RES. 968</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220308">March 8, 2022</action-date><action-desc><sponsor name-id="G000596">Mrs. Greene of Georgia</sponsor> (for herself, <cosponsor name-id="G000595">Mr. Good of Virginia</cosponsor>, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, and <cosponsor name-id="B001302">Mr. Biggs</cosponsor>) submitted the following resolution; which was referred to the <committee-name committee-id="HRU00">Committee on Rules</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">To amend the Rules of the House of Representatives to prohibit remote voting and voting by voice and to require a recorded vote on any question put before the House, and for other purposes.</official-title></form><resolution-body style="OLC" id="HF7CB76266B4946F5A13CAD2534F5E200"><section display-inline="no-display-inline" section-type="section-one" id="H48B1555852334B548063AEBDA7E1F14C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This resolution may be cited as the <quote><short-title>Congressional Voting Accountability Act</short-title></quote>. </text></section><section id="HE08A3735FDF246C3929852E4738A929D"><enum>2.</enum><header>Requirements with respect to voting and general debate in the House of Representatives</header><subsection id="H4F7C6B5B49ED4949BCC5721394E300E5" display-inline="no-display-inline"><enum>(a)</enum><header>Prohibition against proxy voting</header><text display-inline="yes-display-inline">Section 3(s) of House Resolution 8 (relating to remote voting by proxy and remote committee activity) is repealed.</text></subsection><subsection id="HAE91892E7ED64732A5D563A6E67D6778"><enum>(b)</enum><header>Recorded vote requirement for any question before the House</header><text>Rule XXIX of the Rules of the House of Representatives is amended by adding at the end the following: </text><quoted-block style="OLC" id="H99F6BF280A3E48F0933D45B7A3CD56D3" display-inline="no-display-inline"><rules-clause id="HE8BBC7305D0D41FAA3524F1E05A66B85"><enum>5.</enum><text display-inline="yes-display-inline">Notwithstanding any other rule of the Rules of the House, a recorded vote conducted pursuant to the voting procedures under rule XX shall be considered as ordered on any question put before the House. The Speaker may not entertain a request for the suspension of this rule by unanimous consent or otherwise.</text></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H80ADCBDA1D554B839D6A44CC7D8C9788"><enum>(c)</enum><header>Questions put by Speaker of the House</header><paragraph id="HA90539C44B3D4EC590450992F10ABDD4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Clause 6 of rule I of the Rules of the House of Representatives is amended to read as follows:</text><quoted-block style="OLC" id="HF462C4033E0747A69E8B26570A086C25" display-inline="no-display-inline"><rules-clause id="H9FDD6D1598DF4FC3A5879308A896B9CB" indent="down1"><enum>6.</enum><text display-inline="yes-display-inline">The Speaker shall put a question in the form of a vote by the yeas and nays pursuant to the voting procedures described under rule XX.</text></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFA03B2EB48014CB6BF6ABD863B14DA27"><enum>(2)</enum><header>Conforming amendment</header><text>Clause 1(a) of rule XX of the Rules of the House of Representatives is amended by striking <quote>by voice</quote>.</text></paragraph></subsection><subsection id="H120A2C94C2D9450CA9831F9F1AA01E98" display-inline="no-display-inline"><enum>(d)</enum><header>Prohibiting Members from voting <quote>present</quote> on questions on which record vote is taken</header><text>Rule XX of the Rules of the House of Representatives is amended by adding at the end the following new clause:</text><quoted-block style="OLC" id="HE024A2B881A744D9AC44850041EA798B" display-inline="no-display-inline"><rules-clause id="H544CF865021C49448BA7693430B37078"><rules-clause-header>Requiring voting in affirmative or negative</rules-clause-header><enum>12.</enum><text display-inline="yes-display-inline">On any question on which a record vote is taken in the House, including the Committee of the Whole House on the state of the Union, or in any committee of the House, a Member may vote only in the affirmative or the negative and may not vote <quote>present</quote> except during a quorum call.</text></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF6AF83D3DD784720BF74F9CF9A06A406"><enum>(e)</enum><header>Requirements with respect to voting in the House</header><paragraph id="H0EFB35FD910140F78E372E321E1E722F"><enum>(1)</enum><header>Vote by the yeas and nays required</header><text>Clause 10 of rule XX of the Rules of the House of Representatives is amended to read as follows:</text><quoted-block style="OLC" id="H905B80641A7144E180847F5F8688C059" display-inline="no-display-inline"><rules-clause id="H3B6B1AFD6C9B46A3A58014C01F5F076E" indent="down1"><enum>10.</enum><text display-inline="yes-display-inline">A recorded vote shall be considered as ordered whenever the Speaker puts the question on passage of a bill or joint resolution, on adoption of an amendment thereto, making general appropriations, on final adoption of a concurrent resolution on the budget, or on adoption of a conference report or Senate amendment. The Speaker may not entertain a request for the suspension of this clause by unanimous consent or otherwise.</text></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H70234CE1102B44FCB2B2AF0F2A8C8CA9"><enum>(2)</enum><header>Conforming amendment</header><text>Clause 1(b) of rule XX of the Rules of the House of Representatives is amended by striking <quote>If a Member, Delegate, or Resident Commissioner requests a recorded vote, and that request is supported by at least one-fifth of a quorum, the vote</quote> and inserting <quote>A recorded vote under this rule</quote>. </text></paragraph></subsection><subsection id="HB762ACDA3FB446FE9C519B1E9E9A3445"><enum>(f)</enum><header>Quorum and voting requirements in the Committee of the Whole House on the state of the Union</header><paragraph id="H9840623F27DF48CBB7CFC0B7ACD17F81" display-inline="no-display-inline"><enum>(1)</enum><header>Requirements with respect to quorum</header><text display-inline="yes-display-inline">Clause 6(b)(1) of rule XVIII is amended by striking <quote>may refuse</quote> and inserting <quote>may not refuse</quote>.</text></paragraph><paragraph id="H8B19FC476C61428ABB068B6139D008FB"><enum>(2)</enum><header>Recorded vote required</header><text>Clause 6(e) of rule XVIII is amended to read as follows: </text><quoted-block style="OLC" id="H68DF6EC2D6E2498FAA003F9AA8CF9036" display-inline="no-display-inline"><rules-clause id="H5E69A17B497E4CABBF5E0AA23041EDD4"><enum>(e)</enum><text display-inline="yes-display-inline">In the Committee of the Whole House on the state of the Union, a recorded vote shall be considered as ordered whenever the Chair puts the question on passage of a bill or joint resolution, on adoption of an amendment thereto, making general appropriations, on final adoption of a concurrent resolution on the budget, or on adoption of a conference report or Senate amendment. A recorded vote taken in the Committee of the Whole House on the state of the Union under this paragraph shall be considered a vote by the yeas and nays.</text></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></resolution-body></resolution>
