which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to require affirmative consent from the governing body of certain Indian Tribes for jurisdiction to be conferred on the State of Kansas over offenses committed on the reservations of such Indian Tribes, and for other purposes.</official-title></form><legis-body id="H854E9DBDC2D3436BACE78941D685041D" style="OLC"><section id="H43D8CA561DD14037BC7C6A13E120BF07" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kansas Indian Country Law Enforcement Improvement Act of 2022</short-title></quote>.</text></section><section id="H64041D76DFE649BDA15F30E1FCA911EF"><enum>2.</enum><header>Repeal of Act of June 8, 1940</header><text display-inline="no-display-inline">The Act of June 8, 1940 (54 Stat. 249; ch. 276) is repealed.</text></section><section id="HB0758DE19F58473B9820964866DEB807"><enum>3.</enum><header>Amendments to Kansas jurisdiction</header><subsection id="H20F38A8AF4FF46E5BD5173EEF4571154"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 3243 of title 18, United States Code, is amended—</text><paragraph id="H54CFDB78341E4CFBAE43DE4752362575"><enum>(1)</enum><text>by striking <quote>Jurisdiction is conferred</quote> and inserting the following:</text><quoted-block style="USC" id="HE6CB7BD92FCE4B4580E8E248F005A044" display-inline="no-display-inline"><subsection id="HFB723E73F2F84C21B5B3E042F7E42A12"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Jurisdiction is conferred </text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC36FD70E9158425DAB532FE0B8AC973E"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H9B9A522C993F4B6C88F91A6ACE4C7289" display-inline="no-display-inline"><subsection id="H02BAA1B4F2994A938CFDBFCBD2019A21"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">With respect to offenses committed on the reservation of a covered Indian Tribe, jurisdiction may only be conferred on the State of Kansas under subsection (a) upon the affirmative consent of the governing body of such covered Indian Tribe, as reflected by a certified official Tribal resolution or law filed with the Attorney General which shall be effective upon publication in the Federal Register.</text></subsection><subsection id="HD4A71575C3E741DA99B597F90D2C9FC4" commented="no"><enum>(c)</enum><header>Law enforcement cooperative agreements</header><paragraph id="HB15D69B3B05E477F8D257EE671AD8839" commented="no"><enum>(1)</enum><text>Federal agencies and State and local governments in Kansas may enter into cooperative agreements or compacts with the governing bodies of covered Indian Tribes for the purposes of improving law enforcement effectiveness, reducing crime in Indian country and nearby communities, and developing successful cooperative relationships that effectively combat crime in Indian country and nearby communities.</text></paragraph><paragraph id="H5C3114DD692C49B8B678BF71BD5FD75B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Each cooperative agreement or compact entered into pursuant to this subsection shall include the following:</text><subparagraph id="H95F866C0EFC74D05B0D114886FDF1EEA" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Authorization for the deputization of law enforcement officers to enforce the laws of one or more of the other governments party to such cooperative agreement or compact.</text></subparagraph><subparagraph id="HB6D8819FDAA44ED58DDDA8C03D3E03E7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Requirements for the reporting of crimes occurring within Indian country covered under such cooperative agreement or compact to appropriate State, Federal, and Tribal law enforcement entities.</text></subparagraph><subparagraph id="H53E8DE267C8145CA8B9C1BD7529F855A" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">If a covered Indian Tribe is party to the cooperative agreement or compact, a description of—</text><clause id="HAA37E16FFD0B43958A7F9EF1074C40BA" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the geographic limits within the reservation of the covered Indian Tribe on which the State may exercise criminal jurisdiction, if any; and</text></clause><clause id="H1FABE5733AE8478DB7D15AEC4F198365" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the categories of criminal offenses within the reservation of the covered Indian Tribe over which the State may exercise jurisdiction, if any. </text></clause></subparagraph><subparagraph id="H309A35EDC48849829E56CA31883A743B" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Other requirements under Federal law.</text></subparagraph></paragraph><paragraph id="HBBEDCC1B5F044C4F9B711884612BBAA1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The Attorney General shall, upon request from the governing body of a covered Indian Tribe, provide technical assistance in the development of cooperative agreements or compacts under this section.</text></paragraph></subsection><subsection id="HFF017A4F96EA43E582EB06B78E6596F9"><enum>(d)</enum><header>Covered Indian Tribe defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered Indian Tribe</term> means the following:</text><paragraph id="H2A5414A784DF466B865C0AB68CD01DA8"><enum>(1)</enum><text>The Iowa Tribe of Kansas and Nebraska.</text></paragraph><paragraph id="HC9926FE62E954EBC9D93611F7C14DF98"><enum>(2)</enum><text>The Kickapoo Tribe of Indians of the Kickapoo Reservation in Kansas.</text></paragraph><paragraph id="HC6D34A4A12C14D379E66D8F895BB29C5"><enum>(3)</enum><text>The Prairie Band Potawatomi Nation.</text></paragraph><paragraph id="HD86C40402019463F9545F5D8EA5DAEF3"><enum>(4)</enum><text>The Sac &amp; Fox Nation of Missouri in Kansas and Nebraska.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H622AA0D8F47A4A9DB9F93566DA544B05"><enum>(b)</enum><header>Rule of construction</header><text>The amendments made by this Act shall not apply retroactively to any individual arrested, prosecuted, or convicted by the State of Kansas prior to the effective date under subsection (c).</text></subsection><subsection id="H44701EE9B89C4748AB22C78F859930B9"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 90 days after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
