which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the head of each agency to establish a safety plan relating to COVID–19 for any worksite at which employees or contractors are required to be physically present during the COVID–19 pandemic, and for other purposes.</official-title></form><legis-body id="H4DAAC8ED0143430699C47ED15623CEB6" style="OLC"><section id="H3150E96E96ED470DB6C3C6EF9FAE168E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chai Suthammanont Remembrance Act of 2021</short-title></quote>.</text></section><section id="H89B27B7FCAF646A2A5A203A4404CA013"><enum>2.</enum><header>Worksite safety for Federal employees and contractors</header><subsection id="HA37E1F34FA714179977110AB9BEFDEDE"><enum>(a)</enum><header>Issuance of policies and procedures by agencies</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the head of each agency, in consultation with the Chief Human Capital Officer of the agency and the Assistant Director of Administration of the agency (or any individual holding an equivalent position) shall—</text><paragraph id="H1B102DFFAE4C4611BEDED9F620F8661F"><enum>(1)</enum><text>establish, and publish on the website of that agency, a safety plan containing procedures and policies for—</text><subparagraph id="H99636C685F70409994ED0E140B69FF2B"><enum>(A)</enum><text>covered worksites; and</text></subparagraph><subparagraph id="H935806B851F74DC7B3A172E2C0B7A626"><enum>(B)</enum><text>being present at a covered worksite; and</text></subparagraph></paragraph><paragraph id="HAE1F568F51A8487896B9E72764123F9D"><enum>(2)</enum><text>communicate such plan to each employee of the agency and contractor of the agency (and any subcontractor thereof at any tier) in such a manner as to ensure that each such employee and contractor acknowledges receipt and understanding of the plan.</text></paragraph></subsection><subsection id="HAD3217C78A764D5F8D76C15571DD727A"><enum>(b)</enum><header>Plan</header><text>The safety plan required under subsection (a) shall, at a minimum, include the following:</text><paragraph id="H1D3209E4C11E4DE48A6F1D8B5EFA9B5F"><enum>(1)</enum><text>A description of the efforts of the agency with respect to mitigating the spread of COVID–19 at covered worksites, including the following: </text><subparagraph id="HA7FE324EC0DF4DC7B5A1B4524997DA9F"><enum>(A)</enum><text>A description of any personal protective equipment that is being or will be provided by the agency to any employee of the agency and contractor of the agency (and any subcontractor thereof at any tier) physically present at a covered worksite. </text></subparagraph><subparagraph id="HA269973EB24E4B6E8BC61270BB6D3603" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A description of any procedures established by the agency for—</text><clause id="HD474162641744C25BDBAEB773B8943E9" commented="no"><enum>(i)</enum><text>testing employees of the agency and contractors of the agency (and any subcontractor thereof at any tier) required to be present at a covered worksite; </text></clause><clause id="H6CF1241EC2F04999841B2845AEA61BAC" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">contact-tracing at covered worksites, including procedures by which such employees and contractors (and any subcontractor thereof at any tier) will be notified of a potential exposure to an individual who is diagnosed with COVID–19; and</text></clause><clause id="H429C695C0113490E9C64B517075BC0A5"><enum>(iii)</enum><text display-inline="yes-display-inline">administering the COVID–19 vaccine to employees of the agency.</text></clause></subparagraph></paragraph><paragraph id="HCE1F444937EE44E39805A33ABF24192B"><enum>(2)</enum><text display-inline="yes-display-inline">Guidance on—</text><subparagraph id="HF011177EA0A4447F8210344D87426807"><enum>(A)</enum><text>any cleaning protocols to be implemented at covered worksites;</text></subparagraph><subparagraph id="H91C1B2F33FB341FEA5C8BA949A18E123"><enum>(B)</enum><text display-inline="yes-display-inline">occupancy limits for covered worksites; and </text></subparagraph><subparagraph id="H9F5F3890C5634221A3EFD046DCB42A08"><enum>(C)</enum><text>the use of appropriate face coverings by employees of the agency and contractors of the agency (and any subcontractor thereof at any tier) while physically present at a covered worksite.</text></subparagraph></paragraph><paragraph id="HEC847776AA47460DB4E69A9264F7169F" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">A description of the actions the agency is or will be taking to protect from exposure to COVID–19 employees of the agency who conduct activities in an official capacity while not physically present at a covered worksite, including employees of the agency—</text><subparagraph id="HC50F8DB187814A698E8536821AB977DA" commented="no"><enum>(A)</enum><text>who are required to travel in an official capacity; or</text></subparagraph><subparagraph id="H97452B6F827A49E594B0C36102B9E7B4" commented="no"><enum>(B)</enum><text>perform audits or inspections. </text></subparagraph></paragraph><paragraph id="H061F702F231E40C5AA12616FC8BB1769"><enum>(4)</enum><text>A description of any requirements that members of the public are required to meet in order to enter a facility in which covered worksites are located.</text></paragraph><paragraph id="H066586DE67084299A1B056EEE6B49049"><enum>(5)</enum><text display-inline="yes-display-inline">A description of any alternative option to being physically present at a covered worksite that are available for employees who—</text><subparagraph id="H2BABD226673D4F2686B3DCC2AAEEC181" commented="no"><enum>(A)</enum><text>have a high risk of contracting COVID–19 (as determined by the Director of the Centers for Disease Control and Prevention); or </text></subparagraph><subparagraph id="HA1107B068C30414D897B504D8E46C95E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">live in a household with individuals that have a high risk of contracting COVID–19 (as determined by the Director of the Centers for Disease Control and Prevention).</text></subparagraph></paragraph><paragraph id="HF47860A7331346DEB2B7BEFBE2BCF6C7" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">A description of any rule or protocol regarding whether employees of the agency required to be physically present at covered worksites are—</text><subparagraph id="HB49C760BB4D64D81B3D593111E622E9E" commented="no"><enum>(A)</enum><text>required to be fully vaccinated before being present at covered worksites; or</text></subparagraph><subparagraph id="H5D03773FC17E4EDA86EE103D7DB7A53D" commented="no"><enum>(B)</enum><text>allowed to take leave—</text><clause id="HAC059E355E4A4498B5B9C62C7F2D1B1D" commented="no"><enum>(i)</enum><text>to get each dose of the vaccine; or</text></clause><clause id="HD0C2367D5337477995297D87F7C989EE" commented="no"><enum>(ii)</enum><text>upon experiencing severe side-effects as a result of receiving any dose of such vaccine.</text></clause></subparagraph></paragraph><paragraph id="HF07D046EB77E44C1B49D03722A923A0A"><enum>(7)</enum><text>Protocols that ensure the continuity of operations, including a plan to reverse any requirement for an employee or contractor (or subcontractor thereof at any tier) to be present at a facility in which covered worksites are located if there is a surge in COVID–19 cases in the geographic area of such facility.</text></paragraph><paragraph id="HC3357D1402CF44EF916859992F6588A4" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">The hotline website and hotline telephone number of the Inspector General of the agency for employees of the agency and contractors of the agency (and any subcontractor thereof at any tier) to report to the Inspector General any instance in which the agency is not implementing the plan required by this section. </text></paragraph></subsection><subsection id="HA7D72E80A879459EBBEBD970E14466DD" commented="no"><enum>(c)</enum><header>Delayed applicability for certain worksites</header><text display-inline="yes-display-inline">For any worksite that the head of the agency has temporarily closed due to COVID–19, the requirements of subsection (a) shall be carried out not later than 30 days before any employee of the agency or contractor of any agency (or any subcontractor thereof at any tier) is required to be physically present at such worksite.</text></subsection><subsection id="H2EBD23F8D79A4D16B61D9F04EB60FB1C"><enum>(d)</enum><header>Inspectors general reports</header><text>Not later than 6 months after the date of the enactment of this Act, the Inspector General of each agency shall submit to the Committee on Oversight and Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on whether that agency—</text><paragraph id="HF55093B454684B93BD1F728369687075"><enum>(1)</enum><text display-inline="yes-display-inline">has published and communicated the public safety plan required by subsection (a), in accordance with such subsection; and</text></paragraph><paragraph id="H56EC85129C9741DFA7A0C2937CF6B464"><enum>(2)</enum><text>implemented such plan.</text></paragraph></subsection><subsection id="H55854B06CC984C0DB19E5CBF2DC14D05"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to alter or otherwise limit the rights and obligations afforded under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code. </text></subsection><subsection id="H05D6DAA2703D401C934E47BC4293D1F9"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H482FA30B61CF4DFD850D61709DD2B3AD"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given that term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H2ADEE02E5E02451EA92360906CBE88F9" commented="no"><enum>(2)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period beginning on the date of the enactment of this Act and ending on the date on which the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247">42 U.S.C. 247</external-xref>) as a result of the COVID–19, or any renewal thereof, terminates.</text></paragraph><paragraph id="HE730519549724D62A8C5925CA289DB93"><enum>(3)</enum><header>Covered worksite</header><text display-inline="yes-display-inline">The term <term>covered worksite</term> means a worksite at which an employee of the agency or a contractor of the agency (or subcontractor thereof at any tier) is required to be present during the covered period. </text></paragraph><paragraph id="H5201561C095A46EE868779D344338BAB"><enum>(4)</enum><header>Worksite</header><text display-inline="yes-display-inline">The term <term>worksite</term> means—</text><subparagraph id="HAAEE9F5EC1D14008BED61194714B5AD9"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an employee of the agency, the location of the employee's position of record where the employee regularly performs his or her duties, but does not include any location where the employee teleworks (as that term is defined in section 6501 of title 5, United States Code); and </text></subparagraph><subparagraph id="HE692E47D9B65426FA16785765322E3BA"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a contractor of the agency (or subcontractor thereof at any tier), the location in a facility of the agency where the contractor or subcontractor performs his or her duties under a contract with the agency, or a subcontract thereof at any tier, as applicable. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
