<section id="H891C4ACD23D745708BC54FDEAAACA0DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blocked Rail Crossings Safety Improvement Act of 2021</short-title></quote>.</text></section> <section id="H1EA2AC5F199242BE8268DDF929ED785A"><enum>2.</enum><header>Highway-rail grade crossing separation grants</header> <subsection id="H94B1DC562F174D808BBCB94492354715"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/229">Chapter 229</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text>

<section id="H697FD8D7020A4556BF2DC4C8A5BEDFCA" section-type="subsequent-section"><enum>22911.</enum><header>Highway-rail grade crossing separation grants</header>
<subsection id="H67EE5E2FEF174EE0B1BF3FE9404F2D7D"><enum>(a)</enum><header>General authority</header><text>The Secretary of Transportation shall make grants under this section to eligible entities to assist in funding the cost of highway-rail grade crossing separation projects.</text></subsection> <subsection id="HCA0BDCF8B0A64D1DB0C5745545E5FB85"><enum>(b)</enum><header>Application requirements</header><text>To be eligible for a grant under this section, an eligible entity shall submit to the Secretary an application in such form, in such manner, and containing such information as the Secretary may require, including—</text>
<paragraph id="H4BE1D2BB827E475080F5F8D8C2A7BADC"><enum>(1)</enum><text>an agreement between the entity that owns or controls the railroad right-of-way and the applicant addressing access to the railroad right-of-way throughout the project; and</text></paragraph> <paragraph id="H32E561A9136F48A581A5E91A598DA78F"><enum>(2)</enum><text>a cost-sharing agreement with the funding amounts that the entity that owns or controls the railroad right-of-way shall contribute to the project, which shall be not less than 10 percent of the total project cost.</text></paragraph></subsection>
<subsection id="HD5AF057753CF4CCD97190738D4F4189B"><enum>(c)</enum><header>Eligible projects</header><text>The following projects are eligible to receive a grant under this section:</text> <paragraph id="H1B58A6AB18DF4313A9BAFE4BC21380D8"><enum>(1)</enum><text display-inline="yes-display-inline">Installation, repair, or improvement, including necessary acquisition of real property interests, of highway-rail grade crossing separations.</text></paragraph>
<paragraph id="HA2D9CD2B28B0462081AAF376EA196620"><enum>(2)</enum><text display-inline="yes-display-inline">Highway-rail grade crossing elimination incidental to eligible grade crossing separation projects.</text></paragraph> <paragraph id="HFABDA6A941BF4529848BF44F1F96F445"><enum>(3)</enum><text>Project planning, development, and environmental work related to a project described in paragraph (1) or (2).</text></paragraph></subsection>
<subsection id="H1704A67D3F29429CA31024EC65A43B5B"><enum>(d)</enum><header>Project selection criteria</header><text>In awarding grants under this section, the Secretary—</text> <paragraph id="H14A0EE4B0861440FAAA05BECF9E1F4D3"><enum>(1)</enum><text>shall give priority to projects that maximize the safety benefits of Federal funding; and </text></paragraph>
<paragraph id="HA4A7ABB6C1514EE7ACA4C36201EAB2E0"><enum>(2)</enum><text display-inline="yes-display-inline">may evaluate applications on the safety profile of the existing crossing, 10-year history of accidents at such crossing, inclusion of the proposed project on a State highway-rail grade crossing action plan, average daily vehicle traffic, total number of trains per day, average daily number of crossing closures, the challenges of grade crossings located near international borders, proximity to established emergency evacuation routes, and proximity of community resources, including schools, hospitals, fire stations, police stations, and emergency medical service facilities.</text></paragraph></subsection> <subsection id="H72274EE49A5A44FCB21A73C5E82731E0"><enum>(e)</enum><header>Federal share of total project costs</header> <paragraph id="H83A706F3194B4B768F560AE76063E0DC"><enum>(1)</enum><header>Total project costs</header><text>The Secretary shall estimate the total costs of a project under this section based on the best available information, including any available engineering studies, studies of economic feasibility, environmental analysis, and information on the expected use of equipment or facilities.</text></paragraph>
<paragraph id="H0EFEEFBB0D0D431D8E9E4B3CCD42C408"><enum>(2)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share for a project carried out under this section shall not exceed 85 percent.</text></paragraph></subsection> <subsection id="H33E97DE7D90D4F48AADB3AC323AD7695"><enum>(f)</enum><header>Grant conditions</header><text display-inline="yes-display-inline">An eligible entity may not receive a grant for a project under this section unless such project complies with section 22905.</text></subsection>
<subsection display-inline="no-display-inline" id="H7DF86CA7BCD74846AD8B6EF28E89AF79"><enum>(g)</enum><header>Letters of intent</header>
<paragraph id="HE3493CC55F0244BEB4630A1049EEBFD0"><enum>(1)</enum><header>In general</header><text>The Secretary shall, to the maximum extent practicable, issue a letter of intent to a recipient of a grant under this section that— </text> <subparagraph id="HEF09156AA97648EBBA9D7CEEB8584717"><enum>(A)</enum><text>announces an intention to obligate for a project an amount that is not more than the amount stipulated as the financial participation of the Secretary for the project; and </text></subparagraph>
<subparagraph id="HD89AE712CCC04EECA6D07BA1B4AA1AB2"><enum>(B)</enum><text>states that the contingent commitment— </text> <clause id="HC8173D22ADBA4CFCB3DA4ECFB0835EA0"><enum>(i)</enum><text>is not an obligation of the Federal Government; and </text></clause>
<clause id="H387221547CFE4B71B744A2C26A48032B"><enum>(ii)</enum><text>is subject to the availability of appropriations for grants under this section and subject to Federal laws in force or enacted after the date of the contingent commitment. </text></clause></subparagraph></paragraph> <paragraph id="HE99FB048849E46CD8FAAF33525E2B11E"><enum>(2)</enum><header>Congressional notification</header> <subparagraph id="HF0679D09223740CC8E52B37BC5678A45"><enum>(A)</enum><header>In general</header><text>Not later than 3 days before issuing a letter of intent under paragraph (1), the Secretary shall submit written notification to— </text>
<clause id="H896CBD9765AA4E40A71D1A5D049EBA81"><enum>(i)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; </text></clause> <clause id="H26117875E19B40449686C9A282590720"><enum>(ii)</enum><text>the Committee on Appropriations of the House of Representatives; </text></clause>
<clause id="H6F50E4C0BF0D4B40ACE99B871B044248"><enum>(iii)</enum><text>the Committee on Appropriations of the Senate; and </text></clause> <clause id="H2DFCDB3A4F8F49CBA7AAA6C070507682"><enum>(iv)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate. </text></clause></subparagraph>
<subparagraph id="HD2840A52ED30469DBC5F619DFFA191A3"><enum>(B)</enum><header>Contents</header><text>The notification submitted under subparagraph (A) shall include— </text> <clause id="H1EEC8E7BEFA74138A01627D8163714DE"><enum>(i)</enum><text>a copy of the letter of intent; </text></clause>
<clause id="HB03A7AAA3FC541E99ECFB534B38ADF0E"><enum>(ii)</enum><text>the criteria used under subsection (d) for selecting the project for a grant; and </text></clause> <clause id="H4FD40870FE93482BA49315F9BBDBEC52"><enum>(iii)</enum><text>a description of how the project meets such criteria. </text></clause></subparagraph></paragraph></subsection>
<subsection id="H7F4FA8EE8C524553906278AA7409AF5A"><enum>(h)</enum><header>Appropriations required</header><text display-inline="yes-display-inline">An obligation or contingent commitment may be made under subsection (g) only after amounts are appropriated for such purpose. </text></subsection> <subsection id="H16D630051FBD48D793E6EE621D3247DE"><enum>(i)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H255F0C6F305C4401B5D66FAFCC88F08B"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H26637305596D49F7925ED6B245989889"><enum>(A)</enum><text>a State; </text></subparagraph>
<subparagraph id="HBC5788D07BB04B84A166B539B0978F55"><enum>(B)</enum><text>a public agency or publicly chartered authority; </text></subparagraph> <subparagraph id="HF7A49DD55AE54A02B90AB370BD7463AC"><enum>(C)</enum><text>a metropolitan planning organization; </text></subparagraph>
<subparagraph id="H9B81EB2CCD10478298B4420CA88E9549"><enum>(D)</enum><text>a political subdivision of a State; and </text></subparagraph> <subparagraph id="H1BCD153CBC9240F1A6AD666CDBCFB6D3"><enum>(E)</enum><text>a Tribal government.</text></subparagraph></paragraph>
<paragraph id="H67B2E77FB5F54CF189DB713D02665564"><enum>(2)</enum><header>Metropolitan planning organization</header><text display-inline="yes-display-inline">The term <term>metropolitan planning organization</term> has the meaning given such term in section 134(b) of title 23. </text></paragraph> <paragraph id="H47025E4DC62B4D9D92041DEF4CBCE414"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State of the United States or the District of Columbia.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H0B81E4C0138541E88842886752298A54"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/229">chapter 229</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text> <quoted-block display-inline="no-display-inline" id="H83B847752EEA4BC7A8D5625133B9C8AA" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">22911. Highway-rail grade crossing separation grants.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H6D7C2D583538448AB906B8E6826E78DF" commented="no"><enum>3.</enum><header>Rail safety public awareness grant</header><text display-inline="no-display-inline">Section 22907 of title 49, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H40271CD88B3646B3868EADC0B8EEB1CD"><enum>(m)</enum><header>Rail safety public awareness grants</header>
<paragraph id="H2000DD7B7DDF4A60946C6D53E516210D"><enum>(1)</enum><header>Grant</header><text display-inline="yes-display-inline">Of the amounts made available to carry out this section, the Secretary shall make grants to nonprofit organizations to carry out public information and education programs to help prevent and reduce rail-related pedestrian, motor vehicle, and other incidents, injuries, and fatalities, and to improve awareness along railroad right-of-way and at highway-rail grade crossings.</text></paragraph> <paragraph id="HEBE3CE3AA4B54C4B941EE1D4411277CB"><enum>(2)</enum><header>Selection</header><text>Programs eligible for a grant under this subsection—</text>
<subparagraph id="H09672E046DB94D84A668D4F35B5D5340"><enum>(A)</enum><text>shall include, as appropriate—</text> <clause id="H97F35078FF2B447EB00A58F58AE47058"><enum>(i)</enum><text>development, placement, and dissemination of public service announcements in appropriate media;</text></clause>
<clause id="HCC0257229A044E90BDE5BB30D00C35C7"><enum>(ii)</enum><text>school presentations, driver and pedestrian safety education, materials, and public awareness campaigns; and</text></clause> <clause id="HCB84B4F9CDFA4289AF7B7A3C72BF169F"><enum>(iii)</enum><text>disseminating information to the public on how to identify and report to the appropriate authorities—</text>
<subclause id="HEC93B7B2990741739E244839F655B881"><enum>(I)</enum><text>unsafe or malfunctioning highway-rail grade crossings and equipment; and</text></subclause> <subclause id="H01A0C6FF7DB54EA8A8F72D5F70D5707F"><enum>(II)</enum><text>high-risk and unsafe behavior and trespassing around railroad right-of-way; and</text></subclause></clause></subparagraph>
<subparagraph id="H20870C8083E4414B946F999B985FBF6B"><enum>(B)</enum><text>may include targeted and sustained outreach in communities at greatest risk to develop measures to reduce such risk.</text></subparagraph></paragraph> <paragraph id="H88492351E135455E8B1B20065F2300D7"><enum>(3)</enum><header>Coordination</header><text>Eligible entities shall coordinate program activities with local communities, law enforcement and emergency responders, and railroad carriers, as appropriate, and ensure consistency with State highway-rail grade crossing action plans required under section 11401(b) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/49/22501">49 U.S.C. 22501</external-xref> note) and the report titled <quote>National Strategy to Prevent Trespassing on Railroad Property</quote> issued by the Federal Railroad Administration in October 2018.</text></paragraph>
<paragraph id="H861F793B0C7E4BFFB8FEF3CAB750CA0E"><enum>(4)</enum><header>Prioritization</header><text>In awarding grants under this subsection, the Administrator shall give priority to applications for programs that—</text> <subparagraph id="HEBEDE8AF72724037AE648B9DBE617481"><enum>(A)</enum><text>are nationally recognized;</text></subparagraph>
<subparagraph id="H81A7F7A4FDB14E008BE564A6967B5FE3"><enum>(B)</enum><text>are targeted at schools in close proximity to railroad right-of-way;</text></subparagraph> <subparagraph id="H6FDD2E47D11143B7BCAA056A438322DC"><enum>(C)</enum><text>partner with nearby railroad carriers; or</text></subparagraph>
<subparagraph id="H3464A36B86D94B4294FCF7EB2E3F194E"><enum>(D)</enum><text>focus on communities with a recorded history of repeated pedestrian and motor vehicle accidents, incidents, injuries, and fatalities at highway-rail grade crossings and along railroad right-of-way.</text></subparagraph></paragraph> <paragraph id="H15F092213FC84DE1958EB26434DBB34A"><enum>(5)</enum><header>Applicability</header><text>Section 22905 shall not apply to contracts and agreements made under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H7BE44C78FF9345D5A04E7E9989A071B0"><enum>4.</enum><header>Establishment of 10-minute time limit for blocking public highway-rail grade crossings</header>
<subsection id="H1CA9E4FCCDF24059AAAA47F1C84ED2D3"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block id="H5492703E7B0A4EA582D29562133DBE9E" style="USC"> <section id="HC4C99B9242494A80B1DDAA34A85C8E40"><enum>20172.</enum><header>Time limit for blocking public highway-rail grade crossing</header> <subsection id="H6AA6A54AB66544F0901C062191524030"><enum>(a)</enum><header>Time limit</header><text display-inline="yes-display-inline">A railroad carrier may not cause a blocked crossing incident that is longer than 10 minutes in duration, unless the blocked crossing incident is caused by—</text>
<paragraph id="H13AA03CCCA06438AA9A5E587D61ABBBD"><enum>(1)</enum><text>a casualty or serious injury;</text></paragraph> <paragraph id="H04676015B5264D6AB77D685EFC88E5C3"><enum>(2)</enum><text>an accident;</text></paragraph>
<paragraph id="HA75379C7D7CB402B9FC650F02B35C738"><enum>(3)</enum><text>a track obstruction;</text></paragraph> <paragraph id="H4B68221B38EF4424A9D0758323076F0C"><enum>(4)</enum><text display-inline="yes-display-inline">actions necessary to comply with Federal rail safety laws, regulations, or orders issued thereunder unless the action to comply could reasonably occur at a different time or location;</text></paragraph>
<paragraph id="HD9198BFB5FF843CB986F44F0CF1B89EF"><enum>(5)</enum><text display-inline="yes-display-inline">actions necessary to adhere to section 24308;</text></paragraph> <paragraph id="HCB701AE6AA314BAC8E5D3D98FC809168"><enum>(6)</enum><text display-inline="yes-display-inline">a train fully contained within rail yard limits or fully contained in a rail siding;</text></paragraph>
<paragraph id="H3B8F29C20C144D0F8D62CDC2C4D48C1E"><enum>(7)</enum><text>an act of God; or</text></paragraph> <paragraph id="HDAE7B6C0F7E44DCFAED1D304E5EC9806"><enum>(8)</enum><text>a derailment or a safety appliance equipment failure that prevents the train from advancing.</text></paragraph></subsection>
<subsection id="H22B0EECA9A3E4821A0ADF39B0FA991A7"><enum>(b)</enum><header>Investigation of frequently blocked crossings</header><text display-inline="yes-display-inline">For any public highway-rail grade crossing that has had 3 or more blocked crossing incidents that exceed the time limit set forth in subsection (a) and are reported to the blocked crossing database, and such incidents have occurred on at least 3 calendar days within a 30-day period, the Secretary shall—</text> <paragraph id="HC8CF52843D0743139751F95509B1B89D"><enum>(1)</enum><text display-inline="yes-display-inline">provide an electronic notice of the number of reported blocked crossing incidents to the railroad carrier that owns the public highway-rail grade crossing;</text></paragraph>
<paragraph id="H9C2EED3728F54D628622853B8243978C"><enum>(2)</enum><text>investigate the causes of the blocked crossing incidents; and</text></paragraph> <paragraph id="HCA467FB6A1EA4994A7D6C8080836930D"><enum>(3)</enum><text>investigate possible measures to reduce the frequency and duration of blocked crossing incidents at such grade crossing.</text></paragraph></subsection>
<subsection id="H24FC8CA959D5478CB8C1E01ADECFE9C3"><enum>(c)</enum><header>Recordkeeping</header>
<paragraph id="H3C4C665C55C54403A4A81CBF533CC2A4"><enum>(1)</enum><header>In general</header><text>A railroad carrier shall, upon receiving a notice under subsection (b), maintain train location data records for the public highway-rail grade crossing that was the subject of the notice. </text></paragraph> <paragraph id="H8BC911B087674A4AAA28C0E8262AA750"><enum>(2)</enum><header>Contents of records</header><text>The train location data records required under paragraph (1) shall include—</text>
<subparagraph id="H239F0DA062E541DA91F00C6351EBBA3E"><enum>(A)</enum><text>a list of all blocked crossing incidents at the public highway-rail grade crossing that is the subject of the report exceeding 10 minutes;</text></subparagraph> <subparagraph id="H8D433A6007684F3483BD2E1C32543DF1"><enum>(B)</enum><text>the cause of the blocked crossing incident (to the extent available);</text></subparagraph>
<subparagraph id="H565E431DB93542229818506DA891F42D"><enum>(C)</enum><text>train length; and</text></subparagraph> <subparagraph id="HECCCFA277F7D457982044BFA6BE70E5C"><enum>(D)</enum><text>the estimated duration of each blocked crossing incident.</text></subparagraph></paragraph>
<paragraph id="H5E478BC7F5D34B98BC673049D08E7954"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">Beginning on the date on which a railroad carrier receives a notice under subsection (b), the Secretary may consult with the carrier for a period of 60 days to address concerns with blocked crossing incidents at the public highway-rail grade crossing that is the subject of the notice.</text></paragraph> <paragraph id="H0C1B2CF9BF224EBFB7768C4B0C713072"><enum>(4)</enum><header>Expiration of data collection</header><text display-inline="yes-display-inline">The requirement to maintain records under paragraph (1) shall cease with respect to a public highway-rail grade crossing noticed under subsection (b)(2) if there are no reports submitted to the blocked crossing database for blocked crossing incidents reported to occur at such grade crossing during the previous 365 consecutive calendar days.</text></paragraph></subsection>
<subsection id="HB86B3BEDDDB24F13951D2A62BF8C5F29"><enum>(d)</enum><header>Civil penalties</header>
<paragraph id="H7EADB6CA06DA4D07ABD0C8F7C09970CD"><enum>(1)</enum><header>In general</header><text>The Secretary may issue civil penalties in accordance with section 21301 to railroad carriers for violations of subsection (a) occurring 60 days after the date of submission of a notice under subsection (b).</text></paragraph> <paragraph id="H404025D4A098449FB3ABAFD17728BCCE"><enum>(2)</enum><header>Release of records</header><text display-inline="yes-display-inline">Upon the request of, and under requirements set by, the Secretary, railroad carriers shall provide the records maintained pursuant to subsection (c)(1) to the Administrator of the Federal Railroad Administration.</text></paragraph>
<paragraph id="HEDA9F7975B974A1D86FFAD8DCCEE6A63"><enum>(3)</enum><header>Alternate route exemption</header><text display-inline="yes-display-inline">Civil penalties may not be issued for violations of subsection (a) that occur at a public highway-rail grade crossing if an alternate route created by a public highway-rail grade separation exists within a half mile by road mileage of such public highway-rail grade crossing.</text></paragraph> <paragraph id="H562A3BA942E04259945A81774C615D5B"><enum>(4)</enum><header>Grade separation project</header><text display-inline="yes-display-inline">Civil penalties may not be issued for violations of subsection (a) if the violation occurs at a public highway-rail grade crossing for which there is a proposed grade separation project—</text>
<subparagraph id="H68D3F355702D4C76BBD6B112E1CC2031"><enum>(A)</enum><text>that has received written agreement from the relevant local authorities; and</text></subparagraph> <subparagraph id="H9CC9726B5D8B453BBA3057D2B07F57FE"><enum>(B)</enum><text>for which railroad carrier and project funding from all parties has been budgeted.</text></subparagraph></paragraph>
<paragraph id="H7D00446A9E3345CE8D7ACB3A77BE044A"><enum>(5)</enum><header>Considerations</header><text display-inline="yes-display-inline">In determining civil penalties under this section, the Secretary shall consider increased penalties in a case in which a pattern of the blocked crossing incidents continue to cause delays to State or local emergency services. </text></paragraph></subsection> <subsection id="H3836ADB4F2F84A5385D73054452B2886"><enum>(e)</enum><header>Application to Amtrak and commuter railroads</header><text>This section shall not apply to Amtrak or commuter authorities, including Amtrak and commuter authorities’ operations run or dispatched by a Class I railroad.</text></subsection>
<subsection id="H9FEF86C32E254DACB3929A2F8A5CE8F1"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H1760D3E1DAC643D5A424034A41959CD2"><enum>(1)</enum><header>Blocked crossing database</header><text display-inline="yes-display-inline">The term <term>blocked crossing database</term> means the national blocked crossing database established under section 20174. </text></paragraph>
<paragraph id="H28D709A1CA5843ECA9020AD6CA176095"><enum>(2)</enum><header>Blocked crossing incident</header><text display-inline="yes-display-inline">The term <term>blocked crossing incident</term> means a circumstance in which a train, locomotive, rail car, or other rail equipment is stopped in a manner that obstructs travel at a public highway-rail grade crossing.</text></paragraph> <paragraph id="HC49D192CB67047618730B82646860365"><enum>(3)</enum><header>Public highway-rail grade crossing</header><text>The term <term>public highway-rail grade crossing</term> means a location within a State in which a public highway, road, or street, including associated sidewalks and pathways, crosses 1 or more railroad tracks at grade.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H6CE0A272973248E0B017E35D58DAD67F"><enum>(a)</enum><header>Database</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of this section, the Secretary of Transportation shall establish a national blocked crossings database for the public to report blocked crossing incidents.</text></subsection> <subsection id="H64439C27F8964A3EB0883BB62BE3CF5E"><enum>(b)</enum><header>Public awareness</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this section, the Secretary shall require each railroad carrier to publish the active link to report blocked crossing incidents on the website of the national blocked crossings database described in subsection (a) on the home page of the publicly available website of the railroad carrier.</text></subsection>
<subsection id="HF9B8D9290DEF413EA7A2F2D97C64E8D8" commented="no"><enum>(c)</enum><header>Blocked crossing incident; public highway-Rail grade crossing</header><text display-inline="yes-display-inline">In this section, the terms <term>blocked crossing incident</term> and <term>public highway-rail grade crossing</term> have the meanings given the terms in section 20173.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7A2E4723E8E5462787A74AA97AAE76CE"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is further amended by adding at the end the following new item:</text>

<section id="H33E17939EE784B5A8DEAA85EBFDCF847"><enum>6.</enum><header>Railroad point of contact for blocked crossing matters</header><text display-inline="no-display-inline">Section 20152 of title 49, United States Code, is amended—</text> <paragraph id="H298A769DA53D475EAF11119B9657AF6E"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="H8DAE67BEBA504A269B905FCC1EA7A132"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H8D5C6239B4814100B70DFD26601B6C8B"><enum>(i)</enum><text>in subparagraph (C) by striking <quote>or</quote> at the end;</text></clause>

<paragraph commented="no" id="HF72B405A3AB048EFACE9B0347DBB8118"><enum>(6)</enum><text display-inline="yes-display-inline">upon receiving a report of a blocked crossing pursuant to paragraph (1)(D), the railroad carrier shall, within 14 days of receipt of the report—</text> <subparagraph id="HC1C4AEB2EE9D4447A74344A8EC9975F7"><enum>(A)</enum><text display-inline="yes-display-inline">verify that the public highway-rail grade crossing, as defined in section 20173, was blocked for a period of at least 10 minutes; and </text></subparagraph>
<subparagraph id="H92567F3EEA1E43D1ACD3A7223261AC58"><enum>(B)</enum><text display-inline="yes-display-inline">upon positive verification of the report, enter the report into the national blocked crossings database established in section 20174; and</text></subparagraph></paragraph> <paragraph id="HB5F5E4ABC3D2420B9B551012836952D3"><enum>(7)</enum><text>promptly inform the Secretary of any update to the number maintained under paragraph (1). </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HB13C9CAE6A0646A88016F05838536489"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="HED7CB2E4FB3B4771954679D510576AA0" style="OLC"> <subsection id="H606B936ECDE94262979728719D14C497"><enum>(c)</enum><header>Publication of telephone numbers</header><text>The Secretary shall make any telephone number established under subsection (a) publicly available on the website of the Department of Transportation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section display-inline="no-display-inline" id="H9EC6B3965CD144BCBEA5C3BD53D7F048" section-type="subsequent-section"><enum>7.</enum><header>National highway-rail crossing inventory review</header>
<subsection id="HC14454685EB047168792F7A1CF3352CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall expend such sums as are necessary to conduct a comprehensive review of the national highway-rail crossing inventory of the Department of Transportation established under section 20160 of title 49, United States Code.</text></subsection> <subsection id="HD582AB8E446C4119BBF0D851010D3431"><enum>(b)</enum><header>Contents</header><text>In conducting the review required under subsection (a), the Secretary shall—</text>
<paragraph id="H3C45C1FD28644F13BB4C37255AEF61F4"><enum>(1)</enum><text display-inline="yes-display-inline">verify the accuracy of the geographical location data contained in the inventory described in subsection (a) using mapping technologies and other methods; and</text></paragraph> <paragraph id="HD28157FC9A5E4A6EA91420FA0CEE8895"><enum>(2)</enum><text display-inline="yes-display-inline">notify the relevant railroad and State agencies of the erroneous data in the inventory and require such entities to correct the erroneous data within 30 days of notification.</text></paragraph></subsection>
<subsection id="H87956C9383D7488EBA29B6D6433C9BDA"><enum>(c)</enum><header>State reports</header><text display-inline="yes-display-inline">The Secretary shall require State agencies to ensure that any geographic data contained in the inventory described in subsection (a) remains consistent with any geographic data identified in biennial State reports required under section 130 of title 23, United States Code.</text></subsection> <subsection id="H2D421144DADE4290951D241A003DC432"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 120 days after the completion of the review required under subsection (a), the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report summarizing the corrections made to the inventory described in subsection (a) and the Secretary’s plans to ensure continued accuracy of such inventory.</text></subsection></section>
<section id="HE5F810844F264A06B7934ADD51BE6C01" commented="no"><enum>8.</enum><header>Railroad trespassing enforcement grants</header><text display-inline="no-display-inline">Section 22907 of title 49, United States Code, is further amended by adding at the end the following:</text> <quoted-block id="HE8D301E3393348278561694189F3D693" style="USC"> <subsection id="HEF61FF01F8EF44A8BE862D1F97357632" commented="no"><enum>(n)</enum><header>Railroad trespassing enforcement grants</header> <paragraph id="HA2E2765F0DED463198D7BA97586C4C2C" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Of the amounts made available under this section, the Secretary may make grants to public law enforcement agencies engaged in, or seeking to engage in, suicide prevention efforts along railroad right-of-way to pay wages of law enforcement personnel to patrol railroad right-of-way located in communities at risk for rail trespassing incidents and fatalities.</text></paragraph>
<paragraph id="H23110A2F56BD43AAA9BD9754987033EC" commented="no"><enum>(2)</enum><header>Prioritization</header><text>In awarding grants under this subsection, the Administrator shall give priority to applications from entities that have jurisdiction within the boundaries of the 10 States with the highest incidence of rail trespass related casualties as reported in the previous fiscal year, as reported by the National Rail Accident Incident Reporting System.</text></paragraph> <paragraph id="H7603BC81AD574A7F90256F28B8107C11" commented="no"><enum>(3)</enum><header>Limitation</header><text>The Secretary shall not award more than 3 annual grants under this subsection to the same entity.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H5389B562AE74430B9D82EEBD5C60C9C4" commented="no"><enum>9.</enum><header>Railroad trespassing suicide prevention grants</header><text display-inline="no-display-inline">Section 22907 of title 49, United States Code, is further amended by adding at the end the following:</text> <quoted-block id="HDD4E9E6FD07A483CB5447470B997ECE9" style="USC"> <subsection id="H00DBD9C8C02941A5A44D4A3713B72A82" commented="no"><enum>(o)</enum><header>Railroad trespassing suicide grants</header> <paragraph id="HF19E992E8E384A9A80BB1472E1F85449" commented="no"><enum>(1)</enum><header>In general</header><text>Of the amounts made available to carry out this section, the Secretary may make grants to eligible entities to implement a public outreach campaign to reduce the number of railroad suicides.</text></paragraph>
<paragraph id="HA8DC0AED7D1149A1A491E3FAB19EE64C" commented="no"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible entity</term> means a nonprofit mental health organization engaged in, or seeking to engage in, suicide prevention efforts along railroad right-of-way in partnership with a railroad carrier, as defined in section 20102.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></section> <section id="H61F9936CD68443D89EA49D48E005FC23"><enum>10.</enum><header>Including railroad suicides</header> <subsection id="H14D9381DE33B4291A8C0DCCBE74023C0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not less than 180 days after the enactment of this Act, the Secretary of Transportation shall revise any regulations, guidance, or other relevant agency documents to include the number of suicides on a railroad crossing or railroad right-of-way in the total number of rail fatalities the Secretary reports each year.</text></subsection>
<subsection id="H8E79A3B9CE7F4B7D97659BC63307C27F"><enum>(b)</enum><header>Authority of the Secretary</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Secretary may require Federal, State, and local agencies, railroads, or other entities to submit such data as necessary.</text></subsection> <subsection id="H7B7AA963CABF4996B44A9A29028C06C2"><enum>(c)</enum><header>Applicability of rulemaking requirements</header><text display-inline="yes-display-inline">The requirements of section 553 of title 5, United States Code, shall not apply to the modification required by subsection (a).</text></subsection></section>
<section id="H607E6B8754BD4EF882B80758FF3646FC"><enum>11.</enum><header>Report on safety measures required for Quiet Zones</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Railroad Administration shall—</text> <paragraph id="H25E3EAC3C6F542C5ADB4F132B86141E0"><enum>(1)</enum><text>submit to Congress a report on any supplementary safety measures and alternative safety measures not contained in part 222 of title 49, Code of Federal Regulations, that can be used to qualify for a Quiet Zone or Partial Quiet Zone; and</text></paragraph>
<paragraph id="HFF4ECE3D17A844B6941FA4141B72B7D1"><enum>(2)</enum><text>include in the report submitted under paragraph (1)—</text> <subparagraph id="H7EE84A4D479D4EF48FF4FFBB03513C01"><enum>(A)</enum><text>a summary of the supplementary safety measures and alternative safety measures for which a public authority has requested approval from the Administrator to implement; and</text></subparagraph>
<subparagraph id="H750912E6043B4266BAB622D95C4406B0"><enum>(B)</enum><text>an explanation for why such requests were not granted.</text></subparagraph></paragraph></section> </legis-body> </bill>
