(11)</enum><text>many environmental justice communities, such as communities in <quote>Cancer Alley</quote> in the State of Louisiana, have been clearly affected by extreme environmental hazards such that the communities—</text><subparagraph id="id784FFE4959274A3EA4E4CC48CFA0C8A7"><enum>(A)</enum><text>are identifiable before the establishment of the tool under subsection (b) of section 5 and the completion of the data gap audit under subsection (d) of that section; and </text></subparagraph><subparagraph id="id8016FC2BF7914AD9B320D19EDECF127C"><enum>(B)</enum><text>should be eligible for programs targeted toward environmental justice communities that have faced extreme environmental hazards before the establishment of that tool and the completion of that audit;</text></subparagraph></paragraph><paragraph id="idc9aa4269731044c8adbf1603ddcc6b55"><enum>(12)</enum><text>in addition to investment in environmental justice communities, pollution reduction is essential to achieving equitable access to a healthy and clean environment and an equitable energy system; and</text></paragraph><paragraph id="id1ec394198e0d476091e6eede941e668b"><enum>(13)</enum><text>specific policy and permitting decisions and investments may rely on different combinations of data sets and indicators relating to environmental justice, and race alone may be considered a criterion when assessing the susceptibility of a community to environmental injustice.</text></paragraph></section><section id="id0779BBB5FB5C458395943424C7156D44"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id860A632E0FBA4DCEAFE1116E9F183985"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="id4036210F742F48D486FF25955787D39A"><enum>(2)</enum><header>Advisory council</header><text>The term <term>advisory council</term> means the advisory council established under section 4(d)(2)(A).</text></paragraph><paragraph id="id6690FCA39CC548CCB14EA6AA964C84F4"><enum>(3)</enum><header>Committee</header><text>The term <term>Committee</term> means the Environmental Justice Mapping Committee established by section 4(a).</text></paragraph><paragraph id="id096B9C3AE66B4C048200BEEAC8341DF6"><enum>(4)</enum><header>Environmental justice</header><text>The term <term>environmental justice</term> means the fair treatment and meaningful involvement of all people regardless of race, color, culture, national origin, or income, with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies to ensure that each person enjoys—</text><subparagraph id="id4cb1a93a61644fa6a157b51496510a1f"><enum>(A)</enum><text>the same degree of protection from environmental and health hazards; and</text></subparagraph><subparagraph id="idcfb5e934914d40edae1790ef40fdef8d"><enum>(B)</enum><text>equal access to any Federal agency action relating to the development, implementation, and enforcement of environmental laws, regulations, and policies for the purpose of having a healthy environment in which to live, learn, work, and recreate. </text></subparagraph></paragraph><paragraph id="id20A6F1FC7D2644259E107F4E29D4E1CF"><enum>(5)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and indigenous communities, that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects, as compared to other communities.</text></paragraph><paragraph id="id855494BFBA4E4A13A0B204D050C2D1A6"><enum>(6)</enum><header>Ground-truthing</header><text>The term <term>ground-truthing</term> means a community fact-finding process by which residents of a community supplement technical information with local knowledge for the purpose of better informing policy and project decisions. </text></paragraph><paragraph id="id4B23185139E344EC9D8CE67E587A9F5A"><enum>(7)</enum><header>Relevant stakeholder</header><text>The term <term>relevant stakeholder</term> means—</text><subparagraph id="id52FD3E57A39641159289D8A75F97BE13"><enum>(A)</enum><text>a representative of a regional, State, Tribal, or local government agency;</text></subparagraph><subparagraph id="id2014658D54304B87826B0C9D132E0889"><enum>(B)</enum><text>a representative of a nongovernmental organization with experience in areas that may include Tribal relations, environmental conservation, city and regional planning, and public health; </text></subparagraph><subparagraph id="id41B15F085E2849CB942C102C030950A6"><enum>(C)</enum><text>a representative of a labor union;</text></subparagraph><subparagraph id="ida9242b06c6044780929c393b8aeac7f9"><enum>(D)</enum><text>a representative or member of—</text><clause id="idD13DD9A56F1F41CABAE3D2151FCBF476"><enum>(i)</enum><text>an environmental justice community; or</text></clause><clause id="id3696BF0A698D456D9E276D44C0C5BAD9"><enum>(ii)</enum><text>a community-based organization for an environmental justice community;</text></clause></subparagraph><subparagraph id="idFFA7052E1D1F4F68B5D13ACA9281449C"><enum>(E)</enum><text>an individual with expertise in cumulative impacts, geospatial data, and environmental justice, particularly such an individual from an academic or research institution; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4269AB7A3F154D26866317906C65BBE5"><enum>(F)</enum><text>an advocate with experience in environmental justice who represents an environmental justice community. </text></subparagraph></paragraph></section><section id="idE7F335AED4694ADB9442FFCE445A48E0"><enum>4.</enum><header>Establishment of Committee</header><subsection id="id85088b513f684eb785b1e4f9cea35579"><enum>(a)</enum><header>In general</header><text>There is established a committee, to be known as the <quote>Environmental Justice Mapping Committee</quote>.</text></subsection><subsection id="id7f4b70eb882b4e15b3dc38fc2ffb34b5"><enum>(b)</enum><header>Membership</header><paragraph id="ida3fe54c2d98c4e859dce1b321d17e875"><enum>(1)</enum><header>In general</header><text>The Committee shall be composed of not fewer than 1 representative of each of the following:</text><subparagraph id="id0fdfd6db3b91443bbddfafc7639a59a0"><enum>(A)</enum><text>Of the Environmental Protection Agency—</text><clause id="idfb9de13ada9a41a582c9ea5ddf32f5f9"><enum>(i)</enum><text>the Office of Air and Radiation;</text></clause><clause id="ida95108f0b5704b429838892c34f11614"><enum>(ii)</enum><text>the Office of Chemical Safety and Pollution Prevention;</text></clause><clause id="id2201e58c2c374db1bba668344cc3352d"><enum>(iii)</enum><text>the Office of International and Tribal Affairs;</text></clause><clause id="ide38ddebd0baa4df6bba53ae65457036f"><enum>(iv)</enum><text>the Office of Land and Emergency Management;</text></clause><clause id="ida701a57e5dbc477b98801f9415e6fd51"><enum>(v)</enum><text>the Office of Water; </text></clause><clause id="ide0b13300ccaf4599aa33f855c6d3b3f8"><enum>(vi)</enum><text>the Office of Environmental Justice;</text></clause><clause id="idB4A46EDED92949A18F5183E4A9B25509"><enum>(vii)</enum><text>the Office of Research and Development; and</text></clause><clause id="id8E23220A0BFE480F928EE37ED3649A74"><enum>(viii)</enum><text>the Office of Public Engagement and Environmental Education.</text></clause></subparagraph><subparagraph id="idFA0FC1FF31BA4E59A3E220859421491F"><enum>(B)</enum><text>The Council on Environmental Quality.</text></subparagraph><subparagraph id="id85842e70949b486ebb4e5fee931cb6ea"><enum>(C)</enum><text>Of the Department of Commerce—</text><clause id="id1765ed28e68c4132a3d9b57c75b4ac21"><enum>(i)</enum><text>the Office of Oceanic and Atmospheric Research, including not fewer than 1 representative of the Climate Program Office;</text></clause><clause id="id4a14b867d19b4f3591b22b21c5028649"><enum>(ii)</enum><text>the Economics and Statistics Administration, including not fewer than 1 representative of the Bureau of Economic Analysis; and</text></clause><clause id="id482D17E5E5364337B3C15DB4CF802F1A"><enum>(iii)</enum><text>the National Institute of Standards and Technology.</text></clause></subparagraph><subparagraph id="id31cf995a783c48b0ae69984195f7fdaf"><enum>(D)</enum><text>Of the Department of Health and Human Services—</text><clause id="id6ffdad91edc44816ad3d22d3fb5249db"><enum>(i)</enum><text>the Centers for Disease Control and Prevention, not including the Agency for Toxic Substances and Disease Registry;</text></clause><clause id="idba66465346da4874bbf2aeeec6805acb"><enum>(ii)</enum><text>the Agency for Toxic Substances and Disease Registry;</text></clause><clause id="id1eb327a68da44a049751dd163f85ddb9"><enum>(iii)</enum><text>the Administration for Children and Families;</text></clause><clause id="ided5a2d30653c48d0a0d3c58b50337f63"><enum>(iv)</enum><text>of the National Institutes of Health—</text><subclause id="idD68AB5ABF760488FAC50BC1278DB14EB"><enum>(I)</enum><text>the National Institute of Environmental Health Sciences;</text></subclause><subclause id="id090082E02A704A619870A78A86D1F210"><enum>(II)</enum><text>the National Institute of Mental Health; and</text></subclause><subclause id="idB85C3528A4374EA1B360E75016BA6749"><enum>(III)</enum><text>the National Institute on Minority Health and Health Disparities; and</text></subclause></clause><clause id="idbae984321a924d2ca9339a764e29539d"><enum>(v)</enum><text>the Office for Civil Rights.</text></clause></subparagraph><subparagraph id="id142b2315e6494102bc792e0e4c256429"><enum>(E)</enum><text>Of the Department of the Interior—</text><clause id="id90fb530a26ac4f059e5d91f6aadb04ea"><enum>(i)</enum><text>the Bureau of Indian Affairs; </text></clause><clause id="id0cc5da3035904e60b9e4662b9b4f0699"><enum>(ii)</enum><text>the Office of Civil Rights; and</text></clause><clause id="id1EF9BD22BD70405BB44E92EBEB149423"><enum>(iii)</enum><text>the United States Geological Survey.</text></clause></subparagraph><subparagraph id="id148478d89bda4abeaa6fbede6503a4f2"><enum>(F)</enum><text>The Forest Service.</text></subparagraph><subparagraph id="id8672c8cf716c44ee8b5cd789ffca4fe4"><enum>(G)</enum><text>The Department of Housing and Urban Development.</text></subparagraph><subparagraph id="id2e0c8d4cd7044b109d3abd6dfbcf660b"><enum>(H)</enum><text>The Department of Energy.</text></subparagraph><subparagraph id="id8162940c15f94446a8c39d1fba249449"><enum>(I)</enum><text>The Department of Transportation.</text></subparagraph><subparagraph id="id0f96a46e3a714edd9f96b3346b8b45df"><enum>(J)</enum><text>The Department of Justice.</text></subparagraph><subparagraph id="id9a7dacafa4a34442aeab22286a2002f1"><enum>(K)</enum><text>The Federal Energy Regulatory Commission.</text></subparagraph><subparagraph id="id71E6E14D658543A68D4D5A16DEFB9FCE"><enum>(L)</enum><text>The Department of the Treasury.</text></subparagraph><subparagraph id="id27d77d778164490e9bdb5dd60453bfed"><enum>(M)</enum><text>Such other Federal departments, agencies, and offices as the Administrator determines to be appropriate, particularly offices relating to public engagement.</text></subparagraph></paragraph><paragraph id="id169712871d3648e5bafc6ba6d25bd417"><enum>(2)</enum><header>Selection of representatives</header><text>The head of a department or agency described in paragraph (1) shall, in appointing to the Committee a representative of the department or agency, select a representative—</text><subparagraph id="id943c4bfc38554d24b13ae66e00825bb0"><enum>(A)</enum><text>of a component of the department or agency that is among the components that are the most relevant to the responsibilities of the Committee; or</text></subparagraph><subparagraph id="idd6f84660df4d4ca99336e155580f03d2"><enum>(B)</enum><text>who has expertise in areas relevant to those responsibilities, such as demographic indicators relating to socioeconomic hardship, environmental justice, public engagement, public health, exposure to pollution, future climate and extreme weather mapping, affordable energy, sustainable transportation, and access to water, food, and green space.</text></subparagraph></paragraph><paragraph id="id6993eda75d7a4b33930e08621f243454"><enum>(3)</enum><header>Co-chairs</header><subparagraph id="id042500ebf0f04234bcf01b6f5f1a4412"><enum>(A)</enum><header>In general</header><text>The members of the Committee shall select 3 members to serve as co-chairs of the Committee—</text><clause id="id292FFEB5C5204126B18C70CC2A09B933"><enum>(i)</enum><text>1 of whom shall be a representative of the Environmental Protection Agency;</text></clause><clause id="idF2DBA782324A42F3AB96E15E17FEEA49"><enum>(ii)</enum><text>1 of whom shall be a representative of the Council on Environmental Quality; and</text></clause><clause id="idC12F95AC7E7041A0B15A2DB2EFEAEDCA"><enum>(iii)</enum><text>1 of whom shall have substantial experience in public engagement.</text></clause></subparagraph><subparagraph id="idc557a1f536734699b089a4d15acc2543"><enum>(B)</enum><header>Terms</header><text>Each co-chair shall serve for a term of not more than 3 years.</text></subparagraph><subparagraph id="id76f41c06cd5b4c798336c3b06b149f82"><enum>(C)</enum><header>Responsibilities of co-chairs</header><text>The co-chairs of the Committee shall—</text><clause id="id31a4f1eb064c4028a06e3f1d8c3a8ce0"><enum>(i)</enum><text>determine the agenda of the Committee, in consultation with other members of the Committee;</text></clause><clause id="id2494b591a72a4d708925c49f18ef698a"><enum>(ii)</enum><text>direct the work of the Committee, including the oversight of a meaningful public engagement process; and</text></clause><clause id="id77ba0094277e4e299fc72dd0e92c573e"><enum>(iii)</enum><text>convene meetings of the Committee not less frequently than once each fiscal quarter.</text></clause></subparagraph></paragraph></subsection><subsection id="id9fad992d45924b459894c5db8fc4cbac"><enum>(c)</enum><header>Administrative support</header><paragraph id="id45C54E7D8B0C4A17B87943E45F101F1C"><enum>(1)</enum><header>In general</header><text>The Administrator shall provide technical and administrative support to the Committee.</text></paragraph><paragraph id="id911FD024B80D4E6BA05F8EF2621AA137"><enum>(2)</enum><header>Funding</header><text>The Administrator may carry out paragraph (1) using, in addition to any amounts made available under section 7, amounts authorized to be appropriated to the Administrator before the date of enactment of this Act and available for obligation as of that date of enactment.</text></paragraph></subsection><subsection id="idfb8fbff06b294bd1899ad720e528d33f"><enum>(d)</enum><header>Consultation</header><paragraph id="ide9338ab743e54b05858d20d8cabb1916"><enum>(1)</enum><header>In general</header><text>In carrying out the duties of the Committee, the Committee shall consult with relevant stakeholders.</text></paragraph><paragraph id="idc585f9860881425a83ecd3b2e7863139"><enum>(2)</enum><header>Advisory council</header><subparagraph id="idFA50A2D51F534779854A81FA38086573"><enum>(A)</enum><header>In general</header><text>The Committee shall establish an advisory council composed of a balanced proportion of relevant stakeholders, at least ½ of whom shall represent environmental justice communities.</text></subparagraph><subparagraph id="id38CBC33E1EB64D81BAB98598E5404B80"><enum>(B)</enum><header>Chair</header><text>The advisory council shall be chaired by an environmental justice advocate or other relevant stakeholder with substantial experience in environmental justice.</text></subparagraph><subparagraph id="idDB5C55B30FAA4E759118C11C128C52FA"><enum>(C)</enum><header>Requirements</header><text>Consultation described in paragraph (1) shall include—</text><clause id="idC6BED8C6E73E476CA9825007054CDE82"><enum>(i)</enum><text>early and regular engagement with the advisory council, including in carrying out public engagement under paragraph (3); and</text></clause><clause id="id477B900533614875B1F32E47BE852124"><enum>(ii)</enum><text>consideration of the recommendations of the advisory council.</text></clause></subparagraph><subparagraph id="id097110387EEE4303AB2D6B23D40D4088"><enum>(D)</enum><header>Recommendations not used</header><text>If the Committee does not use a recommendation of the advisory council, not later than 60 days after the date on which the Committee receives notice of the recommendation, the Committee shall—</text><clause id="id7142D1B558EC49919DD1731E4ECDDC37"><enum>(i)</enum><text>make available to the public on an internet website of the Environmental Protection Agency a written report describing the rationale of the Committee for not using the recommendation; and</text></clause><clause id="id4EE910B2CD75417F9F98717C2E7FCBE9"><enum>(ii)</enum><text>submit the report described in clause (i) to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives.</text></clause></subparagraph><subparagraph id="id5588A64CA21C4AB3BE85CD63219CEE13"><enum>(E)</enum><header>Outreach</header><text>The advisory council may carry out public outreach activities using amounts made available under section 7 to supplement public engagement carried out by the Committee under paragraph (3). </text></subparagraph></paragraph><paragraph id="id181ace079f09454fbf4695b1f286ec75"><enum>(3)</enum><header>Public engagement</header><subparagraph id="id7528EFE4EC404CF5B4DE4C5F4C46B55A"><enum>(A)</enum><header>In general</header><text>The Committee shall, throughout the process of carrying out the duties of the Committee described in section 5—</text><clause id="idA9A3BB78FC2E4C8B91EA31E43E9FE7DA"><enum>(i)</enum><text>meaningfully engage with relevant stakeholders, particularly—</text><subclause id="idB39DFFFF97C847E995485C593670D7C3"><enum>(I)</enum><text>members and representatives of environmental justice communities;</text></subclause><subclause id="id6FE0918A707D45D8B89CB275137F9030"><enum>(II)</enum><text>environmental justice advocates; and </text></subclause><subclause id="id2FE8D5CD5CB441E597C690BFB373D863"><enum>(III)</enum><text>individuals with expertise in cumulative impacts and geospatial data; and</text></subclause></clause><clause id="id41E214CB4ED241D4A759BD7C48784C18"><enum>(ii)</enum><text>ensure that the input of the stakeholders described in clause (i) is central to the activities of the Committee.</text></clause></subparagraph><subparagraph id="idB4BC7B9936EA4D329B4C3B3315B6AC12"><enum>(B)</enum><header>Plan</header><clause id="idDC8B84C0283444CAB353043C5DB98043"><enum>(i)</enum><header>In general</header><text>In carrying out subparagraph (A), the Committee shall develop a plan, in consultation with the advisory council, for comprehensive public engagement with, and incorporation of feedback from, environmental justice advocates and members of environmental justice communities.</text></clause><clause id="id5E8F2A279DB74AFA8B79C38DC54BE19A"><enum>(ii)</enum><header>Strategies to overcome barriers to public engagement</header><text>The plan developed under clause (i) shall include strategies to overcome barriers to public engagement, including—</text><subclause id="id3A4D1B99B549401D8C82B036F0750F5C"><enum>(I)</enum><text>language barriers;</text></subclause><subclause id="idF82BB5768193471B8708C76EE19B28E4"><enum>(II)</enum><text>transportation barriers;</text></subclause><subclause id="id252DAD94554A422CA8E96A4789C301BB"><enum>(III)</enum><text>economic barriers; and</text></subclause><subclause id="idA5C3E7E7663649A7A8AD355DC15D5741"><enum>(IV)</enum><text>lack of internet access.</text></subclause></clause><clause id="idE41560A6E1C0434387DECF4DB97C6954"><enum>(iii)</enum><header>Consideration</header><text>In developing the plan under clause (i), the Committee shall consider the diverse and varied experiences of environmental justice communities relating to the scope and types of environmental hazards and socioeconomic injustices.</text></clause></subparagraph><subparagraph id="id59914B563EA8429085FCDC06EBF8F8D0"><enum>(C)</enum><header>Consultation and solicitation of public comment</header><clause id="id7B4851E5FD06498E9A3821D5FC477126"><enum>(i)</enum><header>In general</header><text>In carrying out subparagraph (A), not less frequently than once each fiscal quarter, the Committee shall consult with the advisory council and solicit meaningful public comment, particularly from relevant stakeholders, on the activities of the Committee.</text></clause><clause id="id17F5A814E4B64607B06863E126ACB8CC"><enum>(ii)</enum><header>Requirements</header><text>The Committee shall carry out clause (i) through means including—</text><subclause id="idB864E8D69F9A46568B6943F7E1BC43AB"><enum>(I)</enum><text>public notice of a meeting of the Committee occurring during the applicable fiscal quarter, which shall include— </text><item id="id59e23d1d3fd54098b9adaf952f2a734f"><enum>(aa)</enum><text>notice in publications relevant to environmental justice communities; </text></item><item id="id97c6660d563845ceb56d221a433d3b69"><enum>(bb)</enum><text>notification to environmental justice communities through direct means, such as community centers and schools; and</text></item><item id="id459E8420200F484E82EA5DDE38C57F26"><enum>(cc)</enum><text>direct outreach to known environmental justice groups;</text></item></subclause><subclause id="id8989FD6D69614E85943B4EDC9F829A27"><enum>(II)</enum><text>public broadcast of that meeting, including soliciting and receiving comments by virtual means; and</text></subclause><subclause id="id03F3424C226C45E8B17A68E3AB8D1750"><enum>(III)</enum><text>public availability of a transcript of that meeting through publication on an accessible website.</text></subclause></clause><clause id="id995E665D0DDF465FAF0BB19CE601C1AB"><enum>(iii)</enum><header>Languages</header><text>The Committee shall provide each notice, notification, direct outreach, broadcast, and transcript described in clause (ii) in each language commonly used in the applicable environmental justice community, including through oral interpretation, if applicable.</text></clause></subparagraph><subparagraph id="id774B23E5A9D74FCFAE0889E1DE4ADE9F"><enum>(D)</enum><header>Funding</header><text>Of amounts made available under section 7, the Administrator shall make available to the Committee such sums as are necessary for participation by relevant stakeholders in public engagement under this paragraph, as determined by the Administrator, in consultation with the advisory council. </text></subparagraph></paragraph></subsection></section><section id="idCB95FD4932BE4288A41CE7E4E8F098F0"><enum>5.</enum><header>Duties of Committee</header><subsection id="idd96de97237e54c6f888013dfe980043b"><enum>(a)</enum><header>In general</header><text>The Committee shall—</text><paragraph id="id92C8826ED477491E86545A0735177334"><enum>(1)</enum><text>establish a tool described in subsection (b) to identify environmental justice communities, including the identification of—</text><subparagraph id="id1DD78B9B6CDA490D8B3781C3E0C5C0E8"><enum>(A)</enum><text>criteria to be used in the tool; and</text></subparagraph><subparagraph id="id8CD20A67E71049A2B15046F8041FA5F4"><enum>(B)</enum><text>a methodology to determine the cumulative impacts of those criteria;</text></subparagraph></paragraph><paragraph id="id5E257AF4BE7F442A8F05E536B97107AA"><enum>(2)</enum><text>assess and address data gaps in accordance with subsection (d); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30C50C60F4614967A21F695B22624331"><enum>(3)</enum><text>collect data for the environmental justice data repository established under section 6.</text></paragraph></subsection><subsection id="idfeddd07a71114d44bbfd0d65e839ddf8"><enum>(b)</enum><header>Establishment of tool</header><paragraph id="idCDC34C0B966C49CDBFF2561B0C300B7E"><enum>(1)</enum><header>In general</header><text>The Committee, in consultation with relevant stakeholders and the advisory council, shall establish an interactive, transparent, integrated, and Federal Government-wide tool for assessing and mapping environmental justice communities based on the cumulative impacts of all indicators selected by the Committee to be integrated into the tool.</text></paragraph><paragraph id="id4EEF568DCDC84F2190D46D63B26EA042"><enum>(2)</enum><header>Requirements</header><text>In establishing the tool under paragraph (1), the Committee shall—</text><subparagraph id="idf3f27a38c09848cb86a89ef73f6115a4"><enum>(A)</enum><text>integrate into the tool multiple data layers of indicators that fall into categories including—</text><clause id="id57d883a84063455aad660120d95c01a0"><enum>(i)</enum><text>demographics, particularly relating to socioeconomic hardship and social stressors, such as—</text><subclause id="id53F17E86B8D14BA99068703ED273850D"><enum>(I)</enum><text>race and ethnicity;</text></subclause><subclause id="id727d084926ed4e719f47a3a67490be2b"><enum>(II)</enum><text>low income;</text></subclause><subclause id="id6536b258c4e64fe68e7fc27bf2f3b6c4"><enum>(III)</enum><text>high unemployment;</text></subclause><subclause id="id967cad6ed5f34c9da6017e658d402023"><enum>(IV)</enum><text>low levels of home ownership;</text></subclause><subclause id="id42a3c5f6afd54ab18c464ba8eab4990e"><enum>(V)</enum><text>high rent burden;</text></subclause><subclause id="idB6B316978CFE4072B99EE044E535AAE4"><enum>(VI)</enum><text>high transportation burden;</text></subclause><subclause id="id44ef949e70c648ef8f79774243b26514"><enum>(VII)</enum><text>low levels of educational attainment;</text></subclause><subclause id="idC58DAA3EB55149C6B595335751CBB2F1"><enum>(VIII)</enum><text>linguistic isolation; </text></subclause><subclause id="id5608DFE7AADF425A8794F516C0A29B81"><enum>(IX)</enum><text>energy insecurity or high utility rate burden; </text></subclause><subclause id="id7752E49A2223440AB86B4857B83AFA2B"><enum>(X)</enum><text>food insecurity; </text></subclause><subclause id="id1180E8234B3B4EF480950FC43543B295"><enum>(XI)</enum><text>health insurance status and access to healthcare; and</text></subclause><subclause id="idF9AAB32C498641F78EA8404FBBD31840"><enum>(XII)</enum><text>membership in an Indian Tribe;</text></subclause></clause><clause id="id0050305cca1d4be88c9109cb02298522"><enum>(ii)</enum><text>public health, particularly data that are indicative of sensitive populations, such as—</text><subclause id="id947F756CA6A547CF91571F217059C336"><enum>(I)</enum><text>rates of asthma;</text></subclause><subclause id="idB079EF432DEE4E799C37F8CF13E9A59D"><enum>(II)</enum><text>rates of cardiovascular disease; </text></subclause><subclause id="idC3D206A1A49E46F48737478A22F0D6BD"><enum>(III)</enum><text>child leukemia or other cancers that correlate with environmental hazards;</text></subclause><subclause id="id006709ABD8EF42B489CEE01D09554075"><enum>(IV)</enum><text>low birth weight;</text></subclause><subclause id="id3F86C3A60A25463B9F352D14C0F84D8A"><enum>(V)</enum><text>maternal mortality;</text></subclause><subclause id="id124629A9B8EA4CBE91076E50A11A04B9"><enum>(VI)</enum><text>rates of lead poisoning; and</text></subclause><subclause id="id2854319CEF3C4635A9C602399FB9C130"><enum>(VII)</enum><text>rates of diabetes;</text></subclause></clause><clause id="idaddc0ae327384580b52ea12f693d6703"><enum>(iii)</enum><text>pollution burdens, such as pollution burdens created by—</text><subclause id="id89B25169E51C429283E86FC06256563B"><enum>(I)</enum><text>toxic chemicals;</text></subclause><subclause id="idA7A86FDFB4EE4E97AE03CA97113FD7E7"><enum>(II)</enum><text>air pollutants;</text></subclause><subclause id="id8478F8D64C2C41568C908BBEC5533D90"><enum>(III)</enum><text>water pollutants; </text></subclause><subclause id="idCAD6D521E4734C32ACA3AA637AE3B820"><enum>(IV)</enum><text>soil contaminants; and</text></subclause><subclause id="idDED22F645ACD4C9AB7420E481EFB79D6"><enum>(V)</enum><text>perfluoroalkyl and polyfluoroalkyl substances; and</text></subclause></clause><clause id="idE726EF39731240A08DA466998664158F"><enum>(iv)</enum><text>environmental effects, such as effects created by proximity to—</text><subclause id="id60D9799A40B840C88269FF5C6F640AF1"><enum>(I)</enum><text>risk management plan sites;</text></subclause><subclause id="idAE27F16A1BEC4B9CB8414BA98692ABCF"><enum>(II)</enum><text>hazardous waste facilities;</text></subclause><subclause id="idE7F6B05A4A25402BBE46F0EFA53DD686"><enum>(III)</enum><text>sites on the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>); and</text></subclause><subclause id="id34499AFAE59F4A5594D523DE56FD2C13"><enum>(IV)</enum><text>fossil fuel infrastructure;</text></subclause></clause></subparagraph><subparagraph id="id1540117aaa434170a863e2fd0493bd66"><enum>(B)</enum><text>investigate how further indicators of vulnerability to the impacts of climate change (including proximity and exposure to sea level rise, wildfire smoke, flooding, drought, rising average temperatures, extreme storms, and extreme heat, and financial burdens from flood and fire insurance) should be incorporated into the tool as an additional set of layers; </text></subparagraph><subparagraph id="id194f6d896c4c4fd28252f34ff604b2a5"><enum>(C)</enum><text>identify and consider the effects of other indicators relating to environmental justice for integration into the tool as layers, including—</text><clause id="idd809f5523d3844eab0b5309d90f2a31a"><enum>(i)</enum><text>safe, sufficient, and affordable drinking water, sanitation, and stormwater services; </text></clause><clause id="idE2D058DDCAF64864B35FE5ED8C9D0315"><enum>(ii)</enum><text>access to and the quality of—</text><subclause id="id4BAB6DF5E47141ACAAB906A9DB7A2B05"><enum>(I)</enum><text>green space and tree canopy cover;</text></subclause><subclause id="id182A267484CA4D3ABA0398C49A5228D1"><enum>(II)</enum><text>healthy food; </text></subclause><subclause id="id2F01BE5E3B1843849CC2421E8F1843D8"><enum>(III)</enum><text>affordable energy and water;</text></subclause><subclause id="id3D31C3DAD5284B8B957E8E67C3533FB0"><enum>(IV)</enum><text>transportation; </text></subclause><subclause id="id0550A65EC2C5419B9ECD5DA27598579A"><enum>(V)</enum><text>reliable communication systems, such as broadband internet;</text></subclause><subclause id="idF78BEBCC62BD422C920A580DB5065FB8"><enum>(VI)</enum><text>child care;</text></subclause><subclause id="id0F9ED1C3DBF74D2B91D1D09E9643B73E"><enum>(VII)</enum><text>high-quality public schools, early childhood education, and child care; and</text></subclause><subclause id="idFA6C8A81BFEA4982B66DD38E7F59413C"><enum>(VIII)</enum><text>heath care facilities;</text></subclause></clause><clause id="id357EA67BFBBB49C8A56154BE3FEC4CDE"><enum>(iii)</enum><text>length of commute;</text></clause><clause id="idF098C947CD6E406EB0EADCFE6B126325"><enum>(iv)</enum><text>indoor air quality in multiunit dwellings; </text></clause><clause id="id286ACEF1894A40F1B5D5C615A3B405AC"><enum>(v)</enum><text>mental health;</text></clause><clause id="id54147919DD4940579ED20B355E397289"><enum>(vi)</enum><text>labor market categories, particularly relating to essential workers; and</text></clause><clause id="idACB8914C76C249A5BEB9D6DC74E56B4C"><enum>(vii)</enum><text>each type of utility expense;</text></clause></subparagraph><subparagraph id="idff3960a13f8c4923b8c37fed69b147a2"><enum>(D)</enum><text>consider the implementation of specific regional indicators, with the potential—</text><clause id="id5A103B7AF59E46F5B8785A64A6B0D923"><enum>(i)</enum><text>to create regionally and locally downscaled maps in addition to a national map;</text></clause><clause id="idf33e48f56dca4fa08172c7ec87680ec6"><enum>(ii)</enum><text>to provide incentives for States to collect data and conduct additional analyses to capture conditions specific to their localities; </text></clause><clause id="id5042757b237d4cc7b442b1b6a3446d1f"><enum>(iii)</enum><text>to provide resources for and engage in ground-truthing to identify and verify important data with community members; and</text></clause><clause id="id914a5f5f44bc40439ef45650ba88b4e7"><enum>(iv)</enum><text>to develop companion resources for, and provide technical support to, regional, State, local, or Tribal governments to create their own maps and environmental justice scores with relevant regional, State, local, and Tribal data; </text></clause></subparagraph><subparagraph id="idbec5b2d3dfa740c3aca8a9bd7983777a"><enum>(E)</enum><text>identify a methodology to account for the cumulative impacts of all indicators selected by the Committee under subparagraph (A), in addition to other indicators as the Committee determines to be necessary, to provide relative environmental justice scores for regions that are—</text><clause id="idA764C04FE57D477CB4AEC0799283138E"><enum>(i)</enum><text>as small as practicable to identify communities; and </text></clause><clause id="idBF58D62A7EEA44C5B8CDECEB0E8E15BF"><enum>(ii)</enum><text>not larger than a census tract;</text></clause></subparagraph><subparagraph id="idc60a2c82c2484506b90e82c9defbe49e"><enum>(F)</enum><text>ensure that the tool is capable of providing maps of environmental justice communities based on environmental justice scores described in subparagraph (E);</text></subparagraph><subparagraph id="id57b12dbbd3184cf9ac123619796f5868"><enum>(G)</enum><text>ensure that users of the tool are able to map available layers together or independently as desired; </text></subparagraph><subparagraph id="ide8de01c44bc14e8d96f2952bb9e33145"><enum>(H)</enum><text>implement a method for users of the tool to generate a map and environmental justice score based on a subset of indicators, particularly for the purpose of using the tool in addressing various policy needs, permitting processes, and investment goals; </text></subparagraph><subparagraph id="idAA00DA9BAD8A4C30899020CF374AB2A1"><enum>(I)</enum><text>make the tool customizable to address specific policy needs, permitting processes, and investment goals;</text></subparagraph><subparagraph id="id5cf0cb4a7e204f2b8475d16f6b1beb82"><enum>(J)</enum><text>account for conditions that are not captured by the quantitative data used to develop the 1 or more maps and environmental justice scores comprising the tool, by—</text><clause id="id7F04D14D72CD48F0953147543A118136"><enum>(i)</enum><text>developing and executing a plan to perform outreach to relevant communities; and </text></clause><clause id="idF3E3CA3ABA0F4633B6352EECB3E0B4D0"><enum>(ii)</enum><text>establishing a mechanism by which communities can self-identify as environmental justice communities to be included in the tool, which may include citing qualitative data on conditions for which quantitative data are lacking, such as cultural loss in Tribal communities; </text></clause></subparagraph><subparagraph id="id2fd60029e4ba436bbe4d436d4ee21ce8"><enum>(K)</enum><text>consider that the tool—</text><clause id="id75BF77F0464F4C578F989573A3F88D58"><enum>(i)</enum><text>will be used across the Federal Government in screening Federal policies, permitting processes, and investments for environmental and climate justice impacts; and</text></clause><clause id="id82A3DBE100C7431180ED9FE050D13A0A"><enum>(ii)</enum><text>may be used to assess communities for pollution reduction programs; and </text></clause></subparagraph><subparagraph id="id931617761d56439f96a07200433acbf9"><enum>(L)</enum><text>carry out such other activities as the Committee determines to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="idfdfdf7b134ea4fed929cefc7fb9f038e"><enum>(c)</enum><header>Transparency and updates</header><paragraph id="idbd58f95521364db4884d1b3696a4cec5"><enum>(1)</enum><header>In general</header><subparagraph id="id0869964878734ED09755490892B03F2A"><enum>(A)</enum><header>Notice and comment</header><text>The Committee shall establish the tool described in subsection (b) after providing notice and an opportunity for public comment.</text></subparagraph><subparagraph id="id60F33B7E2562478F937E4E9956C4840E"><enum>(B)</enum><header>Hearings</header><text>In carrying out subparagraph (A), the Committee shall hold hearings, which shall be time- and language-appropriate, in communities affected by environmental justice issues in geographically disparate States and Tribal areas.</text></subparagraph></paragraph><paragraph id="idd22dc7fa5cc3487a93835e2f49c654a0"><enum>(2)</enum><header>Updates</header><subparagraph id="idBC24F0056DFF48F8BC1612F442EDC3C8"><enum>(A)</enum><header>Annual updates</header><text>The Committee shall update the tool described in subsection (b) not less frequently than annually to account for data sets that are updated annually.</text></subparagraph><subparagraph id="id177F477AB08D45618CA8F6E00FB2D3C3"><enum>(B)</enum><header>Other updates</header><text>Not less frequently than once every 3 years, the Committee shall—</text><clause id="id69F39660583E489F83AAFBC65224A602"><enum>(i)</enum><text>update the indicators, methodology, or both for the tool described in subsection (b); and </text></clause><clause id="id60C9A1EEA9C441729A5205A957C345F2"><enum>(ii)</enum><text>reevaluate data submitted by Federal departments and agencies that is used for the tool.</text></clause></subparagraph><subparagraph id="id1df94f131d704013a136c8929451da5c"><enum>(C)</enum><header>Reports</header><text>After the initial establishment of the tool described in subsection (b) and each update under subparagraph (A) or (B), the Committee shall publish a report describing—</text><clause id="id9BBD76D863204EF898CCB5F0E32DCB7D"><enum>(i)</enum><text>the process for identifying indicators relating to environmental justice in the development of the tool;</text></clause><clause id="idC7A9D17EE6C34C419C7C609F9BBA43E8"><enum>(ii)</enum><text>the methodology described in subsection (b)(2)(E); and</text></clause><clause id="idE074A8A4C1F84C24ABDB536BC96CF934"><enum>(iii)</enum><text>the use of public input and community engagement in that process.</text></clause></subparagraph></paragraph><paragraph id="idB78A7CE1B71F4C5FAF03250BA1792D02"><enum>(3)</enum><header>Training tutorials and sessions</header><subparagraph id="id7C3F8D9D38D740C88040395C6A31C8AE"><enum>(A)</enum><header>In general</header><text>The Committee shall—</text><clause id="idEEBFAA259D5F49F2B6793C1E7C90D8D5"><enum>(i)</enum><text>develop virtual training tutorials and sessions for environmental justice communities for the use of the tool described in subsection (b); and</text></clause><clause id="id7771A6B87541495D87D150138370A5AA"><enum>(ii)</enum><text>where practicable, provide in-person training sessions for environmental justice communities for the use of that tool.</text></clause></subparagraph><subparagraph id="idCE5ABB2F7E3E47DC9D600E2D43C993E6"><enum>(B)</enum><header>Languages</header><text>The tutorials and sessions under subparagraph (A) shall be made available in each language commonly used in the applicable environmental justice community.</text></subparagraph></paragraph><paragraph id="id637652d34d7a42c4bcc3bb5d8a3e6622"><enum>(4)</enum><header>Public availability</header><subparagraph id="id7FCA0FFA81FD4720BDCEF70357FB1723"><enum>(A)</enum><header>In general</header><text>The Committee shall make available to the public on an internet website of the Environmental Protection Agency—</text><clause id="idD8130354B5064602A1420222108322C8"><enum>(i)</enum><text>the tool described in subsection (b);</text></clause><clause id="id9F86E8F204BF418ABD79210D86271E4D"><enum>(ii)</enum><text>each update under subparagraphs (A) and (B) of paragraph (2); </text></clause><clause id="id3492A33C4EC9429EA1921164D929CB76"><enum>(iii)</enum><text>each report under paragraph (2)(C); and</text></clause><clause id="idd876d8e9d9324eb7b0b85a3d6f354e36"><enum>(iv)</enum><text>the training tutorials and sessions developed under paragraph (3)(A)(i).</text></clause></subparagraph><subparagraph id="id4EBCBC83DDE44A8FB60259FFA5B78381"><enum>(B)</enum><header>Accessibility</header><text>The Committee shall make the tool, updates, and reports described in subparagraph (A) accessible to the public by publication in relevant languages and with accessibility functions, as appropriate.</text></subparagraph><subparagraph id="id93F8EC121D1E4273BD2E6E500468ED3C"><enum>(C)</enum><header>Requirement</header><text>In carrying out subparagraph (A)(i), the Committee shall take measures to prevent the tool from being misused to discriminate against environmental justice communities, such as by providing safeguards against the use of downscaled data that may enable the identification of individuals.</text></subparagraph></paragraph></subsection><subsection id="ide137ff90e7c045be86ae46f137db9d09"><enum>(d)</enum><header>Data gap audit</header><paragraph id="idfa3b144a730b45ffb25fe717e5f30ea7"><enum>(1)</enum><header>In general</header><text>In establishing the tool described in subsection (b), the Committee shall direct relevant Federal departments and agencies to conduct an audit of data collected by the department or agency to identify any data that are relevant to environmental justice concerns, including data relating to—</text><subparagraph id="id6ee47e86c4de4beca90fd53a1ec3fb51"><enum>(A)</enum><text>public health metrics;</text></subparagraph><subparagraph id="idcf5b16062c6c4aedb155fa0896f1fa35"><enum>(B)</enum><text>toxic chemicals;</text></subparagraph><subparagraph id="ida276e7d7b772415d9d4d575778d58508"><enum>(C)</enum><text>socioeconomic demographics;</text></subparagraph><subparagraph id="idc8ada3b24d1d4556a6f47365652ddcdf"><enum>(D)</enum><text>air quality; </text></subparagraph><subparagraph id="idd369fad4eb21406386fca8791077b2fb"><enum>(E)</enum><text>water quality; and</text></subparagraph><subparagraph id="idAAA7C6B8886144CABD724C354B226364"><enum>(F)</enum><text>killings of individuals by law enforcement officers.</text></subparagraph></paragraph><paragraph id="iddb7a58e8f71645abbd5d0c3eceeddaf8"><enum>(2)</enum><header>Requirements</header><text>An audit described in paragraph (1) shall—</text><subparagraph id="idC4B26A58FA64430B8DB2C1721156436D"><enum>(A)</enum><text>examine the granularity and accessibility of the data; </text></subparagraph><subparagraph id="id613B2B9DBEEE45CC99DC85BEB24A32F1"><enum>(B)</enum><text>address the need for improved air quality monitoring; and</text></subparagraph><subparagraph id="id44BE158B1F7A441DA914D839A4DF4ACA"><enum>(C)</enum><text>include recommendations to other Federal departments and agencies on means to improve the quality, granularity, and transparency of, and public involvement in, data collection and dissemination.</text></subparagraph></paragraph><paragraph id="ida2a47349082d462592aec7f6ddcac0ad"><enum>(3)</enum><header>Improvements</header><text>The Committee shall direct a Federal department or agency, in conducting an audit under paragraph (1), to address gaps in existing data collection that will assist the Committee in establishing and operating the tool described in subsection (b), including by providing to the department or agency—</text><subparagraph id="id5032937e7b794936aba30ed21e1b7557"><enum>(A)</enum><text>benchmarks to meet in addressing the gaps;</text></subparagraph><subparagraph id="idcd699dd542ec405589aba630b0c42c55"><enum>(B)</enum><text>instructions for consistency in data formatting that will allow for inclusion of data in the environmental justice data repository described in section 6; and</text></subparagraph><subparagraph id="id1644f745a43448ad9aaa27220c409ec5"><enum>(C)</enum><text>best practices for collecting data in collaboration with local organizations and partners, such as engaging in ground-truthing.</text></subparagraph></paragraph><paragraph id="idb72fb95333b64cc89286017f6b06b53c"><enum>(4)</enum><header>Reports</header><text>Not later than 180 days after a Federal department or agency has conducted an audit under paragraph (1), the Committee shall—</text><subparagraph id="id6d515021ad144b2a88b2cb46e7998f6a"><enum>(A)</enum><text>make available to the public on an internet website of the Environmental Protection Agency a report describing the findings and conclusions of the audit, including the progress made by the Federal department or agency in addressing environmental justice data gaps; and</text></subparagraph><subparagraph id="iddae3f2e3c33b4ca894019392d4e8ffdb"><enum>(B)</enum><text>submit the report described in subparagraph (A) to—</text><clause id="ida26a3d5f6da8450b975e3aadac32898d"><enum>(i)</enum><text>the Committee on Environment and Public Works of the Senate;</text></clause><clause id="id747053bf4d4b4025b0ca1e7cd6ea58b1"><enum>(ii)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></clause><clause id="id41b6b575c795437fa71223215d50de33"><enum>(iii)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></clause><clause id="id685d845c850b47729a7f3d4cbd333ec3"><enum>(iv)</enum><text>the Committee on Education and Labor of the House of Representatives.</text></clause></subparagraph></paragraph></subsection></section><section id="id9f016c51e84e461fa24c60cf6a189364"><enum>6.</enum><header>Environmental justice data repository</header><subsection id="id3EE736EDE5AE4CBBA276DC9B07B602E1"><enum>(a)</enum><header>In general</header><text>The Administrator shall establish an environmental justice data repository to maintain—</text><paragraph id="id2D1F8B530FFA44D6BD83E54407C7C7DD"><enum>(1)</enum><text>the data collected by the Committee through the establishment of the tool described in section 5(b) and the audits conducted under section 5(d)(1); and</text></paragraph><paragraph id="id07496225458C44A4842C55D09075C2F5"><enum>(2)</enum><text>any subnational data collected under subsection (c)(2).</text></paragraph></subsection><subsection id="idB51E5C424FC944439AE3169D9724F468"><enum>(b)</enum><header>Updates</header><text>The Administrator shall update the data in the data repository described in subsection (a) as frequently as practicable, including every year if practicable, but not less frequently than once every 3 years.</text></subsection><subsection id="idbcb3bea07b79462ba3cab4b2ccf5916b"><enum>(c)</enum><header>Availability; inclusion of subnational data</header><text>The Administrator—</text><paragraph id="id88ACFF920DBF453D83509CDA0573B385"><enum>(1)</enum><text>shall make the data repository described in subsection (a) available to regional, State, local, and Tribal governments; and</text></paragraph><paragraph id="idBA16C2641BCA494391C856D7AEC85905"><enum>(2)</enum><text>may collaborate with the governments described in paragraph (1) to include within that data repository subnational data in existence before the establishment of the tool described in section 5(b) and the completion of the audits under section 5(d)(1). </text></paragraph></subsection><subsection id="id89B1492617DE445DA6C20ADD2FE5AEE7"><enum>(d)</enum><header>Requirement</header><text>The Administrator shall take measures to prevent the data in the data repository described in subsection (a) from being misused to discriminate against environmental justice communities, such as by providing safeguards against the use of downscaled data that may enable the identification of individuals.</text></subsection></section><section id="id7F7759D8064B4501B503D8B659FB03DB"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Administrator to carry out this Act, including any necessary administrative costs of the Committee—</text><paragraph id="id02C1D228EA444A2F980138F936F4E024"><enum>(1)</enum><text>$20,000,000 for each of fiscal years 2021 and 2022; and</text></paragraph><paragraph id="idD053A2305A914A2D81D5B87CDFD784CD"><enum>(2)</enum><text>$18,000,000 for each of fiscal years 2023 through 2025.</text></paragraph></section><section id="id973C073CC7674CB2844EC5405623C2AB"><enum>8.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in any provision of this Act relating to the tool described in section 5(b) prohibits a State from developing a map relating to environmental justice or pollution burden that relies on different data, or analyzes data differently, than that tool.</text></section></legis-body></bill>
