which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Marketing Act of 1946 to modify the definition of hemp, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hemp Economic Mobilization Plan Act of 2021</short-title></quote> or the <quote><short-title>HEMP Act of 2021</short-title></quote>.</text></section><section id="id71B45E246A16418FB69154193A29416F"><enum>2.</enum><header>Hemp production</header><subsection id="idF439263A69D941C7A2108579DD06E3A3"><enum>(a)</enum><header>Definition of hemp</header><paragraph id="idED58DD7A8FD343C1BB56127C72D5A51A"><enum>(1)</enum><header>In general</header><text>Section 297A(1) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o(1)</external-xref>) is amended by striking <quote>0.3 percent</quote> and inserting <quote>1 percent</quote>.</text></paragraph><paragraph id="id4F7669FDD13A4BA3A859E2162378D890"><enum>(2)</enum><header>Conforming amendment</header><text>Section 297B(e)(2)(A)(iii) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639p">7 U.S.C. 1639p(e)(2)(A)(iii)</external-xref>) is amended by striking <quote>0.3 percent</quote> and inserting <quote>1 percent</quote>.</text></paragraph></subsection><subsection id="id6D666722523645C5846B65E4EF4EDE7E"><enum>(b)</enum><header>Testing for delta-9 THC; documentation during transport</header><paragraph id="idB010EA3E9DDD4F6692504953AC355CEC"><enum>(1)</enum><header>State and Tribal plans</header><text>Section 297B(a)(2)(A) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639p">7 U.S.C. 1639p(a)(2)(A)</external-xref>) is amended—</text><subparagraph id="id3D4200076A874D68B3937A5845262A7F"><enum>(A)</enum><text>in clause (ii)—</text><clause id="id5C1912A856DB4D9DB13847D4268A84C8"><enum>(i)</enum><text>by inserting <quote>the measurement of uncertainty of which is not greater than 0.075 percent,</quote> after <quote>methods,</quote>; and</text></clause><clause id="id1A60ACC57F4648F598DD9AF8CA78ED92"><enum>(ii)</enum><text>by striking <quote>hemp</quote> and inserting <quote>products derived from hemp plants</quote>;</text></clause></subparagraph><subparagraph id="id60C7424CD9B54C5B810711BB27F87B61"><enum>(B)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id0C606C830163448EA1F22A5245ADC8DB"><enum>(C)</enum><text>by redesignating clause (vii) as clause (viii);</text></subparagraph><subparagraph id="id40491CCB09A94AD190EA33BE30E9FA88"><enum>(D)</enum><text>by inserting after clause (vi) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3B4BEB0FFD8A45E582E9B2E3EA7A285C"><clause id="idCA9AED9E75B342C3B7875E3F83C1FE95"><enum>(vii)</enum><text>a requirement that any person transporting hemp shall keep with the shipment of hemp—</text><subclause id="id77DEDC4B35134476B5B827AA58D04427"><enum>(I)</enum><text>a copy of a valid license or other required authorization from the State department of agriculture or Tribal government, as applicable, or a license from the Secretary, issued to the producer, as is required to be submitted to the Secretary under clause (vi), as applicable, and collected by the Secretary under section 297C(d)(2)(C); or </text></subclause><subclause id="idBF25DB5E37844FA180FFA6406C4D191E"><enum>(II)</enum><text>a copy of a certificate from a laboratory demonstrating that the hemp contains a delta-9 tetrahydrocannabinol concentration of not more than 1 percent on a dry weight basis; and</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id831F9ABA36874E64B316A64F88401461"><enum>(E)</enum><text>in clause (viii) (as so redesignated), by striking <quote>the practices and procedures described in clauses (i) through (vi)</quote> and inserting <quote>clauses (i) through (vii)</quote>.</text></subparagraph></paragraph><paragraph id="idC4F15C7A325C4A40B2E7A9F45B119697"><enum>(2)</enum><header>Department of Agriculture plan</header><text>Section 297C(a)(2) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639q">7 U.S.C. 1639q(a)(2)</external-xref>) is amended—</text><subparagraph id="id48BB778D28A94E078A81FCE7AEC87D09"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="id24D07B7B0ECD4A43B8715A42A3DD24A1"><enum>(i)</enum><text>by inserting <quote>the measurement of uncertainty of which is not greater than 0.075 percent,</quote> after <quote>methods,</quote>; and </text></clause><clause id="idEA929B722FFE4CA0B6780004BBC20FB6"><enum>(ii)</enum><text>by striking <quote>hemp</quote> and inserting <quote>products derived from hemp plants</quote>;</text></clause></subparagraph><subparagraph id="id1714502C1C0844A8942DD660626B3AE9"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idB1CBB94D5A5F4D60B5B7CA16C092231A"><enum>(C)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idFAADC7063C994E6FA664C3ADEAC953BA"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1A13921FAC6F457F83AF3A3E3BDBE331"><subparagraph id="id2AD1750AD32D40498B6FC4D7DF7125F7"><enum>(G)</enum><text>a requirement that any person transporting hemp shall keep with the shipment of hemp—</text><clause id="idBC1F36D609D549B8BB88BFCF4D54626F"><enum>(i)</enum><text>a copy of a valid license or other required authorization from a State department of agriculture or Tribal government, as applicable, or a license from the Secretary, issued to the producer, as is required to be submitted to the Secretary under section 297B(a)(2)(A)(vi), as applicable, and collected by the Secretary under subsection (d)(2)(C); or</text></clause><clause id="id2004E7B3A5AA489F81FDF358CE11F7B5"><enum>(ii)</enum><text>a copy of a certificate from a laboratory demonstrating that the hemp contains a delta-9 tetrahydrocannabinol concentration of not more than 1 percent on a dry weight basis.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id0E496B2353294C999F49362860CC6F00"><enum>(c)</enum><header>Conforming revisions to regulations</header><text>Not later than 90 days after the date of enactment of this Act, without regard to the notice and comment provisions of section 553 of title 5, United States Code, the Secretary of Agriculture shall revise part 990 of title 7, Code of Federal Regulations, to make any conforming changes that are necessary as a result of this section and the amendments made by this section.</text></subsection></section></legis-body></bill>
