R. 9658</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20221221">December 21, 2022</action-date><action-desc><sponsor name-id="H001082">Mr. Hern</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to establish a new criterion for the nonapplication of site-neutral payments to long-term care hospitals under the Medicare program.</official-title></form><legis-body id="HB30B4A76CA2446C49F2786EA7BBD2D46" style="OLC"><section id="H9A6B0B944F324CB8B329A773DD596739" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Access to Care for Seniors in Critical Condition Act of 2022</short-title></quote>.</text></section><section id="H810F4E0142994C77AA316968538F46F9"><enum>2.</enum><header>Establishing a new criterion for the nonapplication of site-neutral payments to long-term care hospitals under the Medicare program</header><text display-inline="no-display-inline">Section 1886(m)(6)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(m)(6)(A)</external-xref>) is amended—</text><paragraph id="H367D7C19EF86470F9FF8D9EA8478FAAA"><enum>(1)</enum><text>by striking <quote>or the ventilator criterion under clause (iv)</quote> and inserting <quote>, the ventilator criterion under clause (iv), or the high acuity criterion described in clause (v)</quote>; and</text></paragraph><paragraph id="HF577556D5CB045288276CC71DDA16B46"><enum>(2)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" id="H02C4272A91B242AC8757488AC2881505" display-inline="no-display-inline"><clause id="H171BEFE04D534BEEBB2A753FF11669E3"><enum>(v)</enum><header>High acuity criterion</header><subclause id="H6DB572241E6C4713B66BA0E7B1C7216E"><enum>(I)</enum><header>In general</header><text>The criterion specified in this clause (in this paragraph referred to as the <quote>high acuity criterion</quote>) for a discharge from a long-term care hospital in a fiscal year is that—</text><item id="H77C59CCE2F944CFB9942554B28463B8B"><enum>(aa)</enum><text display-inline="yes-display-inline">the individual discharged had a primary diagnosis assigned to a Medicare-Severity-Long-Term-Care-Diagnosis-Related-Group (MS–LTC–DRG) with a relative weight for such fiscal year that was equal to or greater than the specified amount for such fiscal year; and</text></item><item id="H0811722859F148EB9AD19B2B373FB101"><enum>(bb)</enum><text>the discharge occurred on or after October 1, 2025.</text></item></subclause><subclause id="id6C02DC00391946C0B7E69293DF5F0BC8"><enum>(II)</enum><header>Specified amount defined</header><text display-inline="yes-display-inline">For purposes of subclause (I), the term <quote>specified amount</quote> means, with respect to a fiscal year, an amount equal to the 80th percentile of the relative weights for Medicare-Severity-Long-Term-Care-Diagnosis-Related-Groups that were assigned to primary diagnoses for all discharges occurring in the preceding fiscal year.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
