R. 990</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210211">February 11, 2021</action-date><action-desc><sponsor name-id="G000592">Mr. Golden</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to require broadcasting stations, providers of cable and satellite television, and online platforms to make reasonable efforts to ensure that political advertisements are not purchased by a foreign national.</official-title></form><legis-body id="HB5B9A6BEFAC14E09BA6C497D6024D104" style="OLC"><section id="HF8EE56D78F994EB6BAE612A73978303A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Block Foreign-Funded Political Ads Act</short-title></quote>. </text></section><section id="HBE4EADBCFCA74131BFF26FC6660042C5" section-type="subsequent-section"><enum>2.</enum><header>Preventing contributions, expenditures, independent expenditures, and disbursements for electioneering communications by foreign nationals in the form of online advertising</header><text display-inline="no-display-inline">Section 319 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H53539509CDDC42AA97F493271FD81823" style="OLC"><subsection id="HC0E1049A9F1F45A8B643110EEFCE101E"><enum>(c)</enum><header>Responsibilities of broadcast stations, providers of cable and satellite television, and online platforms</header><paragraph id="H97114EA791F142BABF817ABF2759C85F"><enum>(1)</enum><header>Responsibilities described</header><text display-inline="yes-display-inline">Each television or radio broadcast station, provider of cable or satellite television, or online platform shall make reasonable efforts to ensure that communications described in section 318(a) and made available by such station, provider, or platform are not purchased by a foreign national, directly or indirectly. For purposes of the previous sentence, a station, provider, or online platform shall not be considered to have made reasonable efforts under this paragraph in the case of the availability of a communication unless the station, provider, or online platform directly inquires from the individual or entity making such purchase whether the purchase is to be made by a foreign national, directly or indirectly.</text></paragraph><paragraph id="H4F8647C4D97C4480819D400A63663D0C"><enum>(2)</enum><header>Special rules for disbursement paid with credit card</header><text display-inline="yes-display-inline">For purposes of paragraph (1), a television or radio broadcast station, provider of cable or satellite television, or online platform shall be considered to have made reasonable efforts under such paragraph in the case of a purchase of the availability of a communication which is made with a credit card if—</text><subparagraph id="HDE88FEB25E344C3F8045E05225F6B766"><enum>(A)</enum><text>the individual or entity making such purchase is required, at the time of making such purchase, to disclose the credit verification value of such credit card; and</text></subparagraph><subparagraph id="H69017C7D2AF045AC936D9CE7221E4BEE"><enum>(B)</enum><text display-inline="yes-display-inline">the billing address associated with such credit card is located in the United States or, in the case of a purchase made by an individual who is a United States citizen living outside of the United States, the individual provides the television or radio broadcast station, provider of cable or satellite television, or online platform with the United States mailing address the individual uses for voter registration purposes.</text></subparagraph></paragraph><paragraph id="H5C68F9CA8E294869A40A833B24A67858"><enum>(3)</enum><header>Definitions</header><subparagraph id="HF12171544D624680985D93D501DBFC04"><enum>(A)</enum><header>Online platform</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>online platform</term> means any public-facing website, web application, or digital application (including a social network, ad network, or search engine) which—</text><clause id="H171E99AAD0F64C44840B50EE5E8251F9"><enum>(i)</enum><text>sells qualified political advertisements; and</text></clause><clause id="HFCF48C9A58D642F9B019A304B438C591"><enum>(ii)</enum><text>has 50,000,000 or more unique monthly United States visitors or users for a majority of months during the preceding 12 months.</text></clause></subparagraph><subparagraph id="H3B1B1D0BD44644B6BA6DB996E75D5B3C"><enum>(B)</enum><header>Qualified political advertisement</header><text>For purposes of subparagraph (A), the term <term>qualified political advertisement</term> means any advertisement (including search engine marketing, display advertisements, video advertisements, native advertisements, and sponsorships) that—</text><clause id="H10F896D2A83E4692AF2CA50721F102B1"><enum>(i)</enum><text>is made by or on behalf of a candidate; or</text></clause><clause id="HA7BC4E4CE6D945809A93B26D1F656562" commented="no"><enum>(ii)</enum><text>communicates a message relating to any political matter of national importance, including—</text><subclause id="H31447FAD52954EA58187510A0E5CDC66" commented="no"><enum>(I)</enum><text>a candidate;</text></subclause><subclause id="HA6E0650D7D394A678F4B449103605282" commented="no"><enum>(II)</enum><text>any election to Federal office; or</text></subclause><subclause id="H9FF235FADA574069AAADB341C1DCA069" commented="no"><enum>(III)</enum><text>a national legislative issue of public importance.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
