Homeland Security Act of 2002 regarding the procurement of certain items related to national security interests for Department of Homeland Security frontline operational components, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF012AF40C46441F29C5DC60AFB25D755"><section section-type="section-one" id="H65BE0BE7A31A4E1692C2E55FC65B13EF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeland Procurement Reform Act</short-title></quote> or the <quote><short-title>HOPR Act</short-title></quote>.</text></section><section id="H2B1FA736BDF34866A86EAA483A833038"><enum>2.</enum><header>Requirements to buy certain items related to national security interests according to certain criteria</header><subsection id="H04D91CECD9C44054A3119CE4AB0CBD92"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA7F238C8D48F47CAA189BCDDEDE41B49"><section id="H6A429F5598CA4CA8A00D7A6480A16A11"><enum>836.</enum><header>Requirements to buy certain items related to national security interests</header><subsection id="id9955CB0697674204AA12A44C791542B1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7A0813BCE0D14CD28BBF57B09F3A079D"><enum>(1)</enum><header>Covered item</header><text>The term <term>covered item</term> means any of the following: </text><subparagraph id="id583323C2D46B4C72AFBED303FBB14D93"><enum>(A)</enum><text display-inline="yes-display-inline">Body armor components intended to provide ballistic protection for an individual, consisting of 1 or more of the following:</text><clause id="idF47CDBC84B4B4F58AD32DF8C700A7F90"><enum>(i)</enum><text>Soft ballistic panels.</text></clause><clause id="id0202208407B84932ABE083399AAED025"><enum>(ii)</enum><text>Hard ballistic plates.</text></clause><clause id="idBE2A596E6C94411D8B19498B9517E467"><enum>(iii)</enum><text>Concealed armor carriers worn under a uniform.</text></clause><clause id="id25ED1170ACA34494AA0F7B6388748637"><enum>(iv)</enum><text>External armor carriers worn over a uniform.</text></clause></subparagraph><subparagraph id="idF4687A5CDED14A2F84F1FC8701426BD3"><enum>(B)</enum><text display-inline="yes-display-inline">Helmets that provide ballistic protection and other head protection and components.</text></subparagraph><subparagraph id="id8967BCC910194288906649D0A618E797"><enum>(C)</enum><text>Protective eyewear.</text></subparagraph><subparagraph id="id173B999AE4C249BAA794EB02A712D6C9"><enum>(D)</enum><text display-inline="yes-display-inline">Rain gear, cold weather gear, other environmental and flame-resistant clothing.</text></subparagraph><subparagraph id="id8A2B6B816A754068A7D7BA9C7F2E9B69"><enum>(E)</enum><text>Footwear.</text></subparagraph><subparagraph id="idC993840C079C4816B44D93DD6FC154A3"><enum>(F)</enum><text>Uniforms.</text></subparagraph><subparagraph id="id73D353293CA145CDA78AC0FE2F45EF8D"><enum>(G)</enum><text display-inline="yes-display-inline">Bags and packs.</text></subparagraph><subparagraph id="id2566A9413AF24D4CB9DD977C1BD39308"><enum>(H)</enum><text display-inline="yes-display-inline">Holsters and tactical pouches.</text></subparagraph><subparagraph id="idCA71550E2E2948599B5F46D5E3AC576A"><enum>(I)</enum><text>Patches, insignia, and embellishments.</text></subparagraph><subparagraph id="id97844B606962462F9A468169153B7EB9"><enum>(J)</enum><text>Respiratory protective masks.</text></subparagraph><subparagraph id="idE21E5FDE28BC46C6BE5B145F80538501"><enum>(K)</enum><text>Chemical, biological, radiological, and nuclear protective gear.</text></subparagraph><subparagraph id="id2C9004CAFCBD42CAA410AF90BC847E75"><enum>(L)</enum><text display-inline="yes-display-inline">Hearing protection equipment.</text></subparagraph><subparagraph id="id8382B8B5941B4BC58ECCB3AB0CE1BE98"><enum>(M)</enum><text>Powered air purifying respirators and required filters.</text></subparagraph><subparagraph id="id317C99A0F25847E3977CE9219062D8D8"><enum>(N)</enum><text>Disposable and reusable surgical and isolation gowns.</text></subparagraph><subparagraph id="idBE2F997F261F4F659C9BD2D0B0864D2B"><enum>(O)</enum><text>Protective eyewear.</text></subparagraph><subparagraph id="id18F525B032A2459E989FEE62CB54AA03"><enum>(P)</enum><text>Gloves.</text></subparagraph><subparagraph id="id4F60F0B2B63442ACA4847BF60D35F3B0"><enum>(Q)</enum><text>Face shields.</text></subparagraph><subparagraph id="id3D55F122AC394B4BBC55E8E6D9A2F6A4"><enum>(R)</enum><text>Head and foot coverings.</text></subparagraph><subparagraph id="id61F260BA98E24071844358261ADDB93B"><enum>(S)</enum><text>Sanitizing and disinfecting wipes.</text></subparagraph><subparagraph id="id09120112C2844C49B71175EBA1FBFF30"><enum>(T)</enum><text>Privacy curtains.</text></subparagraph><subparagraph id="idF06628F8F6194025A21CA788D37376CF"><enum>(U)</enum><text>Beds and bedding.</text></subparagraph><subparagraph id="idE5FD0932689A450A9C236235465631DE"><enum>(V)</enum><text>Testing swabs.</text></subparagraph><subparagraph id="idA6AD7B10C7404C388C29E1A238D65C5E"><enum>(W)</enum><text>Gauze and bandages.</text></subparagraph><subparagraph id="id336FC6A8668641CCBE582033DB673D70"><enum>(X)</enum><text>Tents and tarpaulins. </text></subparagraph><subparagraph id="idC408785BBDF941979E8CB245982D85DE"><enum>(Y)</enum><text>Any other critical safety item as determined appropriate by the Secretary. </text></subparagraph></paragraph><paragraph id="H496A78F9319D49DFA08BACBC4027E58F"><enum>(2)</enum><header>Frontline operational component</header><text> The term <term>frontline operational component</term> means any of the following components of the Department:</text><subparagraph id="HD954433EC59E41BFA606D5915359C24D"><enum>(A)</enum><text>U.S. Customs and Border Protection.</text></subparagraph><subparagraph id="H33E5EE33F716425B9F090BD82D8F5372"><enum>(B)</enum><text>U.S. Immigration and Customs Enforcement.</text></subparagraph><subparagraph commented="no" id="H5F17037E509B4224AE6C8EE7E6FCCCE8"><enum>(C)</enum><text>The United States Secret Service.</text></subparagraph><subparagraph id="H432C6C87710F47DA84DA18DBA8CC0706"><enum>(D)</enum><text>The Transportation Security Administration.</text></subparagraph><subparagraph id="H274243EB418D419390D53A880FD44147"><enum>(E)</enum><text display-inline="yes-display-inline">The Cybersecurity and Infrastructure Security Agency.</text></subparagraph><subparagraph id="H0755A8E2C43442C58293C7A3A51EC5C5"><enum>(F)</enum><text display-inline="yes-display-inline">The Federal Protective Service.</text></subparagraph><subparagraph id="HC48DAB67B3A041FFA1FA495129994D50"><enum>(G)</enum><text display-inline="yes-display-inline">The Federal Emergency Management Agency.</text></subparagraph><subparagraph id="H320A5243F01F4D5CB52B005E61DFD223"><enum>(H)</enum><text display-inline="yes-display-inline">The Federal Law Enforcement Training Centers.</text></subparagraph></paragraph></subsection><subsection id="HE75E6CF4C44E42BFB27E53245E9E41B3"><enum>(b)</enum><header>Requirements</header><paragraph id="idA8941EAAC0B840DB924D73B58368FBB9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall ensure that any procurement of a covered item for a frontline operational component meets the following criteria:</text><subparagraph id="HF55BD9916CDF4E83BF1C3635CF2ACF1D"><enum>(A)</enum><text display-inline="yes-display-inline">To the maximum extent possible, not less than one-third of funds obligated in a specific fiscal year for the procurement of such covered items shall be covered items that are manufactured in the United States by entities that qualify as small business concerns, as such term is described under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></subparagraph><subparagraph id="H5D52ECB6133E476E9D599DE48F33EB59"><enum>(B)</enum><text display-inline="yes-display-inline">Each contractor and first-tier subcontractor with respect to the procurement of such a covered item, including the end-item manufacturer of such a covered item—</text><clause commented="no" id="HC07D45F8EC464D389EB351FCF12B9777"><enum>(i)</enum><text>is an entity registered with the System for Award Management (or successor system) administered by the General Services Administration; and</text></clause><clause id="HCB289AF917E84D7D852AB91F342D9F2D"><enum>(ii)</enum><text>is in compliance with ISO 9001:2015 of the International Organization for Standardization (or successor standard).</text></clause></subparagraph><subparagraph id="HD0A116DC45904639B5D1B49764F8B139"><enum>(C)</enum><text display-inline="yes-display-inline">Each supplier of such a covered item with an insignia (such as any patch, badge, or emblem) and each supplier of such an insignia, if such covered item with such insignia or such insignia, as the case may be, is not produced, applied, or assembled in the United States, shall—</text><clause id="H7B24E9C9B6054C108586E20096FFD439"><enum>(i)</enum><text>store such covered item with such insignia or such insignia in a locked area;</text></clause><clause id="HEC6A6A21C61D4C8993495906DBDEE6F1"><enum>(ii)</enum><text display-inline="yes-display-inline">report any pilferage or theft of such covered item with such insignia or such insignia occurring at any stage before delivery of such covered item with such insignia or such insignia; and</text></clause><clause id="H56E1DD8BD72144D09FF58B3C7BA41336"><enum>(iii)</enum><text display-inline="yes-display-inline">destroy any such defective or unusable covered item with insignia or insignia in a manner established by the Secretary, and maintain records, for three years after the creation of such records, of such destruction that include the date of such destruction, a description of the covered item with insignia or insignia destroyed, the quantity of the covered item with insignia or insignia destroyed, and the method of destruction.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id1B79E6293D084DBE83080394DEEBF9C3"><enum>(2)</enum><header>Waiver</header><subparagraph commented="no" id="idBAC22841AF3140A396B241FE6C84B15B"><enum>(A)</enum><header>In general</header><text>In the case of a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.), the Secretary may waive a requirement in subparagraph (B) or (C) of paragraph (1) if the Secretary determines there is an insufficient supply of a covered item that meets the requirement. </text></subparagraph><subparagraph id="idf2395f682f5d49408c6514765d2c7d38"><enum>(B)</enum><header>Notice</header><text>If the Secretary determines a waiver under subparagraph (A) is necessary, the Secretary shall provide to the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate and the Committee on Homeland Security, the Committee on Oversight and Reform, and the Committee on Appropriations of the House of Representatives notice of such determination, which shall include—</text><clause id="id6147198dcd0c493191b39c6f8c63c48b"><enum>(i)</enum><text>identification of the national emergency declared by the President; </text></clause><clause id="id75290dcf7fd6419fab7a06dba4ff1202"><enum>(ii)</enum><text>identification of the covered item for which the Secretary intends to issue the waiver; and</text></clause><clause id="id24258d4e1c134d7ab908dc9fca570385"><enum>(iii)</enum><text>a description of the demand for the covered item and corresponding lack of supply from contractors able to meet the criteria described in subparagraph (B) or (C) of paragraph (1). </text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="HBB7DDF622AB2458790096FC4256BB6FD"><enum>(c)</enum><header>Pricing</header><text display-inline="yes-display-inline">The Secretary shall ensure that covered items are purchased at a fair and reasonable price, consistent with the procedures and guidelines specified in the Federal Acquisition Regulation.</text></subsection><subsection commented="no" id="HE59FE055B5694F29BEBC32B4A2EE75E0"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section and annually thereafter, the Secretary shall provide to the Committee on Homeland Security, the Committee on Oversight and Reform, and the Committee on Appropriations of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate a report on instances in which vendors have failed to meet deadlines for delivery of covered items and corrective actions taken by the Department in response to such instances.</text></subsection><subsection id="H98CADD93904C4792AA21B758726AB1AD"><enum>(e)</enum><header>Effective date</header><text>This section applies with respect to a contract entered into by the Department or any frontline operational component on or after October 1, 2021.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HF2518774F4F04168AA184EDE00CCF062"><enum>(b)</enum><header>Study</header><paragraph commented="no" id="id14C72FA3AAC64084A00E3AA39044B669"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a study of the adequacy of allowances provided to employees of frontline operational components (as defined in section 836 of the Homeland Security Act of 2002, as added by subsection (a)). </text></paragraph><paragraph commented="no" id="id95EE58D2E14D482E84CE301BF1514ADB"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The study conducted under paragraph (1) shall—</text><subparagraph commented="no" id="idB4AFAF60B3254FA5BCED371D943DF6F2"><enum>(A)</enum><text display-inline="yes-display-inline">be informed by a Department-wide survey of employees from across the Department who receive uniform allowances that seeks to ascertain what, if any, improvements could be made to the current uniform allowances and what, if any, impacts current allowances have had on employee morale and retention; and</text></subparagraph><subparagraph commented="no" id="idB383CE50634B402F9EEF89EC1D8E4BA7"><enum>(B)</enum><text display-inline="yes-display-inline">consider increasing by 25 percent, at minimum, the uniform allowance for first year employees and by 50 percent, at minimum, the annual allowance for all other employees.</text></subparagraph></paragraph></subsection><subsection id="H38FD18BDE776480EB7EF75300B2A421E"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 835 the following:</text><quoted-block style="OLC" display-inline="no-display-inline"
