which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the disclosure of intimate digital depictions, and for other purposes.</official-title></form><legis-body id="H2581B3C3A88A42C08B25DDFE9549F614" style="OLC"><section id="HA56F1AB26A77441C87572DA87414C4DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Deepfakes of Intimate Images Act</short-title></quote>.</text></section><section id="HF333A097BED942AC974E323BF0D5677F"><enum>2.</enum><header>Intimate digital depictions</header><text display-inline="no-display-inline">The Violence Against Women Act Reauthorization Act of 2022 is amended by inserting after section 1309 the following:</text><quoted-block style="OLC" id="HDF061A4E6FFA493B9512DD2D44CE672A" display-inline="no-display-inline"><section id="H1B70FAF9F95D447C8485173BEE2E441F"><enum>1309A.</enum><header>Disclosure of intimate digital depictions</header><subsection id="H0EE865EC2D2A401FB090A13BF72648BB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H1967C702F46C4CFF91C884CE0FB287F1"><enum>(1)</enum><header>Consent</header><text display-inline="yes-display-inline">The term <term>consent</term> has the meaning given such term in section 1309.</text></paragraph><paragraph id="HFFEA55B9A143441082BC19D8544B53A6"><enum>(2)</enum><header>Depicted individual</header><text>The term <term>depicted individual</term> means an individual who, as a result of digitization or by means of artificial intelligence or similar technology, appears in whole or in part in an intimate digital depiction and who is identifiable by virtue of the person’s face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature, or from information displayed in connection with the digital depiction.</text></paragraph><paragraph id="HCEC4077D9055463D9D1DFD31C3FC8660"><enum>(3)</enum><header>Digital depiction</header><text>The term <term>digital depiction</term> means a realistic visual depiction, as that term is defined in section 2256(5) of title 18, United States Code, of an individual that has been created or altered using artificial intelligence or similar technology.</text></paragraph><paragraph id="H381139747B3B4376838DB2FC6D9D4EF1"><enum>(4)</enum><header>Disclose</header><text>The term <term>disclose</term> has the meaning given such term in section 1309.</text></paragraph><paragraph id="H5D35F30625C94C88A458322F7F4126FB"><enum>(5)</enum><header>Intimate digital depiction</header><text>The term <term>intimate digital depiction</term> means a digital depiction of an individual that has been created or altered using artificial intelligence or similar technology and that depicts—</text><subparagraph id="H9BEC8356E7C84D84A8D1814620BEEF88"><enum>(A)</enum><text>the uncovered genitals, pubic area, anus, or postpubescent female nipple of an identifiable individual; </text></subparagraph><subparagraph id="H26B5F07D25394A919887FE709D14D498"><enum>(B)</enum><text>the display or transfer of bodily sexual fluids—</text><clause id="H4F9D09ED457245DFBF80FB2FF1FA76DD"><enum>(i)</enum><text>onto any part of the body of an identifiable individual; or</text></clause><clause id="H7C767547576F44DABFF0DFD3C33B1D37"><enum>(ii)</enum><text>from the body of an identifiable individual; or</text></clause></subparagraph><subparagraph id="HBB76B91B2AF44E5599070B4AE8F05BFD"><enum>(C)</enum><text>an identifiable individual engaging in sexually explicit conduct.</text></subparagraph></paragraph><paragraph id="H64CBC5610DA54EAC85778F9DE59CEA6A"><enum>(6)</enum><header>Sexually explicit conduct</header><text>The term <term>sexually explicit conduct</term> has the meaning given the term in subparagraphs (A) and (B) of section 2256(2) of title 18, United States Code.</text></paragraph></subsection><subsection id="H2FF88361EE454485ABDF90843AFFB5E9" display-inline="no-display-inline"><enum>(b)</enum><header>Right of action</header><paragraph id="H84D541E8209449D1B600C0B5A15500BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (e), an individual who is the subject of an intimate digital depiction that is disclosed, in or affecting interstate or foreign commerce or using any means or facility of interstate or foreign commerce, without the consent of the individual, where such disclosure was made by a person who knows that, or recklessly disregards whether, the individual has not consented to such disclosure, may bring a civil action against that person in an appropriate district court of the United States for relief as set forth in subsection (d).</text></paragraph><paragraph id="HEB021EE5B37D490199D7669C9C3DE983"><enum>(2)</enum><header>Rights on behalf of certain individuals</header><text>In the case of an individual who have not attained 18 years of age or are incompetent, incapacitated, or deceased, the legal guardian of the individual or representative of the individual’s estate, another family member, or any other person appointed as suitable by the court, may assume the individual’s rights under this section, but in no event shall the defendant be named as such representative or guardian.</text></paragraph></subsection><subsection id="HDAFEE855C4F84433A2987920EE2EB6B9" display-inline="no-display-inline"><enum>(c)</enum><header>Consent</header><text>For purposes of an action under subsection (b)—</text><paragraph id="H71048C04E54F4477AB666EA3808FC3B5"><enum>(1)</enum><text>an individual’s consent to the creation of the intimate digital depiction shall not establish that the person consented to its disclosure; and</text></paragraph><paragraph id="H2487D283ED1C4B4DAE21B841DE5A0776"><enum>(2)</enum><text>consent shall be deemed validly given only if—</text><subparagraph id="H8C30EB25B44C49469DF0810F7DEE6FD8"><enum>(A)</enum><text>it is set forth in an agreement written in plain language signed knowingly and voluntarily by the depicted individual; and</text></subparagraph><subparagraph id="H45CB7352A94A40DBADC371F05A048B33"><enum>(B)</enum><text>it includes a general description of the intimate digital depiction and, if applicable, the audiovisual work into which it will be incorporated.</text></subparagraph></paragraph></subsection><subsection id="H85C2B0EFFE6F4BEE822A706CEE16F6DE" display-inline="no-display-inline"><enum>(d)</enum><header>Relief</header><paragraph id="HA64C753AE5AB4B2CAB8DBB5F673298AA"><enum>(1)</enum><header>In general</header><subparagraph id="H9918121A49C24B2B98ACAF37B3E0F6F3"><enum>(A)</enum><header>Damages</header><text>In a civil action filed under this section, an individual may recover any of the following:</text><clause id="HD39AC19F9D8E45618A655C39D89BBEDB"><enum>(i)</enum><text>An amount equal to the monetary gain made by the defendant from the creation, development, or disclosure of the intimate digital depiction.</text></clause><clause id="HD2DE5685B64D450DBD21BA743E270E42"><enum>(ii)</enum><text>Either of the following:</text><subclause id="HD75A8C4F77B840DD873B532BF20BE6B6"><enum>(I)</enum><text>The actual damages sustained by the individual as a result of the intimate digital depiction, including damages for emotional distress.</text></subclause><subclause id="H96F5D3D187244E2B88635211122111C0"><enum>(II)</enum><text>Liquidated damages in the amount of $150,000.</text></subclause></clause><clause id="HE156C900FADB483AB07097FA076A7A74"><enum>(iii)</enum><text>Punitive damages.</text></clause><clause id="H77A5A492E8E0475884B579CF76262F94"><enum>(iv)</enum><text>The cost of the action, including reasonable attorney’s fees and other litigation costs reasonably incurred.</text></clause></subparagraph><subparagraph id="HED7F9C7934FC4448B225CA61A868F13C"><enum>(B)</enum><header>Equitable relief</header><text>In a civil action filed under this section, a court may, in addition to any other relief available at law, order equitable relief, including a temporary restraining order, a preliminary injunction, or a permanent injunction ordering the defendant to cease display or disclosure of the intimate digital depiction.</text></subparagraph></paragraph><paragraph id="H9D3EE98C33B840D79D0E8372C7C7A9DD"><enum>(2)</enum><header>Preservation of anonymity</header><text>In ordering relief under this subsection, the court may grant injunctive relief maintaining the confidentiality of a plaintiff using a pseudonym.</text></paragraph></subsection><subsection id="H905FB502CFE743E687F3920BDA78C9AB" display-inline="no-display-inline"><enum>(e)</enum><header>Exceptions</header><text>An identifiable individual may not bring an action for relief under this section relating to—</text><paragraph id="HC8ECF879B35E46D28DAA03F4D9234C3A"><enum>(1)</enum><text>a disclosure made in good faith—</text><subparagraph id="HBB36F377109A418291941238E1FE1448"><enum>(A)</enum><text>to or by a law enforcement officer or agency in the course of reporting or investigating—</text><clause id="H45DFC409343F46018BF208A014A03EBC"><enum>(i)</enum><text>unlawful activity; or</text></clause><clause id="H3F3D97C6530943DEA75627DF1E1E7CCE"><enum>(ii)</enum><text>unsolicited or unwelcome conduct; or</text></clause></subparagraph><subparagraph id="H7E46B9C316AE4E6DA7DE5AB2084EF44A"><enum>(B)</enum><text>as part of a legal proceeding; </text></subparagraph></paragraph><paragraph id="H6B45C1C1E8594AD98E8E59C08838D151"><enum>(2)</enum><text>a matter of legitimate public concern or public interest, except that it shall not be considered a matter of legitimate public interest or public concern solely because the depicted individual is a public figure; or</text></paragraph><paragraph id="HA17D1AB5B6314C0BB15904FD2842BDB4"><enum>(3)</enum><text>a disclosure reasonably intended to assist the identifiable individual.</text></paragraph></subsection><subsection id="H132DAC7779BC4FF5B0E903772B01504C"><enum>(f)</enum><header>In camera</header><text>A court may authorize an in camera proceeding under this section.</text></subsection><subsection id="HA3FB2201AB284058AC8A0AFF73E62CF3" display-inline="no-display-inline"><enum>(g)</enum><header>Disclaimers</header><text>It shall not be a defense to an action under this section that there is a disclaimer stating that the intimate digital depiction of the depicted individual was unauthorized or that the depicted individual did not participate in the creation or development of the material.</text></subsection><subsection id="H0CFE4B6524BE42BAA5491CA233218050"><enum>(h)</enum><header>Limitations</header><text>For purposes of this section, a provider of an interactive computer service shall not be held liable on account of—</text><paragraph id="HA46B9259EC294E81BBA89BB138ED2D77"><enum>(1)</enum><text>any action voluntarily taken in good faith to restrict access to or availability of intimate digital depictions; or</text></paragraph><paragraph id="H510163799AE74825B3ED8F9D061DAB60"><enum>(2)</enum><text>any action taken to enable or make available to information content providers or other persons the technical means to restrict access to intimate digital depictions.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H886D28B5819A4A49893EE226AA78C714"><enum>3.</enum><header>Criminal action</header><subsection id="H8F659CB2AEE540D4935875DA452607DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2252C">section 2252C</external-xref> the following:</text><quoted-block style="USC" id="H5C686746602640CA843C78042C75C5B3" display-inline="no-display-inline"><section id="H43AEB2CA2867409F8AA4154BE907233C"><enum>2252D.</enum><header>Intimate digital depictions</header><subsection id="H5A04BAA82A794552A89F07C9C403A6E6"><enum>(a)</enum><header>Offense</header><text>Whoever, in or affecting interstate or foreign commerce, discloses or threatens to disclose an intimate digital depiction—</text><paragraph id="HCFA46F4455CE4BB2B84F413F134409CF"><enum>(1)</enum><text display-inline="yes-display-inline">with the intent to harass, annoy, threaten, alarm, or cause substantial harm to the finances or reputation of the depicted individual; or </text></paragraph><paragraph id="H29483E2D7AAE4D12A69CDE7C07DC7E3A"><enum>(2)</enum><text display-inline="yes-display-inline">with actual knowledge that, or reckless disregard for whether, such disclosure or threatened disclosure will cause physical, emotional, reputational, or economic harm to the depicted individual, </text></paragraph><continuation-text continuation-text-level="subsection">shall be punished as provided under subsection (b).</continuation-text></subsection><subsection id="H968B8F138C1143C0BF0B50A9D442EED9"><enum>(b)</enum><header>Penalty</header><text>Any person who commits an offense under subsection (a) shall be—</text><paragraph id="H4E43E5F53B5F4E69AA8EB8554B687B56"><enum>(1)</enum><text>fined under this title, imprisoned for not more than 2 years, or both; or</text></paragraph><paragraph id="H35CDAC4C20AE4E0E84766B6D40965A9A"><enum>(2)</enum><text>fined under this title, imprisoned for not more than 10 years, or both, in the case of a violation in which the creation, reproduction, or distribution of the intimate digital depiction could be reasonably expected to—</text><subparagraph id="H0F0FD295782B455198768468135B3D77"><enum>(A)</enum><text>affect the conduct of any administrative, legislative, or judicial proceeding of a Federal, State, local, or Tribal government agency, including the administration of an election or the conduct of foreign relations; or</text></subparagraph><subparagraph id="HC79362D384F144888B1736E8030EEB1E"><enum>(B)</enum><text>facilitate violence.</text></subparagraph></paragraph></subsection><subsection id="H7F3619FEFF6F45A59C0963EDAE905546" display-inline="no-display-inline"><enum>(c)</enum><header>Disclaimers</header><text>It shall not be a defense to an action under this section that there is a disclaimer stating that the intimate digital depiction of the depicted individual was unauthorized or that the depicted individual did not participate in the creation or development of the material.</text></subsection><subsection id="HF87A6D31A22B419D96541846AB716D83"><enum>(d)</enum><header>Limitations</header><text>For purposes of this section, a provider of an interactive computer service shall not be held liable on account of—</text><paragraph id="HBA928268335C41C498D9B40F383AD6E4"><enum>(1)</enum><text>any action voluntarily taken in good faith to restrict access to or availability of intimate digital depictions; or</text></paragraph><paragraph id="HD26E064761CB4A238C275A09C618B3B0"><enum>(2)</enum><text>any action taken to enable or make available to information content providers or other persons the technical means to restrict access to intimate digital depictions.</text></paragraph></subsection><subsection id="H1BAE680BF2D84875B891E48492FB0DA6"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H7F0D106902364184AA9349C84088362A"><enum>(1)</enum><header>Consent</header><text display-inline="yes-display-inline">The term <term>consent</term> has the meaning given such term in section 1309 of the Violence Against Women Act Reauthorization Act of 2022.</text></paragraph><paragraph id="HE6090BF9FAFA4AC1AF261BEE31A6E8F1"><enum>(2)</enum><header>Depicted individual</header><text>The term <term>depicted individual</term> means an individual who, as a result of digitization or by means of artificial intelligence or similar technology, appears in whole or in part in an intimate digital depiction and who is identifiable by virtue of the person’s face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature, or from information displayed in connection with the digital depiction.</text></paragraph><paragraph id="H30C8BA62F6B54C9A8DD45D78B5D87885"><enum>(3)</enum><header>Digital depiction</header><text>The term <term>digital depiction</term> means a realistic visual depiction, as that term is defined in section 2256(5), of an individual that has been created or altered using artificial intelligence or similar technology.</text></paragraph><paragraph id="HEE82D7643CCC4D74A35006F3DE0D5567"><enum>(4)</enum><header>Disclose</header><text display-inline="yes-display-inline">The term <term>disclose</term> has the meaning given such term in section 1309 of the Violence Against Women Act Reauthorization Act of 2022.</text></paragraph><paragraph id="HD330CE627DE54F5DAF5521315A60ADD8"><enum>(5)</enum><header>Intimate digital depiction</header><text>The term <term>intimate digital depiction</term> means a digital depiction of an individual that has been created or altered using artificial intelligence or similar technology and that depicts—</text><subparagraph id="H8EA1ACCDBE0D495CA64560580784EE67"><enum>(A)</enum><text>the uncovered genitals, pubic area, anus, or postpubescent female nipple of an identifiable individual; </text></subparagraph><subparagraph id="H7B05AA6208954B88B2E1F289213E047C"><enum>(B)</enum><text>the display or transfer of bodily sexual fluids—</text><clause id="H85D60795440C4ABABD8F0A400807543F"><enum>(i)</enum><text>onto any part of the body of an identifiable individual; or</text></clause><clause id="HC7C336AD5A824DAAA06C341D206DF766"><enum>(ii)</enum><text>from the body of an identifiable individual; or</text></clause></subparagraph><subparagraph id="H80DBE87D841643FCBC27088C86844D99"><enum>(C)</enum><text>an identifiable individual engaging in sexually explicit conduct.</text></subparagraph></paragraph><paragraph id="H2E35ABD05B6847D3BF66859D17F13A51"><enum>(6)</enum><header>Sexually explicit conduct</header><text>The term <term>sexually explicit conduct</term> has the meaning given the term in subparagraphs (A) and (B) of section 2256(2).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC69E7BAB2A7249279A648654AE9B439F"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code is amended by inserting after the item relating to section 2252C the following new item:</text><quoted-block style="USC" id="HB66DA6613AA643B7A70068893BEC347B" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2252D.
