which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to submit to Congress a weekly report on COVID–19 vaccine distribution, and for other purposes.</official-title></form><legis-body id="HA8F4E454739541598582A90F7A13CF77" style="OLC"><section id="H4C419AE81D2F49E78DAF4E556EB52546" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vaccine Fairness Act</short-title></quote>.</text></section><section id="HDF90DF7AD9354635BC094545FEB385D0"><enum>2.</enum><header>COVID–19 vaccine distribution reports</header><subsection id="HA6A34EB85F5D4DC985A7C2B89EBD142E"><enum>(a)</enum><header>Weekly report to Congress</header><text display-inline="yes-display-inline">Not later than 7 days after the date of the enactment of this Act, and every 7 days thereafter, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall submit to Congress a report on the effectiveness of efforts relating to the distribution of COVID–19 vaccines to the public.</text></subsection><subsection id="H8D99BB624EA6477DAEAFC6F0C2293658"><enum>(b)</enum><header>Contents of report</header><text>Each report submitted under subsection (a) shall include, with respect to the 7-day period preceding the date on which such report is submitted, the following:</text><paragraph id="H18F299A3E5B141FD8FC36CA171A168D5"><enum>(1)</enum><text>The number of doses of COVID–19 vaccines distributed for administration to the public. </text></paragraph><paragraph id="H48CEADD0D513408B810338D775FF062D"><enum>(2)</enum><text>A description of any substantial purchase of COVID–19 vaccines by a Federal Government agency or private organization.</text></paragraph><paragraph id="H792A8A522EA342F0B7CCE912CF95C29E"><enum>(3)</enum><text>The number of doses of COVID–19 vaccines that were distributed to State or local health departments.</text></paragraph><paragraph id="H9FD9B5C962FF436C9E64926FDB816A51"><enum>(4)</enum><text display-inline="yes-display-inline">A description of the progress made in distributing COVID–19 vaccines to the following:</text><subparagraph id="HB0595FBC9D574515AA6A6789B4986E8D"><enum>(A)</enum><text>High-risk and other priority groups, including—</text><clause id="H0C34F13D26184C799811D1A546E9EF7C"><enum>(i)</enum><text>racial and ethnic minorities;</text></clause><clause id="HA776AD0AAB9E4FC387F5161DAAC17067"><enum>(ii)</enum><text>individuals who are pregnant or breastfeeding;</text></clause><clause id="HC28CF39C5EC84557BA6244D818D51690"><enum>(iii)</enum><text>individuals with disabilities;</text></clause><clause id="H2B4E229449974DD3AD7BF1B295A8BA30"><enum>(iv)</enum><text>homeless individuals; </text></clause><clause id="H60687402D04E41189799B006F4BADFF1"><enum>(v)</enum><text>newly resettled refugees; and</text></clause><clause id="HAD6ED5856844470B9B919E492D0020F9"><enum>(vi)</enum><text>individuals in rural communities. </text></clause></subparagraph><subparagraph id="HA6E857B7588245109AB68F98FBCD999C"><enum>(B)</enum><text>High-risk facilities, including—</text><clause id="H55C6E00346934FC293A0C5E7B58EAE39"><enum>(i)</enum><text>long-term care facilities;</text></clause><clause id="H452F7FA0F44B462CB85198F880832D39"><enum>(ii)</enum><text>group homes; and</text></clause><clause id="HCAF23800F8514A2A81B13F78232BD8A6"><enum>(iii)</enum><text>jails and prisons.</text></clause></subparagraph></paragraph><paragraph id="H607ECE28CA604C3AA3DAAE3F93C5EB87"><enum>(5)</enum><text>A description of any deviations from Federal distribution plans, including issues relating to the following:</text><subparagraph id="H7630AA37360344AF89924F724F468A2C"><enum>(A)</enum><text>Sites administering large numbers of COVID–19 vaccines, such as pharmacy chain stores, schools, and primary health care providers.</text></subparagraph><subparagraph id="HF1E55F0CA77F4F52A4DC2B96117AA2CE"><enum>(B)</enum><text>Tracking procedures for COVID–19 vaccines, particularly in areas of greatest need.</text></subparagraph><subparagraph id="H06D32159AD344DB79761ACA11263DC52"><enum>(C)</enum><text display-inline="yes-display-inline">Outreach to health care providers and the public about the availability, benefits, safety, contraindications, and costs of receiving COVID–19 vaccines.</text></subparagraph><subparagraph id="H43CA300847344857BC67641A16A5629E"><enum>(D)</enum><text>Outreach to health care providers regarding the responsibilities of such providers to track vaccine administration and monitor adverse events. </text></subparagraph><subparagraph id="HE9244544B4B949C7B79733BF0D320C13"><enum>(E)</enum><text display-inline="yes-display-inline">Recordkeeping and data collection relating to the administration of COVID–19 vaccines (including Federal support for State and local immunization information systems).</text></subparagraph><subparagraph id="HE869833466CC475EA227E75F0A2D6643"><enum>(F)</enum><text>Overuse or gaps in treatment.</text></subparagraph></paragraph></subsection><subsection id="HC670CBA331AB4D9DB17ACFDA8BB5F3F4"><enum>(c)</enum><header>Public availability of certain data</header><text display-inline="yes-display-inline">The Secretary shall make publicly available on an appropriate website of the Department of Health and Human Services, and regularly update, data on the number of doses of COVID–19 vaccines administered to the public, dis­ag­gre­gated with respect to each of the following:</text><paragraph id="HD1CE2FE791F646B09C64946FC51719CE"><enum>(1)</enum><text display-inline="yes-display-inline">Age.</text></paragraph><paragraph id="H4621162F541D4DDAAA25F31DCA2F31AB"><enum>(2)</enum><text>Race.</text></paragraph><paragraph id="H7FB2F8E3E6714ACFBD83CBEA8F431864"><enum>(3)</enum><text>Ethnicity.</text></paragraph><paragraph id="H1EB8882545034B6789381DD99F2C51BC"><enum>(4)</enum><text display-inline="yes-display-inline">ZIP Code. </text></paragraph></subsection><subsection id="H49459322B78F4B18B167BD81136715ED"><enum>(d)</enum><header>Termination</header><text>This section shall cease to have effect on the date that is 18 months after the date on which the initial report is submitted to Congress under subsection (a). </text></subsection><subsection id="H14CB20ECCBA444CB893327D99613F16F"><enum>(e)</enum><header>State defined</header><text display-inline="yes-display-inline">In this section, the term <term>State</term> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></subsection></section></legis-body></bill>
