<official-title display="yes">To amend the Workforce Innovation and Opportunity Act to direct the Secretary of Labor to carry out a competitive grant program to support community colleges and career and technical education centers in developing immersive technology education and training programs for workforce development, and for other purposes.</official-title>

<section id="HA20588195CBF4BAC8F3A12AEA67DFD1B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immersive Technology for the American Workforce Act of 2022</short-title></quote>.</text></section> <section id="H2F0A02C0662C4EF1A503C9C32181C939"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H8654FF089E0A44A3BE615637A180CC49"><enum>(1)</enum><text>Rural communities have unique workforce considerations and challenges.</text></paragraph> <paragraph id="HEC8C547D39F0489D9663D75A9CE6457E"><enum>(2)</enum><text>Almost 25 percent of Americans live in rural communities, and while urban areas have experienced job and population growth, rural communities face static or declining populations and job decline.</text></paragraph>
<paragraph id="H8C6BA96231DD45B08F5D6375DA4A5A38"><enum>(3)</enum><text>Rural communities were hit harder and recovered more slowly than urban centers during the 2007–2008 recession and have experienced more economic depression and decline in college enrollment due to the COVID–19 pandemic.</text></paragraph> <paragraph id="H1C0B6D94D34D4AAFA314BE51F551FF15"><enum>(4)</enum><text>Rural communities historically have lower rates of postsecondary education, which is a barrier to traditional employment in industries like agriculture and manufacturing.</text></paragraph>
<paragraph id="H21D221FFC3E340CB9125FA22742B0434"><enum>(5)</enum><text>It is estimated that by the end of 2022 over half of all employees will require <quote>significant</quote> reskilling, which is less expensive than replacing an individual employee.</text></paragraph> <paragraph id="HED24014F1D584074BD9367AA53947890"><enum>(6)</enum><text>Immersive technologies are proving effective in helping rural communities tackle these challenges.</text></paragraph>
<paragraph id="H720EE1C408F8453F8157949B04AE1467"><enum>(7)</enum><text>Technologically mediated training, including augmented reality, virtual reality, mixed reality, and high-tech simulations are increasingly valued as tools to train workers in industries ranging from manufacturing to health care, agriculture to construction, and clean energy to public safety.</text></paragraph> <paragraph id="H66031548CF12424182B9A9DDAD1FF741"><enum>(8)</enum><text>Use of immersive technology permits on-site training and continued education, promotes efficiency, aids recruiting as well as retention, improves communication and collaboration, and increases safety.</text></paragraph>
<paragraph id="H4E87AEEB04B641F99D1DD93EC6DFA37E"><enum>(9)</enum><text>Immersive technologies allow workers to train directly under the supervision and tutelage of more experienced experts who are located outside of the local community.</text></paragraph> <paragraph id="HAAAFD7FE17304A4AABE7847866661031"><enum>(10)</enum><text>These technologies help workers remain well equipped for the demands of the modern economy. As the need for reskilling increases, so will the need for technologies which support American workers rather than replace them.</text></paragraph>
<paragraph id="HDC542F5E51264926B96700F0516372C5"><enum>(11)</enum><text>Community colleges, area career and technical education centers, and other training providers are uniquely positioned to support rural communities in skills development and workforce training.</text></paragraph> <paragraph id="H6895D72E5ABA44EAAF2772079D50C1C5"><enum>(12)</enum><text>People without a postsecondary credential are 4 times more likely to have a job that can be lost to automation than those who have one, increasing their need to learn new skills in order to remain competitive and employable.</text></paragraph>
<paragraph id="H2C014CEBB0654BFD8E3A304D34443981"><enum>(13)</enum><text>Community colleges provide education at a lower cost, with most graduates incurring no student debt.</text></paragraph> <paragraph id="HA0DBF429C23F49739AAD7D5AE5595827"><enum>(14)</enum><text>In addition to providing lower cost workforce development training and skills education applicable across a range of roles and occupations, community colleges serve as large regional employers and critical community hubs.</text></paragraph>
<paragraph id="H0BCB89CE2DD8447DA7817FA4083FCCF1"><enum>(15)</enum><text>Offering grants to community colleges and area career and technical education centers in rural areas to develop and provide immersive technology training programs will help rural communities in the short term and position them for success in the longer term.</text></paragraph> <paragraph id="H042FA6F77D4F42F1942A41BF35007628"><enum>(16)</enum><text>Despite their proven value, community colleges and area career and technical education schools bear significant funding limitations and shortages.</text></paragraph>
<paragraph id="H20DAA825DBE84B07BEB39D4FE70886C2"><enum>(17)</enum><text>Providing immersive technology training programs through community colleges can help rural communities retain local talent, whether by providing qualification for new local jobs or for remote employment opportunities with companies headquartered in urban centers that are struggling to fill jobs.</text></paragraph> <paragraph id="H600634BDCD1945F681D5132CC15C63F2"><enum>(18)</enum><text>Immersive technology training partnership with community colleges and area career and technical education schools also complements recent Federal funding for broadband connection and physical infrastructure, the two other biggest hurdles facing rural students and workers seeking reskilling or upskilling.</text></paragraph></section>
<section id="H92DFFB07986140509067F6572AD3AE77"><enum>3.</enum><header>Grants for immersive technology and education workforce training programs and career pathways</header><text display-inline="no-display-inline">Subtitle D of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221 et seq.</external-xref>) is amended—</text> <paragraph id="H78C8799007594EA697E9D1E9577D1BC1"><enum>(1)</enum><text>by redesignating section 172 as section 173; and</text></paragraph>
<paragraph id="HF730C5B815FD4FF6B79C17D5DF517666"><enum>(2)</enum><text>by inserting after section 171 the following:</text> <quoted-block style="OLC" id="H8A62F5D980FD4EF0B0135612CE210C3E" display-inline="no-display-inline"> <section id="H22727390DE3E44D9938D58F45F9EA42F" commented="no"><enum>172.</enum><header>Grants for immersive technology and education workforce training programs and career pathways</header> <subsection id="H70F3CF3032C7439FA6130A0B1FB50AEB" commented="no"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of enactment of this section, from the amounts appropriated to carry out this section, the Secretary shall award grants, on a competitive basis, to eligible entities to carry out immersive technology education and workforce training programs or career pathways that use immersive technology.</text></subsection>
<subsection id="HBC0DCCCD721A466F9D113AE7B6403F9F" commented="no"><enum>(b)</enum><header>Use of funds</header><text>An eligible entity receiving a grant under this section shall use such grant for at least one of the following:</text> <paragraph id="HBBDD525B73CF4721823178C36C82A00F" commented="no"><enum>(1)</enum><text>To develop and implement or improve an immersive technology education and workforce training program, or a related policy, program, or other activity that uses immersive technology that—</text>
<subparagraph id="H3A5AF1B9C14B46358C5D7D0F9DEAE7F9" commented="no"><enum>(A)</enum><text>facilitates the transfer of academic credits (including for courses in the same field or program of study) between covered community colleges and other institutions of higher education, including other covered community colleges; and</text></subparagraph> <subparagraph id="H2BDE7BD0910841DD9312B10DD1041E07" commented="no"><enum>(B)</enum><text>develops or enhances supportive services for students enrolled in such a program or activity.</text></subparagraph></paragraph>
<paragraph id="HC0C51FFA2A6F4E48B240B13F89172B92" commented="no"><enum>(2)</enum><text>The creation or alignment of a career pathway that provides a sequence of education and occupational training that leads to a recognized postsecondary credential, including a program or activity that—</text> <subparagraph id="H618996A6245348F487460BD17A31F335" commented="no"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="H541F02D71DE2406AA34D74E25CF6B576"><enum>(i)</enum><text>includes integrated education and training that uses immersive technology; and</text></clause>
<clause id="H62AC7E1D5B144EA4AA5E30043FF12CEC" indent="up1" commented="no"><enum>(ii)</enum><text>is designed to increase the provision of workforce training for students (including individuals who are members of the Armed Forces and veterans) in order to facilitate the entry of such students into in-demand industry sectors or occupations; or</text></clause></subparagraph> <subparagraph id="H0F6A893EB2AA4CE88915E2262B0B2EBC" commented="no"><enum>(B)</enum><text>enables the training of instructors in the use of immersive technology in education and workforce training programs.</text></subparagraph></paragraph></subsection>
<subsection id="H2B58CCBE1F214D61AA1BE1FD8E3B45F4" commented="no"><enum>(c)</enum><header>Duration of grants</header><text>A grant awarded under this section shall be for a period of not more than 5 years, except that in the case of an eligible entity that has carried out a program or activity with such a grant that meets the criteria for satisfactory progress on performance indicators as determined under subsection (h)(1) for the initial 5-year grant period, the Secretary may extend the grant period for such eligible entity by not more than 5 additional years.</text></subsection> <subsection id="HE37BAD744AF24D308EEE5DF1FADD2E64" commented="no"><enum>(d)</enum><header>Application</header><text>An eligible entity seeking a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection>
<subsection id="H0D4BD0A3B835464A8D7A8643661E68CC" commented="no"><enum>(e)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to any eligible entity that—</text> <paragraph id="H8C92BF1C713D4FA8A2D9480B69FCCE47" commented="no"><enum>(1)</enum><text>is working with, or in carrying out a program or activity to be funded with such a grant plans to work with, an industry or sector partnership that prioritizes the hiring of individuals who have obtained a recognized postsecondary credential as a result of the program or activity; or</text></paragraph>
<paragraph id="H748FA829F55F424ABF7BC08C0132E264" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">submits an application under subsection (d) that demonstrates—</text> <subparagraph id="H41F55237F5664817864E6900553F850F"><enum>(A)</enum><text>alignment with—</text>
<clause id="HADE4F0F043594D3298B9416C7645835F"><enum>(i)</enum><text>the State plan under section 102 or 103 of a State in which the eligible entity will be carrying out a program or activity to be funded with such a grant;</text></clause> <clause id="H34C1AAD62058455498176540E487A583"><enum>(ii)</enum><text>the local plan under section 108 of a local area in which such a program or activity will be carried out; or</text></clause>
<clause id="H93D7497FF0A64361A2882A168FA685BA"><enum>(iii)</enum><text display-inline="yes-display-inline">the State plan under section 122 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2342">20 U.S.C. 2342</external-xref>) with respect to a State in which such a program or activity will be carried out; </text></clause></subparagraph> <subparagraph id="H53C7D3E475B446DFB7317EB4ADE0CB36" commented="no"><enum>(B)</enum><text>with quantitative data and evidence, the extent to which the program or activity to be funded by such a grant will meet the needs of employers;</text></subparagraph>
<subparagraph id="HCD3343D491E14C61ADEE7D743FF02690" commented="no"><enum>(C)</enum><text>how such a program or activity will target a specific in-demand industry sector or occupation which has a skills gap;</text></subparagraph> <subparagraph id="HD9099E19E94E45698F2BE1C7564FF7E5" commented="no"><enum>(D)</enum><text>how such a program or activity will retrain workers from an industry sector that is experiencing decreasing employment;</text></subparagraph>
<subparagraph id="H757451E9991249588C7FCD17B6DB6D03" commented="no"><enum>(E)</enum><text>how such a program or activity will target individuals with barriers to employment;</text></subparagraph> <subparagraph id="H1FF924078561486C80051F1E9E01ECDE" commented="no"><enum>(F)</enum><text>how such a program or activity will serve an area of substantial unemployment (as defined in section 132(b)(1)(B)); or</text></subparagraph>
<subparagraph id="HCAA1CB2B9BB64243B957A7D5F1F84A57" commented="no"><enum>(G)</enum><text>how such a program or activity will serve a rural area. </text></subparagraph></paragraph></subsection> <subsection id="H7D9BD7A6EC584C1DA2CEA5489257FB80" commented="no"><enum>(f)</enum><header>Reports</header> <paragraph id="HA7DB2A119CD94A0196617F6287BBD980" commented="no"><enum>(1)</enum><header>Report to the Secretary</header><text>Each eligible entity receiving a grant under this section shall submit to the Secretary a report for each year of the grant period for such grant that includes a description of each program and activity funded under the grant, including—</text>
<subparagraph id="H118A4D8E08BE402DA4C09417A2AEE93B"><enum>(A)</enum><text display-inline="yes-display-inline">the levels of performance achieved for each indicator of performance under section 116(b)(2)(A)(i), disaggregated by age, race or ethnicity, gender, barrier to employment, and income of the participants of such program or activity; and</text></subparagraph> <subparagraph id="HED6006FD76784111A7BE09D43AE306B4"><enum>(B)</enum><text>in a case of an eligible entity that worked with an industry or sector partnership in carrying out such a program or activity, the role of such partnership in carrying out the program or activity.</text></subparagraph></paragraph>
<paragraph id="H75097DA0BE4F4C4182909909D26DDAC8" commented="no"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 1 year after the first grant is awarded under this section and biennially thereafter, the Secretary shall submit to Congress a report that includes a summary of the information submitted under paragraph (1) for the most recent 2-year period.</text></paragraph></subsection> <subsection id="HCD6D7BDE5BD74F4A91E89579713E0818" commented="no"><enum>(g)</enum><header>Evaluation</header><text>The Secretary shall reserve not less than 1 percent and not more than 5 percent of any amounts made available for each fiscal year to conduct a rigorous, independent evaluation of the programs and activities carried out under this section.</text></subsection>
<subsection id="H9BB472A7E21248EB936C93E473D1698C" commented="no"><enum>(h)</enum><header>Satisfactory progress</header>
<paragraph id="H5F21EC211EC446F1AE8E6270F2A949D0" commented="no"><enum>(1)</enum><header>Determination of criteria</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Education, shall determine the criteria for satisfactory progress on the indicators of performance under section 116(b)(2)(A)(i) for programs and activities funded by grants awarded to eligible entities under this section.</text></paragraph> <paragraph id="HA9B3F9CB7D0A47DD9CB474973BF5497C" commented="no"><enum>(2)</enum><header>Cessation of funds</header><text>The Secretary may not provide funds to any eligible entity under a grant under this section after the third year of the grant period unless each program and activity carried out by the eligible entity with the grant has met the criteria for satisfactory progress for the first 3 years of such grant period, as determined under paragraph (1).</text></paragraph></subsection>
<subsection id="H217B3D630B014402B63D521E8129E0C1" commented="no"><enum>(i)</enum><header>Best practices</header><text>The Secretary, in coordination with the Secretary of Education and each eligible entity that receives funds under grants awarded under this section after the third year of the grant periods for such grants, shall—</text> <paragraph id="H4658605D4AF145BA96A8887B96CB0CD6"><enum>(1)</enum><text>establish best practices for using immersive technology in workforce training and education programs; and</text></paragraph>
<paragraph id="H3DE0766C628A445B9485175F408BDAAE"><enum>(2)</enum><text>publish such best practices on a publicly available website of the Department of Labor.</text></paragraph></subsection> <subsection id="H755EA37AF5A449D88F929C8CE504E421" commented="no"><enum>(j)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HC504FB0B6EA04598A1D62D87A1915D89" commented="no"><enum>(1)</enum><header>Covered community college</header><text>The term <term>covered community college</term> means—</text> <subparagraph id="HEBB32D526B434EA5A41FEB6C8268CE8F" commented="no"><enum>(A)</enum><text>a public institution of higher education (as defined in section 101(a) of the Higher Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>), at which—</text>
<clause id="HBA9EFA0D57D84F84B31BF3573E4F544C" commented="no"><enum>(i)</enum><text>the highest degree awarded is an associate degree; or</text></clause> <clause id="HE85C045393F84884A44C0A3A14629F39" commented="no"><enum>(ii)</enum><text>an associate degree is the most frequently awarded degree;</text></clause></subparagraph>
<subparagraph id="HB6DD0D6BB3084A7BB4E0F2CC1E6F93CF" commented="no"><enum>(B)</enum><text>a branch campus of a 4-year public institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), if, at such branch campus—</text> <clause id="H5A58CC343D224C5DBB689817DEEC41D5" commented="no"><enum>(i)</enum><text>the highest degree awarded is an associate degree; or</text></clause>
<clause id="HBBBEF4A018D7467698B8135BA38F2EF8" commented="no"><enum>(ii)</enum><text>an associate degree is the most frequently awarded degree;</text></clause></subparagraph> <subparagraph id="H4E943501A51248FAB092EB6FA46551D4" commented="no"><enum>(C)</enum><text>a 2-year Tribal College or University (as defined in section 316(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)(3)</external-xref>)); or</text></subparagraph>
<subparagraph id="H0B36AB3F9CFC4CCCAFE4D1ECAB9676E5" commented="no"><enum>(D)</enum><text>a degree-granting Tribal College or University (as defined in section 316(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)(3)</external-xref>)) at which—</text> <clause id="H05665452866540748197283E7E75D93A" commented="no"><enum>(i)</enum><text>the highest degree awarded is an associate degree; or</text></clause>
<clause id="H09E7F1080FC243C6B3EB06A6D250D1FA" commented="no"><enum>(ii)</enum><text>an associate degree is the most frequently awarded degree.</text></clause></subparagraph></paragraph> <paragraph id="H672DB416554F40859E413191A4A9CAD0" commented="no"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>
<subparagraph id="HBC0E2A598D084FC6A575655466ACE814" commented="no"><enum>(A)</enum><text>a community college;</text></subparagraph> <subparagraph id="H42D02599FBF048F9A237596E3C9C10ED"><enum>(B)</enum><text display-inline="yes-display-inline">an area career and technical education school; </text></subparagraph>
<subparagraph id="H933A2E72085D4C7692EA8175D299672F" commented="no"><enum>(C)</enum><text>a postsecondary vocational institution (as defined in section 102(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>)); or</text></subparagraph> <subparagraph id="H91870C56F8974C9AA2447EB40FD9B1A3" commented="no"><enum>(D)</enum><text>a consortium of such colleges, schools, or institutions.</text></subparagraph></paragraph>
<paragraph id="HBE99D0E81E574A148E84F5CD768C2D77" commented="no"><enum>(3)</enum><header>Immersive technology</header><text display-inline="yes-display-inline">The term <term>immersive technology</term> means tools, including virtual reality and augmented reality, that integrate the physical environment with digital content to support user engagement.</text></paragraph> <paragraph id="H94C80A0B592949B4B2A7D39B9DCB7E08" commented="no"><enum>(4)</enum><header>Rural</header><text>The term <term>rural</term> means all populations, housing, and territories not included within an urban area, in which an urban area is defined as any gathered populations, housing, and territories that meets or exceeds 50,000 or more people, or is comprised of clusters consisting of at least 2,500 gathered populations, housing, and territory but less than 50,000 people.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HA3A85CFDF11C45D797E316920A84BA89"><enum>4.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">The table of contents for the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101</external-xref>) is amended by striking the item relating to section 172 and inserting the following: </text> <quoted-block style="OLC" id="H0A326B0B50AE4E0E98C505E733B966CD" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 172. Grants for immersive technology and education workforce training programs and career pathways.</toc-entry> <toc-entry level="section" idref="HBACD9F65A9A84C27B3BA088122773A20">Sec. 173.
