R. 988</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210211">February 11, 2021</action-date><action-desc><sponsor name-id="G000563">Mr. Gibbs</sponsor> (for himself, <cosponsor name-id="C001115">Mr. Cloud</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="E000294">Mr. Emmer</cosponsor>, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="H001052">Mr. Harris</cosponsor>, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, <cosponsor name-id="M001177">Mr. McClintock</cosponsor>, <cosponsor name-id="M001195">Mr. Mooney</cosponsor>, <cosponsor name-id="N000189">Mr. Newhouse</cosponsor>, <cosponsor name-id="R000597">Mr. Rice of South Carolina</cosponsor>, <cosponsor name-id="R000603">Mr. Rouzer</cosponsor>, <cosponsor name-id="S000250">Mr. Sessions</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="W000815">Mr. Wenstrup</cosponsor>, <cosponsor name-id="Y000033">Mr. Young</cosponsor>, <cosponsor name-id="C001039">Mrs. Cammack</cosponsor>, <cosponsor name-id="L000266">Mr. LaTurner</cosponsor>, <cosponsor name-id="M000194">Ms. Mace</cosponsor>, <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>, and <cosponsor name-id="H001084">Ms. Herrell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect the right of individuals to bear arms at water resources development projects administered by the Secretary of the Army, and for other purposes.</official-title></form><legis-body id="HD90D5F323CEB40B99C2CEE30EF47FB9D" style="OLC"><section id="H17518BAE08D74D5FA02A07A922755CE2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recreational Lands Self-Defense Act of 2021</short-title></quote>.</text></section><section id="H3750F7FC854546D0BC9EAFE4417138E4"><enum>2.</enum><header>Protecting Americans from violent crime</header><subsection id="H6C7111B70AFC4ECD8CCBFAE25D133168"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H2ACEE2C7E0784BCEBF26EB3AC73931F0"><enum>(1)</enum><text>The Second Amendment to the Constitution provides that <quote>the right of the people to keep and bear Arms, shall not be infringed</quote>.</text></paragraph><paragraph id="H884E7A93DCEC4049A0B6A0F5861E7A63"><enum>(2)</enum><text display-inline="yes-display-inline">Section 327.13 of title 36, Code of Federal Regulations, provides that, except in special circumstances, <quote>possession of loaded firearms, ammunition, loaded projectile firing devices, bows and arrows, crossbows, or other weapons is prohibited</quote> at water resources development projects administered by the Secretary of the Army.</text></paragraph><paragraph id="H7D592CBA09C24670BD97E6C83233EA01"><enum>(3)</enum><text>The regulations described in paragraph (2) prevent individuals complying with Federal and State laws from exercising the Second Amendment rights of the individuals while at such water resources development projects.</text></paragraph><paragraph id="H2E92E023ECF74FC7B92768CBB14FAE92"><enum>(4)</enum><text>The Federal laws should make it clear that the Second Amendment rights of an individual at a water resources development project should not be infringed.</text></paragraph></subsection><subsection id="H14D881351D4C43DAB32CC21533349971"><enum>(b)</enum><header>Protecting the right of individuals To bear arms at water resources development projects</header><text>The Secretary of the Army shall not promulgate or enforce any regulation that prohibits an individual from possessing a firearm, including an assembled, functional, or loaded firearm, at a water resources development project covered under section 327.0 of title 36, Code of Federal Regulations (as in effect on the date of enactment of this Act), if—</text><paragraph id="HD5E0B38E437A42579AE765710A55AE4E"><enum>(1)</enum><text>the individual is not otherwise prohibited by law from possessing the firearm; and</text></paragraph><paragraph id="HE9E53B80725D4E84A0080D58D9067050"><enum>(2)</enum><text>the possession of the firearm is in compliance with the law of the State in which the water resources development project is located.</text></paragraph></subsection></section></legis-body></bill>
