RES. 1064</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220426">April 26, 2022</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> (for herself and <cosponsor name-id="G000592">Mr. Golden</cosponsor>) submitted the following resolution; which was referred to the <committee-name committee-id="HRU00">Committee on Rules</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Establishing the Select Committee on Older Americans.</official-title></form><resolution-body style="OLC" id="HB2E5214996EA44EBA12AF3946AEF2639"><section id="HA70D3903036C4DD4B0B5BC10E661A7F3" section-type="section-one"><enum>1.</enum><header>Select Committee on Older Americans</header><text display-inline="no-display-inline">There is hereby established in the House of Representatives the Select Committee on Older Americans (hereafter in this resolution referred to as the <quote>Select Committee</quote>).</text></section><section id="HB65619BC31AC4CBE80DDEBF4473FF1FF"><enum>2.</enum><header>Composition</header><subsection id="H1480A705EC3A4895946B9D76803BC0C0"><enum>(a)</enum><header>In general</header><text>The Speaker shall appoint 12 Members to the Select Committee, 6 of whom shall be appointed on the recommendation of the Minority Leader.</text></subsection><subsection id="H2C937AB280C041088D4CC08A04742FF2"><enum>(b)</enum><header>Chair; ranking minority member</header><text>The Speaker shall designate one Member to serve as chair of the Select Committee. On the recommendation of the Minority Leader, the Speaker shall designate one Member to serve as the ranking minority member of the Select Committee.</text></subsection><subsection id="H7ED6355E73234C0C8B8BE47EACE5F619"><enum>(c)</enum><header>Vacancies</header><text>Any vacancy in the Select Committee shall be filled in the same manner as the original appointment.</text></subsection></section><section id="H404A6ED5CBF449DD82BED2082A76B590"><enum>3.</enum><header>Duties</header><subsection id="H92567ABDA09A44959168F29D00E283B1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Select Committee shall—</text><paragraph id="H7264D38C64434BA49D3D156BDB4B8776"><enum>(1)</enum><text>serve as a forum for bipartisan discussion of and inquiry into the unique economic, health, housing, and social issues facing older Americans generally, and with specific emphasis on challenges arising from the COVID–19 pandemic;</text></paragraph><paragraph id="H2780406DE10948239D98DA7E15C0AC67"><enum>(2)</enum><text display-inline="yes-display-inline">through regular briefings and hearings, raise awareness of challenges that older Americans face; and</text></paragraph><paragraph id="HD7C6FFCF973F4C779EC9A93BB06D0169"><enum>(3)</enum><text>collaborate with committees of Congress, other entities of the legislative branch, entities of the executive branch, and nongovernmental organizations to promote initiatives within the House of Representatives, organize and publish reports, and issue recommendations that advance policies that support the well-being of older Americans.</text></paragraph></subsection><subsection id="HFE7095AEADBE40FDBD4442E7C80E6F0A"><enum>(b)</enum><header>Exclusion of recommendations related to Social Security and Medicare</header><text>The Select Committee may not issue recommendations related to the program for Federal old-age, survivors, and disability insurance benefits under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) or the program for health insurance for the aged and disabled under titles XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>).</text></subsection></section><section id="H5A32163EAFF9495C946B921744B5C1DA"><enum>4.</enum><header>Rules and procedures</header><subsection id="HEC53F4844B874CBBA3697C60CBAB50B9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, the Select Committee shall have the authorities and responsibilities of, and shall be subject to the same limitations and restrictions as, a standing committee of the House, and shall be deemed a committee of the House for all purposes of law or rule.</text></subsection><subsection id="HD35538BF9784463EA435D6C0D7D903EC"><enum>(b)</enum><header>Applicability of general rules for standing committees</header><text>Rules X and XI of the Rules of the House of Representatives shall apply to the Select Committee except as follows:</text><paragraph id="HCD8B33957562462E9EC8697ECE6D3161"><enum>(1)</enum><text display-inline="yes-display-inline">Service on the Select Committee shall not count against the limitations in clause 5(b)(2) of rule X.</text></paragraph><paragraph id="HC1BA667BF60E453CBE9F0AE98D38710D"><enum>(2)</enum><text display-inline="yes-display-inline">Clause 2(m)(1)(B) of rule XI, clause 2(m)(3) of rule XI, and section 3(a) of House Resolution 8, One Hundred Seventeenth Congress, shall not apply to the Select Committee, but the Select Committee may recommend subpoenas and depositions and submit such recommendations to the relevant standing committee.</text></paragraph><paragraph id="H30378A9F720E4FBEAA5312D20E6AF987"><enum>(3)</enum><text display-inline="yes-display-inline">Clause 2(d) of rule X shall not apply to the Select Committee.</text></paragraph></subsection><subsection id="HDEA0AC80D8EE498EAE558D6C1EAB1EBA"><enum>(c)</enum><header>No legislative jurisdiction</header><text display-inline="yes-display-inline">The Select Committee shall not have legislative jurisdiction and shall have no authority to take legislative action on any bill or resolution.</text></subsection></section><section id="H3672450D9C954DC49C7DDEA0822468C5"><enum>5.</enum><header>Staff; funding</header><subsection id="H3C064292338B4A5BB85649A62D7B926A"><enum>(a)</enum><header>Staff</header><paragraph id="HCC6E04EDD9C74F6CA0724F285D86B550"><enum>(1)</enum><header>Use of existing staff</header><text display-inline="yes-display-inline">The Select Committee may use the services of staff of the House.</text></paragraph><paragraph id="H3E379B96432E4FA7867D104AD106171D"><enum>(2)</enum><header>Authority to appoint staff</header><text>The chair of the Select Committee, upon consultation with the ranking minority member of the Select Committee, may appoint and fix the compensation of such staff as the chair considers necessary to carry out this resolution.</text></paragraph><paragraph id="HDEA19531F8A04BE495903AE581FF8A30"><enum>(3)</enum><header>Detail of House employees</header><text display-inline="yes-display-inline">Upon the request of the Select Committee, the head of any office of the House of Representatives is authorized to detail, without reimbursement, any of the personnel of such office to the Select Committee to assist the Select Committee in carrying out its duties.</text></paragraph></subsection><subsection id="H4E81FF0B2AD648B7B448D35D7AF6E39C"><enum>(b)</enum><header>Authority To use experts and consultants</header><text>Section 202(i) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4301">2 U.S.C. 4301(i)</external-xref>) shall apply with respect to the Select Committee in the same manner as such section applies with respect to a standing committee of the House of Representatives.</text></subsection><subsection id="H8BE43933CE424D8E92C03FE3754D932B" commented="no"><enum>(c)</enum><header>Funding</header><text>There shall be paid out of the applicable accounts of the House of Representatives such sums as may be necessary for the expenses of the Select Committee. Such payments shall be made on vouchers signed by the chair of the Select Committee and approved in the manner directed by the Committee on House Administration. Amounts made available under this subsection shall be expended in accordance with regulations prescribed by the Committee on House Administration.</text></subsection></section><section id="H390F59199F5941FA9029E2C8914A5A33"><enum>6.</enum><header>Reports</header><subsection id="H48526519EDAB4AD1954CEF9D6C51ACD3"><enum>(a)</enum><header>Interim status reports</header><text>Not later than 120 days after the appointment of its members and every 120 days thereafter, the Select Committee shall submit to the Committee on House Administration and the Committee on Rules an interim status report on its activities, and shall include in each such report—</text><paragraph id="H7D1D61FE052D4B72B758E3B69717ED8E"><enum>(1)</enum><text>transcripts of the hearings and meetings held by the Select Committee since the most recent such report;</text></paragraph><paragraph id="H98CED189EF794992A4D7C2C8EB4B8743"><enum>(2)</enum><text>an itemized statement of Select Committee’s expenditures since the most recent such report; and</text></paragraph><paragraph id="HCD02EB5CE9B94C5789ADF7B35E47038D"><enum>(3)</enum><text>a plan for the activities to be carried out by the Select Committee during the next 120 days.</text></paragraph></subsection><subsection id="H1C48AD81D48D43F8BA31D2A66CF0C1BF"><enum>(b)</enum><header>Final report</header><text>No later than 2 years after the appointment of its members, the Select Committee shall submit a final report to the House which shall include the results of the Select Committee’s studies, detailed findings, and any policy recommendations as the select committee may deem advisable. The Select Committee shall submit the policy recommendations included in the final report to the relevant standing committees.</text></subsection><subsection id="H5AD9AC0CBEEC47C1902C868B28C7E379"><enum>(c)</enum><header>Publication</header><text>The Select Committee shall ensure that each report submitted under subsection (a) or (b) is, upon completion, made available to the general public in widely accessible formats not later than 30 calendar days following the date the report is submitted to a committee or the House, as the case may be.</text></subsection><subsection id="H327EBB4A4C824404BA7705C143720589"><enum>(d)</enum><header>Other findings and recommendations</header><text>In addition to the reports required under subsections (a) and (b), the Select Committee may report to the House or any committee from time to time the results of its investigations and studies, together with such detailed findings and policy recommendations as it may deem advisable.</text></subsection></section><section id="HF0C145E13BF94101885B21C9DE1B3B5C"><enum>7.</enum><header>Termination</header><text display-inline="no-display-inline">The Select Committee shall terminate on the date on which the final report submitted under section 6(b) is made available to the general public under section 6(c).</text></section></resolution-body></resolution>
