RES. 1009</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220329">March 29, 2022</action-date><action-desc><sponsor name-id="M001166">Mr. McNerney</sponsor> submitted the following resolution; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Expressing the sense of the House of Representatives regarding the consideration of <quote>Just War</quote> principles prior to any vote with respect to a declaration of war or an authorization of the use of military force.</official-title></form><preamble><whereas><text>Whereas the incorporation of <quote>Just War</quote> principles into deliberations with regard to a declaration of war or an authorization of the use of military force will ensure that the United States takes military action only under certain circumstances: Now, therefore, be it</text></whereas></preamble><resolution-body style="traditional" id="H7BF0A46C033349428A858E156BB08A7E"><section display-inline="yes-display-inline" section-type="undesignated-section" id="HD5516654C67447C498F200C579602F48"><enum/><text display-inline="yes-display-inline">That it is the sense of the House of Representatives that, prior to any vote by the House with respect to the introduction of the United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicated by the circumstances, the House should also determine—</text><paragraph id="H1B7353B10A1A43719A29EF51CF30EBEF"><enum>(1)</enum><text display-inline="yes-display-inline">whether such introduction is for the purpose of a just cause, such as—</text><subparagraph id="HD9A4D940029B4F939799BFCD1E5584FE"><enum>(A)</enum><text>stopping a genocide or ethnic cleansing;</text></subparagraph><subparagraph id="H57A2A226E1C14858BFEE0D331753A108"><enum>(B)</enum><text>stopping grievous, massive, and irreparable harm to the environment; or</text></subparagraph><subparagraph id="H05C3FBD1ADCA4CF9B1C7FAB483172636"><enum>(C)</enum><text>protecting the United States or its allies from invasion or mass destruction;</text></subparagraph></paragraph><paragraph id="HA75F2B7DEE404E429C08457494208425"><enum>(2)</enum><text>whether the proposed action will be—</text><subparagraph id="H550FFE8CCADD456AA53441176C82F058"><enum>(A)</enum><text display-inline="yes-display-inline">in response only to the underlying just cause;</text></subparagraph><subparagraph id="H7375295F430E4895BD8DD90F24529E77"><enum>(B)</enum><text>proportional to the underlying just cause; and</text></subparagraph><subparagraph id="HDDA437C9B4D345E1B5F7959773E15952"><enum>(C)</enum><text>undertaken with the intent to reestablish peace;</text></subparagraph></paragraph><paragraph id="H4D3ED58C5A5C403691811E2D81870990"><enum>(3)</enum><text display-inline="yes-display-inline">whether the presumed benefits of the proposed action outweigh the harm done;</text></paragraph><paragraph id="H1023B939C44C4F8DA3EF63D2FE0914F4"><enum>(4)</enum><text>whether there is a reasonable probability that the proposed action will succeed; and</text></paragraph><paragraph id="H3964EF34B08848CAA74425B41829495E"><enum>(5)</enum><text>whether all alternatives to military action have been exhausted.</text></paragraph></section></resolution-body></resolution>
