which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program to provide assistance to States to prevent and repair damage to structures due to pyrrhotite.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aid to Homeowners with Crumbling Foundations Act of 2021</short-title></quote>.</text></section><section id="id2EA2E42B4EB14CB3995F0C75C7BF48D9"><enum>2.</enum><header>Grant program</header><subsection id="idF62270EC743D49D8AE7B414D39194B81"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id452AE9B3301C4E88B5C0AE954DF15743"><enum>(1)</enum><text>the term <term>covered State</term> means a State that administers a crumbling foundations assistance fund;</text></paragraph><paragraph id="idD3283C4D0BB4498DA7C46600958E75C9"><enum>(2)</enum><text>the term <term>crumbling foundations assistance fund</term> means a fund established by a State the purpose of which is to receive public or private contributions to provide financial assistance to owners of residential buildings in the State to repair or replace the concrete foundations of those residential buildings that have deteriorated due to the presence of pyrrhotite;</text></paragraph><paragraph id="idB503612D682F4DBD8C2506B3B7D4E1B8"><enum>(3)</enum><text>the term <term>residential building</term> means any family dwelling, including any building, condominium unit, or dwelling in a planned unit development; and</text></paragraph><paragraph id="id06C0438A1D6340AA8B4BCCE79FED3B17"><enum>(4)</enum><text>the term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection><subsection id="idCB3AF43992324F78989C49E6A8A2336A"><enum>(b)</enum><header>Authorization</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish and implement a program to make grants to covered States to assist owners of residential buildings with concrete foundations that have deteriorated due to the presence of pyrrhotite.</text></subsection><subsection id="id6DE13554C5F04532A5CF43C16CD470C9"><enum>(c)</enum><header>Application</header><text>A covered State desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may require.</text></subsection><subsection id="id1A073DAB83F34B919781F75B566F60D1"><enum>(d)</enum><header>Deposit of funds</header><text>A covered State receiving a grant under this section shall deposit any grant amounts into the crumbling foundations assistance fund of the State for the purpose of carrying out the activities described in subsection (e).</text></subsection><subsection id="id047ADC15F04941F1A5EA1733B18A45B5"><enum>(e)</enum><header>Use of funds</header><text>A covered State receiving a grant under this section shall—</text><paragraph id="id7232c72acbb241c79ee5a7d71f6a9016"><enum>(1)</enum><text>develop a single, unified application for owners of residential buildings to apply for all financial assistance from the crumbling foundations assistance fund of the covered State;</text></paragraph><paragraph id="idbf30d00558bf463b89dea1845f923a21"><enum>(2)</enum><text>provide financial assistance to approved owners of residential buildings for the repair or replacement of concrete foundations that have deteriorated due to the presence of pyrrhotite, including financial reimbursement to owners who have had such repair or replacement performed before the date of enactment of this Act;</text></paragraph><paragraph id="idf6c168e0d018425693b8ff3456296b4f"><enum>(3)</enum><text>assist approved owners of residential buildings to obtain additional financing necessary to fully fund the repair or replacement of concrete foundations that have deteriorated due to the presence of pyrrhotite;</text></paragraph><paragraph commented="no" id="id52c18170fa944b77819f47fb6554531b"><enum>(4)</enum><text>approve contractors or other vendors for eligibility to perform foundation repairs or replacements on behalf of approved owners;</text></paragraph><paragraph id="id3456763020a0486380969873534b992a"><enum>(5)</enum><text>ensure that the financial assistance is used solely for costs of repairing and replacing concrete foundations that have deteriorated due to the presence of pyrrhotite; and</text></paragraph><paragraph id="ida086eda1c3084e7d9fd160eebd3b3d6f"><enum>(6)</enum><text>require the disclosure of the amount of all financial compensation received by an owner of the residential building, if any, arising out of a claim for coverage under the property coverage provisions of the homeowners policy for foundation deterioration due to the presence of pyrrhotite and ensure that the amount is considered when determining the amount of financial assistance offered to the owner.</text></paragraph></subsection><subsection id="id23BEE1E5849940438E4F0AD424144AA0"><enum>(f)</enum><header>Grant amount and duration</header><paragraph id="id1EC7D2C4D3104F4C98853E602D8336DA"><enum>(1)</enum><header>Amount</header><text>Each grant awarded to a covered State under this section in a fiscal year shall be in an amount of not more than $30,000,000.</text></paragraph><paragraph id="idD3388C3A14144A9A9EAD6E3F36B35F65"><enum>(2)</enum><header>Duration</header><text>A grant awarded under this section shall be for a period of 5 years.</text></paragraph></subsection><subsection commented="no" id="id4A49084FA9D44BFEA52B17EAC1EF944C"><enum>(g)</enum><header>Annual report</header><text>The Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives an annual report on the grant program established under this section, including a summary of the use of funds by covered States receiving a grant under this section.</text></subsection><subsection id="id8EA8A8E0757B49A593C4585FEF1EED92"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section></legis-body></bill>
