which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit former employees of covered health agencies from serving on the board of entities involved in development and research of covered vaccines, and for other purposes.</official-title></form><legis-body id="HFFF5252A1F9C4A2180C9D841F9375BB5" style="OLC"><section id="HE346E1CCE9344EDE88C010DC61E0A96F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fixing Administrations Unethical Corrupt Influence Act</short-title></quote> or the <quote>FAUCI Act</quote>.</text></section><section id="HA4728DC7E56F4CA5A8C3A11A25039D0A" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Prohibition against service by former employees of covered health agencies on boards of entities involved in development and research of vaccines</header><subsection id="H07D37F01A4D6491BB163C751E83F6DCB"><enum>(a)</enum><header>Prohibition against service on boards of entities</header><text display-inline="yes-display-inline">Title 18, United States Code, is amended by inserting after section 207 the following new section:</text><quoted-block style="USC" id="HC3A58B5A9DD846D4849338402D1E88EF" display-inline="no-display-inline"><section id="H0F138BB62CCF462199CBACD9C7A47CD2"><enum>207A.</enum><header>Prohibition against service by former employees of covered health agencies on boards of entities involved in development and research of vaccines.</header><subsection id="H6828DBB779C54F0E8C1D3AB83899CD51"><enum>(a)</enum><header>Prohibition against service by former employees of covered health agencies on boards of entities involved in development and research of vaccines</header><text display-inline="yes-display-inline">Any person who is a top official of a covered health agency of the United States, and who, after the termination of his or her service or employment with the United States, serves as an officer or member of the board of any association, corporation, or entity that directly manufactures or researches covered vaccines shall be punished as provided in section 216 of this title.</text></subsection><subsection id="H92092BD9F67F468A920A952E0036887C"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HDDA4DE64D6924C909B4DF6748EE78CE5"><enum>(1)</enum><header>Covered health agency</header><text>The term <quote>covered health agency</quote> means any of the following:</text><subparagraph id="H0C82A953D723433FBD6DA7B9ED9EE90D"><enum>(A)</enum><text>The National Institutes of Health.</text></subparagraph><subparagraph id="H33FCCADF10D545328EDBFBC8F9E6A81B"><enum>(B)</enum><text>The Food and Drug Administration.</text></subparagraph><subparagraph id="H8BC883B492FF40378E9909B18D372CC9"><enum>(C)</enum><text>The Centers for Disease Control and Prevention.</text></subparagraph></paragraph><paragraph id="H3A58CB7F337E49C78D17A4F9547E6F8F" commented="no"><enum>(2)</enum><header>Covered vaccines</header><text display-inline="yes-display-inline">The term <quote>covered vaccine</quote> means—</text><subparagraph id="HB81841675042412B8F336E03E7912E3C" commented="no"><enum>(A)</enum><text>a vaccine licensed under section 351 of the Public Health Service Act; or</text></subparagraph><subparagraph id="HC91CF8F614684330ADAE3CFDFAFD0B22" commented="no"><enum>(B)</enum><text>a vaccine authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act.</text></subparagraph></paragraph><paragraph id="HDF113B9D78004997ABA81ED2B2EA9753"><enum>(3)</enum><header>Top official</header><text>The term <quote>top official</quote> means—</text><subparagraph id="HE141F9467BEA4985BEB443330E92B3E3"><enum>(A)</enum><text display-inline="yes-display-inline">any officer or employee in the executive branch who occupies a position classified at or above GS–13 of the General Schedule or, in the case of positions not under the General Schedule, for which the rate of basic pay is equal to or greater than the minimum rate of basic pay payable for GS–13 of the General Schedule; or</text></subparagraph><subparagraph id="H2E06BD84743E45678FB694A0C336A75A"><enum>(B)</enum><text display-inline="yes-display-inline">any employee of the Federal Government who directly or indirectly has input or any authority to determine or help determine the authorization for use or emergency use authorization of vaccines.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF0A6855F695C40EC8CB9AFE3228318C1"><enum>(b)</enum><header>Table of chapters</header><text display-inline="yes-display-inline">Chapter of 11 of title 18, United States Code, is amended by inserting after the item relating to section 207 the following:</text><quoted-block style="USC" id="H8E61D5E2F08D43A482304F74249CB7CD" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 207A. Prohibition against service by former employees of covered health agencies on boards of entities involved in development and research of vaccines.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEC7A9676B41449FAA66F58773C00BC12"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to an individual whose service or employment with the United States terminates on or after the date of the enactment of this Act.</text></subsection></section><section id="H0223746F5D5D41FCBD00C003F40FC17A" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Prohibition against ownership or financial interest in certain patents</header><subsection id="HE6DEBAA4CC7846C6ACF9854CEB9E3BAA"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 208 of title 18 is amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H40B0C34AE4BB4432BA292168C9BDDF0F" display-inline="no-display-inline"><subsection id="H5D96FE9B545641D0B6D9B9337F19E60B"><enum>(e)</enum><header>Prohibition against ownership or financial interest in certain patents</header><paragraph id="HE3A11FC1686F4FCE90E890239CE63021"><enum>(1)</enum><header>In general</header><text>A person who is a top official may not own or profit from a covered patent (or any right or interest in a covered patent), submit an application for a covered patent, (or be included in the application for a covered patent)—</text><subparagraph id="H52509DF2D0204954B381662823DAAA9B"><enum>(A)</enum><text>in the case of a vaccine or medical treatment invented by the person during the course of employment as a top official, at any point after becoming a top official;</text></subparagraph><subparagraph id="H4E438E3B56754BC7B67FF34159A1F888"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a vaccine or medical treatment invented by the person before or outside the course of employment as a top official, at any point after becoming a top official;</text></subparagraph><subparagraph id="H61267B3166784FEB97D506C916CBEED5"><enum>(C)</enum><text>in the case of a covered patent for which the top official was issued a patent before or outside the course of employment as a top official, at any point after becoming a top official; and</text></subparagraph><subparagraph id="HA679A6BFE704486DAF749259FFF66AF4"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of a covered patent owned by the top official or a covered patent in which the top official has any right or interest in before the course of employment as a top official, at any point after becoming a top official.</text></subparagraph></paragraph><paragraph id="H85FFF9B6FFC94E79A1F23333D2DE95A7"><enum>(2)</enum><header>Assignment of prior patents</header><subparagraph id="H2E7CAF1195BD4558A84F3BB0FF6E2BDE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To comply with paragraph (1), a person who is a top official may assign grant, or convey ownership of a covered patent, or any rights or interest in a covered patent, to another person, before becoming a top official.</text></subparagraph><subparagraph id="H0BF1E043F46B46EFBA40E10F8A2DAB44"><enum>(B)</enum><header>After Federal service</header><text>In the case of a covered patent described under paragraph (1)(A), any rights or interest in the patent that are assigned, granted, or conveyed under subparagraph (A), may not be reassigned to the top official after such individual ceases to be a top official.</text></subparagraph></paragraph><paragraph id="HA5339269813B482A9E6CA3DFC8600B51"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection: </text><subparagraph id="H01836611851D41188515CE3356D28028"><enum>(A)</enum><header>Covered patent</header><text display-inline="yes-display-inline">The term <quote>covered patent</quote> means a patent issued by the United States for a vaccine or medical treatment.</text></subparagraph><subparagraph id="H9CBAAF56373242D2BD8BCD3F14CFD4DF"><enum>(B)</enum><header>Top official</header><text>The term <quote>top official</quote> means—</text><clause id="HA09CD54A9E2A4CECA9F5B808F0D6B14B"><enum>(i)</enum><text display-inline="yes-display-inline">Each officer or employee in the executive branch who occupies a position classified at or above GS–13 of the General Schedule or, in the case of positions not under the General Schedule, for which the rate of basic pay is equal to or greater than the minimum rate of basic pay payable for GS–13 of the General Schedule; or</text></clause><clause id="H6A419862F4494A7B92B302BBDD6C311B"><enum>(ii)</enum><text display-inline="yes-display-inline">any employee of the Federal Government who directly or indirectly has input or any authority to determine or help determine the authorization for use or emergency use authorization of vaccines.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCC75351E40C6441CA5B0759E60ED51F6"><enum>(b)</enum><header>Prior patents</header><paragraph id="HD2B016BCE3B64A8F8D9B24D42DD587F7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To comply with section 208 of title 18, United States Code, as added by subsection (a), a top official that owns, or is profiting from, any patent for a vaccine or medical treatment (or any right or interest in such a patent), may assign grant, or convey ownership of the patent, or any rights or interest in the patent, to another person, not later than 6 months after the date of the enactment of this Act.</text></paragraph><paragraph id="H08B5E1E889B74005BFDC4EA983F47403"><enum>(2)</enum><header>After Federal service</header><text>In the case of patent described under section 208(e)(1)(A) of title 18, United States Code, as added by subsection (a), any rights or interest in the patent that are assigned, granted, or conveyed under paragraph (1), may not be reassigned, to the top official after such individual ceases to be a top official.</text></paragraph></subsection></section></legis-body></bill>
