<section id="HA495AE89A773440EA0FB6A8746A5EB53" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Review the Expansion of Government Act</short-title></quote> or as the <quote><short-title>REG Act</short-title></quote>.</text></section> <section id="HD5FE214858644B70B6B99E40E0809032"><enum>2.</enum><header>Periodic review of final rules required</header><text display-inline="no-display-inline">Section 23 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78w">15 U.S.C. 78w</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H2FF2404C903D48DFA096E75E02FAF4E3"><enum>(e)</enum><header>Periodic review of final rules required</header> 
<paragraph id="HF6314373A0C447E7B2C0E50ACACC6F28"><enum>(1)</enum><header>In general</header><text>With respect to a final rule issued by the Commission, the Commission shall review such rule not later than 3 years after the date on which such final rule is issued, and every 3 years thereafter, to determine if any revision (including a repeal) to the rule is—</text> <subparagraph id="H237E4A7D2A3443D09B5E7B8CDCC05663"><enum>(A)</enum><text>necessary to ensure that the rule is authorized pursuant to Federal law;</text></subparagraph> 
<subparagraph id="HD5F1FDDF61AF4C69A2D02D6E50153986"><enum>(B)</enum><text>necessary to comply with Federal law; or</text></subparagraph> <subparagraph id="HC12E60CCCC5B4380AB8E48944A92A177"><enum>(C)</enum><text>necessary or appropriate—</text> 
<clause id="H13B00E751E5E4A779462DA62B088A6B2"><enum>(i)</enum><text>to facilitate capital formation;</text></clause> <clause id="H034EC02BDAE244DC841F6A3E4A7689BF"><enum>(ii)</enum><text>to maintain fair and orderly markets; or</text></clause> 
<clause id="H6BBCAEA8952043CAB9E7517ECB11630B"><enum>(iii)</enum><text>for the protection of investors.</text></clause></subparagraph></paragraph> <paragraph id="HD9D88A11159D465C9AC5647ED83CDCF7"><enum>(2)</enum><header>Application</header><text>With respect to a final rule issued by the Commission before the date of enactment of this subsection, the first review of such rule required under paragraph (1) shall occur before the end of the 3-year period beginning on the date of enactment of this subsection.</text></paragraph> 
<paragraph id="HFC2EE5753335495987EA847CEE303D41"><enum>(3)</enum><header>Reports required</header><text>The Commission shall—</text> <subparagraph id="H47B722A528DF432D801A0109E737AD8E"><enum>(A)</enum><text>not later than 1 year after the date of the enactment of this subsection, submit to Congress a report that includes a plan to carry out the review required under this subsection with respect to the final rules described in paragraphs (1) and (2);</text></subparagraph> 
<subparagraph id="H8526C92B0A634F1080273863A5D93DC6"><enum>(B)</enum><text>not later than 2 years after the date of the enactment of this subsection, submit to Congress a report that identifies each action or review the Commission failed to carry out in the preceding year under the plan required under subparagraph (A) and an explanation for such failure; and</text></subparagraph> <subparagraph id="H7A387BFB18514A0E9B44623BC40E709E"><enum>(C)</enum><text>not later than 3 years after the date of the enactment of this subsection, and annually thereafter, submit to Congress a report that identifies each final rule the Commission failed to review under this subsection in the preceding year and an explanation for such failure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
