RES. 779</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211105">November 5, 2021</action-date><action-desc><sponsor name-id="G000563">Mr. Gibbs</sponsor> (for himself, <cosponsor name-id="G000577">Mr. Graves of Louisiana</cosponsor>, <cosponsor name-id="S001199">Mr. Smucker</cosponsor>, <cosponsor name-id="A000377">Mr. Armstrong</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="S001195">Mr. Smith of Missouri</cosponsor>, <cosponsor name-id="S001189">Mr. Austin Scott of Georgia</cosponsor>, and <cosponsor name-id="M001180">Mr. McKinley</cosponsor>) submitted the following resolution; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Expressing the sense of the House of Representatives that Congress disapproves of the Occupational Safety and Health Administration’s Vaccine Mandate.</official-title></form><preamble><whereas><text>Whereas the Occupational Safety and Health Administration issued an emergency temporary standard (ETS) to require employers with more than 100 employees to ensure that all their workers are either fully vaccinated against COVID–19 or subject them to weekly testing and mask-wearing;</text></whereas><whereas><text>Whereas non-complying businesses could be fined, and non-complying employees fired;</text></whereas><whereas><text>Whereas Congress tasked the Department of Health and Human Services with determining the safety, efficacy, and appropriate use of vaccines;</text></whereas><whereas><text>Whereas Congress authorized the Food and Drug Administration to determine whether vaccines should be allowed in interstate commerce;</text></whereas><whereas><text>Whereas Congress empowered the Centers for Disease Control and Prevention to recommend who should receive such vaccines;</text></whereas><whereas><text>Whereas Congress authorized the Occupational Safety and Health Administration to set and enforce standards affecting the working conditions for workers resulting from workplace specific risks;</text></whereas><whereas><text>Whereas the Occupational Safety and Health Administration’s use of the emergency temporary standard is an abuse of executive authority because COVID–19 is not a workplace specific risk; and </text></whereas><whereas><text>Whereas other agencies have already been given broad authority by Congress on COVID–19 vaccines and mitigating the public health effects of COVID–19: Now, therefore, be it</text></whereas></preamble><resolution-body style="traditional" id="H3DB67828A7D84E80A8BEE646E07BBE45"><section display-inline="yes-display-inline" section-type="undesignated-section" id="H33A40886DA554748872213566E8B3655"><enum/><text display-inline="yes-display-inline">That the House of Representatives stands in opposition to any adverse punishment for private employers and private employees who choose not to receive the COVID–19 vaccine.</text></section></resolution-body></resolution>
