<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1012</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210325">March 25, 2021</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself, <cosponsor name-id="S389">Mr. Kennedy</cosponsor>, and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Secretary of Transportation from prohibiting the transportation of liquefied natural gas by rail, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H75648C911CDA4396A10E17C311C1FC6D"><section section-type="section-one" id="HB516ACF652734467B4C0AA85EE627251"><enum>1.</enum><header>Liquefied natural gas by rail</header><subsection id="H0041B5B03758434BA9551E534DFD5929"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation may not issue any regulation or long-term order that—</text><paragraph id="H52BC2A5A50294384AF765D9F50790648"><enum>(1)</enum><text>prohibits the transportation of methane, refrigerated liquid (commonly known as <quote>liquefied natural gas</quote> or <quote>LNG</quote>) by rail; or</text></paragraph><paragraph id="H4B79A676ACAB43878C4C96E2A4138FF9"><enum>(2)</enum><text>restricts or contracts the scope of allowance provided by the final rule of the Pipeline and Hazardous Materials Safety Administration, titled <quote>Hazardous Materials: Liquefied Natural Gas by Rail</quote>, which was published in the Federal Register on July 24, 2020 (85 Fed. Reg. 44994).</text></paragraph></subsection><subsection id="HA520FC5BBCE8443186B0A98122248D8E"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit the authority of the Secretary of Transportation to issue short-term emergency orders related to the transportation of liquefied natural gas by rail. </text></subsection></section></legis-body></bill>
