which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the establishment of a COVID–19 containment and mitigation for essential workers program for assisting small businesses and employee representatives of essential workers to reopen or operate consistent with guidance and practices intended to prevent the spread of COVID–19, and for other purposes.</official-title></form><legis-body id="H4F94C9E8423A4F168EC65CD64F00E1C4" style="OLC"><section id="H01E271AAB3BE4F879EA07BC9954A1CBB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Getting Americans Safely Back to Work Act of 2021</short-title></quote>.</text></section><section id="H0EE61C49A77F469CAD7F0B649F062CFD"><enum>2.</enum><header>Grants to State, local, Tribal, or territorial health departments for COVID–19 containment and mitigation for essential workers</header><subsection id="H1D03E61118494ABEB874E7D5D5C0CD51"><enum>(a)</enum><header>Program</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention and in consultation with the Director of the National Institute for Occupational Safety and Health and Assistant Secretary for Occupational Safety and Health, shall establish a COVID–19 containment and mitigation for essential workers program consisting of awarding grants under subsection (b).</text></subsection><subsection id="H18AB3B84912346109D7677C6C7D0CD2C"><enum>(b)</enum><header>Grants</header><text>For the purpose of improving essential worker safety, the Secretary—</text><paragraph id="HF94C5F4A154146B0AA828EB18097C8B5"><enum>(1)</enum><text>shall award a grant to each State health department; and</text></paragraph><paragraph id="H2F26C0D9DF134EE0A43185E145EF5557"><enum>(2)</enum><text>may award grants on a competitive basis to State, local, Tribal, or territorial health departments.</text></paragraph></subsection><subsection id="H2FB65A046E96475AAEBF138DED9CA42B"><enum>(c)</enum><header>Use of funds</header><text>A State, local, Tribal, or territorial health department receiving a grant under subsection (b) shall use the grant funds—</text><paragraph id="H2C5867D2097F49EE909E86F21C6EDFB3"><enum>(1)</enum><text>to purchase or procure personal protective equipment and rapid testing equipment and supplies for distribution to employers of essential workers, including public employers; or</text></paragraph><paragraph id="H90B5C8B9D153415392DD03FF6F672079"><enum>(2)</enum><text>to support the implementation of other workplace safety measures for use in containment and mitigation of COVID–19 transmission among essential workers in their workplaces, including workplaces of public employers.</text></paragraph></subsection><subsection id="HF9FD266D37524854BB968C64E3D2FA1A"><enum>(d)</enum><header>Formula grants to State health departments</header><text>In making grants under subsection (b)(1), the Secretary shall award funds to each State health department in accordance with a formula based on overall population size, essential workers population size, and burden of COVID–19.</text></subsection><subsection id="HA90CFDA167EF4E8E9FCE21C313526AA8"><enum>(e)</enum><header>Competitive grants to State, local, Tribal, and territorial health departments</header><text>In making grants under subsection (b)(2), the Secretary shall give priority to applicants demonstrating a commitment to containing and mitigating COVID–19 among racial and ethnic minority groups who are disproportionately represented in essential worker settings.</text></subsection><subsection id="HE8FF2099B71048D3A8E5F9F077007615"><enum>(f)</enum><header>No duplicative assistance</header><text>The Secretary may not provide, and a State, local, Tribal, or territorial health department or employer of essential workers may not accept, assistance under this section for containment and mitigation of COVID–19 transmission among essential workers in their workplaces with respect to which—</text><paragraph id="H17EBF2BB3DDF4829BF40DC2F6ACD180A"><enum>(1)</enum><text>the State, local, Tribal, or territorial health department or employer of essential workers receives assistance from other sources for such purposes; or</text></paragraph><paragraph id="HFA0DF10BBDA0486A89227CF42469CB8E"><enum>(2)</enum><text>other sources are obligated to provide assistance to such health department or employer for such purposes.</text></paragraph></subsection><subsection id="HC9E6E886D77E43119C1A1B2C124AA83F"><enum>(g)</enum><header>Technical assistance</header><text>In carrying out the program under this section, the Secretary shall provide technical assistance to State, local, Tribal, or territorial health departments.</text></subsection><subsection id="H89743D82642A4768BEA881095C3A0B10"><enum>(h)</enum><header>Report</header><text>No later than 90 days after the date of enactment of this Act, and every 90 days thereafter, the Secretary shall submit to the Committee on Energy and Commerce and the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on the activities funded through this section, including—</text><paragraph id="H04695F9F1C984971A90DB9FACE65BDCF"><enum>(1)</enum><text>the amount expended and the awardees under subsection (b)(1);</text></paragraph><paragraph id="HD5E8A3DA677C401295E8B30CB6B1AF32"><enum>(2)</enum><text>the amount expended and the awardees under subsection (b)(2);</text></paragraph><paragraph id="H89F9F9723F7047A5A709DB81F9DC2A86"><enum>(3)</enum><text>the total amount remaining of the amounts appropriated or otherwise made available to carry out this section; and</text></paragraph><paragraph id="H0694222E99FA481C90E1B6E82492E760"><enum>(4)</enum><text>evaluating the progress of State, local, Tribal, and territorial health departments in reducing COVID–19 burden among essential workers.</text></paragraph></subsection></section><section id="H2636E5566AAA4F0292D5F68AB1354A28"><enum>3.</enum><header>Consultation with essential worker employers and essential workers</header><subsection id="HBD6CB4FC5D1C40AABDBDF1651FA65D0D"><enum>(a)</enum><header>In general</header><text>In developing the COVID–19 containment and mitigation for essential workers program under section 2 and in determining criteria for distribution of competitive grants under section 2(b)(2), the Secretary, acting through the Director of the Centers for Disease Control and Prevention and in consultation with the Director of the National Institute for Occupational Safety and Health, shall consult in advance with—</text><paragraph id="H0E726E800AE340269EA9223FF1BD3D4A"><enum>(1)</enum><text>employers of essential workers; and</text></paragraph><paragraph id="HB43F6A5AD29942F3839407E48BABB324"><enum>(2)</enum><text>representatives of essential workers.</text></paragraph></subsection><subsection id="H908C29E7EC13449E92A81CC41DA33B31"><enum>(b)</enum><header>Optional advance consultation</header><text>A State health department may, before receiving funds through a grant under section 2, consult with employers of essential workers and representatives of essential workers in determining—</text><paragraph id="H675DFDCA55DA4DA5BC2745DEBD1B532F"><enum>(1)</enum><text>priorities for the use of such funds; and</text></paragraph><paragraph id="HE5DEFAF9A90A4CC3AFE80AC43D7AA2D9"><enum>(2)</enum><text>the distribution of COVID–19 containment and mitigation equipment and supplies.</text></paragraph></subsection></section><section id="H36FA4DCD30904611ADCC398E6016B6FC"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HD46A83F5666746D083043543201DC4AD"><enum>(1)</enum><header>Containment and mitigation</header><text>The term <term>containment and mitigation</term> includes—</text><subparagraph id="H7A0D78C1CC4E47788679021ED9C3F798"><enum>(A)</enum><text display-inline="yes-display-inline">the use of—</text><clause id="H1718DD239D70406BBB1DBC3A85E35149"><enum>(i)</enum><text>personal protective equipment; and</text></clause><clause id="H354258500F9C4CE68206A3736309BA9C"><enum>(ii)</enum><text>other protections, including expanding or improving workplace infrastructure through engineering and work practice controls, such as ventilation systems, plexiglass partitions, air filters, and the use of hand sanitizer or sanitation supplies;</text></clause></subparagraph><subparagraph id="H2E54B5A3B74C4B0E96E638B1AF63F712"><enum>(B)</enum><text>access to medical evaluations, testing (including rapid testing), and contact tracing; and</text></subparagraph><subparagraph id="H4BEC97BC2EC34139B5B443A662255386"><enum>(C)</enum><text>other related activities or equipment recommended or required by the Director of Centers of Disease Control and Prevention or required pursuant to the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651</external-xref> et seq.) or a State plan approved pursuant to section 18 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>).</text></subparagraph></paragraph><paragraph id="H6175179F9E7B48CD84396A65CA1928BA"><enum>(2)</enum><header>Essential worker</header><text>The term <term>essential worker</term> refers to—</text><subparagraph id="H6C6941F5AFEE48CFBCABA38F838FE46C"><enum>(A)</enum><text>the <quote>essential critical infrastructure workers</quote> identified in the Department of Homeland Security’s <quote>Advisory Memorandum on Ensuring Essential Critical Infrastructure Workers Ability to Work During the COVID–19 Response</quote> released on August 18, 2020 (or any successor document); and</text></subparagraph><subparagraph id="H42C027C551D6478E889C6C89A965FE90"><enum>(B)</enum><text>workers included as essential workers in executive orders issued by the Governor of a State.</text></subparagraph></paragraph><paragraph id="H584728EC90E04AAF989E203E044CE01B"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services. </text></paragraph><paragraph id="H3E7893DEE7504C3486177A41C320E99E"><enum>(4)</enum><header>Small business</header><text>The term <term>small business</term> means—</text><subparagraph id="H1430F239F14647088804783F535F0E53"><enum>(A)</enum><text>a small business concern described in section 31(b)(2)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657a">15 U.S.C. 657a(b)(2)(C)</external-xref>); or</text></subparagraph><subparagraph id="HB188F64486874674ADBF12ED3E625BB8"><enum>(B)</enum><text>an individual who operates—</text><clause id="H4CCB22288C9E4F3588C4F4E1EBCB68A4"><enum>(i)</enum><text>under a sole proprietorship;</text></clause><clause id="H95F18D0F0A05420D919E692BE3DB9817"><enum>(ii)</enum><text>as an independent contractor; or</text></clause><clause id="HBF5F47309FD14A60BC48D0A16D733E91"><enum>(iii)</enum><text>as an eligible self-employed individual.</text></clause></subparagraph></paragraph></section><section id="H998BD8F2C22E4B0CA30B6E808FF0D025"><enum>5.</enum><header>Authorization of appropriations</header><subsection id="HA3E3D808EC084DC09329B358BAF26E69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out this Act, there is authorized to be appropriated $1,000,000,000, to remain available until expended.</text></subsection><subsection id="H94EE4620E52544AEB9348C2F515A211B"><enum>(b)</enum><header>Small businesses</header><text>Of the amounts made available to grantees pursuant to section 2, at least $250,000,000 shall be reserved for small businesses.</text></subsection></section></legis-body></bill>
