R. 9707</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230103">January 3, 2023</action-date><action-desc><sponsor name-id="G000552">Mr. Gohmert</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to establish a block grant program to provide incentives to underage mothers to stay in school and remain off of welfare, and for other purposes.</official-title></form><legis-body id="H1A9E8CE335C4414888BFF2E8618A6CC0" style="OLC"><section id="HB60CA91522FB458180A19FF9EDF5834B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Opportunities for Mothers Act</short-title></quote> or the <quote><short-title>MOM Act</short-title></quote>.</text></section><section id="HFC321123725D4EBA968A258CEBE80593"><enum>2.</enum><header>Grant program</header><subsection id="H5200D7C214984E938723C499051A52D0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall establish a grant program under which the Secretary makes block grants to States to be administered in accordance with this section. </text></subsection><subsection id="H016510DE965E4203A2872B020C265DC2"><enum>(b)</enum><header>Use of grant</header><text display-inline="yes-display-inline">A State that receives a grant under subsection (a) shall use such grant to pay the cost of—</text><paragraph id="HBC7F7AC8109140F79DD944E09474F37F"><enum>(1)</enum><text>child care services for an eligible mother who is a student enrolled in elementary school or secondary school or enrolled on not less than a half-time basis in an institution of higher education, which enable such mother to attend the courses in which she is enrolled; and</text></paragraph><paragraph id="H755F58DBCAEC471394B727F487AFC497"><enum>(2)</enum><text>child care services for an eligible mother described in paragraph (1) who has employment after attending the courses in which she is enrolled, which enable such mother to be so employed.</text></paragraph></subsection><subsection id="HC3A88520E4AF405FA920445B167CA99E"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H176821104E7C441AA8212D843076C386"><enum>(1)</enum><header>Elementary school</header><text>The term <quote>elementary school</quote> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HB57FC8999CB04D05B9A4DE8C8B1E8C4B"><enum>(2)</enum><header>Eligible Mother</header><subparagraph id="HB2EC8675878446A385DCA6D3E0CE8AA4"><enum>(A)</enum><header>In general</header><text>The term <term>eligible mother</term> means an individual who—</text><clause id="HF7BB62C744444C6C92D73FA4D0AA90A1"><enum>(i)</enum><text>has not attained the age of 18;</text></clause><clause id="H5765CA582B7F46E0862C29F273385B66"><enum>(ii)</enum><text>has given birth to a child; and</text></clause><clause id="HF77A363406DF41AE87B402C41421EAF1"><enum>(iii)</enum><text>has not been permanently separated from such child.</text></clause></subparagraph><subparagraph id="HA8B93A2479EB4D5585ACA2E4D8559DF4"><enum>(B)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to make a mother ineligible for payments or services under this Act by virtue of being married.</text></subparagraph></paragraph><paragraph id="HE16F2323EAAE46AE833C6401029A0F47"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>). </text></paragraph><paragraph id="HD9558A713EE14138A6515EE2EBDCD049"><enum>(4)</enum><header>Secondary school</header><text display-inline="yes-display-inline">The term <quote>secondary school</quote> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H3946C09F7B4F4B60939D8DFE7659B0C6"><enum>(5)</enum><header>State</header><text display-inline="yes-display-inline">In this section, the term <term>State</term> means the several States and the District of Columbia.</text></paragraph></subsection></section></legis-body></bill>
