<section id="H8E4096AD2EFF43149EE239766E9DF17E" commented="no"><enum>2.</enum><header>Amendments to purposes and definitions</header><text display-inline="no-display-inline">The Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101 et seq.</external-xref>) is amended as follows:</text> <paragraph id="H9F94F9F98C69462B8ACE459A44895BAF" commented="no"><enum>(1)</enum><text>In section 2(c) (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101</external-xref> note)—</text>
<subparagraph id="H59FFCDC9FC414FA5A5AF1D55E7BC2B38" commented="no"><enum>(A)</enum><text>by amending paragraph (4) to read as follows:</text> <quoted-block id="H4A7A8129AA3548BBA42D383817EABE5E" style="OLC"> <paragraph id="H3196AADFAA724DBB93EBE932190E03FD" commented="no"><enum>(4)</enum><text>to enhance the prompt resolution of abduction cases by returning children to the United States;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H01603E9692E0418BA825761895C2BEF2"><enum>(B)</enum><text>by redesignating paragraphs (5) through (7) as paragraphs (6) through (8), respectively; and</text></subparagraph> <subparagraph id="H23BA1FB4B6764D5885CC1FFEA507ED1B" commented="no"><enum>(C)</enum><text>by inserting after paragraph (4) the following:</text>

<paragraph id="H23964A8F748D43CE9B05891DCFC50577" commented="no"><enum>(5)</enum><text>to enhance the prompt resolution of access cases by reuniting children with their left-behind parents with unfettered and enforceable access;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HC62342FA33F54F39A30A136AABFB0704" commented="no"><enum>(2)</enum><text>In section 3 (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101</external-xref>)—</text>
<subparagraph id="H29A83A2E3E3D4367B93D8081B2E485CF" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text> <clause id="HF989829817DF4C16BA7F3A592C7C8BF1"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>; and</quote> at the end and inserting a semicolon;</text></clause>
<clause id="HB9F3A9674243428F9BF9BCAA0FF4519B"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and </text></clause> <clause id="HE21F4BF887E741459C9DA78CA164A498"><enum>(iii)</enum><text>by adding at the end the following:</text>

<subparagraph id="H26A260EA9E9644798C4C34553765D467" commented="no"><enum>(C)</enum><text>includes all cases reported involving an application filed with the Central Authority of the United States or directly with the foreign central authority by a parent seeking rights of access or return.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H01023FE38EA945F7B05079814F069F6A" commented="no"><enum>(B)</enum><text>by amending paragraph (7) to read as follows:</text>

<paragraph id="H6796859FE38544D38EA53B83B43AC23B" commented="no"><enum>(7)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="H1BB7E4CF91444C77B294E676CA14C942"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Appropriations, and the Committee on Homeland Security of the House of Representatives; and</text></subparagraph>
<subparagraph id="H44686F42E2CE4AAAA14CC1FFB35475E9"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Appropriations, and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HBA0720915D824A1C8C1B634ADCDE0D77"><enum>(C)</enum><text>in paragraph (11), by striking <quote>16</quote> and inserting <quote>18</quote>; </text></subparagraph>
<subparagraph id="H30BC6BD16CC3424C9006060596B24A24" commented="no"><enum>(D)</enum><text>by amending subparagraph (A) of paragraph (19) to read as follows:</text> <quoted-block id="HAE5A340400A44BAB9A31FB5ADC8E40D0" style="OLC"> <subparagraph id="HB18151A097E84124983C9060DB21456C" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>pattern of noncompliance</term> means the persistent failure—</text>
<clause id="H00FCA05AC9DA43DFA8FE438213F67DA4" commented="no"><enum>(i)</enum><text>of a Convention country—</text> <subclause id="HA0684BE6AC2E49798D2B09B3BC607F27" commented="no"><enum>(I)</enum><text>with respect to abduction cases pending as of the date on which the country entered the Hague Abduction Convention—</text>
<item id="H49F1FA1B92AF435B815DAB7FAAFFBB0E"><enum>(aa)</enum><text>to work with the Central Authority of the United States to resolve such cases; and</text></item> <item id="HE986DB8D1FC34E43A46092B0D4DF82BD" commented="no"><enum>(bb)</enum><text>to abide by any bilateral procedures established between the United States and such country; or</text></item></subclause>
<subclause id="HCB85734E62414688972237A238CBCCA0" commented="no"><enum>(II)</enum><text>with respect to cases initiated after such date of entry, to implement and abide by provisions of such Convention;</text></subclause></clause> <clause id="HE80497BC3B8241379BB0718C6838E62F" commented="no"><enum>(ii)</enum><text>of a non-Convention country to abide by bilateral procedures that have been established between the United States and such country; or</text></clause>
<clause id="H6E45182DE2214BD890E80ECD6FB0849F" commented="no"><enum>(iii)</enum><text>of a non-Convention country to work with the Central Authority of the United States to resolve abduction cases.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H10A63FB05EB145C69822D3A0C0456C5D" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (23)—</text>
<clause id="HFC390F1BCE714CF9A9CD47341FF3E4F6" commented="no"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text> <quoted-block id="HC586EB8EF3414D2F80360FA871A70AD2" style="OLC"> <subparagraph id="HD697A12333FC4618955CA608E2B0EE42" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>unresolved abduction case</term> means an abduction case—</text>
<clause id="H369894BB704C45AEA7F52BD2DF2B60D6"><enum>(i)</enum><text>that does not meet the criteria to be considered resolved pursuant to subparagraph (B), (C), or (D) of this paragraph; and</text></clause> <clause id="H681D77E4E2064494939E80AF7264C722"><enum>(ii)</enum><text>for which the completed application for return of the child or access to the child is submitted by the Central Authority of the United States, or directly by the parent, for determination to the foreign Central Authority, foreign ministry, judicial ministry, or the judicial or administrative authority, as applicable, of the country in which the child is located.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H37311E20AD4744468172C0CB09F8B704" commented="no"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text> <quoted-block id="H03946C744C3545E1899FD8701A6812E5" style="OLC"> <subparagraph id="H741E8C3A865E455CA5FE237F4F61537A" commented="no"><enum>(B)</enum><header>Resolution of case with a return</header><text>An abduction case shall be considered to be resolved if the child is returned to the left-behind parent, pursuant to the Hague Abduction Convention or other appropriate bilateral procedures, if applicable.</text></subparagraph>
<subparagraph id="H221FF25C48A042B19A550B4A899EE6DC" commented="no"><enum>(C)</enum><header>Resolution of case without a return</header><text>An abduction case shall be considered to be resolved without a return if—</text> <clause id="H8913CC59DEC24F529DDF2144A4057E64" commented="no"><enum>(i)</enum><text>the left-behind parent reaches a voluntary arrangement with the other parent or custodian of the child;</text></clause>
<clause id="HB2CEB2E6EFEB471E8E5F760E1CE066F4" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the left-behind parent submits to the Department of State a written withdrawal of the application under the Hague Convention on the Civil Aspects of Child Abduction for Return or the request for assistance in returning the child; or</text></clause> <clause id="HBD012B53318E43098C95E615EA1AA679" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the left-behind parent submits to the Department of State a written withdrawal of the application for the organization of rights of Access under the Hague Convention on the Civil Aspects of International Child Abduction or the request for assistance in obtaining access to the child.</text></clause></subparagraph>
<subparagraph id="H29D2408BE5EC4CB8872D778225483E30" commented="no"><enum>(D)</enum><header>Failed to return; case closed</header><text>An abduction case shall be considered to be resolved as <quote>failed to return; case closed</quote> if—</text> <clause id="H851BD4EC18C94F7CA492CABE68304E44" commented="no"><enum>(i)</enum><text>the judicial or administrative branch, as applicable, of the government of the country in which the child is located—</text>
<subclause id="H322E104D77B849D095DE2F0DE1F5B941"><enum>(I)</enum><text>has implemented, and is complying with, the provisions of the Hague Abduction Convention or other bilateral procedures, as applicable;</text></subclause> <subclause id="HFB1773F0EE1141778700345FD8839677"><enum>(II)</enum><text>has denied with finality the Petition for return of the child under the Convention or request under other bilateral procedure, as applicable; and</text></subclause>
<subclause id="H1B17153F122D49559D2EF849443B015C"><enum>(III)</enum><text>has determined that the child need not be returned to the left-behind parent;</text></subclause></clause> <clause id="HD500D90F559A41488088A42A1D188873" commented="no"><enum>(ii)</enum><text>the Department of State cannot locate the left-behind parent for one year despite the documented efforts of the Department to locate the parent; </text></clause>
<clause id="H5D68B063C8394D72804585C34D6C3B66" commented="no"><enum>(iii)</enum><text>the child is deceased;</text></clause> <clause id="H57B50AA2220E4850A4194824B67B161A" commented="no"><enum>(iv)</enum><text>the left-behind parent is deceased and no amended petition has been filed; or</text></clause>
<clause id="HA95E3B5EA4B74AAEBF0E95852C62C259" commented="no"><enum>(v)</enum><text>the abducted child attains the age of 18.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H2CD61BE7642B4B53BCD5106E696A94DB"><enum>(F)</enum><text>by redesignating paragraphs (5) through (23) (as amended) as paragraphs (6) through (24), respectively; and</text></subparagraph>
<subparagraph id="H7F55EF02A11B424F9535BE387F1E3224"><enum>(G)</enum><text>by inserting the following new paragraph after paragraph (4):</text> <quoted-block style="OLC" id="H4F40A27BE39444448C67239A10B93997" display-inline="no-display-inline"> <paragraph id="H4BEAEDB891014AB89EF78E122DC88EE3" commented="no"><enum>(5)</enum><header>Ambassador-at-Large to Monitor and Combat Child Abductions</header> <subparagraph id="HB4E7A3578E17400A97189350AA77D15E" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Ambassador-at-Large to Monitor and Combat Child Abductions</term> means the Ambassador-at-Large to Monitor and Combat Child Abductions appointed pursuant to section 201(a) of the Admiral James W. Nance and Meg Donovan Foreign Relations Authorization Act, Fiscal Years 2000 and 2001 (<external-xref legal-doc="usc" parsable-cite="usc/22/9009">22 U.S.C. 9009</external-xref>).</text></subparagraph>
<subparagraph id="HE12447E3584442B492A1752A1EDDC460" commented="no"><enum>(B)</enum><header>Duties</header><text>The duties and responsibilities of the Ambassador-at-Large to Monitor and Combat Child Abductions shall be carried out, during any period in which such Ambassador has not been duly appointed and confirmed, by—</text> <clause id="H568464D70D9545CE9427D70042FD4DDE" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the Director of the Office of Children’s Issues of the Department of State, as provided in section 201(a)(2)(B) of the Admiral James W. Nance and Meg Donovan Foreign Relations Authorization Act, Fiscal Years 2000 and 2001; or</text></clause>
<clause id="H5CB47BFC74EB47D2A892C2FEC1A2748D" commented="no"><enum>(ii)</enum><text>if such Director has also not been appointed or confirmed, the Secretary of State.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="H1878267B28B04B2EA6D37DB0AD0050D0"><enum>3.</enum><header>Annual report on international child abduction expanded</header><text display-inline="no-display-inline">Section 101 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9111">22 U.S.C. 9111</external-xref>) is amended as follows:</text>
<paragraph id="HE9132806ED0F4CD4865D5AD6FD175ABA"><enum>(1)</enum><text>In subsection (b)—</text> <subparagraph id="HB3AFEAD978DB4A0EBB3F842C82B07743"><enum>(A)</enum><text>in paragraph (2)—</text>
<clause id="H7BE77CDE8C1C4C5996D755A810A1233E"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="HCC622579F3E04DDD8407D040114FFD54"><enum>(I)</enum><text>by striking <quote>abduction and</quote> after <quote>of such new</quote>; and</text></subclause>
<subclause id="H35E9BB70A3884F479286C7854C19475C"><enum>(II)</enum><text>by striking <quote>, respectively,</quote> and inserting <quote>as were</quote>; </text></subclause></clause> <clause id="H267DD030D8484FB8926C0EBCD9C0C50D"><enum>(ii)</enum><text>in subparagraph (G), by striking <quote>; and</quote> and inserting a semicolon; </text></clause>
<clause id="H08465CB189A043DC9D487E85E0F45E1B"><enum>(iii)</enum><text>by redesignating subparagraphs (A) through (H) as subparagraphs (C) through (J), respectively;</text></clause> <clause id="HD0C3583DD9D149E898591D2AB385C28F"><enum>(iv)</enum><text>by inserting the following new subparagraphs before subparagraph (C) (as so redesignated):</text>
<quoted-block id="H00C8BEC9F5F6426595E60A22A2610A52" style="OLC">
<subparagraph id="H903AD0738CA44B6CA9C8E146D5BF2669"><enum>(A)</enum><text>the number of children abducted from the United States and the number of children returned to the United States with respect to such country for each year of the 10-year period ending on the date of the submission of the report;</text></subparagraph> <subparagraph id="H824A89FD2BC94865B8980288CD45E79B"><enum>(B)</enum><text display-inline="yes-display-inline">the total number of children abducted from the United States and the total number of children returned to the United States with respect to such country during the period beginning January 1, 1994, and the ending on the date of the submission of the report;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="H9682643FEB614F15B151A336EB12DE73"><enum>(v)</enum><text>by adding at the end the following:</text> <quoted-block id="HA8694CA8514B49D5833172ADB9363C03" style="OLC"> <subparagraph id="HFF2C5B808E374700BA5D1FA525F15354"><enum>(K)</enum><text>the number of cases resolved with a return to the United States;</text></subparagraph>
<subparagraph id="H899F4E19902F4249AC5E133F2C184EB2"><enum>(L)</enum><text>for cases resolved without a return, the number resolved with respect to which the left-behind parent—</text> <clause id="HC54745B370594957BD4CACD3AB730B5C"><enum>(i)</enum><text>reached a voluntary arrangement with the other parent or custodian of the child;</text></clause>
<clause id="H5A88DB1E53004AE2A6C1D422DDE08686"><enum>(ii)</enum><text>submitted to the Department of State a written withdrawal of the application under the Hague Abduction Convention for the return of, or requesting assistance in returning, the child; or</text></clause> <clause id="HE60942E92E80425A84F159AD176CF610"><enum>(iii)</enum><text>submitted to the Department of State a written withdrawal of the application for organization of rights of access under the Hague Abduction Convention or requesting for assistance in obtaining access to the child; and</text></clause></subparagraph>
<subparagraph id="HF65BBEB1107D4A18A6ABCF1331E79034"><enum>(M)</enum><text>for cases closed with a failure to return, the number of cases with respect to which—</text> <clause id="H7296023BA7D844F8A7096B5D1CBF6326"><enum>(i)</enum><text>the judicial or administrative branch, as applicable, of the government of the country in which the child is located—</text>
<subclause id="HAA45E24F3C2D47B5BAA64159CCF7BFF9"><enum>(I)</enum><text>has implemented, and is complying with, the provisions of the Hague Abduction Convention or other bilateral procedures, as applicable;</text></subclause> <subclause id="H12486780B44248FAA0992FC4C972BA8D"><enum>(II)</enum><text>has denied with finality the petition for return of the child under the Convention, or request under other bilateral procedure, as applicable; and</text></subclause>
<subclause id="HBE63B21E4BFA43558A7BF622392D6408"><enum>(III)</enum><text>has determined that the child need not be returned to the left-behind parent;</text></subclause></clause> <clause id="HD6D04A6F8AA34898A595911095CCD0BF"><enum>(ii)</enum><text>the Department of State cannot locate the left-behind parent for one year despite the documented efforts of the Department to locate the parent; </text></clause>
<clause id="HA208D558FC724286A86FFF7FBBC2FF89"><enum>(iii)</enum><text>the child is deceased;</text></clause> <clause id="HD26AC6ECD4974132BB1EB2E2AB0E8953"><enum>(iv)</enum><text>the left-behind parent is deceased and no amended petition has been filed; or</text></clause>
<clause id="HE574FB783668432493259FCD97CD71CF"><enum>(v)</enum><text>the victim of the abduction is now over 18 years old.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H3B0D6AA775DE4FB79C172733098DA3B9"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking <quote>and</quote> at the end;</text></subparagraph>

<clause id="H5DFE952CD306416386610B61FA68A5D3"><enum>(ii)</enum><text>the governments of which the Secretary of State determines have neither engaged in a persistent failure described in section 3(20)(B) nor in a pattern of noncompliance, as defined in section 3(20)(A);</text></clause></subparagraph> <subparagraph id="H168AF3991FC2430F98F0078F36B578FB"><enum>(B)</enum><text display-inline="yes-display-inline">a <quote>tier 2</quote> list of countries and territories the governments of which the Secretary of State determines have engaged in a persistent failure described in section 3(20)(B), but are making significant efforts to bring themselves into compliance with those standards, and with respect to which—</text>
<clause id="H5DEF870228BF420FB529BA1A756BF954"><enum>(i)</enum><text>the estimated number of unresolved abduction and access cases is very significant or is significantly increasing and the country is not taking proportional concrete actions; or</text></clause> <clause id="H52682E403C9C46F08D64C304D04BD6B5"><enum>(ii)</enum><text>there is a failure to provide evidence of increasing efforts to resolve unresolved abduction and access cases from the previous year; and</text></clause></subparagraph>
<subparagraph id="H3E7E036292FE428C808057A0FAF1857C"><enum>(C)</enum><text display-inline="yes-display-inline">a <quote>tier 3</quote> list of countries and territories the governments of which the Secretary of State determines have engaged in both a persistent failure described in section 3(20)(B) as well as a pattern of noncompliance, as defined in section 3(20)(A); and</text></subparagraph></paragraph> <paragraph id="HDE101AE319DC4421AED221BE90E0D957"><enum>(7)</enum><text display-inline="yes-display-inline">a section describing the status of legal protections for victims of domestic violence and their children, with appropriate links to substantive intergovernmental reports (such as a United States country report documenting issues of domestic violence against vulnerable populations within the country), including—</text>
<subparagraph id="H95096DDC4F3F45D98B5134B1FDEFA626"><enum>(A)</enum><text>a description of the ability of a victim of domestic abuse to obtain urgent protective and restraining measures with respect to such victim and any child of such victim;</text></subparagraph> <subparagraph id="HC8B303A73B3E4085AF994B353962EF0C"><enum>(B)</enum><text display-inline="yes-display-inline">an indication of where victims of domestic violence may obtain access to justice and essential services;</text></subparagraph>
<subparagraph id="HA0C0CC79CEEB47AF9ED60E7B4CD65283"><enum>(C)</enum><text>whether official findings of domestic or family violence are available outside of the criminal process, and are considered evidential in child custody cases;</text></subparagraph> <subparagraph id="H87861A3743684BC590EA63A64368A03A"><enum>(D)</enum><text>whether evidentiary standards and burdens of proof in legal proceedings are consistent with United States judicial proceedings; and</text></subparagraph>
<subparagraph id="H438448F21DEA4375A89716D2B1D79131"><enum>(E)</enum><text>whether foreign court and law enforcement will honor orders containing arrangements for the protection of a child.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H0D10F0C812354979BE539A1ED37B5D57"><enum>(3)</enum><text>By striking subsection (e) and redesignating subsection (f) as subsection (e).</text></paragraph></section>
<section id="HCD61DA29901E44FF9BA7D4E6342135C5"><enum>4.</enum><header>Amendments to standards and assistance</header><text display-inline="no-display-inline">Section 102 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9112">22 U.S.C. 9112</external-xref>) is amended—</text> <paragraph id="HEE7A11451DEB42958ACAA2C7C90F8C60"><enum>(1)</enum><text>by striking <quote><header-in-text level="section" style="OLC">Sec. 102. Standards and Assistance</header-in-text>.—The Secretary of State shall— </quote> and inserting the following:</text>

<subsection id="H854E40DD412A42B7B9A2E44746D4B48E"><enum>(b)</enum><header>Additional actions by Secretary of State</header>
<paragraph id="HD4F08AC1A2804E999610BF9D0C4BE39C"><enum>(1)</enum><header>Action plan for tier 3 countries</header>
<subparagraph id="HAC238BDFF3CF4F3EBD41A7AC6A4260B2"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the submission of each annual report required by section 101, the Secretary of State, acting through the Ambassador-at-Large to Monitor and Combat Child Abductions and the Assistant Secretary of the appropriate regional bureau, shall—</text> <clause id="HD5C9B785E7BF4A65AE2333BB084CAD72"><enum>(i)</enum><text>prepare an action plan for each country upgraded from the <quote>tier 3</quote> list described in subparagraph (C) of section 101(d)(6) to the <quote>tier 2</quote> list described in subparagraph (B) of such section, to further improve such country’s tier ranking; and</text></clause>
<clause id="HC41B4D9AA8F048279F652C887632A57D"><enum>(ii)</enum><text>present the relevant action plan to the government of each such country.</text></clause></subparagraph> <subparagraph id="H2473E169CB1846D1AF72FC97D3E21230"><enum>(B)</enum><header>Consultation</header><text display-inline="yes-display-inline">In preparing the plan required by subparagraph (A), the Secretary of State shall seek to consult with the Central Authority from the government of each applicable country with the assistance of the United States ambassador to or chargé d’affaires for such country.</text></subparagraph></paragraph>
<paragraph id="H7892F7F9899F46C9B7B71FC09848AA15"><enum>(2)</enum><header>Transmission of information to tier 3 countries</header><text display-inline="yes-display-inline">Not less frequently than annually, the Secretary of State shall provide to the foreign minister of each country that has been downgraded to the <quote>tier 3</quote> list described in subparagraph (C) of section 101(d)(6) in the most recent report submitted in accordance with such section—</text> <subparagraph id="H37B7D4E134EE45539E2929EF3662B6AD"><enum>(A)</enum><text>a copy of the Annual Report on International Child Abductions; and</text></subparagraph>
<subparagraph id="HB8A226FBD2FE4010984F5EFAE4D0C0D8"><enum>(B)</enum><text>information pertinent to that country’s downgrade, including—</text> <clause id="H281FBE458F7C4C85AE533B2D72A3CD2D"><enum>(i)</enum><text>confirmation of the country’s inclusion in such <quote>tier 3</quote> list;</text></clause>
<clause id="HA91E5F8ECD00420ABD6A7D91BFE7D96C"><enum>(ii)</enum><text>the factors that contributed to the downgrade; and</text></clause> <clause id="H869C964F08FB4A4A9EA139ED98021341"><enum>(iii)</enum><text>the steps that the country must take to be considered for an upgrade in status of designation.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H6BC4AF06E5564821A9ADCE8D7546B9F1"><enum>(c)</enum><header>Assistance provided by the Office of Children’s Issues</header>
<paragraph id="H52283F4A8C6E4847BFDAC41E041E231D"><enum>(1)</enum><header>Documentation relating to domestic violence</header><text>For each application that the Director of the Office of Children’s Issues transmits to a Central Authority, the Director shall include documentation of—</text> <subparagraph id="H4D7E6548FC204442976E6EE705DB945E"><enum>(A)</enum><text>domestic violence protections under the laws of the country from which the child has been removed; and</text></subparagraph>
<subparagraph id="H5E18B08246CC4972853348EE6DCAC40D"><enum>(B)</enum><text>the availability of such protections to a parent alleged to have fled the United States due to domestic violence.</text></subparagraph></paragraph> <paragraph id="H4FA0B1D8D7B6412E859BDA169FD89693"><enum>(2)</enum><header>Volunteer national attorney network</header><text>The Director of the Office of Children’s Issues shall take such steps as may be necessary to expand its volunteer national attorney network—</text>
<subparagraph id="H9182C97D90FD43CAA2EBB3F45ADA3716"><enum>(A)</enum><text>to provide attorneys willing to represent a responding parent in an incoming abduction case on a pro bono or reduced fee basis, with respect to which—</text> <clause id="H7DDD87727B5844C4BAF0D6B482F2FB3D"><enum>(i)</enum><text>the parent is advancing the defense that such parent is a victim of domestic violence; or</text></clause>
<clause id="HD0A6E1971E5F42288A137739329E663D"><enum>(ii)</enum><text>in an incoming case brought under the International Child Abduction Remedies Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9001">22 U.S.C. 9001 et seq.</external-xref>), with respect to which a defense of domestic violence has been made; and</text></clause></subparagraph> <subparagraph id="HF592EA59F1C648178230F5CE0D13CF84"><enum>(B)</enum><text>to assist parents, on a pro bono or reduced fee basis, in outgoing cases, with—</text>
<clause id="HD24A048A76FE45FB984F01726D79C5A7"><enum>(i)</enum><text>an application for return or access under the Hague Abduction Convention to be transmitted by the Secretary of State to a foreign Central Authority;</text></clause> <clause id="H0ED00840A35B4D5194C9C33538F41AC1"><enum>(ii)</enum><text>referrals to foreign counsel, or judicial or administrative officials, willing to represent the interests of the child in proceedings in the courts of foreign countries to secure the entry and enforcement of any undertaking orders entered by the foreign court to facilitate access to that child or that child’s return; or</text></clause>
<clause id="H86B3464840C24BBF8F86E1E34E1F7613"><enum>(iii)</enum><text>obtaining, where appropriate, protective orders related to allegations or findings of domestic violence, until the court of competent jurisdiction in the United States can address the child custody case on the merits.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H5737EF43703448758052568EC222C0ED"><enum>5.</enum><header>Amendments relating to notification required to be provided to congressional representatives</header><text display-inline="no-display-inline">Section 104 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9114">22 U.S.C. 9114</external-xref>) is amended—</text>
<paragraph id="H2139BDA9AA004596AF140C9950EF3E28"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block id="H124C7436A8CE403882D936803D963052" style="OLC"> <subsection id="HA3A67E6DA32F4FEAA035D05D6B8FB5BE"><enum>(a)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary of State shall submit written notification to the Member of Congress and Senators, or Resident Commissioner or Delegate, as appropriate, representing the legal residence of a left-behind parent if such parent reports an abduction to the Central Authority of the United States (without regard to whether such report occurred before, on, or after the date of the enactment of this subsection).</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H677F883F59D94B3696EC8FA419BCF645"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text> <quoted-block id="HB1B6EE8767234218A2A7A5CD9960052C" style="OLC"> <subsection id="HEB5C55F99D8E40CCA3248E259409511F"><enum>(b)</enum><header>Timing</header><text>The notification required under subsection (a) shall be provided—</text>
<paragraph id="H1809F1F139F949DE85E771746E2ADCD3"><enum>(1)</enum><text>not later than 90 days after the date of the enactment of such subsection, with respect to a report from a left-behind parent that was made on or before such date of enactment; or</text></paragraph> <paragraph id="HA8092168568F44529CFDC357F8485321"><enum>(2)</enum><text>not later than 90 days after the date of a report from a left-behind parent made after such date of enactment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HE2BBA2ED7F7F4EB78ACFE23D06CBC137"><enum>6.</enum><header>Amendments to authorities to respond to international child abductions</header><text display-inline="no-display-inline">Section 201 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9121">22 U.S.C. 9121</external-xref>) is amended as follows:</text> <paragraph id="HB967BCDEB2994980B77698B913C9E515"><enum>(1)</enum><text>By amending subsection (b) to read as follows:</text>
<quoted-block id="HC76D042186344D7883167C0E23AC3FF3" style="OLC">
<subsection id="H7BA1B821B260472EA1518063013F27C1"><enum>(b)</enum><header>Actions in response to unresolved cases</header>
<paragraph id="H24803FC12D6A42A9AB7E685043601B21"><enum>(1)</enum><header>Determination of action</header><text display-inline="yes-display-inline">For each abduction or access case relating to a child whose habitual residence is in the United States that remains pending after the Central Authority of the United States or the parent submits such case to a foreign country, the Secretary of State shall determine whether the government of such foreign country has failed to take appropriate steps to resolve the case. If such determination is affirmative that such failure occurred, the Secretary should, as expeditiously as practicable—</text> <subparagraph id="H7E8B59B911D6410698C377D50426E7BC"><enum>(A)</enum><text>take 3 or more of the actions described in subsections (d) and (e) of section 202; and</text></subparagraph>
<subparagraph id="H2560F0550F0148078745DE82BB210343"><enum>(B)</enum><text>direct the chief of mission in that foreign country to address the resolution of the case with senior officials in the foreign government.</text></subparagraph></paragraph> <paragraph id="HF7F66DE840AF4DB783B417DE274884DD"><enum>(2)</enum><header>Authority for delay of action</header><text display-inline="yes-display-inline">The Secretary of State may delay any action described in paragraph (1) for up to 1 year if the Secretary determines that such additional time will substantially assist in resolving the case.</text></paragraph>
<paragraph id="H5DE81DEFA7D946B89CCD4C546FDC19EE"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">If the Secretary of State determines to delay an action pursuant to paragraph (2) or decides not to take any action described in subsection (d) or (e) of section 202 after making the determination described in paragraph (1), the Secretary shall provide a report to the appropriate congressional committees, not later than 15 days after such delay or decision, that describes the reasons for such delay or decision.</text></paragraph> <paragraph id="HCF6E9299247B484D8AA4C64336EEF728"><enum>(4)</enum><header>Congressional briefings</header><text display-inline="yes-display-inline">At the request of the appropriate congressional committees, the Secretary of State shall provide a briefing, including a written report, if requested, on actions taken to resolve a case or the cause for delay.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H4009AA8B4FD84B32BE3A98C78BEAAD8C"><enum>(2)</enum><text>By amending subsection (c) to read as follows:</text> <quoted-block id="HA088BE79BFA242C5A35C166BB431F738" style="OLC"> <subsection id="HD548E72B94F84D6EB022E495D79709C0"><enum>(c)</enum><header>Implementation</header> <paragraph id="H2B59D9F89B404EEBB208BB2288E59F54"><enum>(1)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">In carrying out subsection (b), the Secretary of State should—</text>
<subparagraph id="HB789F7F18176457393C3ADEFAC9839C6"><enum>(A)</enum><text>take 3 or more actions pursuant to subparagraph (A) of subsection (b)(1) that most appropriately respond to the nature and severity of the governmental failure to resolve the unresolved abduction case; and</text></subparagraph> <subparagraph id="H86AF14E395FC4202B33CAF1FA0BE1DD1"><enum>(B)</enum><text display-inline="yes-display-inline">seek, to the fullest extent possible—</text>
<clause id="HB683A0C227694A9BBB8D009F40DF8718"><enum>(i)</enum><text>to initially respond to such a failure by communicating with the Central Authority of the country; and</text></clause> <clause id="H29CB2EBC1EB74155B344554999CC3A6B"><enum>(ii)</enum><text>if such communication is unsuccessful in addressing the failure, to target subsequent actions—</text>
<subclause id="HF8ED2795CFB04CFF994299363079E2F0"><enum>(I)</enum><text>as narrowly as practicable, with respect to the agencies or instrumentalities of the foreign government that are responsible for such failures; and</text></subclause> <subclause id="H8D745F51885D47DE8E2D69990E6921CC"><enum>(II)</enum><text>in ways that respect the separation of powers and independence of the judiciary of the foreign country, as applicable.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="HBC22BB952B5B427A934115DB81FB908A" display-inline="no-display-inline"><enum>(2)</enum><header>Additional guidelines for actions under section 202</header><text>In addition to the guidelines under paragraph (1), in determining whether to take 1 or more actions under paragraphs (5) through (7) of section 202(d) or section 202(e) pursuant to subparagraph (A) of subsection (b)(1), the Secretary of State shall seek to minimize any adverse impact on—</text> <subparagraph id="H9355B216A38F444A99F7E61E319B2ADC"><enum>(A)</enum><text>the population of the country the government of which is targeted by the action or actions;</text></subparagraph>
<subparagraph id="H0C32DDE4785A40BE880501C38A39EC2D"><enum>(B)</enum><text>the humanitarian activities of United States and nongovernmental organizations in the country; and</text></subparagraph> <subparagraph id="H4A85D76887E44411BB9E42CD2D97C1F2"><enum>(C)</enum><text>the national security interests of the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H9286897DAB544964B8E36CD2FF74F077"><enum>(3)</enum><text>By adding at the end the following:</text> <quoted-block id="HD371826E0D854EDCADD113A64E0E696A"> <subsection id="HBF856774C5854E049A2C64A39409D3C6"><enum>(d)</enum><header>Action in the case of abducted children who reach the age of 16</header><text>When an individual who is an abducted child attains 16 years of age, a consular officer from a United States diplomatic mission in the country in which such individual resides shall, until either the parent seeking assistance or the individual (after attaining 18 years of age) requests the officer to cease, annually—</text>
<paragraph id="H9D44344EE332423590843FA67538E482"><enum>(1)</enum><text>attempt to contact such individual, engaging other agencies and foreign counterparts as necessary to obtain a verified location;</text></paragraph> <paragraph id="H90E8C0DF0AB64A1DB14A7B9EF117A7D9" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">advise such individual of applicable rights under section 51.28 of title 22, Code of Federal Regulations, including with respect to executing an application for a passport on the individual’s own behalf; and</text></paragraph>
<paragraph id="H1E287FBD4E374797AD34EEE663DE2FAB"><enum>(3)</enum><text>advise such individual of applicable rights under sections 3301 through 3327 of title 38, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HD062CB0A4EF44AC2B39D860C979024D0"><enum>7.</enum><header>Amendments to actions in response to patterns of noncompliance</header><text display-inline="no-display-inline">Section 202 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9122">22 U.S.C. 9122</external-xref>) is amended as follows:</text>

<subparagraph id="H273EFE870548422CA03820A8700BC543"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the submission of the Annual Report, the Secretary of State shall submit a report to Congress on the specific actions taken against countries determined to have engaged in a pattern of noncompliance under this section.</text></subparagraph> <subparagraph id="H47865E6117774D6792A331B0E9B757E4"><enum>(B)</enum><header>Briefing</header><text display-inline="yes-display-inline">The Secretary of State shall annually brief the appropriate congressional committees on the report described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H267E0DCB3A294CD7B9C3F6FC58F5F1DA"><enum>(3)</enum><text display-inline="yes-display-inline">In subsection (d), by striking <quote>subsection (f)</quote> and inserting <quote>subsection (g)</quote>.</text></paragraph> <paragraph id="HC1EBC23E290A43D7A88E2E9B153144E8"><enum>(4)</enum><text>In subsection (e), by striking paragraphs (1) and (2) and inserting the following:</text>

<paragraph id="HFF946E3CB8814027B4CD96138ACB22A5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (g), the Secretary of State may substitute any other action authorized by law for any action described in subsection (d) if the Secretary determines that such action—</text> <subparagraph id="H1A1AF1058E8C47948FF40509681396CC"><enum>(A)</enum><text>is commensurate in effect to the action substituted; and</text></subparagraph>
<subparagraph id="HB6831C6A9E0045769A59D732DECB6746"><enum>(B)</enum><text>would substantially further the purposes of this Act.</text></subparagraph></paragraph> <paragraph id="H761210D17052481C88A818E61753A7C4"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">If commensurate action is taken pursuant to this subsection, the Secretary of State shall submit to the appropriate congressional committees a report that—</text>
<subparagraph id="HEBABB141CA5F4FDC942054BE8D881278"><enum>(A)</enum><text>describes such action;</text></subparagraph> <subparagraph id="HA24988756BA3493AB25BE1ED68A6A775"><enum>(B)</enum><text>explains the reasons for taking such action; and</text></subparagraph>
<subparagraph id="HCA8995964A444D5CBF236B913E6164B9"><enum>(C)</enum><text>specifically describes the basis for the Secretary’s determination under paragraph (1) that such action—</text> <clause id="H04F4AFDFB3C449D6B39A5303325C5759"><enum>(i)</enum><text>is commensurate with the action substituted; and</text></clause>
<clause id="HC824A5A089BD4A8EA00BDE554C90ACB7"><enum>(ii)</enum><text>substantially furthers the purposes of this Act.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H805E0F30AC9A47B28460B3EFC7A391C7"><enum>(5)</enum><text>By inserting the following new subsections after subsection (g):</text>

<subsection id="H901BDEFE61FC4F9B9BFF6255B044E410"><enum>(h)</enum><header>Study on international parental child abduction</header>
<paragraph id="H56270AE75C1F4E8A87F2E1B65ACC8DE6" display-inline="no-display-inline"><enum>(1)</enum><header>Study required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this subsection, the Secretary of State shall seek to enter into an agreement with an appropriate nongovernmental organization to study and publish a report on the grave harm to abducted children and left-behind parents as a result of international parental child abduction.</text></paragraph> <paragraph id="H8AE93418A6FF48B7A81E42CDF497F5A9" display-inline="no-display-inline"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $1,000,000 for each of fiscal years 2023 and 2024 to carry out the study described in paragraph (1).</text></paragraph>
<paragraph id="HB362FE4F5809485295522F834ACC2FF7" commented="no"><enum>(3)</enum><header>Appropriate nongovernmental organization</header><text>In this subsection, the term <term>appropriate nongovernmental organization</term> means a nongovernmental organization that has significant expertise in the trauma associated with international parental abductions.</text></paragraph></subsection> <subsection id="H519518BF170A474598E3D25DF8DE9407" display-inline="no-display-inline"><enum>(i)</enum><header>Audit of efforts</header><text display-inline="yes-display-inline">The Secretary of State shall perform an annual audit of the efforts of the Department of State to monitor and combat international child abductions. Upon the completion of the first such audit, the Secretary shall submit to the appropriate congressional committees the results of the audit, specifically describing the effects of actions taken under subsections (d) and (e).</text></subsection>
<subsection id="HEEEAD7B33EDC4C5A9ACF2A1CC430E40A"><enum>(j)</enum><header>Report</header><text>Not later than 90 days after the Secretary of State submits the first Annual Report required to be submitted after the date of the enactment of this subsection, the Secretary of State shall submit to the appropriate committees a report that contains the following:</text> <paragraph id="HC5B4600012A344229DD24952EE07CD5B"><enum>(1)</enum><text>A description of the activities undertaken to conduct the study required by subsection (h).</text></paragraph>
<paragraph id="H1FFFA622AC734A59B856FD5A87C2D72C"><enum>(2)</enum><text>An update on the progress of the audit required by subsection (i).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H60B7BF6413D44C0F98CF3C0B68A8FD73"><enum>8.</enum><header>Amendments relating to training</header><text display-inline="no-display-inline">Title III of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 is amended—</text>
<paragraph id="H4DF50273FBB84DFF9C31C187D778D382"><enum>(1)</enum><text>by repealing section 301;</text></paragraph> <paragraph id="H70241925E4BC4573AE394CB7730FEB4A"><enum>(2)</enum><text>by redesignating section 302 (as amended by subsection (a)) as section 301; and</text></paragraph>
<paragraph id="HA4CCDCF7A8044732850EBB807D7D3415"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H464EDD0FD20B49E38004F46BFD897A5D" style="OLC"> <section id="HEAB0DB83BD894B2DB992838AF1FEE18B"><enum>302.</enum><header>Additional international parental child abduction training</header> <subsection id="HD1B67B9CA3F34152AB4D335930D280F7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State shall make training available on international parental child abductions to domestic and foreign professionals employed in the judicial, family court, or law enforcement professions.</text></subsection>
<subsection id="H17CFDDE329DD4B3494D9543B85AA57EE"><enum>(b)</enum><header>Authorizations of appropriations</header><text>There is authorized to be appropriated $1,000,000 for each fiscal year to carry out the training described in subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HCBE7F96C309F4D8E963FDB97C84D6763" section-type="subsequent-section"><enum>9.</enum><header>Modifications to the Office of Children’s Issues of the Department of State</header> <subsection id="H50ECC2CD5EA54E4EA058D000E62E6B75"><enum>(a)</enum><header>Establishment of United States ambassador-at-Large To monitor and combat child abductions</header><text display-inline="yes-display-inline">Section 201(a) of the Admiral James W. Nance and Meg Donovan Foreign Relations Authorization Act, Fiscal Years 2000 and 2001 (<external-xref legal-doc="usc" parsable-cite="usc/22/9009">22 U.S.C. 9009</external-xref>) is amended to read as follows:</text>

<subsection id="H918509D7897C42B6B34F6D36882608DF"><enum>(a)</enum><header>Ambassador-at-Large To Monitor and Combat Child Abductions</header>
<paragraph id="HA616ACE0A4A8480FA44CA712462BB5FD"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Office of Children’s Issues of the Department of State (in this section referred to as the <quote>Office</quote>) shall be led by an Ambassador-at-Large to Monitor and Combat Child Abductions (in this section referred to as the <quote>Ambassador</quote>), who shall be appointed by the President by and with the advice and consent of the Senate and who shall report directly to the Secretary of State.</text></paragraph> <paragraph id="H1F2E0DD4444342CFBF7CAE2665CA5B54" display-inline="no-display-inline"><enum>(2)</enum><header>Diplomatic representation</header><text>Subject to the direction of the President and the Secretary of State, the Ambassador is authorized to represent the United States—</text>
<subparagraph id="H13647F331BC24A92B0171FE939F9FD58"><enum>(A)</enum><text>in matters and cases relevant to child abduction affairs, through—</text> <clause id="H97DF9A50F48B4F609D7086835359C440"><enum>(i)</enum><text>contacts with foreign governments, intergovernmental organizations, specialized agencies of the United Nations, and other international organizations of which the United States is a member; and</text></clause>
<clause id="HCB1852DC8E814729984EB61A4225D5AE"><enum>(ii)</enum><text>multilateral conferences and meetings relating to international child abductions; and</text></clause></subparagraph> <subparagraph id="H61BC6940BDEB4B31A602F20AEA98D71F" display-inline="no-display-inline"><enum>(B)</enum><text>in matters and cases relevant to inter-country adoptions.</text></subparagraph></paragraph>
<paragraph id="H802E1F8E053B4BF3BB62C406B2A089BF"><enum>(3)</enum><header>Additional duties and responsibilities</header><text display-inline="yes-display-inline">The Ambassador shall also be responsible for carrying out the duties and responsibilities assigned to the Secretary of State under the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101 et seq.</external-xref>).</text></paragraph> <paragraph id="H16972B3F37EB4B979BE6BC5E0E4FCF54"><enum>(4)</enum><header>Director requirements</header> <subparagraph id="H33193DE75DA04A7B8C50053495A3F210"><enum>(A)</enum><header>In general</header><text>The Secretary of State shall appoint to the position of Director of the Office of the Department of State an individual described in subparagraph (B) who can ensure long-term continuity in the management and policy matters of the Office. Such Director shall report directly to the Ambassador.</text></subparagraph>
<subparagraph id="HF672F8131AC04E3DB6FC8C9FE907987E"><enum>(B)</enum><header>Qualified appointees</header><text>An individual described in this subparagraph is an individual—</text> <clause id="HCA29073450FE4597958D049A0A29900D"><enum>(i)</enum><text>of senior rank in the Department of State;</text></clause>
<clause id="HE3E87A292FCE46D083A52117400F330E"><enum>(ii)</enum><text display-inline="yes-display-inline">who is serving, at the time of the appointment, as a foreign affairs civil service officer; and</text></clause> <clause id="H1A08C1DB4BF34F28A447DD9AC97D4941"><enum>(iii)</enum><text>who has a strong background in consular affairs.</text></clause></subparagraph>
<subparagraph id="H0D601E709FBE4FD984E0164CF9BD3D6F"><enum>(C)</enum><header>Assignment of duties</header><text>During any period in which an Ambassador has not been appointed and confirmed pursuant to paragraph (1), the Director of the Office shall carry out all duties and responsibilities otherwise assigned to the Ambassador.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HB2D9EC8F973340BDB1BDF47432E62F34"><enum>(b)</enum><header>Expansion of duties</header><text display-inline="yes-display-inline">Section 201 of the Admiral James W. Nance and Meg Donovan Foreign Relations Authorization Act, Fiscal Years 2000 and 2001 (<external-xref legal-doc="usc" parsable-cite="usc/22/9009">22 U.S.C. 9009</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H2192A902B00C4F1F9DF1F26E60077CBE"><enum>(e)</enum><header>Formal request requirements</header>
<paragraph id="H84EF281503924F35AB4E9B7633E6BA98"><enum>(1)</enum><header>In general</header><text>The Director of the Office shall ensure that with respect to any abduction case relating to a non-Convention country, a formal request by the Central Authority of the United States to the Central Authority of such country for the return of the abducted child and for rights of contact with the abducted child—</text> <subparagraph id="HE71AB66231A849879DD7FEB3292B1745"><enum>(A)</enum><text display-inline="yes-display-inline">is submitted within 30 days of a case being opened by a parent with the Office; and</text></subparagraph>
<subparagraph id="H4361D090DBDB4824AEFE3ABD1B9BF981"><enum>(B)</enum><text>is renewed, or the Central Authority of the non-Convention country is otherwise appropriately re-engaged, every 90 days thereafter until the case is resolved.</text></subparagraph></paragraph> <paragraph id="H0112C78BB6B640159DD5D395C99D271A"><enum>(2)</enum><header>Accession to Convention</header><text>In the case of a case relating to a non-Convention country that subsequently accedes to the Hague Abduction Convention, the Director of the Office shall ensure that a formal request described in paragraph (1) that is submitted prior to such date of entry is renewed or re-submitted in accordance with the requirements of the Convention, or the Central Authority of such country continues to otherwise be appropriately re-engaged, and the case continues to be pursued until resolved.</text></paragraph></subsection>
<subsection id="HECEFA114F39D49288E689AD45DA935E3"><enum>(f)</enum><header>Assistance for parents</header><text>In addition to the matters described in subsection (d), the Director of the Office shall ensure that parents are provided—</text> <paragraph id="H49C2AFF8B61E4C78B91B260D4F14BF38"><enum>(1)</enum><text>information about domestic reporting and remedies, the existence of humanitarian case assistance through Interpol, and the availability of welfare and whereabout visits in foreign countries;</text></paragraph>
<paragraph id="H9A0DE5B764184D5EAE8656497B3DF8F3"><enum>(2)</enum><text>assistance in—</text> <subparagraph id="H8FB81DEDA15448E8827A39D21F7BDB1C"><enum>(A)</enum><text>locating internationally abducted children, including with respect to coordination between United States and foreign law enforcement officials or other foreign authorities;</text></subparagraph>
<subparagraph id="HB7FE6428CCDC409D832C6546785F48C5"><enum>(B)</enum><text>serving process on an abducting parent through a diplomatic or consular post or through engagement with United States officials at such posts;</text></subparagraph> <subparagraph id="H91BC44146CFC4895A32571DCC032E496"><enum>(C)</enum><text>requesting in-person welfare and whereabout visits to be conducted by a consular officer at a diplomatic or consular post, including seeking cooperation from the abducting parent or from appropriate foreign authorities; and </text></subparagraph>
<subparagraph id="H5213CD2EF91D420096D92C39F9F8E860"><enum>(D)</enum><text>obtaining reports of the results of such visits; and</text></subparagraph></paragraph> <paragraph id="HC4ADC75CBFB84242B132DF98846776EC"><enum>(3)</enum><text>liaison assistance with appropriate counterparts of the Department of Justice to facilitate—</text>
<subparagraph id="H6FAF094856BD47AFBE712625F7E36CDC"><enum>(A)</enum><text>the entry of a child into the National Crime Information Center database;</text></subparagraph> <subparagraph id="H342C36E2A6BC463EB12DDD955E7F6CD9"><enum>(B)</enum><text>the issuance and maintenance of Interpol Red or Yellow notices; and</text></subparagraph>
<subparagraph id="H8CC3D28C69D449E6B5DB1157509B9455"><enum>(C)</enum><text>appropriate Federal criminal prosecution.</text></subparagraph></paragraph></subsection> <subsection id="H0433771DEEA24AE8908D6730B5ADDAF5" commented="no"><enum>(g)</enum><header>In-Person welfare and whereabouts visits</header><text display-inline="yes-display-inline">Upon receiving an one-time request from a parent, a consular officer at a diplomatic or consular post shall conduct in-person welfare and whereabout visits described in subsection (f)(2)(C) every 90 days. Such visits may be discontinued only upon the written notice to discontinue such visits at the election of the non-abducting parent. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HDD18E02D8D3A46E4855FF15CB2511F78" commented="no"><enum>(c)</enum><header>Conforming amendments</header><text>Section 433 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/241">6 U.S.C. 241</external-xref>) is amended by striking <quote>Secretary of State</quote> each place it appears and inserting <quote>Secretary of State (acting through the Ambassador-at-Large to Monitor and Combat Child Abductions of the Department of State)</quote>.</text></subsection> <subsection id="H7175CB5CDD7F4F5CA7AA6A03788AC7C8"><enum>(d)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, in addition to the authorities provided by the amendments made by this section, the Secretary of State, acting through the Ambassador-at-Large to Monitor and Combat Child Abductions, should exercise to the fullest extent all authorities available to the Secretary, such as through mutual legal assistance treaties and other bilateral or multilateral treaties and agreements, to—</text>
<paragraph id="H86385F5A98124B10939BA74556E8C82D"><enum>(1)</enum><text>repatriate abducted children; and</text></paragraph> <paragraph id="H80127A0282EC42FB803D27BEC47645A8"><enum>(2)</enum><text>extradite abducting parents.</text></paragraph></subsection></section>
<section id="HAA9A4F3853994DB9A89DA5AADF8EDA8F"><enum>10.</enum><header>Increasing sentencing guideline for international parental kidnapping</header><text display-inline="no-display-inline">Section 1204 of title 18, United States Code, is amended—</text> <paragraph id="H6CCDC6E9CD3B47019ECC33406F1CC494"><enum>(1)</enum><text>in subsection (a), by striking <quote>3</quote> and inserting <quote>10</quote>; and</text></paragraph>

<paragraph id="H616FCFF17A19419C8FE54A6081FA8B43"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each Federal, State, and local law enforcement agency shall report each case of a missing child under the age of 21 reported to such agency to the National Crime Information Center of the Department of Justice, except that in the case of an international parental child abduction, such agency shall report the case to the Federal Bureau of Investigation. </text></paragraph> <paragraph id="HB33164C3DAF3456A80FFFF732EB32451"><enum>(2)</enum><header>International parental child abductions</header> <subparagraph id="H86312ECF91F947DF96AF042557EAA15F"><enum>(A)</enum><header>Requirement on FBI</header><text>In each case of international parental child abduction, the Federal Bureau of Investigation shall—</text>
<clause id="HC8FDE357F63B495BB6130A1F707913DC"><enum>(i)</enum><text>report each case of a missing child under the age of 21 reported to such agency to the National Crime Information Center of the Department of Justice; and</text></clause> <clause id="HB82190B4CCBC42A8AA31122C3190F6DF"><enum>(ii)</enum><text display-inline="yes-display-inline">request that the United States National Central Bureau, as the official United States representative to the International Criminal Police Organization (INTERPOL), issue a Yellow Notice. </text></clause></subparagraph>
<subparagraph id="HF83541239D214CB7A8793B88FCE05ABD"><enum>(B)</enum><header>Application to previously abducted children</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of the Bring Abducted Children Home Amendments Act, for each covered international parental child abduction—</text> <clause id="H1C828F41F7B24263A362FB3F1764C8B7"><enum>(i)</enum><text>the Federal Bureau of Investigation shall comply with the requirements under subparagraph (A); and </text></clause>
<clause id="H01ED3952A65B422690B11BEFD5B84603"><enum>(ii)</enum><text>the Office of Children’s Issues shall provide information to left-behind parents of the resources and authorities available pursuant to the amendments made by such Act and assist them by liaising with the Department of Justice to ensure that the Federal Bureau of Investigations complies with the requirements under subparagraph (A).</text></clause></subparagraph> <subparagraph id="H74344309960B481A80B6BA7AFF788D21"><enum>(C)</enum><header>Removal from the NCIC</header><text>A child who is the victim of an international parental child abduction who is entered into the National Crime Information Center database of the Department of Justice may not be removed from such database until the child—</text>
<clause id="H1F1E6813B6EB4C948F73ABAA35A6A56F"><enum>(i)</enum><text>is returned to the left-behind parent; or</text></clause> <clause id="HD5C7601D8265444BA56665CD88FF1A2C"><enum>(ii)</enum><text>after reaching the age of 21, requests their removal in person to a United States consular official or Federal law enforcement officer. </text></clause></subparagraph>
<subparagraph id="HBABCDF201F704334BE65C43DD11A63BD"><enum>(D)</enum><header>INTERPOL Yellow Notice</header><text display-inline="yes-display-inline">A Yellow Notice issued by the United States National Central Bureau with respect to a child who is the victim of an international parental abduction shall remain active until the child—</text> <clause id="H11D0521831754795AAF7C66884434C4F"><enum>(i)</enum><text>is returned to the left-behind parent; or</text></clause>
<clause id="H857580015BAB421D9676F200F31DA445"><enum>(ii)</enum><text>after reaching the age of 21, requests their removal in person to a United States consular official or Federal law enforcement officer. </text></clause></subparagraph></paragraph> <paragraph id="H328D98C4E9874EAEA8F8C4AC1F3ECBB9"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="HD23D6946DA894DB589DE9ADF60A9555B"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>international parental child abduction</term> has the meaning given the term <term>abduction</term> in section 3 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101</external-xref>), to the extent that the perpetrator of such abduction is a parent of the child.</text></subparagraph> <subparagraph id="H8CA801F2FBC94FB399512FB94D14597F"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>left-behind parent</term> has the meaning given such term in section 3 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101</external-xref>). </text></subparagraph>
<subparagraph id="HA53F5D63C51A4EB1A1AA888206F5B695"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>covered international parental child abduction</term> means an international parental child abduction—</text> <clause id="HE43714094CE248DAB7D79D809519CB33"><enum>(i)</enum><text display-inline="yes-display-inline">that occurred prior to the date of enactment of the Bring Abducted Children Home Amendments Act—</text>
<subclause id="H63EFAC9C6F0543939C5D79148B241445"><enum>(I)</enum><text>with respect to which paragraph (1) would apply if such abduction were to have occurred on or after the date of enactment of such Act; or </text></subclause> <subclause id="H66C43DDBEF6245069E6B54587BB0AEA6"><enum>(II)</enum><text>that was reported to the Office of Children’s Issues of the Department of State; and </text></subclause></clause>
<clause id="H689BCBAFFFFE4B038A60367C47DAEDAB"><enum>(ii)</enum><text>with respect to which the child who was abducted has not been returned to the left-behind parent. </text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H22238C027F5D475F83F72169D3B20BE7"><enum>13.</enum><header>Legal expense grants for victims of international parental child abduction</header><text display-inline="no-display-inline">Section 1403 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20102">34 U.S.C. 20102</external-xref>) is amended—</text>
<paragraph id="HDA80862520D249B492AF82B0AFF7C7F0"><enum>(1)</enum><text>in subsection (b)(1)—</text> <subparagraph id="H4EF05409A6C64C15A2808F582894EC6A"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>including drunk driving and domestic violence</quote> and inserting <quote>including international parental child abduction, drunk driving, and domestic violence</quote>;</text></subparagraph>
<subparagraph id="HEC9276080D854F5189F978B0723D7FA5"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H141C4A2CB69046D291226B121C15B59E"><enum>(C)</enum><text>in subparagraph (C), by adding <quote>and</quote> at the end; and</text></subparagraph>
<subparagraph id="H8A6D3FE3C74E470ABBA0E0D8BDAC05AF"><enum>(D)</enum><text>by inserting after subparagraph (C) the following: </text> <quoted-block style="OLC" id="H79D9027F5607489586B48415EB8BB2AA" display-inline="no-display-inline"> <subparagraph id="H39B9E370EA604E81B9BD8653F2FEEF9F"><enum>(D)</enum><text display-inline="yes-display-inline">legal expenses in United States and foreign countries attributable to efforts to repatriate a victim of international parental child abduction resulting from a compensable crime; </text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HF7358D484547479F9BD04102EF202D5A"><enum>(2)</enum><text>in subsection (d)—</text> <subparagraph id="H153E8EC9A17740BCB291881D00A36C6E"><enum>(A)</enum><text>in paragraph (3), by inserting <quote>that constitute international parental child abduction,</quote> after <quote>that are described in section 247 of title 18, United States Code,</quote>;</text></subparagraph>
<subparagraph id="H169D64CE1B5A4DD2A8CE1798B6EEA272"><enum>(B)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H0143539172044FEF85862ECC6DA0800E"><enum>(C)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text></subparagraph>
<subparagraph id="H2B5AFC57C13648789339F90AE63E319C"><enum>(D)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="H0FE6842D83B64FE0AC9F16FA66AA797D" display-inline="no-display-inline"> <paragraph id="HD76EAE8C4A82485280A22EA421317D80"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>international parental child abduction</term> has the meaning given such term in section 3701 of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/41307">34 U.S.C. 41307</external-xref>)); and</text></paragraph>
<paragraph id="HC29019731AAE489A8255A66202CCF24A"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>left-behind parent</term> has the meaning given such term in section 3 of the Sean and David Goldman International Child Abduction Prevention and Return Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/22/9101">22 U.S.C. 9101</external-xref>). </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HEBEC49F4104A4AE9AE6328F5BBCC0640"><enum>(3)</enum><text>by adding at the end the following: </text>
