section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Death Penalty Abolition Act of 2021</short-title></quote>.</text></section><section id="H25ECC9207C574DC6A8F4E42E9C3AE1A6"><enum>2.</enum><header>Repeal of Federal laws providing for the death penalty</header><subsection id="H628AE8C8F83548C1A393FA883D7A0520"><enum>(a)</enum><header>Homicide-Related offenses</header><paragraph id="HC8DDDC079F054F35A072A173CA84FA9A"><enum>(1)</enum><header>Murder related to the smuggling of aliens</header><text>Section 274(a)(1)(B)(iv) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(B)(iv)</external-xref>) is amended by striking <quote>punished by death or</quote>.</text></paragraph><paragraph id="H2CA051DE73A2424FB2643770E0A0218C"><enum>(2)</enum><header>Destruction of aircraft, motor vehicles, or related facilities resulting in death</header><text>Section 34 of title 18, United States Code, is amended by striking <quote>to the death penalty or</quote>.</text></paragraph><paragraph id="HE1875471E5394CCA81C8B6F9288206C2"><enum>(3)</enum><header>Murder committed during a drug-related drive-by shooting</header><text>Section 36(b)(2)(A) of title 18, United States Code, is amended by striking <quote>death or</quote>.</text></paragraph><paragraph id="H9DEE109BF24C4C18A2FE58D150D0B270"><enum>(4)</enum><header>Murder committed at an airport serving international civil aviation</header><text>Section 37(a) of title 18, United States Code, is amended, in the matter following paragraph (2), by striking <quote>punished by death or</quote>.</text></paragraph><paragraph id="H85CB59F7902E48D7B61C5FB29BA6D6DB"><enum>(5)</enum><header>Murder committed using chemical weapons</header><text>Section 229A(a)(2) of title 18, United States Code, is amended—</text><subparagraph id="HFBD1CA4D7ED341ACB37046012E9E8AFA"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="USC">Death penalty</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="USC">Causing death</header-in-text></quote>; and</text></subparagraph><subparagraph id="H3458218D29FC48D89CBBB134C8EF439D"><enum>(B)</enum><text>by striking <quote>punished by death legal-doc="usc-chapter" parsable-cite="usc-chapter/18/13">Chapter 13</external-xref> of title 18, United States Code, is amended—</text><subparagraph id="HE42BD93C996F410386CAB6B057AA6A1A"><enum>(A)</enum><text>in section 241, by striking <quote>, or may be sentenced to death</quote>;</text></subparagraph><subparagraph id="HD5D71D14CF0D4439A14BF0A9856C5014"><enum>(B)</enum><text>in section 242, by striking <quote>, or may be sentenced to death</quote>;</text></subparagraph><subparagraph id="H3278FA09A366412AB246905CB7639678"><enum>(C)</enum><text>in section 245(b), by striking <quote>, or may be sentenced to death</quote>; and</text></subparagraph><subparagraph id="H529A4F81C8174DD2A0CDE8C2245206A5"><enum>(7)</enum><header>Murder of a member of congress, an important executive official, or a supreme court justice</header><text>Section 351 of title 18, United States Code, is amended—</text><subparagraph id="H2A4C7353F5B8457EBD2FD566FDE17DF4"><enum>(A)</enum><text>in subsection (b)—</text><clause id="HB603EB89434A457BADD879CEA6FB4765"><enum>(i)</enum><text>by striking <quote>(1)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC670D4976DFF4C84895BC3252181A699"><enum>(ii)</enum><text>by striking <quote>, or (2) by death</quote> and all that follows through the end of the subsection and inserting a period; id="H95231753CB774AF99CF7053676D858C6"><enum>(A)</enum><header>Conspiracy</header><text>Section 881(b) of title 10, United States Code (article 81(b) of the Uniform Code of Military Justice), is amended by striking <quote>, if death results</quote> and all that follows through the end and inserting <quote>as a court-martial or military commission may A judgment as to legality of the proceedings is final in such cases when review is completed by a Court of Criminal Appeals and—</text><subparagraph id="H6F27C23AFE3944A3B9AD4DE6EE320207" indent="up1"><enum>(A)</enum><text>the time for the accused to file a petition for review by the Court of Appeals for the Armed Forces has expired and the accused has not filed a timely petition for such review and the case is not otherwise under review by that Court;</text></subparagraph><subparagraph id="HDABAAD72044C4B168190CD0C86E0CBB0" indent="up1"><enum>(B)</enum><text>such a petition is rejected by the Court of Appeals for the Armed Forces; or</text></subparagraph><subparagraph id="H151C51DD836A40B0AE812E2D283D5977" indent="up1"><enum>(C)</enum><text>review is completed in accordance with the judgment of the Court of Appeals for the Armed Forces and—</text><clause id="H40DE063901F9461DBBFF1AEA40A21E9B"><enum>(i)</enum><text>a petition for a writ of certiorari is not filed within the time limits prescribed by the Supreme Court;</text></clause><clause id="H8FC0CA4174594B19AF10AA08B65CCBB0"><enum>(ii)</enum><text>such a petition is rejected by the Supreme Court; or</text></clause><clause id="H25332F46D0B9458884F3CEB13C962DF3"><enum>(iii)</enum><text>review is otherwise completed in accordance with the judgment of the Supreme Court.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1B24768C280C4C1FB4BB3ACBB4CDCBF5" indent="up1"><enum>(2)</enum><text>If a sentence extends to dismissal or a dishonorable or bad conduct discharge and if the right of the accused to appellate review is waived, or an appeal is withdrawn, under section 861 of this title (article 61), that part of the sentence extending to dismissal or a bad conduct or dishonorable discharge may not be executed until review of the case by a judge advocate (and any action on that review) under section 864 of this title (article 64) is completed. Any other part of a court-martial sentence may be ordered executed by the convening authority or other person acting on the case under section 860 of this title (article 60) when approved by him under that section.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H30FDB1A62D184955BF6A40FD7E77C690"><enum>(iv)</enum><text>by redesignating subsection (d) as subsection (c);
